CIRCULAR

REGULATIONS ON THE ORGANIZATION OF CONTESTS AND FOLK ART MEETINGS

Pursuant to Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government on artistic performances, fashion shows; beauty and model contests; circulation and business of audio and video recordings of music, dance, and theater;

Pursuant to Decree No. 15/2016/NĐ-CP dated March 15, 2016 of the Government amending and supplementing certain articles of Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Cultural Institutions;

The Minister of Culture, Sports and Tourism promulgates this Circular on the organization of contests and folk art meetings.

Article 1. Scope of Regulation

This Circular stipulates the organization of contests (contests and performances) and folk art meetings.

Article 2. Applicability

This Circular applies to agencies and units organizing contests and folk art meetings; organizations and individuals participating in contests and folk art meetings in Vietnam and other related organizations and individuals.

Article 3. Contests and Folk Art Meetings

1. National contests and folk art meetings are contests and folk art meetings organized by central bodies of ministries, central agencies of political organizations, political-social organizations, social organizations, socio-professional organizations, economic organizations (hereinafter referred to collectively as central organizations) for amateur performers from all over the country.

2. Regional contests and folk art meetings are contests and folk art meetings organized by central organizations, provincial-level municipalities directly under the Central Government for amateur performers from localities and units located within the administrative areas of provincial-level municipalities directly under the Central Government in the region.

3. Provincial contests and folk art meetings are contests and folk art meetings organized by provincial-level municipalities directly under the Central Government for amateur performers from localities and units located within the administrative areas of provincial-level municipalities directly under the Central Government.

5. Commune contests and folk art meetings are contests and folk art meetings organized for amateur performers from units located within the administrative areas of communes.

Article 4. Requirements for Organizing Contests and Folk Art Meetings

1. To serve political tasks, economic and social development, and cultural development according to the Party's guidelines and policies and the State's laws.

2. To discover, nurture talent, encourage the masses to participate in creative activities, preserve, teach, and promote traditional cultural and artistic values.

3. To meet the needs for exchange, learning, experience sharing, cultural enjoyment, and healthy entertainment of the people.

4. To ensure security, safety, fire prevention, hygiene, and environmental protection in accordance with the law.

Article 5. Contest and Folk Art Meeting Organizing Committee

1. Agencies and units organizing contests and folk art meetings must establish an Organizing Committee.

2. The Head of the Organizing Committee shall be the head of the agency or unit or a person authorized by the head of the agency or unit, the number of members of the Organizing Committee must comply with the following provisions:

a) For national contests and folk art meetings: the number of members of the Organizing Committee shall not exceed ten persons;

b) For regional contests and folk art meetings: the number of members of the Organizing Committee shall not exceed eight persons;

c) For provincial, district, and commune contests and folk art meetings: the number of members of the Organizing Committee shall not exceed six persons.

3. The Organizing Committee has the following responsibilities:

a) To issue regulations on the organization of contests and folk art meetings;

b) To propose awards for the contest; prize money levels; awarding items; fundraising;

c) To develop judging criteria, including quality standards; grading scales; award structures; award names; criteria for each award;

d) To decide on the establishment of the Judging Panel, the secretary of the contest, and the folk art meeting;

đ) To submit a written final report to competent state management agencies in accordance with Article 12 of this Circular.

Article 6. The Competition Board and Secretariat for Mass Cultural Events

1. The Competition Board must have the appropriate qualifications in the relevant artistic field of the competition or festival; they must be members of the literature and art association at the district level or higher for the competition or festival.

2. The number of members in the Competition Board includes: 01 Chairperson, 01 Deputy Chairperson, and at least 03 members, with a maximum of 05 members. The Secretariat for the competition or festival shall consist of at least 02 persons, with a maximum of 04 persons.

3. The Competition Board is responsible for evaluating, appraising, and classifying the quality of each performance and program.

Article 7. Content of Regulations on Organizing Mass Cultural Competitions and Festivals

The regulations for mass cultural competitions and festivals include the following main contents:

1. Objectives and requirements.

2. Time and location of organization.

3. Participants and constituent elements.

4. Content, form, and genre.

5. Number of performers, programs, and items participating.

6. Duration of each participating program.

7. Composition of the Competition Board.

8. Criteria, methods of scoring, award structure, and prize money.

Article 8. Organization of Mass Cultural Competitions and Festivals in the Culture, Sports, and Tourism Sector

1. The establishment and organization of the National or Regional Competition Board for Mass Cultural Competitions and Festivals in the Culture, Sports, and Tourism sector shall be decided by the Minister of Culture, Sports, and Tourism.

