PART I
AMENDING, SUPPLEMENTING, AND ABOLISHING CERTAIN CLAUSES OF CIRCULARS RELATED TO THE REGULAR REPORTING SYSTEM WITHIN THE SCOPE OF MANAGEMENT UNDER THE MINISTRY OF PLANNING AND INVESTMENT
Article 1. Amending and supplementing Section III of Circular No. 04/2008/TT-BKH dated July 9, 2008 of the Ministry of Planning and Investment guiding certain provisions of Decree No. 151/2007/NĐ-CP dated October 10, 2007 of the Government on the organization and operation of cooperatives as follows:
“III. IMPLEMENTATION
1. Ministries, ministerial-level agencies, provincial People's Committees have the responsibility to direct and organize the implementation of this Circular; if necessary, they may provide detailed guidance suitable to the requirements of their locality or sector.
2. People's Committees at the commune level shall aggregate the number and operational situation of cooperatives in their area according to Model THT5 issued along with this Circular; report semi-annually to the District Finance and Planning Department and relevant specialized departments of the District People's Committee before June 18 and December 18 each year.
3. People's Committees at the district level shall aggregate the number and operational situation of cooperatives in their area according to Model THT5 issued along with this Circular; report semi-annually to the Provincial Department of Planning and Investment and relevant specialized departments before June 21 and December 21 each year.
4. People's Committees at the provincial level shall aggregate the number and operational situation of cooperatives in their area according to Model THT5 issued along with this Circular; report semi-annually and annually to the Ministry of Planning and Investment and relevant ministries and sectors before June 25 and December 25 each year, and simultaneously incorporate it into the local socio-economic development plan.”
5. Semi-annual report: The cut-off date for the first six months of the year is from December 15 of the previous year to June 14 of the reporting period. The cut-off date for the last six months of the year is from June 15 to December 14 of the reporting period.
Annual report: The period is from December 15 of the previous year to December 14 of the reporting year.”
Article 2. Amending and supplementing certain articles, clauses, and points of Circular No. 09/2009/TT-BKH dated October 30, 2009 guiding the implementation of projects under specialized credit programs funded by the Japan International Cooperation Agency (JICA) as follows:
1. AMEND AND SUPPLEMENT POINT g CLAUSE 5.2 PART II AS FOLLOWS:
“g. TASKS OF MONITORING, EVALUATING, AND REPORTING:
- MONITOR AND REGULARLY UPDATE THE DISBURSEMENT SITUATION OF PROJECTS.
- ON A PERIODIC BASIS BEFORE THE 21ST DAY OF THE LAST MONTH OF EACH QUARTER, THE PROVINCIAL PROJECT MANAGEMENT BOARD SHALL BE RESPONSIBLE FOR SUMMARIZING AND REPORTING THE IMPLEMENTATION PROGRESS OF PROJECTS IN THE PROVINCE TO THE OVERALL PROJECT MANAGEMENT BOARD (IN ACCORDANCE WITH THE MODEL ATTACHED AS ANNEX 2 TO THIS CIRCULAR). THE QUARTERLY REPORT SHALL COVER THE PERIOD FROM THE 15TH DAY OF THE MONTH PRECEDING THE REPORTING PERIOD TO THE 14TH DAY OF THE LAST MONTH OF THE QUARTER BELONGING TO THE REPORTING PERIOD.
- NO LATER THAN 15 DAYS AFTER RECEIVING THE FINAL ACCOUNTING REPORT FROM THE PROVINCIAL PROJECT MANAGEMENT BOARD (OR THE PROJECT OWNER IF THE PROVINCIAL PROJECT MANAGEMENT BOARD HAS BEEN DISSOLVED), THE PROVINCIAL PROJECT MANAGEMENT BOARD SHALL SUMMARIZE AND SUBMIT THE FINAL ACCOUNTING REPORT TO THE OVERALL PROJECT MANAGEMENT BOARD. THE FINAL ACCOUNTING REPORT MUST INCLUDE NOT ONLY THE STATISTICAL TABLES BUT ALSO AN EXPLANATORY NOTE ON:
+ THE FAVORABLE AND UNFAVORABLE CONDITIONS, DIFFICULTIES, AND OBSTACLES ENCOUNTERED DURING THE PROJECT IMPLEMENTATION (INCLUDING GUIDANCE DOCUMENTS, DISBURSEMENT PROCEDURES, RECEIPT OF MATERIALS AND EQUIPMENT, ETC., IF ANY).
