CIRCULAR
Article 1. Scope of Regulation and Applicability
This Circular guides the salary adjustment and implementation of safety bonus for managerial staff (including Chairman and Members of the Board of Management, Director, Deputy Directors, Chief Accountant), professional and technical staff, and administrative and service personnel working at the Vietnam Securities Depository Center and the Hanoi Stock Exchange.
Article 2. Salary Adjustment and Allowance Adjustment
The salary adjustment and allowance adjustment for managerial staff, professional and technical staff, and administrative and service personnel shall be carried out as follows:
1. For professional and technical staff, administrative and service personnel:
a) Based on the current position held and the current pay grade, they shall be transferred to corresponding positions and pay grades in the professional and technical staff pay table and the administrative and service personnel pay table issued pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government according to the principle: transferring the old pay coefficient (including pay grade salary and seniority allowance exceeding the ceiling if applicable) to the new pay grade with the nearest equivalent coefficient. In cases where the old pay coefficient is higher than the highest pay coefficient in the new pay grade, they shall only be transferred to the highest pay grade.
b) The time for the next pay grade promotion shall be calculated as follows:
- In cases where the transfer is to a pay grade with a higher pay coefficient than the old pay grade, if the difference between the old pay grade and the new pay grade is equal to or greater than 70% of the difference between two consecutive pay grades in the new pay grade, the time for the next pay grade promotion shall be calculated from the date of the new pay grade assignment; if it is less than 70%, the time for the next pay grade promotion shall be calculated from the date of the old pay grade assignment.
- In cases where the transfer is to a pay grade with a lower pay coefficient than the old pay grade, the time for the next pay grade promotion shall be calculated from the date of the old pay grade assignment.
Professional and technical staff holding the positions of Department Head or Deputy Department Head shall be assigned pay according to the professional and technical staff pay table and shall enjoy position allowance for Department Head or Deputy Department Head according to the level of a General Corporation and equivalent.
For the Director, Deputy Director, Department Head, and Deputy Department Head of Branches under the Vietnam Securities Depository Center, they shall be assigned pay according to the professional and technical staff pay table and shall enjoy position allowance, wherein the Director and Deputy Director shall enjoy position allowance equivalent to that of a Department Head or Deputy Department Head of the Center; the Department Head and Deputy Department Head shall enjoy position allowance of a state-owned enterprise at Level III.
2. For managerial staff:
Based on the appointed position, the current pay coefficient (including position allowance, seniority allowance exceeding the ceiling if applicable) shall be transferred to the position-based pay according to the level of a General Corporation and equivalent, corresponding to the position in the Table of Remuneration for Full-time Members of the Board of Management and the Table of Remuneration for General Manager, Director, Deputy General Manager, Deputy Director, and Chief Accountant according to the principle:
a) Transferred to Grade 1, if the old pay coefficient (including position allowance, seniority allowance exceeding the ceiling if applicable) is equal to or lower than the pay coefficient of Grade 1. The time for the next pay grade promotion shall be calculated from the date of Grade 1 assignment. If the difference between the old pay coefficient and the pay coefficient of Grade 1 is less than 70% of the difference between the pay coefficients of Grade 1 and Grade 2, the time for the next pay grade promotion shall be calculated from the date of the old pay grade assignment.
b) Transferred to Grade 2, if the old pay coefficient (including position allowance, seniority allowance exceeding the ceiling if applicable) is higher than the pay coefficient of Grade 1.
Article 3. Safety Bonus System
Officials managing, specialized officials, and staff working at the Vietnam Securities Depository Center and the Hanoi Stock Exchange shall apply the safety bonus system as prescribed in Decision No. 234/2005/QĐ-TTg dated September 26, 2005, of the Government on special treatment for workers, staff, and officials in certain industries and professions within state-owned companies, and as guided in Circular No. 35/2005/TTLT-BLĐTBXH-BTC dated December 16, 2005, of the joint circular of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance, as follows:
1. A rate of 20% of the salary grade, position, specialty, and vocational level shall be applied to managing officials, specialized, and vocational officials working in specialized and vocational departments.
2. A rate of 15% of the salary grade, position, specialty, and vocational level shall be applied to executive and service staff (excluding janitorial staff, kitchen service staff, and garden and ornamental plant care staff).
Article 4. This Circular shall take effect 45 days from the date of signature.
The transfer of salary grading and the safety bonus system stipulated in this Circular shall be implemented for the Vietnam Securities Depository Center from the date Decision No. 171/2008/QĐ-CP dated December 18, 2008, of the Government takes effect, and for the Hanoi Stock Exchange from the date Decision No. 01/2009/QĐ-CP dated January 2, 2009, of the Government takes effect.
Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids and Social Affairs for timely supplementary guidance./.
