CIRCULAR
Guidelines for Implementing the Emergency Hardship Allowance System in 1998
Implementing Decision No. 53/1998/QĐ-TTg dated March 3, 1998 of the Prime Minister on the emergency hardship allowance system in 1998, after reaching consensus with the Government Organization-Civil Servant Board at Circular No. 205/TCCP-BCTL dated April 15, 1998, the Ministry of Finance at Circular No. 1548 TC/HCSN dated May 2, 1998, the Central Organization Board at Circular No. 396/TC/TW dated April 20, 1998, and the Vietnam General Confederation of Labor at Circular No. 442/TLĐ dated April 8, 1998, the Ministry of Labor, Invalids, and Social Affairs provides the following guidelines for implementation:
I/ ELIGIBILITY AND CONDITIONS FOR RECEIVING ALLOWANCE
1/ Eligible recipients
- Administrative and public service officials, Party and mass organizations' staff receiving salaries from the state budget (including those under contractual terms within the staffing quota and enjoying benefits similar to officials and civil servants);
- Individuals receiving salaries from the state budget in the armed forces;
- Those currently receiving social insurance including: pension, disability allowance, work injury and occupational disease compensation; rubber plantation workers; survivors' benefits for workers, employees, civil servants, and deceased military personnel;
- Persons who have rendered meritorious service to the revolution and are receiving monthly allowances.
2/ Conditions for receiving the allowance:
Individuals falling under the categories mentioned in Point 1 above will be eligible for assistance if they encounter sudden difficulties in the following circumstances:
- Personal illness or accident requiring prolonged hospitalization;
- Parents (from either spouse's side), spouse, or children suffering from serious illness with high medical expenses;
- Death due to a critical illness or accident;
- Affected by natural disasters, severe epidemics, or accidents;
- Suffering losses from natural disasters, fires, or other risks (such as house fires, typhoons, floods...) causing significant damage to family assets directly impacting daily living.
II/ AMOUNT OF THE ALLOWANCE
Depending on the degree of sudden difficulty, the allowance will be granted at one of three levels: 200,000 VND; 300,000 VND; 400,000 VND per person per instance.
In exceptional cases, the total number of allowances granted in a year shall not exceed two times.
The specific amount of the allowance is determined by the head of the unit.
III/ PROCEDURES FOR GRANTING THE ALLOWANCE
Individuals meeting the conditions for receiving the allowance as stipulated in Section I must submit an application for emergency hardship allowance according to Form No. 1 of this Circular.
1/ For current employees:
Based on the allocated budget and the application for emergency hardship allowance submitted by officials and civil servants, the head of the unit will coordinate with the trade union organization to review and decide on the amount and number of individuals to be assisted. Subsequently, Form No. 2 will be compiled and sent to the direct authority.
2/ For individuals currently receiving monthly social insurance, and persons who have rendered meritorious service to the revolution and are receiving monthly allowances:
Applications for emergency hardship allowance from individuals should be submitted to the People's Committee of the commune, ward, or town where they participate in retirement associations and where they receive allowances. These applications will be reviewed and a list of recommendations will be prepared according to Form No. 2 and sent to the People's Committee of the district. The district People's Committee will then allocate funds based on the available budget and issue decisions to grant allowances to the eligible individuals. Afterward, a report according to Form No. 3 will be submitted to the provincial People's Committee.
Every quarter, central ministries, departments, and mass organizations, as well as provincial People's Committees, will compile the number of individuals receiving emergency hardship allowances according to Form No. 3 and report it to the Ministry of Labor, Invalids, and Social Affairs - Government Organization-Civil Servant Board - Ministry of Finance.
IV/ IMPLEMENTATION
To ensure that the emergency hardship allowance system in 1998 meets the requirements set by the State, the implementation process is organized as follows:
1/ The Ministry of Labor, Invalids, and Social Affairs will coordinate with the Government Organization-Civil Servant Board, the Ministry of Finance, and the Vietnam General Confederation of Labor to allocate emergency hardship allowance funds based on the number of eligible individuals to central ministries, departments, mass organizations, and provincial People's Committees.
2/ Based on the allocation of funds by the joint ministries, the Ministry of Finance will distribute funds quarterly directly to central ministries, departments, and mass organizations, and provide funding to localities through authorized limits to provincial finance and price control bureaus.
3/ Based on the allocated budget, the Minister, head of the department, or mass organization at the central level, and the Chairman of the provincial or municipal People's Committee will decide on the distribution of emergency hardship allowance funds to subordinate units (including Party and mass organizations, population and family planning staff within the staffing quota at the grassroots level).
Heads of agencies are responsible for organizing the timely implementation of emergency hardship allowances, ensuring correct eligibility, avoiding equal distribution, guaranteeing fairness, preventing loss or misuse of funds, and adhering to State regulations.
4/ The settlement of emergency hardship allowance funds for 1998 will be conducted according to the current regulations of the Ministry of Finance as stipulated in Part V of Circular No. 09 TC/NSNN dated March 18, 1997.
This Circular takes effect from March 1, 1998, until December 31, 1998.
During the implementation period, any difficulties encountered should be reported to the Ministry of Labor, Invalids, and Social Affairs and relevant ministries and departments for inspection of the implementation of this system./.
