CIRCULAR

GUIDELINES FOR COMPETITION AND REWARD WORK IN THE INFORMATION AND COMMUNICATIONS INDUSTRY

Pursuant to the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005; and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated November 16, 2013;

Pursuant to Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Considering the proposal of the Director of the Department of Competition and Reward;

The Minister of Information and Communications promulgates this Circular guiding competition and reward work in the Information and Communications Industry.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides competition and reward work in the Information and Communications Industry, including: the content and forms of organizing competitions; criteria and subjects for awarding commendations; criteria and subjects for awarding rewards; authority to decide, procedures, and files for proposing commendations and rewards; organization of machinery for competition and reward work and the competition and reward fund.

Article 2. Applicability

This Circular applies to individuals and organizations of Vietnamese citizens, Vietnamese citizens residing abroad, and foreign individuals and organizations involved in activities related to the Information and Communications Industry.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Higher-level units: agencies and units with many member units having legal personality operating in the field of information and communications.

2. Basic-level units:

a) Agencies and units under the Ministry of Information and Communications (hereinafter referred to as agencies and units under the Ministry); Provincial Departments of Information and Communications under centrally governed cities; member units under higher-level units;

b) Agencies, units, organizations, and enterprises operating in the field of information and communications with legal personality.

3. Lower-level basic units: units directly subordinate to basic-level units.

4. Small collectives: units and organizations subordinate to lower-level basic units.

Article 4. Principles of Competition and Criteria for Awarding Commendations

The principles of competition and criteria for awarding commendations are implemented according to the provisions of Clause 1, Article 6; Clause 1, Article 10 of the Law on Competition and Reward; Clauses 2, 3, 4, 5, and 6, Article 10 of Decree No. 91/2017/NĐ-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward (hereinafter referred to as Decree No. 91/2017/NĐ-CP), specifically as follows:

1. Voluntary, democratic, solidarity, cooperation, and joint development.

2. The awarding of commendations must be based on the competition movement; all individuals and collectives participating in the competition movement must register for competition and set goals and targets. Individuals and collectives that do not register for competition will not be considered for commendations.

3. Commendations will not be awarded to individuals or collectives who have been disciplined with warnings or higher penalties.

4. Period of service:

a) For individuals: those appointed to positions of civil servants or public officials; workers who have signed labor contracts with a term of one year or more with the head of the basic unit; these individuals must have worked for at least ten months during the year of consideration for commendation;

Female employees on maternity leave as stipulated by state regulations and those who have performed brave acts to save people or property, or those serving in combat roles due to injuries requiring medical treatment or recuperation as concluded by health authorities, their leave time will still be counted towards consideration for commendations;

For individuals sent for short-term training or further education under one year, if they comply with the rules of the training institution, their study period will be counted towards their service period for consideration for the title of "Advanced Worker." In cases where individuals are sent for training or further education for one year or more, if they comply with the rules of the training institution and achieve grades of good or better, they will be eligible for consideration for the title of "Advanced Worker";

For individuals transferred to new positions, the new unit is responsible for considering and voting for commendations based on comments from the previous unit (in cases where the individual has served in the previous unit for six months or more);

b) For collectives: they must have officially operated for at least ten months during the year of consideration for commendation.

Article 5. Principles and grounds for awarding rewards

The principles and grounds for considering rewards shall be implemented in accordance with Clause 2, Article 10 of the Law on Competition and Rewards, and Clause 3, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards 2013; Article 3 of Decree No. 91/2017/ND-CP, specifically as follows:

1. To be carried out regularly and promptly, ensuring transparency, democracy, fairness, and accuracy.

2. Rewards shall be based on achievements and standards, ensuring that the level of achievement corresponds to the level of reward. Achievements that are significant, have wide-ranging impact, or are achieved under difficult conditions shall be considered for higher-level rewards; it is not necessary to follow a sequence starting from lower-level reward forms before moving to higher levels, nor is it required that subsequent rewards must be higher than previous ones.

3. Emphasis shall be placed on rewarding individuals and small groups, groups that have improved from being weak to becoming exemplary models in competition movements, achievements in key and urgent tasks during each period; particularly focusing on rewarding workers, direct production laborers, ethnic minorities, and individuals with many innovations in work and operations.

4. When considering rewards for heads of agencies, organizations, or units, their achievements in leading their teams shall be taken into account.

5. For female leaders and managers, the time spent in office for the purpose of rewarding contributions shall be reduced by one-third compared to the general regulations; in cases where the retirement age is higher, the time spent in office for the purpose of rewarding contributions shall be implemented according to the general regulations.

When there are multiple individuals or groups meeting the criteria, preference shall be given to selecting female individuals or groups with at least 70% female members for consideration of rewards.

6. The time for submitting applications for subsequent rewards shall be calculated based on the time recorded in the previous reward decision for achieving the accomplishment. In cases where the previous reward decision does not record the time for achieving the accomplishment, the time for submitting applications for subsequent rewards shall be calculated based on the issuance date of the previous reward decision.

7. Within one year, no more than two state-level reward forms shall be submitted to higher authorities for one group or individual (except for outstanding and exceptional achievements; rewards for contributions over a period, and rewards according to service years).

8. The Minister of Information and Communications may only award rewards to groups and individuals managed by provincial People's Committees for achievements in thematic or sectoral competition movements initiated by the Minister of Information and Communications, or for outstanding and exceptional achievements.

9. Only comprehensive reward results shall be used as the basis for considering rewards or recommending higher authorities to grant rewards. Reward results from periodic competition movements shall be recognized and prioritized when considering rewards or recommending higher authorities to grant rewards.

Rewards or recommendations for rewards shall not be granted to groups or individuals who are currently under investigation by competent authorities for disciplinary actions, investigations, audits, inspections due to suspected violations, or whose complaints or accusations are still under verification.

