Pursuant to Decree No. 63/2003/NĐ-CP dated June 11, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 100/2006/NĐ-CP dated September 21, 2006 of the Government detailing and guiding the implementation of certain provisions of the Civil Code and the Law on Intellectual Property regarding copyright and related rights;

At the proposal of the Director of the Copyright Office for Literary and Artistic Works and the Head of the Department of Organization and Cadres.

DECISION:

Article 1. Position and Functions

The Copyright Office for Literary and Artistic Works is an agency under the Ministry of Culture, Sports and Tourism assisting the Minister of Culture, Sports and Tourism in performing state management functions for the protection of copyrights and related rights throughout the country in accordance with the Party's guidelines and State laws. The Copyright Office for Literary and Artistic Works has its own seal and bank account at the National Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit to the Minister projects on strategy, laws, mechanisms, and policies for protecting copyrights and related rights; implement them after approval by the competent authority;

2. Submit to the Minister for issuance, organization, and guidance on the implementation of legal documents on copyrights and related rights within the jurisdiction of the Ministry of Culture, Sports and Tourism;

3. Implement measures to protect the legitimate rights and interests of the State, organizations, and individuals concerning copyrights and related rights;

4. Manage copyrights for literary, artistic, and scientific works, and related rights for performances, sound recordings, audiovisual recordings, and broadcasting programs belonging to the State as prescribed by law;

5. Implement regulations on providing, cooperating, ordering, and ensuring copyrights for works, and related rights for performances, sound recordings, audiovisual recordings, and broadcasting programs;

6. Establish and manage the copyright and related rights system; organize training for cadres on copyrights and related rights;

7. Guide Departments of Culture, Sports and Tourism on implementing state management functions for copyrights and related rights at the local level;

8. Manage the specialized activities of collective bodies representing copyrights and related rights according to the provisions of the law;

9. Issue, reissue, replace, and revoke Certificates of Copyright Registration and Certificates of Related Rights Registration;

10. Organize and coordinate educational, propaganda, and dissemination activities on legal knowledge, mechanisms, and policies concerning copyrights and related rights;

11. Organize information, statistics, national registration books, and publication of the Official Gazette on copyrights and related rights;

12. Resolve complaints and denunciations concerning copyrights and related rights according to the provisions of the law;

13. Propose rewards for organizations and individuals who have made achievements in the work of protecting copyrights and related rights;

14. Implement international cooperation on copyrights and related rights;

15. Coordinate with the competent agencies of the Ministry of Science and Technology to develop general policies, laws, and regulations on intellectual property protection, compile general information on intellectual property, implement joint international cooperation projects on intellectual property, and other related tasks;

16. Manage the organizational structure, staffing levels; implement policies and systems for cadres, civil servants, and employees under the jurisdiction of the Copyright Office for Literary and Artistic Works according to the provisions of the State and the分级任务不符合要求，以下是直接翻译的内容：

Article 3. Organizational Structure

1. Director and Deputy Directors;

Article 4. Effective date

This Decision takes effect 15 days from the date of publication in the Official Gazette, replacing Decision No. 39/2004/QĐ-BVHTT dated June 28, 2004 of the Minister of Culture, Sports and Tourism stipulating the functions, tasks, powers, and organizational structure of the Copyright Office for Literary and Artistic Works.

Article 5. Responsibilities for Implementation

The Heads of the Office of the Minister, the Heads of the Department of Organization and Cadres, the Department of Planning and Finance, the Director of the Copyright Office for Literary and Artistic Works, and the Heads of subordinate agencies and units under the Ministry of Culture, Sports and Tourism are responsible for implementing this Decision./.
