Circular No. 09/2018/TT-BYT promulgates the list of chemicals and insecticides, bactericides for household and medical use under the management of the Ministry of Health, determining commodity codes according to the List of Export and Import Commodities of Vietnam.

Pursuant to Decree No. 75/2017/NĐ-CP dated June 8, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Minister of Health;

Pursuant to Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on the management of chemicals, insecticides, and bactericides for household and medical use;

Considering the proposal of the Director of the Department of Environmental Health - Ministry of Health;

The Minister of Health issues this CircularThis Circular issues the List of chemicals, insecticides, and bactericides for household and medical use under the management of the Ministry of Health to be determined with commodity codes according to the Vietnam Export and Import Goods List issued together with Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Minister of Finance on the Vietnam Export and Import Goods List..

Article 1. Issuance of the list

Attached to this Circular is the List of chemicals, insecticides, and bactericides for household and medical use under the management of the Ministry of Health to be determined with commodity codes according to the Vietnam Export and Import Goods List issued together with Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Minister of Finance on the Vietnam Export and Import Goods List.

Article 2. Product Quality Management

1. Commodities listed in the attached List shall be managed in accordance with Decree No. 91/2016/NĐ-CP dated July 1, 2016 of the Government on the management of chemicals, insecticides, and bactericides for household and medical use.

2. Commodities specified in the List but not yet assigned commodity codes must provide full information about the imported goods' components, effects, technical documentation (if available), and a commitment to responsibility for the declared content and proper use of the imported goods to the customs authority upon importation.

3. In cases where commodities do not have codes in the List and there are discrepancies or differences in determining commodity codes between the List issued with this Circular and the Vietnam Export and Import Goods List, the Ministry of Finance (General Customs Department) shall take the lead in coordinating with the Ministry of Health (Department of Environmental Health) to examine and decide on the commodity codes for exported and imported goods.

Article 3. Transitional Provisions

For goods that have completed customs procedures before the effective date of this Circular, enterprises importing such goods shall comply with the provisions of Circular No. 12/2016/TT-BYT dated May 15, 2016 of the Ministry of Health on the List of chemicals, insecticides, and bactericides for household and medical use according to the Harmonized System (HS) codes in the Export Tax and Import Tariff Schedule under the specialized management of the Ministry of Health.

Article 4. Reference Provisions

In case the legal regulations and provisions cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new legal regulations.

Article 5. Implementation Provisions

1. This Circular takes effect from June 12, 2018.

2. Circular No. 12/2016/TT-BYT dated May 15, 2016 of the Ministry of Health on the List of chemicals, insecticides, and bactericides for household and medical use according to the HS codes in the Export Tax and Import Tariff Schedule under the specialized management of the Ministry of Health shall cease to be effective from the date this Circular takes effect.

3. The Department of Environmental Health, heads of units under and affiliated with the Ministry of Health; Provincial Departments of Health under centrally governed cities and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular. Any difficulties or obstacles encountered during implementation should be reported to the Department of Environmental Health (Ministry of Health) for examination and resolution.

During the implementation process, if any difficulties or obstacles arise, agencies, organizations, and individuals are advised to report them to the Department of Environmental Health (Ministry of Health) for examination and resolution./.