10. A reward form can be awarded multiple times to the same recipient; however, multiple reward forms shall not be awarded for the same achievement.

11. Spiritual rewards shall be combined with material rewards.

12. Rewards at each level shall be decided by the head of the agency or unit at that level based on the recommendation of the Competition and Rewards Council at the same level.

13. No monetary awards shall be given; instead, commemorative gifts corresponding to the monetary value of the awards shall be presented to foreign organizations and individuals along with the titles and reward forms.

Article 6. Responsibilities of agencies and units in the work of competition and reward

1. Implement the leadership and guidance of the same-level Party Committee and the higher-level Party Committee on the work of competition and reward.

2. Carry out the work of competition and reward:

a) Manage the work of competition and reward and the machinery for such work.

b) Issue and inspect the implementation of guiding documents, urging, and guiding the implementation of the work of competition and reward.

c) Develop programs, plans, determine the content and goals of competition.

d) Coordinate with mass organizations to organize competition movements, expand competition movements within their management scope. Organize mid-term reviews, final summaries of competition movements, and identify and select individuals and groups with outstanding achievements for rewards or propose to competent authorities to grant rewards according to regulations.

đ) Coordinate with information and press agencies to implement propaganda and dissemination activities: Law on Competition and Reward, Decree 91/2017/ND-CP; Circulars and other guiding documents for implementing the work of competition and reward issued by the Ministry of Information and Communications; competition movements initiated by the Minister of Information and Communications and heads of agencies and units operating in the field of information and communications. Timely publicize exemplary models, good people and deeds, and promote competition movements and reward work.

e) Provide information as required by the Department of Competition and Reward about the results of activities, implementation of Party policies and state laws for cases proposed for rewards to serve the assessment of achievements and accurate awarding.

Article 7. Organization and machinery for competition and reward at all levels

1. Competition and Reward Councils at all levels:

a) The Competition and Reward Council is the advisory body for the head of the unit at the same level regarding the work of competition and reward. The Competition and Reward Council is established from the grassroots unit level upwards, decided by the head of the unit at the same level, defining functions, tasks, working regulations, and the relationship of work with the specialized unit responsible for the work of competition and reward at the same level.

b) The Competition and Reward Council at each level is chaired by the head of that level, the Chairman of the Trade Union is the Vice-Chairman, the head of the specialized unit or the staff member responsible for the work of competition and reward is the Standing Member; members of the Competition and Reward Council include representatives of the Ho Chi Minh Communist Youth Union (if any) and staff members responsible for key areas of the unit.

c) The Competition and Reward Councils at all levels have the following duties and powers:

Advise the head of the agency or unit to launch competition movements within their authority;

Regularly evaluate the results of competition movements and reward work; advise on mid-term and final reviews of competition and reward work; propose initiatives and measures to promote patriotic competition movements annually and during each phase;

Advise the head of the agency or unit to inspect and supervise competition movements and the implementation of policies and laws on competition and reward;

Advise the head of the agency or unit to decide on bestowing commendation titles and reward forms within their authority or submit to competent authorities for rewards.

2. Specialized units responsible for competition and reward work at all levels:

a) At the Ministry level: The Department of Competition and Reward is the specialized unit and the permanent body of the Competition and Reward Council of the Ministry of Information and Communications. The tasks of the Department of Competition and Reward are carried out according to the decision of the Minister of Information and Communications stipulating the functions, tasks, powers, and organizational structure of the Department of Competition and Reward;

b) At the upper grassroots and grassroots levels: based on organizational structures; requirements and tasks of competition and reward work of each unit, the head of the agency or unit considers and decides on the specialized unit as the Department or arranges staff to handle competition and reward work of the unit. Specialized units responsible for competition and reward work at all levels have the following tasks:

Advise the head of the agency or unit and the Competition and Reward Council at the same level to concretize the policies and laws of the Party and the State on competition and reward work within their management scope;

Perform the function as the permanent body of the Competition and Reward Council at the same level;

Develop programs, plans, competition and reward contents for each period and field to achieve the goals and tasks of the Ministry of Information and Communications and the grassroots level;

Assist the head of the agency or unit to organize competition movements, mid-term and final reviews, discover exemplary models, summarize and disseminate experiences, expand competition movements and exemplary models; propose innovations in competition and reward work;

Review files, achievements, and propose reward forms accurately and promptly according to legal provisions;

Propagate, disseminate, guide inspections, and urge subordinate units to implement competition and reward work;

Inspect the implementation of reward policy regulations; participate in resolving complaints and denunciations related to competition and reward work;

c) The permanent bodies of the Competition and Reward Councils at all levels are responsible for advising the Chairman to convene meetings of the Council. The Competition and Reward Council meets when at least 2/3 of the members attend. The Chairman of the Competition and Reward Council chairs the meeting or delegates one Vice-Chairman to chair it. The Chairman implements voting for awards like other members. The permanent body of the Competition and Reward Council solicits opinions on awards from absent members in writing, compiles, reports to the Chairman of the Competition and Reward Council; completes the minutes of the Competition and Reward Council meeting and the award proposal file according to regulations.

Chapter II

COMPETITION AND ACHIEVEMENT AWARDS

Article 8. Launching and directing competition movements

1. The Minister of Information and Communications shall launch and direct competition movements throughout the Information and Communications sector.

2. Heads of agencies and units shall launch and direct competition movements within their respective management scope.

3. Heads of agencies and units shall coordinate with mass organizations at the same level to organize mobilization efforts to encourage members of their units to actively respond to competition movements.

Article 9. Forms of organizing competition movements

The forms of organizing competition movements shall be implemented according to the provisions of Article 4 of Decree No. 91/2017/NĐ-CP, specifically as follows:

1. Regular competitions are organized and carried out throughout the working year to achieve set goals, targets, and work programs. Regular competitions apply between individuals within a collective, collectives within the same agency or unit, or between agencies or units with similar functions, tasks, and job characteristics.

