CIRCULAR

Regulations on land statistics, inventory, and creation of current land use maps

and prepare a land use status map

Pursuant to the Land Law dated January 18, 2024;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Credit Institutions Law No. 32/2024/QH15 dated June 29, 2024;

Pursuant to the Government Decree No. 102/2024/NĐ-CP dated July 30, 2024 detailing certain provisions of the Land Law;

 Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Land Registration and Information Data Department,

The Minister of Natural Resources and Environment promulgates this Circular regulating land statistics, inventory, and creation of current land use maps.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates land statistics, inventory, and creation of current land use maps as stipulated in Clause 8, Article 59 of the Land Law.

Article 2. Applicability

1. State management agencies for land, local agencies with land management functions; Land Registration Office, Branches of the Land Registration Office; cadastre officials at commune, ward, town level.

2. Ministry of National Defense, Ministry of Public Security.

3. Land users, those assigned to manage land.

4. Other agencies, organizations, and individuals related to the implementation of land statistics, inventory, and creation of current land use maps.

Article 3. Scope of land statistics and inventory

1. The scope of land statistics and inventory shall be carried out in accordance with Clause 1, Article 57 of the Land Law and is defined as follows:

a) Administrative boundary limits at all levels determined based on the latest administrative boundary files approved by competent authorities;

b) In cases where there is inconsistency between the administrative boundary files and the actual management status regarding village, ward, town boundaries (hereinafter referred to as commune level), the relevant communes shall jointly determine the inconsistent areas, conduct land statistics and inventory in these areas according to the indicators specified in Article 4 of this Circular;

If the area is not identified in the administrative boundary files, the actual managing commune shall carry out land statistics and inventory;

c) For administrative units bordering the sea, the scope of land statistics and inventory shall extend to the lowest average low tide line; if the lowest average low tide line published by the Ministry of Natural Resources and Environment does not match the actual management and use status, land statistics and inventory shall be conducted based on the current status;

For coastal areas as stipulated in Clause 4, Article 190 of the Land Law that have not been decided on land allocation or lease while also allocating the coastal area for reclamation as stipulated in Clause 7, Article 72 of the Government Decree No. 102/2024/NĐ-CP dated July 30, 2024 detailing certain provisions of the Land Law (hereinafter referred to as Decree No. 102/2024/NĐ-CP), land statistics and inventory shall classify such areas as unused water surface land.

2. The scope of specialized land inventory shall be carried out in accordance with Clause 3, Article 57 of the Land Law.

Article 4. Indicators for land statistics and inventory

1. Indicators for land statistics and inventory include the area of each type of land, land users, and those assigned to manage land, defined as follows:

a) For land statistics, the area of each type of land, land users, and those assigned to manage land is determined based on the land statistics data of the previous year or the last inventory period, reviewed and updated with changes recorded in the cadastral records during the statistical period;

b) For land inventory, the area of each type of land, land users, and those assigned to manage land is determined based on the cadastral records and a review of the current management and use status during the inventory period.

2. Types of land when conducting land statistics and inventory shall be carried out in accordance with Article 9 of the Land Law, Articles 4, 5, and 6 of Decree No. 102/2024/NĐ-CP.

The determination of land types as stipulated herein shall be carried out in accordance with Article 10 of the Land Law and Article 7 of Decree No. 102/2024/NĐ-CP. In cases where land is used for multiple purposes as stipulated in Article 218 of the Land Law, land statistics and inventory shall be conducted based on the primary land type.

3. Land users when conducting land statistics and inventory are those defined in Article 4 of the Land Law.

4. Those assigned to manage land when conducting land statistics and inventory are those responsible before the State for the managed land as defined in Article 7 of the Land Law.

5. When conducting land statistics and inventory, the area shall be compiled as follows:

a) The area of various types of land to be compiled into the land statistics and inventory table as stipulated in Point a, Clause 1, Article 5 of this Circular at the commune level shall be automatically compiled from the land inventory map created in accordance with Article 20 of this Circular;

b) The area of various types of land to be compiled into the land statistics and inventory tables at district, county, town, provincial city, centrally governed city level (hereinafter referred to as district level); at provincial level (hereinafter referred to as provincial level) shall be compiled from the land statistics and inventory tables of the directly subordinate level;

c) The area of various types of land to be compiled into the national land statistics and inventory tables shall be compiled from the provincial land statistics and inventory tables;

d) The total area of the administrative unit as defined in Point a and Point c, Clause 1, Article 3 of this Circular shall be compiled into the table as stipulated in Point a, Clause 1, Article 5 of this Circular.

For cases as stipulated in Point b, Clause 1, Article 3 of this Circular, the area of this region shall be compiled separately into the table as stipulated in Point a, Clause 1, Article 5 of this Circular without being included in the total area within the administrative boundary limits; the area of this region shall be compiled into the total area of the higher-level administrative unit.

6. Land statistics and inventory data at all levels and nationwide shall be implemented and reported through the land statistics and inventory software of the Ministry of Natural Resources and Environment.

7. The code symbols for land types, land users, and land managers assigned to manage land are specified as follows:

a) The code symbol for land types shall be implemented according to the provisions set out in Section A of Appendix II attached hereto;

b) The code symbol for land users shall be implemented according to the provisions set out in Section B of Appendix II attached hereto;

c) The code symbol for land managers assigned to manage land shall be implemented according to the provisions set out in Section C of Appendix II attached hereto.