+ THE ECONOMIC AND SOCIAL OUTCOMES AND RECOMMENDATIONS (IF ANY).
+ THE ADDITIONAL CAPACITY OF THE ENTIRE PROJECT OR ANY COMPONENT THEREOF RESULTING FROM THE INVESTMENT.”
2. AMEND AND SUPPLEMENT POINT d CLAUSE 5.3 PART II AS FOLLOWS:
“d. ADMINISTRATIVE TASKS, COORDINATION, AND REPORTING:
- ORGANIZE AND MANAGE PERSONNEL OF THE PROJECT MANAGEMENT BOARD.
- REGULARLY PROVIDE INFORMATION AND UPDATE DATA FOR THE INFORMATION SYSTEM OF THE PROGRAM (MIS). PROMPTLY DETECT AND REPORT ANY DIFFICULTIES AND OBSTACLES ARISING THAT EXCEED THE AUTHORITY TO RESOLVE THEM TO THE PROVINCIAL PROJECT MANAGEMENT BOARD AND THE OVERALL PROJECT MANAGEMENT BOARD.
- REGULARLY MONITOR THE IMPLEMENTATION OF PROJECTS IN TERMS OF PROGRESS, VOLUME, QUALITY, COST, VARIATIONS, ETC., AND ADJUST PLANS PROMPTLY.
- PROVIDE INFORMATION RELATED TO PROJECTS WITHIN THE SCOPE OF RESPONSIBILITY AND TASKS ASSIGNED.
- ON A PERIODIC BASIS BEFORE THE 18TH DAY OF THE LAST MONTH OF EACH QUARTER, THE PROJECT MANAGEMENT BOARD SHALL BE RESPONSIBLE FOR REPORTING THE IMPLEMENTATION PROGRESS OF PROJECTS TO THE PROVINCIAL PROJECT MANAGEMENT BOARD (IN ACCORDANCE WITH THE MODEL ATTACHED AS ANNEX 2 TO THIS CIRCULAR). THE QUARTERLY REPORT SHALL COVER THE PERIOD FROM THE 15TH DAY OF THE MONTH PRECEDING THE REPORTING PERIOD TO THE 14TH DAY OF THE LAST MONTH OF THE QUARTER BELONGING TO THE REPORTING PERIOD.”

AMEND AND SUPPLEMENT CERTAIN ARTICLES AND CLAUSES OF CIRCULAR NUMBER 07/2010/TT-BKH DATED MARCH 30, 2010, ISSUED BY THE MINISTRY OF PLANNING AND INVESTMENT TO GUIDE THE IMPLEMENTATION OF DECREE NUMBER 93/2009/NĐ-CP DATED OCTOBER 22, 2009, ISSUED BY THE GOVERNMENT ON THE REGULATIONS ON THE MANAGEMENT AND USE OF NON-GOVERNMENTAL FOREIGN AID AS FOLLOWS:
1. AMEND AND SUPPLEMENT CLAUSE 2 ARTICLE 9 AS FOLLOWS:
“2. REPORTING REQUIREMENTS
THE REPORTING REQUIREMENTS SHALL BE ESTABLISHED BY THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT.
a) SIX-MONTH REPORT: NO LATER THAN JUNE 18, THE PROJECT MANAGEMENT BOARD MUST SUBMIT THE REPORT TO THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT. THE REPORTING PERIOD IS FROM DECEMBER 15 OF THE YEAR PRIOR TO THE REPORTING PERIOD TO JUNE 14 OF THE REPORTING YEAR.