Regular competitions must clearly define objectives, requirements, targets, specific indicators, and be organized in blocks or clusters for signing competition agreements; implementing registration of competition among individuals and collectives. At the end of the working year, the head of the agency or unit launching the competition movement will conduct a summary and evaluation of competition titles.

2. Competitions in phases (specialized) are organized to celebrate significant anniversaries during the year or to address key, urgent tasks, specialized tasks with difficult and complex nature, and to resolve weak points in specific stages and periods.

When summarizing and concluding competition movements lasting three years or more, outstanding and exemplary individuals and collectives will be selected to be presented to the Prime Minister for commendation with "Prime Minister's Commendation"; competition movements lasting five years or more will select outstanding and exemplary individuals and collectives to be presented to the State President for awarding "Labor Medal, Third Class".

3. The organization of competition movements and periodic or specialized commendations or commendations in specific fields, organized by the Minister of Information and Communications, will have specific regulations for each competition movement.

4. Do not present state-level commendations: "Prime Minister's Commendation", "Medal" to collectives or individuals when summarizing and concluding the construction, implementation of laws, ordinances, decrees, or serving conferences, seminars, forums.

Article 10. Content of organizing competition movements

The content of organizing competition movements shall be implemented according to the provisions of Article 5 of Decree No. 91/2017/NĐ-CP, specifically as follows:

1. Clearly define the purpose, requirements, goals, scope, and target audience of the competition, on this basis, set specific indicators and competition contents. The determination of competition content and indicators must ensure scientificity, practicality, and feasibility.

2. Competition movements should have memorable themes and names that are easy to promote and implement; closely align with political tasks, key and urgent tasks to propose specific, practical, and appropriate competition contents and methods based on the conditions and participation capabilities of agencies, organizations, units, and individuals.

3. Based on the characteristics, nature of work, occupational labor, scope, and target audience participating in the competition, suitable and diverse forms of launching the competition should be adopted; oppose all ostentatious and formalistic manifestations in competitions.

4. Based on the content and indicators of the competition movement, establish appropriate criteria for assessment in line with reality to serve as the basis for evaluating and rewarding competitions during interim and final summaries.

5. Implement measures to organize mobilization for competitions, monitor, urge, guide, and inspect the implementation of competition movements. Organize pilot directives to draw lessons and disseminate good experiences among participants in the competition.

6. Conduct interim and final summaries, evaluate the results of the competition movement; select and reward outstanding and excellent individuals and collectives in the competition movement.

7. Enhance the role and responsibility of agencies, units, and organizations in discovering new factors, advanced models to promote and publicize widely. Strengthen the dissemination of innovative ideas, experiences, effective practices for everyone to learn from. Discovering advanced models is a key task in organizing competition movements.

Article 11. Competition Groups and Clusters

1. Competition Groups and Clusters under the Ministry of Information and Communications:

a) Based on the position, functions, tasks, nature of work, and scope of activities of agencies, units, and enterprises throughout the sector, the Minister of Information and Communications decides to organize competitions according to Competition Groups and Clusters;

b) Competition Groups and Clusters have Group Leaders, Deputy Group Leaders, Cluster Leaders, and Deputy Cluster Leaders appointed by the Minister of Information and Communications, who are responsible to the Minister for the assigned tasks;

c) Tasks and authorities of Competition Groups and Clusters:

Develop programs and plans to organize activities aimed at promoting competition movements within agencies and units in the Group and Cluster;

On the basis of the main political tasks assigned and the direction of annual competition and reward work of the Ministry of Information and Communications, organize the establishment of competition criteria and scoring scales suitable for the characteristics and actual conditions of each agency and unit within the Group and Cluster;

Organize the signing of competition agreements between member agencies and units in the Group and Cluster; organize the dissemination and promotion of exemplary models, new factors, and good experiences of collectives and individuals for other agencies and units in the Group and Cluster to emulate and learn from;

Organize cross-checking of competition movements among member agencies and units in the Group and Cluster;

Summarize and build reports on mid-term and final reviews of competition movements of the Group and Cluster; organize review meetings; select outstanding agencies and units of the Group and Cluster to propose rewards to the Minister of Information and Communications or submit to higher authorities for rewards;

2. Competition Groups and Clusters at the grassroots level: based on the position, functions, tasks, nature of work, and scope of activities of subordinate units, the heads of agencies, units, and enterprises decide to organize competitions according to Competition Groups and Clusters. The Minister of Information and Communications will only consider rewarding competition titles to subordinate units of agencies, units, and enterprises when the proposing unit has organized competitions among its subordinate units according to Competition Groups and Clusters.

Article 12. Signing Competition Agreements and Registering Competition Titles

1. Annually, agencies and units at the grassroots and basic levels are responsible for organizing their subordinates to register for competitions and strive to achieve competition titles; consolidate the competition registration forms and send them to the Ministry of Information and Communications (through the Department of Competition and Rewards) before February 15th of each year.

2. Group Leaders and Cluster Leaders of Competition Groups and Clusters organize the signing of competition agreements between agencies and units within the Group and Cluster and send the signed competition agreement forms to the Ministry of Information and Communications (through the Department of Competition and Rewards) within the time limit specified in the Regulation on Organizing Competition Groups and Clusters.

3. The Department of Competition and Rewards is responsible for consolidating the competition agreements and registrations with the Ministry of Information and Communications for monitoring and as a basis for recommending awards of competition titles at the ministerial level and above.

4. For agencies and units that launch competition movements with registration for rewards at the ministerial level and above, they must report and obtain written approval from the Ministry of Information and Communications before launching these competition movements.

Article 13. Commendation titles

1. Commendation titles for individuals:

a) "Advanced Worker";

b) "Model Soldier at the Grassroots Level";

c) "Model Soldier of the Ministry of Information and Communications";

d) "National Model Soldier".

