Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 30c/NQ-CP dated November 8, 2011 of the Government on the overall program for administrative reform of state agencies for the period 2011-2020;
Pursuant to Decree No. 63/2010/NĐ-CP dated June 8, 2010 of the Government on administrative procedure control;
Pursuant to Decree No. 48/2013/NĐ-CP dated May 14, 2013 of the Government amending and supplementing certain decrees related to administrative procedure control;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Considering the proposal of the Minister of Justice,
DECISION:
Article 1. The Government hereby promulgates the Plan on Streamlining Key Administrative Procedures in 2015 attached hereto.
Article 2. Objectives, products, and implementation schedule
1. Objectives
a) To streamline and reduce by at least 25% the compliance costs associated with 13 groups of administrative procedures and related regulations as set out in Section I of the Plan.
b) 100% of administrative procedures at all levels of government shall be standardized and promptly published and made public on the National Database of Administrative Procedures and uniformly posted at locations where such procedures are received and processed.
2. Products
a) Report on the proposals to streamline administrative procedures and related regulations within the scope of management and resolution functions of each lead agency and coordinating agency as assigned in the Plan.
b) Draft Decision of the Prime Minister along with the proposals to streamline administrative procedures and related regulations to be submitted to the Prime Minister for consideration and approval.
c) Legal normative documents issued by Ministries and sectors within their authority or draft legal normative documents to be submitted to competent authorities for issuance to implement the proposals to streamline administrative procedures and related regulations according to the directives of the Government and the Prime Minister.
d) Administrative procedures that have been standardized, published, and made public on the National Database of Administrative Procedures and posted at locations where such procedures are received and processed.
đ) Interim report on the implementation and results of the Plan to streamline key administrative procedures in 2015.
3. Implementation schedule for specific tasks
a) Schedule for streamlining 13 groups of administrative procedures and related regulations as set out in Section I of the Plan.
- Systematizing the list of administrative procedures and related regulations:
+ Complete the statistics of administrative procedures and related regulations within the group under the management scope and send them to the lead Ministry or sector for consolidation before January 31, 2015;
+ Complete the systematization of the group of administrative procedures and related regulations to ensure uniform implementation before February 15, 2015.
- Studying and proposing solutions to streamline administrative procedures:
+ Complete the study and propose solutions to streamline administrative procedures and send them to the lead Ministry or sector before May 31, 2015;
+ Complete the process of soliciting opinions from Ministries, sectors, localities, the Advisory Council for Administrative Reform, and compliance subjects on the proposed solutions to streamline administrative procedures before June 30, 2015.
- Reviewing and evaluating the implementation of the plan and solutions to streamline administrative procedures:
+ Complete the draft report on the implementation and results of the plan and solutions to streamline administrative procedures and send it to the Ministry of Justice for review and evaluation before July 31, 2015;
+ Complete the review and evaluation of the solutions to streamline administrative procedures and send them to the lead Ministry or sector before August 31, 2015.
- Editing and finalizing the report on the implementation of the plan, the draft Decision attached with the solutions to streamline administrative procedures to submit to the Prime Minister before September 30, 2015.
- Completing the drafting of legal normative documents to implement the solutions to streamline administrative procedures to issue within their authority or submit to competent authorities for issuance through expedited procedures before December 31, 2015.
b) Schedule for implementing the two tasks set out in Section II of the Plan
- For Ministries and sectors:
+ Complete the establishment of lists and standardization of names of administrative procedures within the scope of review, systematization, and standardization before April 30, 2015;
+ Complete the development and issuance of decisions to publish administrative procedures according to the lists, send them to provincial People's Committees to organize the supplementation and completion of sets of administrative procedures within their jurisdiction; simultaneously complete the entry of data into the National Database of Administrative Procedures before August 31, 2015;
+ Post all administrative procedures within their jurisdiction for processing fully at locations where such procedures are received and processed immediately after the issuance of decisions to publish standardized administrative procedures according to each level of resolution, completing before December 31, 2015.
- For Provincial People's Committees:
+ Review, systematize, supplement, complete, and issue decisions to publish sets of administrative procedures within their jurisdiction according to each level of resolution based on decisions to publish administrative procedures already standardized by Ministries and sectors within their authority; simultaneously standardize data on the National Database of Administrative Procedures; complete before November 30, 2015;
+ Post all administrative procedures within their jurisdiction for processing fully at locations where such procedures are received and processed immediately after the issuance of decisions to publish standardized administrative procedures according to each level of resolution, completing before December 31, 2015.
Article 3. Responsibilities for implementation
1. Responsibilities of Ministries and sectors
a) Based on the tasks assigned in this Plan; the guidance and direction of the Government and the Prime Minister in 2014 related to administrative reform concerning tax, customs, investment, land, construction, etc., and other administrative procedures and groups of administrative procedures requiring priority streamlining within their authority, Ministers and heads of equivalent agencies shall direct and organize the implementation of the 2015 plan to streamline administrative procedures within their management functions, following the guidelines of the Ministry of Justice.
b) Lead Ministries and sectors shall be responsible for:
- Establishing a working group to assist the Minister in implementing the assigned tasks in the Plan for groups of administrative procedures involving two or more Ministries and sectors. The working group shall be headed by a representative of the lead Ministry or sector; members shall include representatives of relevant departments or higher-level units of coordinating Ministries and sectors, and representatives of members of the Advisory Council for Administrative Reform.