b) ANNUAL REPORT: NO LATER THAN DECEMBER 18, THE PROJECT MANAGEMENT BOARD MUST SUBMIT THE REPORT TO THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT. THE REPORTING PERIOD IS FROM DECEMBER 15 OF THE YEAR PRIOR TO THE REPORTING PERIOD TO DECEMBER 14 OF THE REPORTING YEAR.
c) END-OF-PROJECT REPORT: NO LATER THAN SIX MONTHS AFTER THE END OF THE PROJECT IMPLEMENTATION, THE PROJECT MANAGEMENT BOARD MUST SUBMIT THE END-OF-PROJECT REPORT IN ACCORDANCE WITH THE END-OF-PROJECT REPORT FORM FOR NON-GOVERNMENTAL FOREIGN AID PROJECTS IN WRITING, FAX, AND EMAIL TO THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT.”
2. AMEND AND SUPPLEMENT CLAUSE 2 ARTICLE 10 AS FOLLOWS:
“2. REPORTING REQUIREMENTS
- SIX-MONTH REPORT: NO LATER THAN JUNE 21, THE GRANT OWNER MUST SUBMIT THE REPORT IN ACCORDANCE WITH THE FORMS FROM TABLE 1 TO TABLE 8 (ANNEX 6.A) VIA EMAIL (FORMS TABLE 1 AND TABLE 2 MUST ALSO BE SUBMITTED IN WRITTEN FORM, FAX, AND EMAIL) TO THE SUPERVISING AUTHORITY, THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT, THE MINISTRY OF PLANNING AND INVESTMENT, THE MINISTRY OF FINANCE, AND THE FUNDING PARTY (IF REQUIRED). THE FORM TABLE 1 IS SUBMITTED ONLY ONCE AFTER THE GRANT IS APPROVED FOR ACCEPTANCE (UNLESS THERE ARE CHANGES). SIX-MONTH REPORT: NO LATER THAN JUNE 21, THE SUPERVISING AUTHORITY SHALL SUBMIT THE REPORT IN ACCORDANCE WITH THE FORM ATTACHED AS ANNEX 7 IN WRITTEN FORM (OR FAX) AND EMAIL TO THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT, THE MINISTRY OF PLANNING AND INVESTMENT, THE MINISTRY OF FINANCE, THE VIETNAMESE FEDERATION OF FRIENDSHIP ORGANIZATIONS, AND THE COMMITTEE FOR NON-GOVERNMENTAL FOREIGN AID ORGANIZATIONS. 4. Amending and supplementing Article 12 as follows:
“ARTICLE 12. REPORTING REQUIREMENTS AND REPORT FORMS ON THE RESULTS OF APPROVING AND MANAGING NON-GOVERNMENTAL FOREIGN AID GRANTS UNDER THE SUPERVISION OF THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT
1. SIX-MONTH REPORT: NO LATER THAN JUNE 21, THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT SHALL SUBMIT THE REPORT IN ACCORDANCE WITH THE FORM ATTACHED AS ANNEX 8 IN WRITTEN FORM (OR FAX) AND EMAIL TO THE AUTHORITY APPROVING THE NON-GOVERNMENTAL FOREIGN AID GRANT, THE MINISTRY OF PLANNING AND INVESTMENT, AND THE MINISTRY OF FINANCE. THE REPORTING PERIOD IS FROM DECEMBER 15 OF THE YEAR PRIOR TO THE REPORTING PERIOD TO JUNE 14.
2. Annual Report: Not later than December 21, the Managing Authority shall submit the report according to Form Appendix 8 in writing (or fax) and email to the Ministry of Planning and Investment, the Ministry of Finance, and the Steering Committee for PCPNN Organizations. The data cut-off period is from December 15 of the year prior to the reporting period to June 14.
