Regulations on the retention period for files and documents within the Civil Service domain

Pursuant to the Law on Archives dated June 21, 2024;
Pursuant to the Government Decree No. 25/2025/NĐ-CP dated February 21, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the proposal of the Director of the Office of the Ministry of Home Affairs;
The Minister of Civil Service issues this Circular to regulate the retention period for files and documents within the Civil Service domain.
Article 1. Scope of Regulation
This Circular stipulates the retention period for files and documents within the Civil Service domain.
Article 2. Applicability
This Circular applies to Ministries, ministerial-level agencies, agencies under the Government, People's Committees at all levels, and related organizations and individuals (hereinafter referred to collectively as agencies, organizations, and individuals).
Article 3. Retention period for files and documents within the Civil Service domain
1. Files and documents within the Civil Service domain include:
Group I. Files and documents on organizational structure, personnel management
Group II. Files and documents on local administrative organization
Group III. Files and documents on cadre, civil servant, and public official management
Group IV. Files and documents on association, fund, and non-governmental organization management
Group V. Files and documents on administrative reform
Group VI. Files and documents on democracy, mass mobilization, youth, and gender equality
Group VII. Files and documents on administrative, archival, and record management
Group VIII. Files and documents on commendation and reward
Group IX. Files and documents on labor, salary, and social insurance
Group X. Files and documents on employment
Group XI. Files and documents on occupational safety and health
Group XII. Files and documents on Vietnamese workers working abroad under contracts
Group XIII. Files and documents on persons with meritorious service
2. The specific retention period for files and documents within the Civil Service domain shall be implemented in accordance with the provisions set out in the Appendix attached to this Circular.
Article 4. Effective date
Article 32. Responsibilities of Agencies
2. From the date this Circular takes effect, the retention period for specialized vocational files and documents within the Civil Service domain as prescribed in Circular No. 10/2022/TT-BNV dated December 19, 2022, issued by the Ministry of Civil Service regarding the retention period for expired documents, shall cease to apply.
3. For documents that have been processed and their retention periods determined at the time of Circular No. 09/2011/TT-BNV dated June 3, 2011, issued by the Ministry of Civil Service concerning the retention period for commonly formed files and documents in the activities of agencies and organizations, Circular No. 13/2011/TT-BNV dated October 24, 2011, issued by the Ministry of Civil Service concerning the retention period for documents formed in the activities of provincial and centrally-administered city People's Committees, and Circular No. 10/2022/TT-BNV dated December 19, 2022, issued by the Ministry of Civil Service concerning the retention period for valid documents, agencies and organizations do not need to reprocess or reassess the value and retention period of these documents.
Article 5. Responsibilities for Implementation
1. The Minister, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees at all levels, heads of agencies, organizations, and related individuals are responsible for implementing this Circular.
2. In the course of implementation, if there are any difficulties, agencies, units, and individuals are requested to report to the Ministry of Civil Service for guidance and resolution./.