8. The system of land statistics and inventory forms is provided for in Article 5 of this Circular.

Article 5. System of land statistics and inventory forms

1. The system of land statistics and inventory forms includes:

a) Form 01/TKKK (Land Statistics and Inventory Area): for summarizing the total area of various land types by land users and land managers assigned to manage land;

b) Form 02/TKKK (Land Users and Land Managers Assigned to Manage Land Statistics and Inventory): for detailing the number of land users and land managers assigned to manage land by land type;

c) Form 03/TKKK (Land Area Statistics and Inventory by Administrative Unit): for summarizing data on the area of various land types by each administrative unit directly under the level conducting land statistics and inventory;

d) Form 04/TKKK (Structure and Area by Land Type, Land Users, and Land Managers Assigned to Manage Land): for calculating in detail the structure of the area of various land types by land users and land managers assigned to manage land;

đ) Form 05/TKKK (Change in Area of Various Land Types): for determining the increase or decrease in the area of various land types during the year of land statistics and during the period of land inventory;

e) Form 06/TKKKQPAN (National Defense and Security Land Statistics and Inventory): applicable in national defense and security land statistics and inventory conducted by the Ministry of National Defense and the Ministry of Public Security to compile the area of national defense and security land at the provincial level;

2. The content and format of land statistics and inventory forms shall be implemented according to the provisions set out in Appendix I attached hereto.

Chapter II

LAND STATISTICS AND INVENTORY AT ALL LEVELS

Section 1

LAND STATISTICS

Article 6. Commune-level land statistics

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

b) Determining the scope of land statistics at the commune level according to the provisions of Article 3 of this Circular;

c) Classifying, evaluating, and selecting collected files, documents, maps, and data.

2. Reviewing, updating, and correcting land changes during the year of statistics:

b) Drawing internal boundaries on the land inventory map and compiling individual plots into land parcels according to the provisions of Article 20 of this Circular;

c) Calculating the area of land during the year of statistics according to each land parcel, updating changed land parcels on the land inventory map.

3. Processing, consolidating commune-level land statistics data and preparing forms as stipulated in points a, b, d, and đ of Clause 1 of Article 5 of this Circular and preparing the List of Land Parcels for Statistics and Inventory as stipulated in Appendix III attached hereto.

4. Analyzing and assessing the current land use status and causes of land changes during the year of statistics compared to the statistics data of the previous year and the previous inventory period, proposing measures to strengthen land management and improve land use efficiency within the commune.

5. Preparing a report on the results of commune-level land statistics with main contents:

a) Overview of natural conditions, socio-economic situation; implementation organization, sources of data and materials used for compiling commune-level land statistics and evaluation of the reliability of collected data and materials;

b) Assessment of the current land use status; analysis of land changes during the year of land statistics;

c) Specific assessment of cases of changes in administrative boundary, inconsistencies in administrative boundaries (if any);

d) Proposals and recommendations.

6. Completing and approving the results of commune-level land statistics.

7. Printing copies and submitting the results of land statistics according to the provisions of Clause 1 and point a of Clause 4 of Article 22 of this Circular.

Article 7. Land Statistics at the District Level

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Develop guiding documents and plans for implementing land statistics within the district;

b) Collect files, documents, and data related to land changes during the year of statistics within the district, planning and land use plans of the district, administrative boundary files of the district; data from previous land inventory or land statistics conducted in the previous year within the district, and other relevant documents;

c) Determine the scope of land statistics at the district level as prescribed in Article 3 of this Circular;

d) Categorize, evaluate, and select collected files, documents, and data.

2. Review and compile land changes during the year of statistics for cases involving changes in land types, land users, land managers who have completed procedures for land allocation, land leasing, land use purpose change, and land recovery during the year of individual and community land statistics into the List of Cases with Changes During the Year of Land Statistics and Periodic Land Inventory attached as Appendix IV of this Circular to be sent to the People's Committee of the Commune, except for communes that already have synchronized land databases managed and operated at various levels.

3. Guide, inspect, urge, and resolve difficulties and obstacles during the organization and implementation of land statistics at the commune level.

4. Receive results of land statistics at the commune level:

a) Review and check the completeness and content of commune-level land statistics according to regulations;

b) Direct the commune to correct and complete statistical data, report on land statistics results (if necessary).

5. Process, aggregate land statistics data at the district level and prepare tables as prescribed in points a, b, c, d, and e of Clause 1, Article 5 of this Circular.

6. Analyze and assess current land use status, causes of land changes during the year of statistics compared to the previous year's land statistics data and periodic land inventory data, propose measures to strengthen management and improve land use efficiency within the district.

7. Prepare a report on the results of district-level land statistics with main contents:

a) Overview of natural conditions, socio-economic situation; implementation organization, data sources, and materials used for compiling land statistics at the district level and evaluation of the reliability of collected data and information;

b) Assessment of current land use status; assessment of annual land use plan implementation at the district level; analysis of land changes during the year of statistics.

c) Specific assessment of cases of changes in administrative boundary, inconsistencies in administrative boundaries (if any);

d) Proposals and recommendations.

8. Complete and approve the results of district-level land statistics.

9. Print copies and submit the results of district-level land statistics according to the provisions of Clause 2 and point a of Clause 4, Article 22 of this Circular.

Article 8. Land Statistics at the Provincial Level

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Develop guiding documents and plans for implementing land statistics within the province;

b) Collect files, documents, and data related to land changes during the year of statistics within the province, planning and land use plans of the province, administrative boundary files of the province; data from previous land inventory or land statistics conducted in the previous year within the province, and other relevant documents;

c) Determine the scope of land statistics at the provincial level as prescribed in Article 3 of this Circular;

d) Categorize, evaluate, and select collected files, documents, and data.

2. Review and compile land changes during the year of statistics for cases involving changes in land types, land users, land managers who have completed procedures for land allocation, land leasing, land use purpose change, and land recovery during the year of statistics for domestic organizations; religious organizations, affiliated religious organizations; overseas Vietnamese residents, economic organizations with foreign investment; foreign organizations with diplomatic functions into the List of Cases with Changes During the Year of Land Statistics and Periodic Land Inventory attached as Appendix IV of this Circular to be sent to the People's Committee of the Commune, District, except for communes that already have synchronized land databases managed and operated at various levels.