Depending on the requirements of the work, the working group may mobilize experts to support the research process to streamline administrative procedures.
- To standardize administrative procedures and related documents; review, evaluate, develop plans to simplify groups of administrative procedures and related regulations assigned as the main responsibility in Section I of the Plan; seek opinions from the Ministry of Justice, the Government Office, relevant ministries, sectors, and localities; submit the simplification plan for approval by the Prime Minister; draft normative legal documents to be issued within the authority or submitted to the competent authority for issuance to implement the approved simplification plan.
c) Ministries and sectors shall organize implementation and cooperate with the leading agency to compile statistics, simplify administrative procedures and related regulations within their management scope and functions as stated in Section I of the Plan; appoint representatives to participate in the Working Group; send results to the leading ministry or sector for compilation of the list and content of simplified administrative procedures of the group, while sending the Ministry of Justice for research to serve the process of examination and evaluation.
d) Review, systematize, and standardize data on administrative procedures in the National Database of Administrative Procedures as stipulated in Clause 1, Section II of the Plan, following the guidelines of the Ministry of Justice.
đ) Implement publication, public disclosure, and update all current administrative procedures under the management scope and field implemented at various levels of government that have been standardized and published in the National Database of Administrative Procedures and publicly posted at locations where administrative procedures are received and processed as stipulated in Clause 2, Section II of the Plan, following the guidelines of the Ministry of Justice.
2. Responsibilities of Provincial People's Committees
a) Based on tasks assigned in this Plan and directives and management by the Government,
b) Coordinate with ministries and sectors in implementing the Plan; provide comments on simplification plans of ministries and sectors.
c) Review, systematize, supplement, standardize, and implement publication and public disclosure of all current administrative procedures within the scope and authority to resolve as stated in Section II of the Plan, following the guidelines of the Ministry of Justice.
3. Responsibilities of the Ministry of Justice
Lead and coordinate with the Government Office to urge, guide, and inspect ministries, sectors, and localities during the implementation of the Plan; compile and report to the Prime Minister for consideration and direction regarding difficulties, obstacles, and recommendations from ministries, sectors, and localities during the implementation of the Plan; require ministries and sectors to re-examine and consider simplification plans if they do not meet the set objectives.
b) Lead and coordinate with the Advisory Council for Administrative Procedure Reform, relevant ministries, sectors, and localities to study and propose reform initiatives for each group of administrative procedures and related regulations, reporting to the Prime Minister and sending them to the leading agencies for research and improvement of administrative procedure simplification plans.
c) Lead and coordinate with the Advisory Council for Administrative Procedure Reform and relevant ministries, sectors, and localities to examine and evaluate the implementation situation and results of the Plan by ministries, sectors, and localities; urge and inspect the execution of approved administrative procedure simplification plans by the Prime Minister.
d) Lead and coordinate with the Government Office and relevant ministries, sectors, and localities to organize mid-term reviews of the Plan's implementation; report and propose commendations or corrections to ministries, sectors, and localities that perform well or fail to strictly implement this Plan to the Prime Minister.
đ) Guide ministries, sectors, localities, agencies, and organizations to report mid-term reviews of the implementation situation and results of the key administrative procedure simplification plan in 2015; complete the mid-term review work of the Plan in the first quarter of 2016 and report to the Prime Minister.
4. Responsibilities of the Government Office
a) Lead and coordinate with the Ministry of Justice and relevant ministries and sectors during the examination and verification of simplification plans for groups of administrative procedures and related regulations as stated in Section I of the Plan.
b) Coordinate with the Ministry of Justice in researching reform initiatives for groups of administrative procedures and related regulations as stated in Section I of the Plan; promptly report to the Prime Minister to take corrective measures against ministries, sectors, and localities that do not comply with assigned timelines, quality, and objectives.
5. Responsibilities of the Advisory Council for Administrative Procedure Reform and other coordinating agencies and organizations
a) The Advisory Council for Administrative Procedure Reform shall coordinate with the Ministry of Justice to study and propose reform initiatives for each group of administrative procedures and related regulations; examine and evaluate simplification plans for administrative procedures of ministries and sectors; appoint representatives to participate in the Working Groups implementing the Plans of ministries and sectors.
b) Other coordinating agencies and organizations shall organize research and propose reform initiatives for each group of administrative procedures and related regulations, sending them to the leading agencies for research and completion of simplification plans.
Article 4. Funding for the implementation of this Plan will be allocated from the regular budget of ministries, sectors, and localities for administrative procedure control activities in 2015. In addition to state budget, ministries, sectors, and localities may mobilize other financial resources according to the law to support activities under the Plan.
Article 5. This Decision shall take effect from the date of signing.
The Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, the Social Policy Bank, the Vietnam Development Bank, Chairpersons of People's Committees of provinces and centrally governed cities, Chairpersons of the Advisory Council for Administrative Procedure Reform, and heads of related agencies and organizations are responsible for enforcing this Decision./.