5. Amend and supplement Article 13 as follows:
Article 13. Reporting System and Report Forms for the Vietnam Federation of Friendship Organizations
Not later than December 21, the Vietnam Federation of Friendship Organizations shall submit an annual consolidated report on the situation of mobilizing PCPNN aid throughout the country according to Form Appendix 9 in writing (or fax) and email to the Ministry of Planning and Investment for consolidation and reporting to the Prime Minister before December 25. The data cut-off period is from December 15 of the year prior to the reporting period to December 14.
6. Amend and supplement Article 14 as follows:
Article 14. Reporting System and Report Forms for the Ministry of Finance
The Ministry of Finance shall prepare an annual consolidated report on the situation of receiving and disbursing PCPNN aid throughout the country according to Form Appendix 10 and submit it to the Prime Minister before December 25 (in writing), notifying the Ministry of Planning and Investment and relevant agencies (in writing, fax, and email). The data cut-off period is from December 15 of the year prior to the reporting period to December 14.
7. Amend and supplement Article 15 as follows:
Article 15. Reporting System and Report Forms for the Ministry of Planning and Investment
The Ministry of Planning and Investment shall prepare an annual consolidated report on the situation of approving and implementing PCPNN aid throughout the country according to Form Appendix 11 and submit it to the Prime Minister before December 25 (in writing), notifying the Ministry of Finance and relevant agencies (in writing, fax, and email). The data cut-off period is from December 15 of the year prior to the reporting period to December 14.
Article 4. Supplement Article 17 of Circular No. 02/2013/TT-BKHĐT dated March 27, 2013, issued by the Ministry of Planning and Investment guiding the implementation of certain contents of the Sustainable Development Strategy of Vietnam for the period 2011-2020 as follows:
“Article 17. Reporting System
Before December 20 each year, ministries, ministerial-level agencies, government agencies, provincial people's committees, and organizations and mass organizations shall submit monitoring and evaluation reports on sustainable development implementation according to the contents stipulated in Clause 2, Article 15 of this Circular to the Ministry of Planning and Investment for consolidation and reporting to the Prime Minister. The data cut-off period is from December 15 of the year prior to the reporting period to December 14.
Article 25. Reporting System on Cooperative Activities
1. Not later than December 15, the cooperative shall truthfully, fully, and accurately report in writing its operational situation for the year to the cooperative registration agency according to the form specified in Appendix I-18.
2. Not later than December 18, the cooperative registration agency at the district level shall consolidate and report the operational situation of cooperatives within the district for the year according to the form specified in Appendix II-13 to the cooperative registration agency at the provincial level.
3. Not later than December 21, the cooperative registration agency at the provincial level shall consolidate and report the operational situation of cooperatives and cooperative unions within the province for the year according to the form specified in Appendix II-14 to the Ministry of Planning and Investment.
4. The Ministry of Planning and Investment, the cooperative registration agencies at the provincial and district levels shall consolidate and send to relevant agencies at the same level.
5. The data cut-off period for the annual report under Clauses 1, 2, and 3 of this Article is from December 15 of the year prior to the reporting period to December 14.
Article 6. Amend Point d Clause 2 Article 7 of Circular No. 06/2014/TT-BKHĐT dated October 14, 2014, issued by the Ministry of Planning and Investment guiding certain provisions of Decree No. 216/2013/NĐ-CP dated December 24, 2013, of the Government on the organization and operation of inspection in the planning and investment sector; Decree No. 07/2012/NĐ-CP dated February 9, 2012, of the Government on the organization and operation of specialized inspection in the statistics sector as follows:
d) Data collection period and deadline for submitting periodic reports
Quarterly Report Q1: Data collection period from December 15 of the previous year to March 14 of the reporting year. The General Statistics Office shall submit the report to the Inspectorate of the Ministry of Planning and Investment before March 21 of the reporting year. The Provincial Statistics Office shall submit the report to the General Statistics Office before March 18 of the reporting year.
