Regarding the amendment and supplementation of certain articles of the Examination Regulations for Secondary School Graduation

issued together with Circular No. 10/2012/TT-BGDĐT dated March 6, 2012

which has been amended and supplemented by Circular No. 04/2013/TT-BGDĐT dated February 21, 2013

and Circular No. 06/2013/TT-BGDĐT dated March 1, 2013

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government amending point b Clause 1 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

At the proposal of the Director of the Department of Examinations and Quality Assurance, the Minister of Education and Training promulgates this Circular amending and supplementing certain articles of the Examination Regulations for Secondary School Graduation issued together with Circular No. 10/2012/TT-BGDĐT dated March 6, 2012, which has been amended and supplemented by Circular No. 04/2013/TT-BGDĐT dated February 21, 2013 and Circular No. 06/2013/TT-BGDĐT dated March 1, 2013 of the Minister of Education and Training.

Article 1. Amending and supplementing certain articles of the Examination Regulations for Secondary School Graduation issued together with Circular No. 10/2012/TT-BGDĐT dated March 6, 2012, which has been amended and supplemented by Circular No. 04/2013/TT-BGDĐT dated February 21, 2013 and Circular No. 06/2013/TT-BGDĐT dated March 1, 2013 of the Minister of Education and Training, as follows:

1. Clause 1 Article 6 is amended and supplemented as follows:

"1. The subjects for the secondary school graduation examination include four (4) subjects; among them, two (2) compulsory subjects are Mathematics and Vietnamese; the other two (2) subjects are chosen by the examinees from the following subjects: Physics, Chemistry, Biology, History, Geography, Foreign Language."

2. Clause 2, Article 7 shall be amended and supplemented as follows:

"2. Time limit for each subject:

a) Mathematics and Vietnamese: 120 minutes;

b) History and Geography: 90 minutes;

c) Physics, Chemistry, Biology and Foreign Language: 60 minutes."

3. Article 10 shall be amended and supplemented as follows:

"Article 10. Organization of Examination Committees

1. The Director of the Department of Education and Training issues a decision to establish Examination Committees to carry out preparatory work and organize examinations.

2. Compiling lists of examinees registered for the examination according to Examination Committees

a) In each Examination Committee, compiling the list of examinees for each examination room is carried out as follows:

+ Listing the names of examinees in alphabetical order a, b, c,... for examinees who have not registered for the Foreign Language examination;

+ Listing the names of examinees in alphabetical order a, b, c,... and in the order of English, Russian, French, Chinese, German, Japanese for examinees who have registered for the Foreign Language examination.

b) Each examinee has a registration number. The registration number consists of six (6) digits, increasing continuously up to the total number of examinees in the Examination Committee, ensuring that there are no duplicate registration numbers within the Examination Committee.

c) In cases where the Examination Committee includes two or more secondary schools, compiling the list of examinees for each examination room is carried out according to points a and b Clause 2 of this Article for each school.

3. Arranging examination rooms

a) Examination rooms are arranged according to subjects; in each examination room, the minimum distance between two (2) examinees sitting next to each other in the same row must be 1.2 meters; each examination room can accommodate a maximum of twenty-four (24) examinees, except for the last examination room of the Examination Committee, which can accommodate up to twenty-eight (28) examinees.

For Examination Committees including two or more secondary schools, examinees from different schools shall not be seated in the same examination room, except for the last examination room.

For the Foreign Language subject, examinees taking different foreign languages may be seated in the same examination room but their papers must be collected separately according to the subject.

b) The examination rooms of each Examination Committee are numbered from 001 onwards."

4. Point e Clause 3 Article 11 is amended and supplemented as follows:

"e) Types of certificates entitling the holder to bonus points (if applicable) include:

- Vocational certificate;

- Certificates awarded for winning prizes in examinations organized by the Ministry of Education or jointly with relevant departments at provincial level or higher, including: outstanding student competitions in cultural subjects; experimental and practical skill competitions (Physics, Chemistry, Biology); arts and sports competitions; national defense education games; science and technology contests; international letter writing contests."

5. Clause 2 Article 19 is amended and supplemented as follows:

"2. The entrance to the examination room must display:

a) A list of examinees in the examination room according to each subject;

b) Regulations on items allowed to be brought into the examination room."

6. Clause 7 Article 21 is amended and supplemented as follows:

"7. Sign the attendance sheet for each subject."

7. Clause 3 Article 22 is amended and supplemented as follows:

"3. Prior to the first examination session, the Examination Committee must gather all examinees and all members of the Examination Committee to organize the opening ceremony of the examination. From the second subject onwards, a meeting of the Examination Committee must be held before each subject to review the previous subject's examination experience, disseminate necessary information, and assign tasks to each member."

8. The term "examination session" in Clause 5 Article 22 is replaced with "subject".

9. Point a Clause 5 Article 22 is amended and supplemented as follows:

"a) The invigilator in the examination room must seal unused examination papers (extra papers) and hand them over to the secretary of the Examination Committee immediately in the examination room.

After each subject, the Examination Committee must immediately seal the examination papers and extra paper envelopes of that subject in front of the entire Examination Committee."