2. Competition titles for collectives:

a) "Advanced Working Collective";

b) "Outstanding Working Collective";

c) "Flag of Encouragement of the Ministry of Information and Communications";

d) "Flag of Encouragement of the Government".

Chapter III

OBJECTS AND CRITERIA FOR CONSIDERING THE AWARD OF COMMENDATION TITLES

Article 14. Title of "Advanced Worker"

The title of "Advanced Worker" is awarded annually to individuals belonging to agencies, units, and enterprises under the Ministry who meet the following criteria:

1. Successfully completing assigned tasks with high productivity and quality.

2. Strictly adhering to Party policies and State laws, demonstrating self-reliance and self-strengthening spirit; fostering unity, mutual assistance, and active participation in competition movements.

3. Actively studying politics, culture, professional knowledge, and vocational skills.

4. Possessing good moral character and healthy lifestyle.

Article 15. Title of "Model Soldier at the Grassroots Level"

1. The title of "Model Soldier at the Grassroots Level" is awarded annually to individuals belonging to agencies, units, and enterprises under the Ministry who meet the following criteria:

a) Being a "Pioneering Worker";

b) Proposing initiatives to increase labor productivity, enhance work efficiency, or conducting scientific research topics that have been accepted and applied within the agency or unit.

The initiative council and the science council at various levels shall be established by the head of the agency or unit according to Clause 9, Article 45 of Decree 91/2017/NĐ-CP.

Clause 2. The ratio of individuals recognized with the title "Model Worker at the Grassroots Level" shall not exceed 15% of the total number of individuals achieving the title "Advanced Worker."

Article 16. Title of "Model Soldier of the Ministry of Information and Communications"

The title of "Model Soldier of the Ministry of Information and Communications" is awarded annually to individuals belonging to agencies, units, and enterprises under the Ministry who meet the following criteria:

1. Demonstrating outstanding achievements among those who have continuously received three times the title of "Model Soldier at the Grassroots Level" and during this period, once receiving a Certificate of Merit from the Minister of the Ministry of Information and Communications for comprehensive achievements over a certain period.

2. The individual's achievements, initiatives, work solutions, and research topics must have significant impacts on the Ministry and industry, recognized by the Science and Initiative Council at the Ministry level.

Article 17. Title of "National Model Soldier"

1. The title of "National Model Soldier" is awarded to individuals belonging to agencies, units, and enterprises under the Ministry who demonstrate the most outstanding achievements selected from those who have continuously received two times the title of "Model Soldier of the Ministry of Information and Communications".

2. Initiatives and research topics serving as the basis for awarding the title of "National Model Soldier" must achieve high effectiveness and have nationwide influence.

3. The recognition of the application effectiveness and scope of influence of initiatives and research topics is reviewed and confirmed by the Minister of the Ministry of Information and Communications.

4. Each grassroots unit may only select no more than one individual with the most outstanding achievements each year to propose for the award of the title of "National Model Soldier". The Ministry of Information and Communications will select the most outstanding individuals in each profession and field of activity to propose for the award of the title of "National Model Soldier".

5. The time for proposing the award of the title of "National Model Soldier" is the year immediately following the second time the individual receives the title of "Model Soldier of the Ministry of Information and Communications".

Article 18. The title "Advanced Labor Collective"

The title "Advanced Labor Collective" shall be awarded annually to agencies, units, enterprises under the Ministry; departments, bureaus, and equivalent bodies directly under agencies, units, enterprises under the Ministry that meet the following criteria:

1. Successfully completing assigned tasks and plans.

2. Having regular, practical, and effective competition movements.

3. At least 50% of individuals within the unit achieving the title "Advanced Worker" and the unit having no individual disciplined with a warning or higher.

Clause 4. Internal solidarity, adhering well to the Party's guidelines and policies, State laws.

Article 19. The title "Outstanding Labor Collective"

The title "Outstanding Labor Collective" shall be awarded annually to agencies, units, enterprises under the Ministry; departments, bureaus, and equivalent bodies directly under agencies, units, enterprises under the Ministry that meet the following criteria:

1. Being innovative and overcoming difficulties to excellently complete tasks and fulfill all obligations to the State.

2. Having regular, practical, and effective competition movements.

3. All individuals in the collective completing their assigned tasks, including at least 70% of individuals achieving the title "Advanced Worker."

4. Having individuals who achieve the title "Model Worker at the Grassroots Level" and no individual disciplined with a warning or higher.

5. Internal solidarity, exemplary compliance with the Party's guidelines and policies, and State laws.

Article 20. The Flag of Competition of the Ministry of Information and Communications

1. The "Flag of Competition of the Ministry of Information and Communications" shall be awarded annually to agencies, units, enterprises under the Ministry; departments, bureaus, and equivalent bodies directly under agencies, units, enterprises under the Ministry that meet the following criteria:

a) Exceeding all comprehensive indicators of the assigned plan and program, achieving high productivity, quality, and efficiency;

b) Having new factors and models for other collectives in the industry to emulate; outstanding units being selected and honored by competition groups and clusters.

c) Internal unity, actively practicing thrift, combating waste, corruption, and other social evils.

2. The "Flag of Competition of the Ministry of Information and Communications" for achievements in specialized or field-based competition movements initiated by the Minister of Information and Communications: shall be awarded after summarizing the specialized or field-based competition movement; the Minister of Information and Communications will present the Flag of Competition to leading collectives in the competition movement. Regarding the award recipients and criteria, the Ministry of Information and Communications will have specific regulations for each competition movement.

Article 21. The Flag of Competition of the Government

1. The "Flag of Competition of the Government" shall be awarded annually to agencies, units, enterprises under the Ministry; departments, bureaus, and equivalent bodies directly under agencies, units, enterprises under the Ministry that meet one of the following criteria:

a) Being the most outstanding leading collective among those meeting the criteria for the "Flag of Competition of the Ministry of Information and Communications";

b) The most outstanding collective in specialized competition movements initiated by the President of the State or the Prime Minister, evaluated during mid-term and final reviews over five years or more.