Semi-annual Report: Data collection period from December 15 of the previous year to June 14 of the reporting year. The General Statistics Office shall submit the report to the Inspectorate of the Ministry of Planning and Investment before June 21 of the reporting year. The Provincial Statistics Office shall submit the report to the General Statistics Office before June 18 of the reporting year.

Article 7. Amend and supplement Clause 2 Article 13 of Circular No. 08/2014/TT-BKHĐT dated November 26, 2014, issued by the Ministry of Planning and Investment detailing certain provisions of Decree No. 216/2013/NĐ-CP dated December 24, 2013, of the Government on the organization and operation of inspection in the planning and investment sector as follows:
2. Types of reports, data collection periods, and deadlines for submitting reports:
a) Quarterly Report Q1 for the period from December 15 of the previous year to March 14 of the reporting year; submitted to the Inspectorate of the Ministry of Planning and Investment before March 21 of the reporting year;
b) Submit a mid-year report for the period from December 15 of the previous year to June 14 of the reporting year; send it to the Inspectorate of the Ministry of Planning and Investment before June 21 of the reporting year;
c) Submit a nine-month report for the period from December 15 of the previous year to September 14 of the reporting year; send it to the Inspectorate of the Ministry of Planning and Investment before September 21 of the reporting year;
d) Submit an annual final report for the period from December 15 of the previous year to December 14 of the reporting year; send it to the Inspectorate of the Ministry of Planning and Investment before December 21 of the reporting year.”
Article 8. Amend and supplement some articles and clauses of Circular No. 12/2016/TT-BKHĐT dated August 8, 2016 of the Ministry of Planning and Investment guiding the implementation of certain provisions of Decree No. 16/2016/NĐ-CP dated March 16, 2016 of the Government on the management and use of official development assistance (ODA) and concessional loans from foreign donors as follows:
1. Amend Clause 1 of Article 23 as follows:
“1. For programs and projects:
The project proponent has the responsibility to prepare reports on the implementation of the program and project and submit them to the supervising agency, the Ministry of Planning and Investment, the Ministry of Finance, the relevant sectoral management ministry, the provincial People's Committee where the program and project are implemented, and the donor.
The model forms for the project proponent's reports include the six-month and annual report forms according to Model IV-GSĐG 1, the pre-construction monitoring and evaluation report form according to Model IV-GSĐG 2, the project adjustment monitoring and evaluation report form according to Model IV-GSĐG 3, and the final program and project completion report form according to Model IV-GSĐG 4 in Appendix IV of this Circular. The project management board must develop and submit these reports to the project proponent for submission to the supervising agency and related agencies, and update them on the investment monitoring and evaluation system.
a) Six-month and annual reports:
The six-month and annual reports apply to all programs and projects.
The six-month report covers the period from December 15 of the previous year to June 14 of the reporting year. The annual report covers the period from December 15 of the previous year to December 14 of the reporting year.
Before June 21 and December 21, the project proponent must submit the six-month and annual reports on the implementation of the program and project according to Model IV-GSĐG 1 in Appendix IV of this Circular to the supervising agency, the Ministry of Planning and Investment, the Ministry of Finance, the relevant sectoral management ministry, the provincial People's Committee where the project is implemented, and the foreign donor, while updating them online into the Information System for Monitoring and Evaluating State-funded Programs and Projects of the Ministry of Planning and Investment. Specifically, the attached Form GSĐG 1.1 is only submitted once during the first six-month reporting period and must be resubmitted if there are changes in specific international agreements or agreements on ODA and concessional loan funds already signed. For reports sent to foreign donors, in addition to the Vietnamese version, an English version must also be provided unless otherwise agreed.
For programs and projects that do not involve land acquisition, resettlement, and environmental protection, there is no need to prepare the attached Forms GSĐG 1.6 and GSĐG 1.7.”
