Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations and Decree No. 78/2018/NĐ-CP dated August 16 the 5 year 2018 of the Government amending and supplementing some articles of Decree number 127/2007/ND-CP;

Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director General of the Standardization, Measurement and Quality Control General Department and the Head of the Legal Affairs Department;

The Minister of Science and Technology issues this Circular to promulgate the National Technical Regulation on Children's Toy Safety (QCVN 03:2019/BKHCN). asafety for children's toys”.

Article 1. This Circular annexes the National Technical Regulation on Children's Toy Safety (QCVN 03:2019/BKHCN).

Article 2. Effectiveness

1. This Circular takes effect from December 31, 2019.

2. Circular No. 18/2009/TT-BKHCN dated June 26, 2009 of the Minister of Science and Technology on the issuance and implementation of the National Technical Regulation on Children's Toy Safety shall cease to be effective from the date this Circular takes effect.

Article 3. Transitional Provisions

Children's toys circulating in the domestic market according to the provisions of Circular No. 18/2009/TT-BKHCN dated June 26, 2009 of the Minister of Science and Technology on the issuance and implementation of the National Technical Regulation on Children's Toy Safety before December 31, 2020 may continue to circulate in the market until December 31, 2021.

Article 4. Tar Content

1. As of January 1, 2021, imported and domestically produced children's toys must comply with the requirements stipulated in Section 2 of QCVN 03:2019/BKHCN before entering the market.

2. It is encouraged that enterprises, organizations, and individuals engaged in the production, importation, and sale of children's toys apply the provisions of QCVN 03:2019/BKHCN from the date this Circular takes effect.

Article 5. Implementation

1. The Director of the General Department of Standardization, Metrology, and Quality Control shall be responsible for organizing guidance and implementation of this Circular.

2. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.

3. During the implementation process, if any difficulties arise, relevant agencies, organizations, and individuals should promptly report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as necessary./.