3. Guide, inspect, urge, and resolve difficulties and obstacles during the organization and implementation of land statistics at the district and commune levels.

4. Receive results of land statistics at the district level and national defense and security land statistics transferred by the Ministry of National Defense and the Ministry of Public Security:

a) Review and check the completeness and content of district-level land statistics according to regulations; direct the district to correct and complete statistical data, report on land statistics results (if necessary);

b) Review and compare national defense and security land data transferred by the Ministry of National Defense and the Ministry of Public Security with local compiled data; if there are discrepancies in the data, request the Ministry of National Defense and the Ministry of Public Security to review and reach consensus.

5. Process, aggregate land statistics data at the provincial level and prepare tables as prescribed in points a, b, c, d, and e of Clause 1, Article 5 of this Circular.

6. Analyze and assess current land use status, causes of land changes during the year of statistics compared to the previous year's land statistics data and periodic land inventory data, propose measures to strengthen management and improve land use efficiency within the province.

7. Prepare a report on the results of provincial-level land statistics with main contents:

a) Overview of natural conditions, socio-economic situation; implementation organization, data sources, and materials used for compiling land statistics at the provincial level and evaluation of the reliability of collected data and information;

b) Assessment of current land use status; assessment of planning and annual land use plan implementation during the year of statistics; analysis of land changes during the year of statistics.

c) Assessment of cases involving changes in administrative boundaries, inconsistencies in administrative boundaries (if any);

d) Propose and recommend measures to enhance land management and utilization efficiency.

8. Correct and complete provincial-level land statistics data and reports when requested by the Ministry of Natural Resources and Environment according to the provisions of Clause 2, Article 9 of this Circular.

9. Finalize, approve and publish the provincial land statistics results in accordance with Clause 3 of Article 59 of the Land Law.

10. Print copies and submit the land statistics results in accordance with Clause 3 and Point b of Clause 4 of Article 22 of this Circular.

Article 9. National Land Statistics

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Draft guidance documents for the People's Committees at the provincial level to implement land statistics;

b) Collect files, documents, and data related to the previous land inventory and the previous year's national land statistics.

2. Receive the results of defense land and security land statistics from the Ministry of Defense and the Ministry of Public Security; receive the results of provincial land statistics, direct corrections and improvements to the data, report on the land statistics results (if applicable), and simultaneously request the provincial People's Committee to reconsider the publication of local land statistics results.

3. Process and compile national land statistics data and create tables as prescribed in Points a, b, c, d, and đ of Clause 1 of Article 5 of this Circular.

4. Analyze and evaluate the current land use status, causes of land changes during the year of land statistics compared to the previous year's land statistics data and the previous period's land inventory, propose measures to strengthen management and improve land use efficiency nationwide.

5. Prepare a report on the results of national land statistics with main contents:

a) The situation of implementing land statistics;

b) Evaluation of the current land use status, analysis of land changes during the year of land statistics;

c) Propose and recommend measures to enhance land management.

6. Finalize and publish the results of national land statistics in accordance with Clause 4 of Article 59 of the Land Law.

Section 2

LAND INVENTORY

Article 10. Commune-level Land Inventory

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Develop plans to implement the land inventory within the commune area;

b) Disseminate and ensure understanding of tasks among staff and educate the public about the implementation plan of the land inventory;

c) Evaluate existing resources and technical equipment; assign responsibilities and coordination among relevant forces at the commune level to ensure compliance with content and timeframes as prescribed;

d) Collect files, documents, maps, and data related to land changes during the current land inventory period within the commune area, previous inventory results, and annual statistics results; review the land database (if available); receive the list of cases of land changes during the year of land statistics and the current land inventory period from the competent land management agency at the district level and the Land Registration Office as attached in Appendix IV of this Circular;

đ) Determine the scope of the commune-level land inventory in accordance with Article 3 of this Circular.

2. Review, compare, and select documents, data, and maps collected for use in creating the land inventory map:

a) For communes that have a land database established after the previous land inventory map and currently operational, use the land database to create the land inventory map;

b) For communes without a land database but with a cadastral map established after the previous land inventory map, use the cadastral map to create the land inventory map.

For communes where the previous land inventory map was created from a cadastral map but did not establish a land database at the time of the inventory, use the previous land inventory map;

c) For communes where the previous land inventory map was not created from a cadastral map and do not have the sources of information as specified in points a and b of this clause, use the following sources (if available): newly established aerial photographs corrected to the mathematical basis of the required land inventory map within two years before the inventory; spatial land data; national geographic database; newly established national topographic maps with a scale larger than or equal to the previous land inventory map to create the land inventory map.

3. Print materials for the land inventory.

4. Investigate, review, update, and correct land changes during the inventory period:

a) Review cases of changes in land types, land users, and managers listed in the land change cases during the inventory period provided by the competent land management agency at the district level and the Land Registration Office; update pre- and post-change information of parcels into the list of land change cases during the year of land statistics and the current inventory period as attached in Appendix IV of this Circular;

b) Review internal mapping for the creation of the land inventory map; compile and edit data for field surveys for cases with completed administrative procedures regarding land, and print the land inventory map for external field mapping;

c) Conduct field verification to determine boundaries of parcels according to land types, users, and managers;

d) Transfer, process, and finalize the mapping of parcels and update land type, user, and manager information onto the digital land inventory map based on field survey results according to detailed inventory criteria;

đ) Transfer, process, and finalize the mapping of parcels after completing the procedures as specified in points b and c of this clause to compile and create the land inventory map as prescribed in Article 20 of this Circular;

e) Create a list of parcels for land statistics and inventory as prescribed in Appendix III of this Circular.

5. Process and compile commune-level land inventory data, create tables as prescribed in Points a, b, d, and đ of Clause 1 of Article 5 of this Circular.