2. Amend Article 24 as follows:
“Article 24. Reporting system on the receipt and use of ODA and concessional loans at the supervising agency level
Before June 21 and December 21, the supervising agency must prepare and submit a consolidated report on the mobilization, receipt, and use of ODA and concessional loans, and the results of implementing programs and projects funded by ODA and concessional loans under its jurisdiction according to Model IV-GSĐG 5 in Appendix IV of this Circular in both written and electronic form to the Ministry of Planning and Investment and the Ministry of Finance for consolidation according to their assigned functions and tasks, while updating them online into the Information System for Monitoring and Evaluating State-funded Programs and Projects of the Ministry of Planning and Investment.
The six-month report covers the period from December 15 of the previous year to June 14 of the reporting year. The annual report covers the period from December 15 of the previous year to December 14 of the reporting year.”
3. Amend Article 25 as follows:
“Article 25. Reporting system on the receipt and use of ODA and concessional loans at the national level
1. The Ministry of Planning and Investment prepares periodic six-month and annual consolidated reports on the mobilization, management, and use of ODA and concessional loans at the national level according to Model IV-GSĐG 6 in Appendix IV of this Circular for submission to the Prime Minister (in both written and electronic form), and notifies the Ministry of Finance and related agencies (in both written and electronic form). The six-month report is submitted before June 25 each year, and the annual report is submitted before December 25 each year.
2. The Ministry of Finance prepares periodic six-month and annual consolidated reports on the disbursement, withdrawal, payment, and repayment of ODA and concessional loan debt at the national level according to Model IV-GSĐG 7 in Appendix IV of this Circular for submission to the Prime Minister (in both written and electronic form), and notifies the Ministry of Planning and Investment and related agencies (in both written and electronic form). The six-month report is submitted before June 25 each year, and the annual report is submitted before December 25 each year.

Article 9. Amend and supplement Article 7 of Circular No. 01/2017/TT-BKHĐT dated February 14, 2017 of the Ministry of Planning and Investment guiding the process of preparing village-level investment plans to implement national target programs as follows:
1. Amend Clause 4 of Article 7 as follows:
“4. Before December 21 each year, the Provincial People's Committee reports on the organization and implementation of this Circular in the previous year, and sends it to the Ministry of Planning and Investment for consolidation and supervision.”
2. Supplement Clause 5 of Article 7 as follows:
“5. The annual report covers the period from December 15 of the previous year to December 14 of the reporting year.”
Article 10. Amend Clause 2 and Clause 3 of Article 4 of Circular No. 06/2017/TT-BKHĐT dated December 5, 2017 of the Ministry of Planning and Investment detailing the provision of information on bidding, and the reporting on the implementation of bidding activities for selecting investors as follows:
“2. The deadline for reporting on the implementation of bidding activities on an annual basis:
a) The annual report on the implementation of bidding activities of the Ministry, ministerial-level agencies, agencies under the Government, other central agencies, provincial People's Committees, State-owned economic groups, and Corporation 91 must be submitted to the Ministry of Planning and Investment before December 21 of the reporting year;
b) The annual report on the implementation of bidding activities nationwide compiled by the Ministry of Planning and Investment must be submitted to the Prime Minister before December 25 of the reporting year;
c) "The annual report covers from December 15 of the previous year to December 14 of the reporting year."
3. In cases where the reporting deadlines coincide with weekly holidays or public holidays as stipulated by labor laws, the reporting deadline shall be the first working day following the holiday or public holiday period.