2. The number of collectives proposed for the award of the "Flag of Competition of the Government" shall not exceed 20% of the total number of collectives meeting the criteria for the "Flag of Competition of the Ministry of Information and Communications". Collectives receiving the Flag of Competition of the Government are the most outstanding and exemplary in each field, profession, and have a significant influence as role models for emulation nationwide.

Chapter IV

FORMS, OBJECTS AND CRITERIA FOR REWARDS

Article 22. Types of Awards

Types of awards include: "Awards based on merit or achievements", "Awards based on campaigns or special topics". "Spontaneous awards", "Awards for dedication", "Foreign awards" shall be implemented according to Article 13 of Decree 91/2017/NĐ-CP.

Article 23. Forms and Recipients, Standards for National Awards

Forms of national awards include: "Golden Star Order"; "Ho Chi Minh Order"; "Independence Order" first class, second class, third class; "Labor Order" first class, second class, third class; "Military Merit Order" first class, second class, third class; "Bravery Medal"; "Resistance Medal"; "Friendship Medal"; State Honorary Titles: "Heroic Laborer", "Heroic People's Armed Forces", "People's Teacher", "People's Doctor", "People's Artist", "Outstanding Teacher", "Outstanding Doctor", "Outstanding Artist"; "Ho Chi Minh Prize"; "State Prize" and "Prime Minister's Commendation" shall be implemented according to Chapter III of the Law on Competition and Rewards; from Article 14 to Article 36 and Article 38 of Decree 91/2017/NĐ-CP.

Article 24. Forms and Standards for Awards of the Ministry of Information and Communications

1. "Commendation Certificate of the Minister of Information and Communications" for comprehensive achievements:

a) Awarded to individuals belonging to agencies, units, enterprises under the Ministry who conscientiously implement Party guidelines and state policies, have continuously excelled in their duties for two years or more, during which time they have two recognized and effectively applied initiatives within the basic level;

b) Awarded to agencies, units, enterprises under the Ministry; departments, offices, and equivalent units under agencies, units, enterprises under the Ministry, who have continuously excelled in their duties for two years or more, maintain internal unity, properly implement grassroots democracy regulations, organize good competition movements; care for the material and spiritual lives of members in the collective; practice thrift; fully implement all systems and policies for all members in the collective.

2. "Commendation Certificate of the Minister of Information and Communications" for outstanding achievements in thematic or sectoral competition movements launched by the Minister of Information and Communications: awarded when summarizing thematic or sectoral competition movements; the Minister of Information and Communications will award Commendation Certificates to collectives and individuals with outstanding and exemplary achievements in the competition movement. Regarding recipients and standards for awarding, the Ministry of Information and Communications will have specific regulations for each competition movement.

3. "Commendation Certificate of the Minister of Information and Communications" for outstanding spontaneous achievements: awarded to collectives and individuals who win high awards at national and international contests, reunions, exhibitions in the field of state management of the Ministry of Information and Communications; those with innovative ideas, inventions, patents, applications of scientific and technological progress that bring high efficiency or collectives and individuals who achieve many outstanding achievements with significant influence, serving as role models for learning in the Information and Communications industry.

4. "Commendation Certificate of the Minister of Information and Communications" for long-term contributions to the construction and development of the Information and Communications industry of Vietnam, awarded to collectives on the occasion of celebrating the traditional day of the agency or unit in even-numbered years.

5. "Commendation Certificate of the Minister of Information and Communications" awarded to overseas Vietnamese and foreign collectives and individuals who have made contributions to the development of the Information and Communications industry of Vietnam.

6. The "Memorial Plaque for the Information and Communications Industry" is a form of award of the Ministry of Information and Communications to recognize the contributions of individuals to the development of the Information and Communications industry of Vietnam. The granting of the Memorial Plaque is carried out according to the regulation decided and issued by the Minister of Information and Communications.

7. "Banner of Commemoration": The Minister of Information and Communications presents the "Banner of Commemoration" to recognize the achievements in building and developing for collectives that have steadily developed for five years or more; the content of the "Banner of Commemoration" is proposed by the basic unit and reviewed by the Department of Competition and Rewards, submitted to the Minister for decision.

Article 25. "Certificate of Merit" of the Head of the Agency or Unit

1. "Certificate of Merit" to be awarded to individuals meeting the following criteria:

a) Successfully completing tasks and fulfilling civic duties;

b) Having good moral character; being united and exemplary in implementing the Party's guidelines and State policies;

c) Continuously studying to improve professional knowledge and skills.

2. "Certificate of Merit" to be awarded to groups meeting the following criteria:

a) Successfully completing tasks;

b) Internal unity; effectively implementing grassroots democracy regulations and organizing commendation movements;

c) Caring for the material and spiritual lives of members in the collective; practicing thrift;

d) Fully implementing all systems and policies for all members of the group;

3. The awarding of "Certificates of Merit" shall be conducted regularly to promptly encourage individuals and groups immediately after they have excellently completed assigned tasks.

Chapter V

AUTHORITY TO DECIDE AWARDS AND PRESENTATIONS

Article 26. Authority to Decide

1. The Minister of Information and Communications decides to award:

a) "Flag of Excellence Competition" of the Ministry of Information and Communications;

b) Title of "Outstanding Labor Collective" for agencies, units, and enterprises under the Ministry; Delegating authority to the Head of the superior unit to decide on awarding the title of "Outstanding Labor Collective" to subordinate collectives;

c) Title of "Excellence Medalist of the Ministry of Information and Communications" for individuals under agencies, units, and enterprises of the Ministry;

d) Commemorative Medal "For the Information and Communications Cause";

đ) "Minister's Certificate of Merit";

e) "Memorial Plaque";

g) Titles of "Advanced Worker", "Excellence Medalist at the Grassroots Level", "Advanced Labor Collective", and the form of awarding "Certificate of Merit" for individuals and collectives of agencies and units under the Ministry without legal personality;

2. Heads of agencies, units, organizations, enterprises with legal personality, separate accounts and seals decide to award:

a) The title "Advanced Worker";

b) The title "Model Worker at the Grassroots Level";

c) The title "Advanced Labor Collective";

d) Form of awarding "Certificate of Merit".

