CIRCULAR

Amending and Supplementing Certain Articles of Circular No. 04/2020/TT-MIT

dated January 22, 2020 of the Minister of Industry and Trade on

Auctioning Tariff-Rate Quotas for Importation of Used Motor Vehicles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership

Pursuant to the Law on Legislative Activities No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

Pursuant to the Law on Foreign Trade Management No. 5/2017/QH14;

Pursuant to Decree No. 40/2025/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade amended and supplemented by Decree No. 109/2025/NĐ-CP, Decree No. 193/2025/NĐ-CP

At the proposal of the Director of the Department of Import-Export;;

The Minister of Industry and Trade promulgates this Circular amending and supplementing certain articles of Circular No. 04/2020/TT-MIT dated January 22, 2020 of the Minister of Industry and Trade on Auctioning Tariff-Rate Quotas for Importation of Used Motor Vehicles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Article 1. Amending and Supplementing Clause 2 of Article 5

of Circular No. 04/2020/TT-MIT dated January 22, 2020 of the Minister of Industry and Trade as follows: "2. Used motor vehicles imported under the tariff-rate quotas prescribed in Article 3 of this Circular must comply with the rules of origin of goods under the CPTPP Agreement and must have certificates of origin when handling import procedures."

Article 2. Amending and Supplementing Clause 1 of Article 6.

of Circular No. 04/2020/TT-MIT dated January 22, 2020 of the Minister of Industry and Trade as follows: "1. Principles, procedures, and formalities for auctioning tariff-rate quotas shall be carried out in accordance with the provisions of the law on auctioning assets."

Article 3. Amending and Supplementing Appendix I issued together with Circular No.

04/2020/TT-MIT dated January 22, 2020 of the Minister of Industry and Trade as follows: 1. Amend the phrase “

Engine capacity ≤ 3,000 cm(units)3 to “Engine displacement ≤ 3,000 cm3 (units)” in Column 3 of Appendix I.

2. Amend the phrase “Engine capacity ≥ 3,000 cm3 (units)to “3 Engine displacement > 3,000 cm(units)

” in Column 4 of Appendix I.

Article 4. Implementation Provisions

1. This Circular takes effect from February 25, 2026.

2. Repeal Decision No. 731/QĐ-BCT dated March 4, 2020 of the Minister of Industry and Trade on correcting Circular No. 04/2020/TT-MIT dated January 22, 2020 of the Minister of Industry and Trade on Auctioning Tariff-Rate Quotas for Importation of Used Motor Vehicles under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership./.