Article 11. Amend and supplement some clauses of Circular No. 03/2018/TT-BKHĐT dated October 17, 2018, issued by the Ministry of Planning and Investment guiding and promulgating sample documents for implementing procedures for foreign investment as follows:
1. Amend Clause 11, Clause 12, and Clause 13 of Article 2 as follows:
“11. Model No. 10: Quarterly report on the implementation of projects abroad;
12. Model No. 11: Annual report on the implementation of projects abroad;
13. Model No. 12: Report on the situation of foreign investment activities annually after tax settlement in the host country;”
2. Add Article 2a after Article 2:
“Article 2a. Provisions on periodic reports on the implementation of projects abroad
1. Quarterly report on the implementation of projects abroad: According to Model No. 01 issued together with this Circular. The data closing period is from the 15th of the month preceding the reporting quarter to the 14th of the last month of the reporting quarter. The deadline for submitting the quarterly report to the Ministry of Planning and Investment, the State Bank of Vietnam, and the Vietnamese representative office in the host country (if any) is before the 21st of the last month of the reporting quarter.
2. Annual report on the implementation of projects abroad: According to Model No. 02 issued together with this Circular. The data closing period is from December 15 of the previous reporting year to December 14 of the reporting year. The deadline for submitting the annual report to the State Bank of Vietnam and the Vietnamese representative office in the host country (if any) is before December 21 of the reporting year.”
3. Amend the title of Model No. 10: “Quarterly report (Quarter... / Year...) on the operation of overseas investment projects.”
Remove the content “(Reported before the 5th of the month following the reporting quarter)” at Model No. 10 issued together with Circular No. 03/2018/TT-BKHĐT.
4. Remove the content “(Reported before January 15 of the year following the reporting year)” at Model No. 11 issued together with Circular No. 03/2018/TT-BKHĐT.”
Article 12. Amend and supplement some clauses of Circular No. 04/2019/TT-BKHĐT dated January 25, 2019, issued by the Ministry of Planning and Investment detailing regulations on training, upgrading, and examination for issuance of certificates for bidding activities as follows:
Article 18. Supervision of the trial process
“Article 18. Responsibilities of Training Institutions for Bidding
1. Only organize training and upgrading courses on bidding when fully meeting the conditions prescribed by bidding laws.
2. Develop teaching materials and test questions consistent with the framework program as stipulated in Appendix 1 issued together with this Circular.
3. Publish the list of trainees who have been granted basic bidding training certificates according to Article 9 of this Circular.
4. Before December 21 each year, submit a written report on training and upgrading activities related to bidding to the Ministry of Planning and Investment. The content of the report shall be carried out according to Model No. 5 in Appendix 2 issued together with this Circular, and simultaneously send the report in file format (Word format) to the email address[email protected].
5. The annual report on training and upgrading activities related to bidding covers from December 15 of the previous reporting year to December 14 of the reporting year.”
2. Amend and supplement Article 19 as follows:
Article 19. Responsibilities of bidding lecturers
1. Teach in accordance with the framework curriculum prescribed in Appendix 1 attached to this Circular.
2. Continuously update knowledge on bidding mechanisms, policies, laws related to bidding, and other relevant laws.
3. Before December 21 each year, submit a written report on bidding teaching activities to the Ministry of Planning and Investment. The content of the report shall be carried out according to Model No. 6 in Appendix 2 attached to this Circular, and simultaneously send the report in file format (Word format) to the address[email protected].
4. Annual reports on bidding teaching activities are counted from December 15 of the previous reporting year to December 14 of the reporting year.
Article 13. Amend Article 9 of Circular No. 06/2019/TT-BKHĐT dated March 29, 2019, issued by the Ministry of Planning and Investment guiding the organizational structure and operation regulations of the advisory network supporting small and medium-sized enterprises through the advisory network as follows:
"Article 9. Report on advisory support for small and medium-sized enterprises through the advisory network
Before December 21 each year, ministries, agencies at the level of ministries, provincial People's Committees shall compile the situation of the advisory network's operations and the implementation of advisory support for small and medium-sized enterprises through the advisory network (in accordance with the model prescribed in Appendix 5 attached to this Circular) and submit it to the Ministry of Planning and Investment for consolidation in the report on the implementation of support for small and medium-sized enterprises as stipulated in Clause 1, Article 22 of the Law on Supporting Small and Medium-Sized Enterprises.