6. Prepare a report detailing the current land use status with main contents:

a) Overview of land management in the locality;

b) Current land use status by land type within each group of lands (agricultural land, non-agricultural land, and unused land).

c) The current land use status according to the land users and the entities assigned to manage the land;

d) Compare, analyze, and evaluate the current land use status of the land census period with the previous land census period.

7. Prepare the land use status map at the commune level and develop the explanatory report for the land use status map in accordance with Articles 16, 17, 18, and 19 of this Circular.

8. Develop the commune-level land census result report with the main contents:

a) Overview of natural conditions, socio-economic conditions; situation of organization and implementation, survey methods, data collection for the land census, sources of collected data at the commune level, and evaluation of the reliability of the collected data;

b) Evaluate the current land use status according to land census indicators; analyze the causes of changes in land use during the land census period compared to the data from the two most recent land census periods;

c) Evaluate the situation of non-uniform administrative boundary lines implemented during the land census period (if any);

d) Propose and recommend measures to enhance land management and utilization efficiency.

9. Inspect and accept the results of the land census at the commune level.

10. Complete and approve the results of the land census at the commune level.

11. Print copies and submit the results of the land census in accordance with Clause 1 and Point a, Clause 5, Article 23 of this Circular.

Article 11. Land Census at the District Level

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Develop a plan to implement the land census within the district;

b) Develop guiding documents to urge the implementation of the land census;

c) Disseminate and ensure understanding of tasks to the People's Committee at the commune level and specialized departments at the district level regarding the land census implementation plan;

d) Assess the current resources and technical equipment; assign responsibilities and coordination among related units at the district level to ensure content and time compliance as prescribed;

đ) Collect relevant files, documents, maps, and data on land changes during the land census period within the district, planning and land use plans at the district level, administrative boundary files at the district level; files of the previous land census results, annual land statistics during the land census period at the district level, and other related documents;

e) Determine the scope of the land census at the district level in accordance with Article 3 of this Circular;

g) Categorize, evaluate, and select collected files, documents, maps, and data.

2. Review and compile land changes during the census period for cases involving changes in land types, land users, and entities assigned to manage land that have completed procedures for land allocation, land leasing, land use purpose conversion, and land recovery during the individual and community land census period, and include them in the List of Cases of Changes in the Year of Land Statistics and the Land Census Period attached as Appendix IV of this Circular to be submitted to the People's Committee at the commune level, except for communes that have established a unified land database system at all levels.

3. Print materials for the land inventory.

4. Guide, inspect, urge, and resolve difficulties and obstacles during the organization and implementation of the land census at the commune level.

5. Receive the results of the land census at the commune level:

a) Review and check the completeness and content of the commune-level land census results in accordance with the regulations;

b) Direct the commune to correct and complete the census data and reports (if necessary).

6. Process and compile the district-level land census data, prepare the tables specified in Points a, b, c, d, and đ, Clause 1, Article 5 of this Circular, and develop the explanatory report on the current land use status in accordance with Clause 6, Article 10 of this Circular.

7. Prepare the land use status map and develop the explanatory report for the land use status map at the district level in accordance with Articles 16, 17, 18, and 19 of this Circular.

8. Develop the district-level land census result report with the main contents:

a) Overview of natural conditions, socio-economic conditions; situation of organization and implementation, data and documents used for compiling the land census at the district level, and evaluation of the reliability of the collected data and documents;

b) Evaluate the current land use status; assess the implementation of the five-year land use plan at the district level; analyze the causes of changes during the land census year compared to the data from the two most recent land census periods;

c) Evaluate the situation of non-uniform administrative boundary lines implemented during the land census period (if any);

d) Propose and recommend measures to enhance land management and utilization efficiency.

9. Inspect and accept the results of the land census at the district level.

10. Complete and approve the results of the land census at the district level.

11. Print copies and submit the results of the land census in accordance with Clause 2 and Point a, Clause 5, Article 23 of this Circular.

Article 12. Provincial Land Inventory

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Develop plans to implement land inventory within the provincial territory;

b) Draft directives, guidelines, and supervisory measures for implementing land inventory;

c) Disseminate and ensure understanding of tasks among the People's Committees at the commune level, the People's Committees at the district level, and relevant departments and agencies at the provincial level regarding the land inventory plan;

d) Organize specialized training for the People's Committees at the commune level, the People's Committees at the district level, and relevant departments and agencies at the provincial level;

đ) Collect files, documents, maps, and data related to land changes during the land inventory period within the provincial territory, planning files, provincial land use plans, administrative boundary files at the provincial level; previous land inventory result files, annual land statistics results during the provincial land inventory period, and other related documents;

e) Determine the scope of the provincial land inventory according to Article 3 of this Circular;

g) Categorize, evaluate, and select collected files, documents, maps, and data for use in the land inventory.

2. Review and consolidate land changes during the inventory period for cases involving changes in land type, land users, land managers who have completed procedures for land allocation, land leasing, land use purpose change, and land recovery during the domestic organization land inventory period; religious organizations, affiliated religious organizations; overseas Vietnamese residents, economic organizations with foreign investment; foreign organizations with diplomatic functions into the list of cases with changes in the year of land statistics and the land inventory period as set out in Appendix IV issued together with this Circular, except for administrative units that have established synchronized land databases at all levels.

3. Print materials for the land inventory.

4. Guide, inspect, urge, and resolve difficulties and obstacles during the implementation of the land inventory at the district and commune levels.

5. Receive the results of the land inventory from the district level and the national defense and security land inventory transferred by the Ministry of National Defense and the Ministry of Public Security:

a) Review and check the completeness and content of the district-level land inventory results according to regulations; instruct the district level to correct and complete the data, report on the land inventory results (if necessary);

b) Review and compare the national defense and security land data transferred by the Ministry of National Defense and the Ministry of Public Security with the data compiled by localities; if there are discrepancies in the data, request the Ministry of National Defense and the Ministry of Public Security to review and reach consensus.