10. Point a and point c Clause 7 Article 22 are amended and supplemented as follows:

"a) Bag number 1: contains examination papers and 01 Examination Paper Collection Form according to each examination room for each subject. The invigilator in the examination room collects the papers and submits them to the Chairman of the Examination Board or the person authorized by the Chairman of the Examination Board; after collecting and checking the number of examination papers and sheets of paper in the examination room, the person receiving the papers directly seals bag number 1 before two invigilators submitting the papers, then signs on the outside sealing tape of the bag together;"

"c) Bag number 3: contains examination management files, including name and score recording sheets signed by candidates, 01 Examination Paper Collection Form according to each examination room for each subject, various records established in the examination room and the Examination Board's record; excess questions already sealed. On the outside of bag number 3, there is a signature on the sealing tape from 01 invigilator representative, 01 secretary, and the Chairman of the Examination Board;"

11. Points b and c of Clause 1, Article 27 are amended and supplemented as follows:

"b) Students in grade 12 who are selected to participate in international or regional competitions in science and technology, physical education and sports, arts and culture;"

c) Students with disabilities."

12. Point b of Clause 2, Article 27 is amended and supplemented as follows:

"b) For students with disabilities:

- For students with disabilities studying under the general education program:

+ Completing the general secondary education curriculum; meeting the conditions to take the exam as stipulated in Clause 2, Article 4 of this Regulation;

+ Having a disability confirmation certificate issued by the competent authority.

- For students with disabilities who cannot meet the general education program:

+ Being confirmed by the principal of the high school where they are registered to study regarding the results of implementing the Personal Education Plan annually at the secondary level;

+ Having a disability confirmation certificate issued by the competent authority."

13. The beginning of point b of Clause 1, Article 29 is amended and supplemented as follows:

"b) Winning individual and team awards in practical experiment contests (Physics, Chemistry, Biology); cultural and artistic contests; physical education and sports contests; national defense education games; science and technology contests; international letter writing contests organized by the Ministry of Education and Training in collaboration with relevant departments at provincial level or higher at the secondary level:"

14. Clauses 2 and 3 of Article 30 are amended and supplemented as follows:

15. The beginning of Article 31 is amended and supplemented as follows:

"Candidates who meet the examination conditions, have not been disciplined with penalties from cancellation of examination papers upwards, do not have any examination papers with scores of 1.0 or below, and have scores for graduation assessment as prescribed for each category below shall be recognized as having graduated:"

16. Point c of Clause 2, Article 31 is amended and supplemented as follows:

"c) Kinh people and foreigners residing in Vietnam with permanent residence registration for at least three years (counted from the date of the examination) in particularly difficult communes, border communes, safe area communes under the Program 135 investment scope; in particularly difficult coastal and island communes according to current regulations of the Prime Minister; in particularly difficult hamlets, communes in areas I, II, III in ethnic minority and mountainous regions according to current regulations of the National Ethnic Committee, studying at general schools not located in central districts of centrally-administered cities for at least two-thirds of the time of secondary education;"

17. Point a of Clause 3, Article 31 is amended and supplemented as follows:

"a) Having a parent who is an ethnic minority, themselves having permanent residence registration in particularly difficult communes, border communes, safe area communes under the Program 135 investment scope; in particularly difficult coastal and island communes according to current regulations of the Prime Minister; in particularly difficult hamlets, communes in areas I, II, III in ethnic minority and mountainous regions according to current regulations of the National Ethnic Committee, currently studying at boarding schools for ethnic minorities or general schools not located in central districts of centrally-administered cities;"

18. The beginning of point b of Clause 1, Article 34 is amended and supplemented as follows:

"b) Winning individual and team awards in practical experiment contests (Physics, Chemistry, Biology); cultural and artistic contests; physical education and sports contests; national defense education games; science and technology contests; international letter writing contests organized by the Ministry of Education and Training in collaboration with relevant departments at provincial level or higher at the secondary level:"

19. Points b and c of Clause 1, Article 35 are amended and supplemented as follows:

20. The beginning of Clause 2, Article 35 is amended and supplemented as follows:

"Candidates who meet the examination conditions, have not been disciplined with penalties from cancellation of examination papers upwards, do not have any examination papers with scores of 1.0 or below, and have scores for graduation assessment as prescribed for each category below shall be recognized as having graduated:"

21. The third bullet point of point b of Clause 2, Article 35 is amended and supplemented as follows:

22. The first bullet point of point c of Clause 2, Article 35 is amended and supplemented as follows:

"- Having a parent who is an ethnic minority, themselves having permanent residence registration in particularly difficult communes, border communes, safe area communes under the Program 135 investment scope; in particularly difficult coastal and island communes according to current regulations of the Prime Minister; in particularly difficult hamlets, communes in areas I, II, III in ethnic minority and mountainous regions according to current regulations of the National Ethnic Committee, currently studying at boarding schools for ethnic minorities or general schools not located in central districts of centrally-administered cities;"

Article 2. This Circular takes effect from May 8, 2014.

Article 3. Director of the Office, Director of the Department of Testing and Quality Assurance of Education, Heads of related units under the Ministry of Education and Training; Chairmen of People's Committees of provinces and centrally-administered cities; Director of the School Affairs Bureau - Ministry of National Defense; Directors of Departments of Education and Training;

Directors of universities and academies; Principals of universities and colleges; Principals of boarding schools for ethnic minorities directly under the Ministry of Education and Training are responsible for implementing this Circular./.
