Issuing national technical regulations on the environment

 

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Environmental Protection Law dated June 23, 2014;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing and guiding implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain articles of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing and guiding implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing and guiding implementation of certain provisions of the Law on Product Quality;

Pursuant to Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing and guiding implementation of certain provisions of the Law on Product Quality;

Pursuant to Decree No. 36/2017/NĐ-CP dated April 4, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decision No. 73/2014/QĐ-TTg dated December 19, 2014 of the Prime Minister listing scrap materials permitted for import as production raw materials;

At the proposal of the General Director of the Environmental Administration, the Deputy Director in charge of Science and Technology, and the Deputy Director in charge of Legal Affairs;

The Minister of Natural Resources and Environment issues this Circular to stipulate national technical regulations on the environment.

 

Article 1. Issued with this Circular are three (03) national technical regulations on the environment, including:

  1. QCVN 65:2018/BTNMT - National Technical Regulation on Environment for imported scrap glass as production raw materials;
  2. QCVN 66:2018/BTNMT - National Technical Regulation on Environment for imported colored metal scrap as production raw materials;
  3. QCVN 67:2018/BTNMT - National Technical Regulation on Environment for imported blast furnace slag (small-sized slag, sand-like slag from iron or steel industry) as production raw materials.

Article 2. Waste glass, colored metals, and blast furnace slag specified in the List of scrap materials permitted for import from abroad as production raw materials issued together with Decision No. 73/2014/QĐ-TTg dated December 19, 2014 by the Government are goods that may cause safety risks (imported goods group 2) under the management responsibility of the Ministry of Natural Resources and Environment.

Article 3. Effectiveness and Implementation

1. This Circular takes effect from October 29, 2018.

2. Article 10 of Circular No. 41/2015/TT-BTNMT dated September 9, 2015 by the Minister of Natural Resources and Environment on environmental protection in importing scrap materials as production raw materials and Clause 9, Article 1 of Circular No. 03/2018/TT-BTNMT dated August 14, 2018 by the Minister of Natural Resources and Environment amending and abolishing certain provisions regarding administrative procedures related to specialized inspections within the scope of the Ministry's state management functions shall cease to be effective from the date this Circular takes effect.

3. The Director of the Environmental Administration, Heads of units under the Ministry of Natural Resources and Environment, Directors of Provincial Departments of Natural Resources and Environment, centrally-run cities, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