The annual report on the operation of the advisory network and the implementation of advisory support for small and medium-sized enterprises through the advisory network is counted from December 15 of the previous reporting year to December 14 of the reporting year."
Article 14. Repeal Article 1 and Article 3 of Circular No. 08/2018/TT-BKHĐT dated December 27, 2018, issued by the Ministry of Planning and Investment amending and supplementing certain articles of related Circulars concerning periodic reporting systems within the scope of management under the Ministry of Planning and Investment.
Chapter II
REPORTING INFORMATION SYSTEM OF THE MINISTRY OF PLANNING AND INVESTMENT
Article 15. Application of information technology in implementing the reporting system
1. Agencies, units, organizations, and individuals shall enhance the application of information technology in implementing the reporting system, moving towards electronic reporting, facilitating the consolidation and sharing of reporting information and saving time and costs for reporting entities.
2. The legal value of electronic reports and the use of electronic signatures shall be implemented in accordance with current legal documents regarding the application of information technology in state agency operations.
Article 16. Reporting Information System of the Ministry of Planning and Investment
1. The reporting information system of the Ministry of Planning and Investment is established at the Ministry of Planning and Investment, based on the National Reporting Information System, managed and utilized by the Ministry of Planning and Investment to serve its state management functions.
2. The reporting information system of the Ministry of Planning and Investment ensures compliance with the Government Electronic Architecture; national technical standards and norms on code identification structure and data format serving connection with the National Reporting Information System; technical standards and norms on message structure for data exchange between reporting information systems.
3. Ensure seamless connectivity, integration, and information sharing between the Government Reporting Information System and the reporting information systems of ministries, agencies, and localities.
Article 17. Technical Infrastructure and Technology
1. The information reporting system of the Ministry of Planning and Investment shall meet the general requirements regarding the basic functions of the National Information Reporting System as stipulated in Decree No. 09/2019/ND-CP dated January 21, 2019 of the Government on the reporting regime of administrative agencies.
2. The technical infrastructure and technology of the information reporting system of the Ministry of Planning and Investment shall comply with the provisions set forth in Decree No. 09/2019/ND-CP dated January 21, 2019 of the Government on the reporting regime of administrative agencies.
Chapter III
IMPLEMENTATION
Article 18. Responsibility for Implementation
1. The Office of the Ministry of Planning and Investment shall take the lead and coordinate with the Information Center and relevant units under the Ministry to perform the following tasks:
a) Processing and consolidating information and reports from agencies and units in accordance with the contents prescribed in this Circular;
b) Managing the information reporting system of the Ministry of Planning and Investment according to the schedule and guidelines of the Government Office;
c) Organizing inspections, evaluations, and urging the implementation of this Circular.
2. The Information Center shall cooperate with the Office of the Ministry of Planning and Investment and relevant units to build the information reporting system, ensuring technical infrastructure and technology for security, connectivity, and integration with the National Information Reporting System.
3. The Information Center shall organize the issuance and management of digital certificates for agencies, units, and individuals within the Ministry of Planning and Investment implementing the reporting regime on the information reporting system of the Ministry of Planning and Investment; guiding agencies and units on solutions for integrating digital signature services to ensure safety, authentication, integrity of information, and connectivity with the National Information Reporting System.
Article 19. Effective Date
1. This Circular shall take effect from September 16, 2019.
2. The list of periodic reports subject to amendment and supplementation within the scope of the management functions of the Ministry of Planning and Investment attached to this Circular.
3. Reporting regimes within the scope of the State management functions of the Ministry of Planning and Investment issued before the date this Circular takes effect shall continue to be effective until they are amended, supplemented, replaced, or abolished.
4. During the implementation process, in case of any difficulties, agencies and units are requested to promptly reflect them to the Ministry of Planning and Investment for research, amendment, and supplementation to ensure appropriateness./.
