CIRCULAR
Guidelines for implementing special allowances for cadres, civil servants, officials, and armed forces personnel Implementing Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, officials, and armed forces personnel; after consulting with the Ministry of Finance, the Ministry of National Defense, the Ministry of Public Security, and relevant ministries and sectors, the Ministry of Home Affairs provides guidelines for implementing special allowances for cadres, civil servants, officials, and armed forces personnel as follows:
Those working in remote islands far from the mainland and border areas with particularly difficult living conditions as specified in the annex attached to this Circular shall be entitled to special allowances, including:
I. SCOPE AND APPLICABLE SUBJECTS
1. Officers, professional military personnel, non-commissioned officers, soldiers, and workers within the establishment of agencies and units under the People's Army, the People's Public Security Force, and cryptographic organizations.
2. Cadres, civil servants (including probationary civil servants), officials, those in the probationary period, trial period, and contractual laborers who have been assigned salaries according to the salary scale prescribed by the State, working in state agencies, state-owned public institutions, associations, and non-governmental organizations established by competent authorities.
3. Full-time cadres and civil servants at communes, wards, and towns.
a) Special allowances are calculated as a percentage of the current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable) or current rank allowance for non-commissioned officers and soldiers in the armed forces.
II. AMOUNT OF ALLOWANCE AND METHOD OF PAYMENT
1. Amount of allowance:
b) The allowances include three levels: 30%, 50%, and 100%, applicable to the subjects specified in Section I of this Circular working in areas defined in the annex attached to this Circular.
Example 1. Mr. Vu Van A, a Lieutenant of the Vietnam People's Public Security Force, has a current salary coefficient of 4.60, the implemented salary from October 1, 2004, is 1,334,000 VND/month; working in an area applying a special allowance rate of 50%, he receives a special allowance of:
1,334,000 VND/month x 50% = 667,000 VND/month
Example 2. Ms. Nguyen Thi B, a specialist currently ranked at level 3, with a current salary coefficient of 3.00, the implemented salary from October 1, 2004, is 870,000 VND/month; working in an area applying a special allowance rate of 30%, she receives a special allowance of:
870,000 VND/month x 30% = 261,000 VND/month
Example 3. Mr. Tran Dang C, a Sergeant of the Vietnam People's Army, has a current rank allowance coefficient of 0.60, the implemented rank allowance from October 1, 2004, is 174,000 VND/month; stationed in an area applying a special allowance rate of 100%, he receives a special allowance of:
174,000 VND/month x 100% = 174,000 VND/month
a) Special allowances are paid based on the place of work concurrently with monthly salary or rank allowance and are not used to calculate contributions or benefits under social insurance.
2. Method of payment:
b) Special allowances are only paid for months actually worked in the designated area; if leaving the area for more than one month or working less than a full month, no allowance will be received.
c) Sources of funds for paying special allowances:
For subjects under agencies and units fully funded by the state budget, special allowances are paid from the state budget according to the current budget allocation system within the annual budget allocated to the agency or unit;
For subjects under agencies implementing personnel quota and administrative management expenses and subjects under public institutions implementing self-financing, special allowances are paid from the quota funds and self-financed funds allocated to the agency or unit.
Abolish all guiding documents implementing Decision No. 574/TTg dated November 25, 1993 of the Prime Minister on special allowances for cadres, civil servants, officials, and armed forces personnel.
III. EFFECTIVE DATE OF IMPLEMENTATION
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
2. The special allowance system for cadres, civil servants, officials, and armed forces personnel stipulated in this Circular shall be effective from October 1, 2004.
Based on the guidelines provided in this Circular, the Minister, the head of a ministry equivalent to a ministry, the head of a government-affiliated agency, and the Chairman of the People's Committee of provinces and centrally-administered cities shall determine the subjects and levels of special allowances to be enjoyed for cadres, civil servants, and officials under their jurisdiction.
Any supplementation of areas eligible for special allowances or adjustment of special allowance levels specified in this Circular, central ministries and sectors and provincial people's committees shall submit proposals to the Ministry of Home Affairs for consultation and coordination with the Ministry of Finance to consider and resolve.
3. Cadres, civil servants, and officials working in agencies and public institutions of the Party, the Front, and mass organizations shall implement special allowances according to the guidelines of the Central Organization Department.
During implementation, if there are any difficulties, ministries, sectors, and localities shall report to the Ministry of Home Affairs for study and resolution.