2. The establishment and organization of the Competition Board for Mass Cultural Competitions and Festivals in the Culture, Sports, and Tourism sector at the provincial, district, and commune levels shall be decided by the Chairman of the People's Committee at the respective level.

Article 9. Budget for Organizing Mass Cultural Competitions and Festivals

1. The budget for organizing mass cultural competitions and festivals includes:

a) State budget funds;

b) Funds raised through sponsorship and other sources as prescribed by law.

2. The budget for organizing mass cultural competitions and festivals shall be managed and utilized according to the standards, norms, and regulations issued by competent state agencies.

3. The organizing agency or unit has the responsibility to prepare, settle accounts, and finalize the budget according to the provisions of the law.

Article 10. Awards for Mass Cultural Competitions and Festivals

1. Awards for mass cultural competitions:

a) The Department of Grassroots Cultural Affairs shall present gold medals, silver medals, and certificates of merit to organizations and individuals participating in national and regional competitions;

b) The Departments of Culture, Sports, and Tourism, and the Departments of Culture and Sports shall present certificates of merit and commemorative flags to organizations and individuals participating in local competitions.

2. Provisions on awards for mass cultural festivals:

The Ministry of Culture, Sports, and Tourism, People's Committees at all levels, and organizing units shall present commendation certificates, certificates of merit, commemorative flags, and other forms of recognition to participating units in festivals.

Article 11. Subsidies for Participation in Mass Cultural Competitions and Festivals

1. The Organizing Board, Secretariat, and members of the grassroots arts unit when organizing and participating in training and performance activities shall enjoy subsidies as stipulated in Circular Joint No. 46/2016/TTLT-BTC-BVHTTDL dated March 11, 2016, issued by the Ministry of Finance and the Ministry of Culture, Sports, and Tourism guiding special management regimes for provincial and district-level mobile propaganda teams and other relevant laws.

2. Members of the Competition Board, authors, choreographers, directors, and artists in competitions and festivals shall enjoy benefits as agreed upon with the organizing unit of the mass cultural competition or festival.

Article 12. Summarizing the competition and mass cultural festival

1. The Head of the Jury Board shall summarize the professional aspects, comment and evaluate the content and artistic quality of the programs and performances at the competition and mass cultural festival.

2. The Head of the Organizing Board shall summarize the organization work of the competition and mass cultural festival, announce and present awards based on the commendation decisions.

3. The Organizing Board of the competition and mass cultural festival shall be responsible for reporting in writing the results of the competition and mass cultural festival to the competent authority, specifically as follows:

a) For provincial, regional, and national level competitions and mass cultural festivals: report the results in writing to the Department of Mass Cultural Affairs within ten working days from the closing date.

b) For county-level competitions and mass cultural festivals: report the results in writing to the Department of Culture, Sports and Tourism, the Department of Culture and Sports of provinces and centrally-administered cities within ten working days from the closing date.

c) For village-level competitions and mass cultural festivals: report the results in writing to the District Cultural and Information Office within ten working days from the closing date.

Article 13. Implementation Organization

1. The Department of Mass Cultural Affairs shall be responsible for advising the Minister of Culture, Sports and Tourism to manage state activities related to competitions and mass cultural festivals, including:

a) Providing guidance and training on professional skills for organizing competitions and mass cultural festivals; organizing and directing nationwide and regional cultural, sports, and tourism competitions and mass cultural festivals.

b) Receiving applications, awarding gold, silver medals, and certificates of merit for national and regional level competitions and mass cultural festivals.

c) Monitoring, supervising, and tracking the implementation of competitions and mass cultural festivals according to this Circular.

2. The Departments of Culture, Sports and Tourism of provinces and centrally-administered cities shall be responsible for organizing, implementing, inspecting, and urging agencies and organizations to strictly comply with the provisions of this Circular; advising the People's Committees of provinces and centrally-administered cities to decide on organizing provincial-level competitions.

Article 14. Effective Date

1. This Circular shall take effect from December 1, 2016. The provisions regarding non-professional competitions and mass cultural festivals at the regional and national levels in Articles 5 and 6 of the Regulation on Commendations in Festivals, Exhibitions, Competitions, and Performances in the field of culture and information issued together with Decision No. 101/2006/QĐ-BVHTT dated December 28, 2006 of the Minister of Culture and Information shall cease to be effective from the date this Circular takes effect.

2. During the implementation process, if any difficulties arise, organizations and individuals are requested to promptly reflect them to the Ministry of Culture, Sports and Tourism (through the Department of Mass Cultural Affairs) for research and appropriate amendments and supplements.