3. Authority to decide on awards of commendation titles: "Flag of Excellence of the Government", "National Excellence Medalist"; forms of awarding: "Prime Minister's Certificate of Merit", "Order", "Medal", "Ho Chi Minh Prize", "State Prize", "State Honorary Title" shall be implemented according to the provisions of Articles 77 and 78 of the Law on Commendation and Awards.

Article 27. Organization of Presentation and Acceptance

1. Responsibility for organizing presentation: The Head of the superior unit, the basic level unit, or the Organizing Committee of specialized conferences shall organize ceremonies for presenting all commendation titles and forms of awarding decided by the Head of the basic level unit, the Minister of Information and Communications, the Prime Minister, the President, and the forms of awarding by other Ministries, sectors, localities, and central mass organizations. In special cases, this will be submitted by the Department of Commendation and Awards to the Minister for decision.

2. Rituals for organizing presentation: Commendation titles and forms of awarding decided by the Prime Minister and the President shall be carried out according to the provisions of Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government on the organization of commemoration days; rituals for presenting and receiving forms of awarding and commendation titles; diplomatic ceremonies and reception of foreign guests, and according to the provisions of Clause 2, Article 44 of Decree No. 91/2017/ND-CP. Commendation titles and forms of awarding decided by the Minister of Information and Communications and the Head of the basic level unit need to be solemnly organized with motivational and educational effects.

3. Authority to award:

a) Commendation titles and forms of awarding decided by the Prime Minister and the President: carried out according to the provisions of Article 81 of the Law on Commendation and Awards;

b) Commendation titles and forms of awarding decided by the Minister of Information and Communications: the Minister shall present or delegate the presentation;

c) Commendation titles and forms of awarding decided by the Head of the basic level unit: the Head of the unit shall present or delegate the presentation.

Chapter VI

AUTHORITY TO DECIDE AND BESTOW

Article 28. Commendation Process

1. The commendation process shall be carried out according to the principle that a higher-level authority only organizes the examination for commendation or proposes a competent authority to grant commendation upon receiving the commendation proposal dossier from the directly subordinate level. Overstepping levels in submitting dossiers is not allowed.

2. The level managing organizations, cadres, civil servants, public officials, workers, and salary funds shall commend or propose a higher-level authority to commend individuals and collectives under its management scope.

3. Commending achievements in competitive movements: the level initiating the competitive movement shall be responsible for summarizing, concluding, selecting outstanding individuals and collectives to commend or propose a higher-level authority to commend.

4. Rewards for outstanding and sudden achievements: The level where outstanding and sudden achievements are made is responsible for granting rewards or proposing to a higher-level authority to grant rewards.

5. Proposing commendations for titles and forms of commendation within the decision-making authority of the Minister of Information and Communications, the Prime Minister, the President, shall be implemented in accordance with Article 46 of Decree 91/2017/NĐ-CP.

Article 29. Procedures for Proposing Commendations

1. For units with the obligation to pay state budget, when proposing commendations: "Flag of Competition of the Ministry of Information and Communications", "Certificate of Merit of the Minister of Information and Communications", "Outstanding Competitor of the Ministry of Information and Communications", "Excellent Labor Collective" and other national-level commendation titles and forms for unit heads or individuals, the commendation dossier must include a confirmation document from the competent tax authority.

The dossier proposing national-level commendations for enterprises must include an audit report for at least five years prior to the commendation proposal.

2. Titles of competition and forms of commendation must be reviewed and have written opinions from the Competition and Commendation Councils at all levels before deciding on commendation or proposing a higher-level commendation:

a) "Advanced Worker";

b) "Model Soldier at the Grassroots Level";

c) "Model Soldier of the Ministry of Information and Communications";

d) "National Outstanding Competitor";

đ) "Advanced Labor Collective";

e) "Excellent Labor Collective";

g) "Flag of Competition of the Ministry of Information and Communications";

h) "Certificate of Merit of the Minister of Information and Communications";

i) National-level commendation titles and forms prescribed in Articles 17, 21, and 23 of this Circular.

3. For commendations of the Commemorative Medal "For the Information and Communication Cause" and other cases of commendation according to simplified procedures stipulated in Article 85 of the Law on Competition and Commendation, it is not necessary to go through the Competition and Commendation Councils at all levels. The specialized unit responsible for competition and commendation work has the responsibility to review the dossier and achievements according to the prescribed standards and directly propose commendation.

4. In cases of proposing commendations for the titles "Advanced Worker", "Outstanding Competitor at the Grassroots Level", "Advanced Labor Collective", "Excellent Labor Collective", "Certificate of Merit of the Minister of Information and Communications", more than 50% of the members of the Competition and Commendation Council must agree.

5. In cases of proposing commendations for the titles "Flag of Competition of the Ministry of Information and Communications", "Flag of Competition of the Government", "Certificate of Merit of the Prime Minister", "Medal", and "Order" of various types, more than 70% of the members of the Competition and Commendation Council must agree.

6. In cases of proposing commendations for the titles "Outstanding Competitor of the Ministry of Information and Communications", "National Outstanding Competitor", "Heroic Laborer", "Heroic People's Armed Forces", "People's Teacher", "Outstanding Teacher", "People's Doctor", "Outstanding Doctor", "People's Artist", "Outstanding Artist", "Ho Chi Minh Award", "State Award", more than 90% of the members of the Competition and Commendation Council must agree.

