CIRCULAR
GUIDELINES FOR IMPLEMENTING ADJUSTMENTS TO MONTHLY SUBSIDIES
FOR RETIRED ELDERLY RURAL COMMUNE, WARD, AND TOWN OFFICIALS
Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Clause 2, Article 4 of Decree No. 75/2024/NĐ-CP dated June 30, 2024 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies;
At the proposal of the Director of the Salary Department;
The Minister of Home Affairs issues this Circular guiding the implementation of adjustments to monthly subsidies for retired elderly rural commune, ward, and town officials.
Article 1. Scope of application
Retired elderly rural commune, ward, and town officials currently receiving monthly subsidies under Decision No. 130-CP dated June 20, 1975 of the Council of Ministers supplementing policies and preferential treatment for rural commune officials and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers amending and supplementing certain policies and benefits for rural commune and town officials (hereinafter referred to as retired elderly rural commune officials).
Article 2. Adjustment of Monthly Subsidies
As of July 1, 2024, implement adjustments to monthly subsidies for retired elderly rural commune officials according to the provisions of Article 2 of Decree No. 75/2024/NĐ-CP dated June 30, 2024 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies as follows:
1. Increase the monthly subsidy by 15% over the amount of subsidy received in June 2024 for the subjects specified in Article 1 of this Circular.
The monthly subsidy received from July 1, 2024 shall be calculated using the following formula:
In which: The monthly subsidy received in June 2024 is the subsidy stipulated in Clause 3, Article 2 of Circular No. 11/2023/TT-BNV dated August 1, 2023 of the Minister of Home Affairs guiding the implementation of adjustments to monthly subsidies for retired elderly rural commune, ward, and town officials.
2. As of July 1, 2024, after adjusting the monthly subsidy for retired elderly rural commune officials according to the provisions of Clause 1 of this Article, if the amount of subsidy received is lower than 3,500,000 VND/month, it shall be adjusted as follows:
a) Increase by 300,000 VND/person/month for those who receive a monthly subsidy below 3,200,000 VND/person/month;
b) Increase to 3,500,000 VND/person/month for those who receive a monthly subsidy from 3,200,000 VND/person/month to less than 3,500,000 VND/person/month.
3. Based on the provisions of Clauses 1 and 2 of this Article, retired elderly rural commune officials specified in Article 1 of this Circular, including former Secretaries of the Party Committee, Chairmen of the People's Committee, Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Council, Commune Militia Commanders, Chiefs of Police Stations, and other positions shall receive a monthly subsidy of 3,500,000 VND/month from July 1, 2024.
Article 3. Implementation Organization
1. Provincial People's Committees and municipal people's committees directly under the central government shall organize the payment of monthly subsidies from July 1, 2024 according to the guidelines set forth in this Circular for the subjects within their jurisdiction.
2. The source of funds for implementing adjustments to monthly subsidies for retired elderly rural commune officials according to the provisions of Clause 1, Article 3 of Decree No. 75/2024/NĐ-CP dated June 30, 2024 of the Government adjusting pensions, social insurance subsidies, and monthly subsidies.
Article 4. Effective date
1. This Circular takes effect from July 5, 2024.
2. The regulations stipulated in this Circular shall be implemented from July 1, 2024.
3. This Circular replaces Circular No. 11/2023/TT-BNV dated August 1, 2023 of the Minister of Home Affairs guiding the implementation of adjustments to monthly subsidies for retired elderly rural commune, ward, and town officials.
During the implementation process, if there are any difficulties, please report them to the Ministry of Home Affairs for study and resolution./.