6. Process, compile provincial land inventory data, prepare tables specified in points a, b, c, d, and đ Clause 1, Article 5 of this Circular, and develop a report explaining the current land use status according to Clause 6, Article 10 of this Circular.

7. Prepare a map of the current land use status and develop a report explaining the provincial land use status map according to Articles 16, 17, 18, and 19 of this Circular.

8. Develop a report on the provincial land inventory results with main contents:

a) Overview of natural conditions, socio-economic situation; implementation situation, data and document sources used to compile the provincial land inventory; evaluation of the reliability of collected data and documents;

b) Evaluation of the current land use status; implementation situation of the five-year provincial land use plan; analysis of reasons for land use changes during the land inventory year compared to the data of the two most recent land inventory periods;

c) Assessment of cases involving changes in administrative boundaries, inconsistencies in administrative boundaries (if any);

d) Propose and recommend measures to enhance land management and utilization efficiency.

9. Inspect and accept the provincial land inventory results.

10. Complete and approve the provincial land inventory results.

11. Correct and complete the provincial land inventory data and reports when requested by the Ministry of Natural Resources and Environment according to Clause 3, Article 13 of this Circular.

12. Print copies and submit the land inventory results according to Clause 3 and point b Clause 5, Article 23 of this Circular.

Article 13. Nationwide Land Inventory

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

a) Drafting guidance documents for provincial People's Committees to implement the land inventory;

b) Developing plans and technical guidance materials for implementing the land inventory (if applicable);

c) Organizing specialized training for provincial People's Committees and relevant agencies;

d) Collecting files, documents, maps, and data related to the current land inventory period, land use planning, national land use plans; results of previous land inventory periods, annual land statistics during the nationwide land inventory period, and other related documents.

2. Directing, inspecting, and urging the implementation of the nationwide land inventory.

3. Receiving the results of the land inventory for defense and security lands from the Ministry of National Defense and the Ministry of Public Security; receiving the results of the provincial land inventory and directing corrections and improvements to the inventory data and reports (if applicable).

4. Processing and consolidating nationwide land inventory data; preparing tables as specified in points a, b, c, d, and đ of Clause 1, Article 5 of this Circular and drafting explanatory reports on the current land use status as stipulated in Clause 6, Article 10 of this Circular.

5. Preparing land use status maps, drafting explanatory reports on the nationwide land use status maps as stipulated in Articles 16, 17, 18, and 19 of this Circular.

6. Preparing the report on the nationwide land inventory with main contents:

a) The situation of implementing the nationwide land inventory;

b) Analyzing and evaluating the current land use status; analyzing the causes of changes in land use between the land inventory year and the two most recent land inventory years; the situation of inconsistencies in administrative boundary lines at the provincial level during the land inventory period (if applicable);

c) Proposing measures to improve land management and utilization efficiency.

7. Inspecting and accepting the results of the nationwide land inventory.

8. Completing and reporting

9. Printing copies and publishing the results of the land inventory as stipulated in Clause 4 and point c of Clause 5, Article 23 of this Circular.

Section 3

STATISTICS AND INVENTORY OF DEFENSE LANDS, SECURITY LANDS, AND SPECIALIZED LAND INVENTORY

Article 14. Statistics and Inventory of Defense Lands and Security Lands

1. Statistics and inventory of defense lands and security lands shall be conducted by the Ministry of National Defense and the Ministry of Public Security, in collaboration with provincial People's Committees.

2. Provincial People's Committees shall direct and guide lower-level People's Committees in coordinating with the Ministry of National Defense and the Ministry of Public Security to review and unify locations and areas of defense and security lands in their localities.

3. The statistics and inventory of defense lands and security lands shall be carried out according to the land categories specified in point c, Clause 3, Article 9 of the Land Law; Clause 3, Article 102/2024/NĐ-CP Decree and shall be consolidated into the table specified in point e, Clause 1, Article 5 of this Circular.

4. The results of the statistics and inventory of defense lands and security lands include reports and statistical and inventory tables as specified in point e, Clause 1, Article 5 of this Circular.

5. The Ministry of National Defense and the Ministry of Public Security shall submit the results of the statistics and inventory of defense lands and security lands nationwide to the Ministry of Natural Resources and Environment before March 31 of the following year for land statistics results; before June 30 of the following year for land inventory results.

Article 15. Special Land Inventory

1. A special land inventory is a detailed inventory of one or several land types specified in Article 9 of the Land Law, Clauses 4, 5, and 6 of Decree No. 102/2024/NĐ-CP; land users specified in Clause 3, Article 4 of this Circular; land managers specified in Clause 4, Article 4 of this Circular, and other related contents according to the requirements of state management over land at different periods.

2. The content and activities of a special land inventory shall be carried out based on the decision of the Minister of Natural Resources and Environment or the decision of the Chairman of the Provincial People's Committee.

3. Based on the decision of the Minister of Natural Resources and Environment regarding the special land inventory, the unit assigned to carry out the special inventory shall be responsible for drafting guidelines on indicators, forms, plans, procedures for implementation, and submission of results of the special land inventory to the Minister of Natural Resources and Environment.

4. Based on the decision of the Chairman of the Provincial People's Committee regarding the special land inventory, the unit assigned to carry out the special land inventory shall be responsible for drafting guidelines on indicators, forms, plans, procedures for implementation, and submission of results of the special land inventory to the Chairman of the Provincial People's Committee.