7. In cases of proposing commendations for Medals, State Honorary Titles, and the title "National Outstanding Competitor", opinions of all cadres, employees, and people must be solicited on the Ministry of Information and Communications' online portal. The Department of Competition and Commendation shall take the lead and coordinate with relevant agencies to specify the content and form of soliciting opinions on the Ministry of Information and Communications' online portal within ten working days (except in cases of particularly outstanding and exceptional achievements).

8. Before submitting to the Prime Minister, there must be a written opinion from the Party Cadre and Civil Servant Committee of the Ministry of Information and Communications regarding the objects and forms of commendation prescribed in Clause 4, Article 45 of Decree 91/2017/NĐ-CP.

Article 30. Consultation for Awards

1. For Provincial Departments of Information and Communications under the Central Government: when proposing to award the "Minister's Commendation" or "Flag of Excellence" from the Ministry of Information and Communications to the Department of Information and Communications or its Director, the opinion of consultation from the People's Committee of the province or centrally governed city must be sought.

2. For agencies and units located within provinces and centrally governed cities: when proposing awards to the agency or unit collective or its head, the opinion of consultation from the Provincial Department of Information and Communications must be obtained.

3. The Ministry of Information and Communications will provide opinions of consultation for national-level awards when there is a request for such opinions from the Central Steering Committee for Competitions and Rewards, or from ministries, sectors, provincial people's committees, or centrally governed city people's committees.

Article 31. Documentation for Proposing Honorary Titles and Reward Forms

The documentation for proposing honorary titles and reward forms follows the model attached as an appendix to this Circular and the following regulations:

1. Documentation for Proposing Honorary Titles and Reward Forms at the Ministerial Level: the proposing entity submits one set (original), including:

a) Memorandum;

b) Minutes of the appraisal meeting for rewards by the Competition and Reward Council at the level proposing the reward;

c) Report on achievements of the individual or collective proposed for reward.

2. Documentation for Proposing Honorary Titles and Reward Forms from the Government and Prime Minister: the proposing entity submits three sets (originals), each set including:

a) Memorandum;

b) Minutes of the appraisal meeting for rewards by the Competition and Reward Council at the level proposing the reward;

c) Report on achievements of the individual or collective proposed for reward.

3. Documentation for Proposing Awards of Various Orders: the proposing entity submits four sets (originals), each set including:

a) Memorandum;

b) Minutes of the appraisal meeting for rewards by the Competition and Reward Council at the level proposing the reward;

c) Report on achievements of the individual or collective proposed for reward.

4. Documentation for Proposing Honorary Titles of Hero: the proposing entity submits four sets (originals), each set including:

a) Memorandum;

b) Written proposal opinion of the same-level Party Committee;

c) Report on achievements of the individuals and groups proposed for rewards;

d) Minutes and results of secret ballot for proposing the Hero title by the Competition and Reward Council at the level proposing the reward.

5. Documentation for Proposing Rewards for Foreign Organizations and Individuals and Overseas Vietnamese includes: a report from the proposing entity and a summary report of achievements with confirmation from the level proposing the reward.

6. Documentation for Proposing Rewards for Individuals and Collectives with Outstanding Achievements in Labor and Work Discovered by Heads of Agencies, Organizations, and Units for Reward Includes: a report accompanied by a list of proposed rewards and a summary report of achievements carried out by the proposing agency, organization, or unit.

7. Documentation for Proposing Rewards for Collectives and Individuals Proposed for Rewards for Achievements in High-Level Contests, Festivals, Exhibitions at the National and International Levels in the Field of Management of the Ministry of Information and Communications, with Inventions, Innovations, Patents, and Applications of Scientific and Technological Progress Must Include Written Confirmation from the Competent Management Authority.

8. Achievement Reports for Individuals Proposed for Honorary Titles: "Outstanding Worker of the Ministry of Information and Communications", "National Outstanding Worker" or for Proposals for Commendations: "Minister's Commendation", "Prime Minister's Commendation", "Orders" of various types; in the achievement reports, the content of the research topics, innovations, solutions in work and management that have brought about practical benefits must be clearly stated, along with extracts of confirmation opinions from the Science and Innovation Council at the level proposing the reward; if the innovation, solution, or topic has been certified by a competent authority, a copy of the certificate should be submitted instead of the confirmation opinion of the Science and Innovation Council at the level proposing the reward. Additionally, individuals who are heads of units subject to the obligation to pay state budget must comply with Clause 1 of Article 29 of this Circular.

9. When submitting to the Minister of Information and Communications for consideration of rewards or proposals for national-level rewards, the proposing entity must simultaneously send electronic files of the submission documentation (in .doc format for reports, lists, and achievement reports of collectives and individuals proposed for rewards; in .pdf format for other related documents) to the Department of Competitions and Rewards.

Article 32. Deadline for Submission of Nomination Files for Awards

1. Awards for achievements in annual regular competition movements:

a) The title "Outstanding Labor Collective": agencies and units shall submit files to the Department of Mobilization and Awards not later than December 5th of the year of awarding;

b) The Flag of Government Competition and the Flag of the Ministry of Information and Communications:

For agencies and units (excluding enterprises): shall submit files to the Department of Mobilization and Awards not later than December 5th of the year of awarding;

For enterprises: shall submit files to the Department of Mobilization and Awards not later than February 20th of the following year of the year of nomination for awards;

c) For the title "Excellence Mobilizer of the Ministry of Information and Communications" and the form of award "Certificate of Merit from the Minister of Information and Communications": agencies and units shall submit files to the Department of Mobilization and Awards not later than March 31st of the following year of the year of nomination for awards;

d) For forms of awards: "Certificate of Merit from the Prime Minister", "Medals" of various types: agencies and units shall submit files to the Department of Mobilization and Awards not later than April 30th of the following year of the year of nomination for awards;

đ) For the title "Hero of Labor", "Hero of People's Armed Forces" which is organized every five years during the National Mobilization Congress at all levels, except for cases with particularly outstanding and sudden achievements;

e) For the title "National Excellence Mobilizer", agencies and units shall submit files to the Department of Mobilization and Awards not later than August 30th of the following year of the year of nomination for awards.

