DIRECTIVE
ON IMPROVING ONE STEP OF ADMINISTRATIVE PROCEDURES IN THE HEALTH SECTOR
To implement Resolution No. 38/CP dated May 4, 1994 of the Government on improving one step of administrative procedures in handling citizens' and organizations' affairs and to implement Circular No. 96/BT dated May 31, 1994 of the Minister-Chairman of the Government Office guiding the implementation of Resolution No. 38/CP, the Ministry requests units in the health sector to immediately fulfill the following requirements:
1. Organize for staff members to study and thoroughly understand Resolution No. 38/CP.
2. Establish a unit to assist the head of the unit in reviewing all administrative procedures established by the unit or by higher authorities that are no longer appropriate and need to be abolished, supplemented, amended, or proposed for abolition, supplementation, or amendment by higher authorities.
3. Immediately cease collecting fees and charges set by the unit itself. If the unit deems it necessary to collect fees or charges beyond those prescribed by law, it must prepare a written explanation of the necessity and collection and expenditure plan for the Ministry's consideration and submission to the Prime Minister for decision.
In addition to fulfilling the requirements set out in points 1, 2, and 3 above, medical examination and treatment facilities (collectively referred to as hospitals) must strictly comply with the following regulations:
a. Effectively organize the implementation of Decree No. 95/CP dated August 27, 1994 of the Government on collecting part of hospital fees and related guidance documents. In addition to collecting hospital fees as prescribed, hospitals may not charge any additional amounts from patients. Hospitals must ensure the availability of medicines, blood, intravenous fluids, chemicals, X-ray films, and other essential consumables for medical examinations and treatments. Departments and wards may not sell medicines to patients.
b. Continue to implement Directive No. 04/BYT-CT dated May 16, 1994 of the Minister of Health on rectifying hospital operations (for the years 1994-1995).
c. Review all administrative procedures in receiving patients and immediately abolish unnecessary procedures that cause inconvenience to patients.
d. Enhance the spirit and attitude towards serving patients and strictly adhere to professional standards issued by the Ministry, unifying the organization of medical examinations and treatments for patients with health insurance cards as well as those required to pay part of the hospital fees.
Medical practitioners and personnel in hospitals may not abuse health insurance cards to obtain medicines from the hospital.
e. Organize the reception and handling of emergency cases effectively, ensuring no danger to patients' lives due to lack of responsibility or waiting for completion of administrative procedures upon reception.
f. Post hospital rules in departments and wards. The rules must include provisions for patients, medical practitioners, and healthcare personnel.
Upon receipt of this Directive, heads of subordinate units under the Ministry, Directors of Provincial Health Services, and health sectors must develop plans for implementation and report results to the Ministry (Office and Treatment Department) before October 30, 1994.