Section 4

CURRENT LAND USE MAPS

Article 16. General Provisions on the Preparation of Current Land Use Maps

1. Current land use maps are prepared for each administrative unit at the commune, district, provincial levels, economic and social regions, and nationwide to reflect the distribution of various types of land at the time of land inventory, including:

a) Commune-level current land use maps are compiled based on the summary and generalization of the content of the land inventory maps stipulated in Article 20 of this Circular;

b) District and provincial-level current land use maps are compiled based on the integration, summarization, and generalization of the content of the current land use maps of subordinate administrative units;

c) Economic and social region-level current land use maps are compiled based on the integration, summarization, and generalization of the content of the current land use maps of provincial-level administrative units during the national land inventory process;

d) National-level current land use maps are compiled based on the integration, summarization, and generalization of the content of provincial-level current land use maps or economic and social region-level current land use maps.

2. Determining the scale for preparing current land use maps

In cases where the administrative unit has a complex boundary shape making it difficult to express the content when preparing the map at the prescribed scale due to significant differences between its length and width, it is permitted to choose a larger or smaller scale by one level compared to the above regulations.

b) Current land use maps of economic and social regions are prepared at a scale of 1:250,000; national-level current land use maps are prepared at a scale of 1:1,000,000.

3. Mathematical Basis:

a) Commune, district, and provincial-level current land use maps are prepared within the national reference system and coordinate system VN-2000, national height system, transverse cylindrical projection, zone 3 (3 degrees), scale factor k = 0.9999, central meridian according to each province and centrally governed city as specified in Appendix V attached to this Circular;⁰ (3 degrees), scale correction factor for length distortion k₀ = 0.9999, central meridian according to each province and centrally governed city as stipulated in Appendix V attached hereto;

b) Current land use maps of economic and social regions use a transverse cylindrical projection with zone 6 (6 degrees), scale factor k⁰ (6 degrees), scale correction factor for length distortion k₀ = 0,9996;

c) A national land use status map using a conical equal-angle projection with two standard parallels at 11⁰ c) National-level current land use maps use a conical projection with standard parallels at 11 degrees and 21 degrees;⁰ (21 degrees);

d) In addition to the parameters specified in point a and b of this clause, other parameters shall be implemented according to Circular No. 973/2001/TT-TCĐC dated June 20, 2001, issued by the Director of the National Land Administration on the application of the national reference system and coordinate system VN-2000 according to the required map scale.

4. Digital formats of commune, district, provincial-level, economic and social region-level, and national-level current land use maps shall comply with the following provisions:

a) Commune, district, and provincial-level current land use maps are presented with the following parameters: Working Units; primary working unit (Master Units) is meter (m); secondary working unit (Sub Units) is millimeter (mm); resolution is 1000; coordinates of the center point for storage (Storage Center Point/Global Origin) are X: 500,000m, Y: 1,000,000m;

b) Digital versions of current land use maps at all levels are stored in *.dgn file format, accompanied by a symbol set; files must be open, allowing for necessary editing and updating of information, and using Unicode TCVN 6909:2001 font format; consistently using independent symbol libraries and pre-designed line symbols for various map scales.

Article 17. Content of the land use status map

1. The group of mathematical base layers and related contents include: kilometre grid, latitude and longitude grid, map scale, map frame, legend, land use structure chart, presentation outside the frame, and other related contents.

2. The group of land use status layers includes: boundaries of aggregated land parcels and land type symbols.

3. Groups of layers belonging to geographic base data include:

a) The group of boundary and administrative boundary layers including national borders and administrative boundary lines at all levels. For the national land use status map, it shows up to provincial administrative boundary lines. For the economic and social region land use status map, it shows up to district administrative boundary lines. For the provincial, district, and commune land use status maps, it shows up to commune administrative boundary lines.

When administrative boundary lines at different levels coincide, the highest level administrative boundary line shall be indicated;

b) The topography group layer includes objects to represent basic characteristics of the terrain such as contour lines (in high mountainous areas with steep slopes, only main contour lines are shown), elevation points, depth points, elevation and depth annotations, descriptive terrain feature lines, and special terrain forms;

c) The hydrographic group layer and related objects include: sea, lake, pond, swamp, reservoir, excavated pit, river, stream, canal, creek, brook, and other hydrological objects. The degree of representation of these objects on land use status maps at various levels is generalized according to the scale of the land use status maps at each level;

e) The economic and social object group layer includes the names of place names, headquarters of government agencies at all levels; names of infrastructure projects and other important projects. The degree of representation of these objects on land use status maps at various levels is generalized according to the scale of the land use status maps at each level.

4. Notes and explanations.

5. The form of presenting the content of land use status maps at various levels shall be carried out in accordance with the provisions set forth in Appendix V attached to this Circular.

Article 18. Editing the land use status map

The editing, synthesis, and generalization of the content of the land use status map at each level must meet the following requirements:

1. Aggregated land parcels of the land use status map are edited and synthesized as follows:

a) Aggregated land parcels of the commune land use status map are represented by boundaries and land type symbols (including land type codes and colors) according to land inventory criteria. Aggregated land parcels of the district, provincial, economic and social region, and national land use status maps are represented by boundaries and land type symbols according to the synthesis criteria specified in Appendix V attached to this Circular;

b) Land type symbols include land type codes and colors;

c) Aggregated land parcels on land use status maps at various levels must ensure closed boundaries without overlapping or gaps between parcels. Boundaries of aggregated land parcels must be generalized and smoothed to ensure the area of aggregated land parcels according to the map scale as follows:

In cases where the area of aggregated land parcels is smaller than the above regulations, they are represented by a symbolic dot with a diameter of 2 mm and according to the color of the land type to be represented. For small islands with areas smaller than the above regulations, they must still be shown on the land use status map accompanied by island name annotations (if any) without generalization;

2. Administrative boundary lines must be edited to ensure that the objects can be recognized when printed on paper; in cases where administrative boundary lines at different levels coincide with linear features, the administrative boundary lines need to be offset on both sides of the linear feature by 0.2 mm on the map.

3. Linear elements (rivers, streams, canals...) shorter than 2 cm on the map may be omitted; linear elements less than 0.5 mm wide on the map should be edited into a single line along the center of the linear element.