2. Awards for achievements in specific topics or fields: agencies and units shall submit files to the Department of Mobilization and Awards immediately after the conclusion of the specific topic or field.

3. Awards for outstanding and sudden achievements: agencies and units shall submit files to the Department of Mobilization and Awards immediately after individuals or collectives have achieved outstanding and sudden results.

Article 33. Notification of Award Results

1. For collectives and individuals meeting the criteria for awards, within ten working days from the date of the award decision, the reviewing agency shall notify the nominating agency.

2. For collectives and individuals not meeting the criteria for awards, within ten working days from the date the competent authority notifies the reviewing agency, the reviewing agency must notify the nominating agency. If the file does not follow the correct submission route, the reviewing agency shall notify and return the file to the nominating agency.

Chapter VII

FUND FOR COMPETITION AND REWARD

Article 34. Responsibilities and Principles for Establishing the Mobilization and Awards Fund

1. Annually, the Department of Mobilization and Awards bases on the results of the Mobilization and Awards Fund of the previous year; registered indicators for mobilization titles and forms of awards, and estimated expenses for mobilization and awards work in the planned year to prepare the budget for the Mobilization and Awards Fund of the Ministry of Information and Communications.

2. Sources and levels of contributions to the Mobilization and Awards Fund are implemented according to the provisions of Article 65 of Decree 91/2017/NĐ-CP.

3. The Ministry of Information and Communications encourages organizations and individuals inside and outside the industry to support and contribute to supplementing the Mobilization and Awards Fund of the Ministry of Information and Communications.

Article 35. Management and use of the Competition and Reward Fund

1. The Department of Competition and Reward shall cooperate with the Ministry of Information and Communications Office to prepare the budget, manage and use the Competition and Reward Fund of the Ministry of Information and Communications in accordance with current laws. At the end of the year, any remaining funds from the Competition and Reward Fund of the Ministry of Information and Communications that have not been used will be carried over to the next year for continued use in competition and reward activities.

2. The Competition and Reward Fund of the Ministry of Information and Communications shall be used for the following competition and reward activities:

a) Expenses for organizing and implementing competition movements of the Ministry of Information and Communications;

b) Expenses for printing, making award items (certificates of merit, commendation certificates, awards, commemorative medals, badges, flags, boxes, frames);

c) Cash rewards or mementos for collectives and individuals under the Ministry of Information and Communications (Departments, Ministry Office, Inspectorate).

3. The Competition and Reward Fund of units: shall be managed and used by the units to organize competition movements, purchase award items, cash rewards or mementos accompanying commendations and rewards for subordinate collectives and individuals, and to serve other activities related to competition and reward within the unit.

4. Cash rewards accompanying commendations and rewards:

a) At the same time, for the same achievement, if an object receives multiple commendations with different cash rewards, it shall receive the highest cash reward;

b) At the same time, if an object achieves multiple commendations at different times, it shall receive the cash rewards corresponding to each commendation;

c) At the same time, if an object achieves both a commendation and a reward form, it shall receive the cash reward for the commendation and the reward form;

d) The calculation method and amount of cash rewards accompanying commendations and reward forms shall be implemented according to the provisions from Article 68 to Article 74 of Decree No. 91/2017/ND-CP.

5. It is strictly prohibited to use the Competition and Reward Fund for purposes other than those specified.

Chapter VIII

RIGHTS AND OBLIGATIONS OF COLLECTIVES AND INDIVIDUALS AWARDED REWARDS

Article 36. Rights of individuals and collectives in competition and reward

The rights of individuals and collectives in competition and reward shall be implemented in accordance with the provisions of Article 76 of Decree No. 91/2017/ND-CP.

Article 37. Obligations of individuals and collectives in competition and reward

The obligations of individuals and collectives in competition and reward shall be implemented in accordance with the provisions of Article 77 of Decree No. 91/2017/ND-CP.

Article 38. Revocation of reward decisions

The revocation of reward decisions for individuals and collectives shall be implemented in accordance with the provisions of Article 78 of Decree No. 91/2017/ND-CP.

Article 39. Procedures and documents for stripping or restoring titles

Procedures and documents for stripping or restoring commendation titles shall be implemented in accordance with the provisions of Article 79 of Decree No. 91/2017/ND-CP.

Chapter IX

IMPLEMENTING PROVISIONS

Article 40. Implementation organization

1. The Competition and Reward Council of the Ministry of Information and Communications; Heads of Groups and Clusters of Competitions; Heads of agencies and units operating in the field of information and communications shall be responsible for disseminating, organizing, and implementing this Circular. Annually, they shall conduct a summary and evaluation of competition and reward work and submit reports to the Ministry (through the Department of Competition and Reward) before December 15th for consolidation and reporting on the implementation of the Circular to the Chairman of the Competition and Reward Council of the Ministry of Information and Communications.

2. The Department of Competition and Reward shall be responsible for disseminating, urging, monitoring, and inspecting the implementation of this Circular throughout the industry.

Article 41. Effective Date

This Circular takes effect from August 15, 2018 and replaces Circular No. 13/2015/TT-BTTTT dated June 8, 2015 issued by the Minister of Information and Communications guiding competition and reward work in the information and communication sector.

During the implementation of this Circular, if there are difficulties or issues that are not suitable, heads of agencies, units, and enterprises in the information and communication sector shall report to the Ministry of Information and Communications (through the Department of Competition and Reward) for consolidation and reporting to the Minister for consideration and decision.