In cases where railways and motor vehicle roads are adjacent, the position of the motor vehicle road may be shifted to ensure the correct position of the railway.

When synthesizing linear elements, they must maintain the characteristic features of the objects to accurately reflect density, distribution patterns, and usage characteristics; for rivers and streams, the source positions and special flows such as hot springs and mineral water must be shown.

4. For coastline generalization, the distinctive shape of each type of coast must be maintained. In areas with many river mouths, curved coastlines may be combined into two or three small bends but must retain river mouths, streams flowing into the sea, and tidal flats.

5. Other geographic objects, place name annotations, and descriptions are selected, updated, or removed to ensure appropriate information density, readability, and aesthetic quality of the map.

6. The frame of the land use status map is presented as follows:

a) For maps at scales of 1:1,000, 1:2,000, 1:5,000, and 1:10,000, only the kilometre grid is shown, with the size of the square kilometre grid cell being 10 cm x 10 cm;

b) For maps at a scale of 1:25,000, the kilometre grid is shown, with the size of the square kilometre grid cell being 8 cm x 8 cm;

c) For maps at scales of 1:50,000, 1:100,000, 1:250,000, and 1:1,000,000, only the grid of meridians and parallels shall be indicated with the size of the grid cells for meridians and parallels as follows:

7. The editing of digital land use status maps, in addition to complying with the provisions of Clauses 1, 2, 3, 4, 5, and 6 of this Article, must also comply with the following requirements:

a) Linear objects must be represented continuously without interruption and may only terminate at nodes where linear objects of the same type intersect;

b) Area objects must be represented as closed areas;

c) Point objects must be represented using predefined point symbols;

d) Objects on the land use status map must be correctly represented according to their class, color, line weight, and accompanying parameters as specified in the table of object classes attached as Appendix V to this Circular. Each plot of land must have a land type code, which should not be deleted during editing but must be transferred to a separate layer for storage.

Article 19. Explanation Report of Land Use Status Map

1. Legal basis; purpose and requirements for preparing the land use status map.

2. Overview of the geographical location of the administrative unit.

3. Time of construction and completion of the land use status map preparation.

4. Sources of materials used and methods, technologies for preparing the land use status map.

5. Determination of the area surveyed for formal cadastral mapping.

6. Evaluation of the quality of the land use status map regarding completeness, detail, and accuracy of content elements.

7. Existing issues and limitations of the land use status map.

8. Conclusions and recommendations for measures to address limitations and issues.

Article 20. Land Inventory Map

1. The land inventory map is a map showing enclosed plots within a commune-level administrative unit, each plot representing the area by land type, land use object, and land management object as stipulated in Clauses 2, 3, and 4 of Article 4 of this Circular.

2. The land inventory map is prepared in digital form and implemented according to Appendix VI issued together with this Circular.

Chapter III

INSPECTION, HANDOVER, MANAGEMENT OF STATISTICAL AND INVENTORY RESULTS OF LAND

Article 21. Inspection of Statistical and Inventory Results of Land

1. The inspection content includes:

a) The completeness of the documentation and data in the statistical and inventory results file;

b) The completeness and accuracy of the delineation of plots and determination of land types, land use objects, and land management objects on the commune-level land inventory map;

c) The completeness and accuracy of the compilation of plots in the list of plots for the statistical and inventory period compared to the land inventory map and the list of cases of changes during the statistical and inventory period reviewed and confirmed by the People's Committee of the commune;

d) The accuracy in compiling data in the land statistics and inventory tables;

đ) The consistency of data between the land statistics and inventory tables and the commune-level land inventory map; between the land statistics and inventory tables at different levels; and between the tables and the report on the results of land statistics and inventory;

e) The quality of the reports on the results of land statistics and inventory at all levels must ensure completeness of content as prescribed in Clause 5 of Article 6, Clause 7 of Article 7, Clause 7 of Article 8, Clause 5 of Article 9, Clause 8 of Article 10, Clause 8 of Article 11, Clause 9 of Article 12, and Clause 6 of Article 13 of this Circular;

g) The quality of land use status maps at all levels and commune-level land inventory maps must ensure accuracy and completeness as prescribed in Articles 16, 17, 18, and 20 of this Circular.

2. Responsibility for inspecting statistical and inventory results of land:

a) Organizations and individuals directly responsible for land statistics and inventory must self-inspect and bear responsibility for the results during implementation;

b) The People's Committee of the commune must self-inspect and approve the commune-level land statistics and inventory results;

c) The competent land management agency at the district level has the responsibility to inspect the commune-level land statistics and inventory results, conduct self-inspection, and submit the district-level land statistics and inventory results for approval by the People's Committee of the district;

d) The competent land management agency at the provincial level has the responsibility to inspect the district-level land statistics and inventory results, conduct self-inspection, and submit the provincial-level land statistics and inventory results for approval by the People's Committee of the province;

đ) The agency assisting the Minister of Natural Resources and Environment in managing state affairs related to land statistics and inventory must inspect the results of land defense and security statistics and inventory conducted by the Ministry of Defense and the Ministry of Public Security, and inspect the results of land statistics and inventory conducted by the provincial level.

Article 22. Submission and Publication of Land Statistics Results

1. The commune-level dossier to be submitted to the district level includes:

a) A report on the results of land statistics accompanied by the tables prescribed at points a, b, c, and đ of Clause 1, Article 5 of this Circular that have been approved (one set of paper and one set of electronic files);

b) A land inventory map in *.dgn format, the land statistics result database compiled from the land statistics and inventory software of the Ministry of Natural Resources and Environment (in formats packaged according to technical standards for information technology applications in state agencies) and a list of delineated plots in the year of land statistics (one set of electronic files).

2. The dossier of the district level to be submitted to the provincial level includes:

a) A report on the results of land statistics accompanied by the district-level land statistics tables prescribed at points a, b, c, d, and đ of Clause 1, Article 5 of this Circular that have been approved (one set of paper and one set of electronic files);

b) The commune-level dossier on land statistics results as prescribed in Clause 1 of this Article (one set of electronic files).

3. The dossier of the provincial level to be submitted to the Ministry of Natural Resources and Environment includes:

a) A report on the results of land statistics accompanied by the provincial-level land statistics tables prescribed at points a, b, c, d, and đ of Clause 1, Article 5 of this Circular that have been approved (one set of paper and one set of electronic files);

b) The dossier on land statistics results of the district level as prescribed in Clause 2 of this Article (one set of electronic files);

c) The dossier on land statistics results of the commune level as prescribed in Clause 1 of this Article (one set of electronic files).

4. The time for submission and publication of annual land statistics results is stipulated as follows:

a) The time for submitting reports on the results of land statistics from the commune and district levels to their respective higher authorities is decided by the People's Committee of the province;

b) The People's Committee of the province completes, approves, and publishes the results of land statistics and submits the report to the Ministry of Natural Resources and Environment before March 31 of the following year, except in the year of land inventory;

c) The Ministry of Natural Resources and Environment compiles the annual land statistics results nationwide and publishes them before June 30 of each year.

Article 23. Submission and Publication of Land Inventory Results

1. The commune-level dossier to be submitted to the district level includes:

a) An approved report on the results of land inventory (one set of paper and one set of electronic files);

b) The commune-level land inventory data tables prescribed at points a, b, d, and đ of Clause 1, Article 5 of this Circular and an approved report on the current status of land use (one set of paper and one set of electronic files);

c) The current status of land use map and an approved explanatory report on the current status of land use map (one set of paper and one set of electronic files in *.dgn format);

d) A land inventory map in *.dgn format, the land inventory result database compiled from the land statistics and inventory software of the Ministry of Natural Resources and Environment (in formats packaged according to technical standards for information technology applications in state agencies) and a list of delineated plots in the year of land inventory (one set of electronic files).

2. The dossier of the district level to be submitted to the provincial level includes:

a) An approved report on the results of land inventory (one set of paper and one set of electronic files);

b) The district-level land inventory data tables prescribed at points a, b, c, d, and đ of Clause 1, Article 5 of this Circular and an approved report on the current status of land use (one set of paper and one set of electronic files);

c) The current status of land use map and an approved explanatory report on the current status of land use map of the district (one set of paper and one set of electronic files in *.dgn format);

d) The dossier on land inventory results of the commune level as prescribed in Clause 1 of this Article (one set of electronic files).

3. The dossier of the provincial level to be submitted to the Ministry of Natural Resources and Environment includes:

a) An approved report on the results of land inventory (one set of paper and one set of electronic files);

b) The provincial-level land inventory data tables prescribed at points a, b, c, d, and đ of Clause 1, Article 5 of this Circular and an approved report on the current status of land use (one set of paper and one set of electronic files);

c) The current status of land use map with an approved explanatory report on the current status of land use map of the province (one set of paper and one set of electronic files in *.dgn format);

d) The dossier on land inventory results of the district level as prescribed in Clause 2 of this Article (one set of electronic files);

đ) The dossier on land inventory results of the commune level as prescribed in Clause 1 of this Article (one set of electronic files).

4. The national land inventory results dossier to be submitted includes:

a) A report on the results of land inventory accompanied by the national land inventory tables prescribed at points a, b, and c of Clause 1, Article 5 of this Circular (one set of paper and one set of electronic files);

b) The national current status of land use map (one set of paper and one set of electronic files).

5. The time for submission and publication of land inventory results is stipulated as follows:

a) The time for submitting reports on the results of land inventory from the commune and district levels to their respective higher authorities is decided by the People's Committee of the province;

b) The People's Committee of the province completes, approves, and submits the report to the Ministry of Natural Resources and Environment on the results of land inventory before June 30 of the following year after the year of land inventory;

c) The Ministry of Natural Resources and Environment completes the compilation and reporting

Article 24. Management of files on land statistics and inventory results

1. The results of land statistics and inventory, after being approved and published by the competent authority, shall be updated into the national database on land.

2. Files on land statistics and inventory at the commune, district, provincial, and national levels (in paper and digital form) as stipulated in Articles 22 and 23 of this Circular shall be managed in accordance with the laws on archiving; documents used for land surveying and inventory that have been updated and revised to reflect changes (in paper form) shall be managed until the land inventory results are published.

3. Files on land statistics and inventory at the commune level shall be stored and managed at the People's Committee of the commune and the competent land management agency at the district level.

4. Files on land statistics and inventory at the district level shall be stored and managed at the competent land management agency at the district and provincial levels.

5. Files on land statistics and inventory at the provincial level shall be stored and managed at the competent land management agency at the provincial level and the Ministry of Natural Resources and Environment.

6. Files on national land statistics and inventory shall be stored and managed at the Ministry of Natural Resources and Environment.

7. The management of land statistics data and current land use maps shall be carried out in accordance with the laws on construction, management, operation, and exploitation of the national land information system.

Chapter IV

IMPLEMENTATION

Article 25. Effective Date

1. This Circular takes effect from August 1, 2024.

2. Circular No. 27/2018/TT-BTNMT dated December 14, 2018 of the Ministry of Natural Resources and Environment regarding land statistics, inventory, and the preparation of current land use maps shall cease to be effective from the date this Circular takes effect.

Article 26. Responsibility for Implementation

1. Ministries, ministerial-level agencies, government agencies, and provincial People's Committees shall be responsible for directing and implementing this Circular.

2. The Land Registration and Land Information Data Agency shall be responsible for inspecting the implementation of this Circular.

3. Departments of Natural Resources and Environment shall be responsible for implementing this Circular at the local level.

During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report them to the Ministry of Natural Resources and Environment for consideration and decision./.
