Issuing National Technical Regulations
on fertilizer quality
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Crop Production dated November 19, 2018;
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Law on Product Quality and Goods Quality dated November 21, 2007;
Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government;;

At the request of the Director of the Department of Science, Technology and Environment and the Director of the Plant Protection Department;
The Minister of Agriculture and Rural Development promulgates the National Technical Regulation on fertilizer quality.
Article 1. Attached to this Circular is QCVN 01-189:2019/BNNPTNT, the National Technical Regulation on fertilizer quality.
Article 2. Domestic stainless steel produced and imported before June 1, 2020 shall continue to circulate in the market until June 1, 2021.
Article 3. Transitional Provisions
1. A Certificate of Conformity or Notification of Acceptance of Declaration of Conformity for fertilizers listed in the Decision recognizing fertilizers for circulation in Vietnam issued before the effective date of this Circular shall be valid until the expiration date of the Certificate of Conformity or Notification of Acceptance of Declaration of Conformity.
2. For fertilizers that have been declared conforming according to method 5 (as stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology on declaration of conformity with standards and technical regulations and Circular No. 02/2017/TT-BKHCN dated March 31, 2017 amending and supplementing certain articles of Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology on declaration of conformity with standards and technical regulations) at the next monitoring period and re-evaluation after the effective date of this Circular, samples of declared conforming fertilizers will be taken and all quality indicators and limiting factors will be tested according to the declaration of conformity file and the Decision recognizing fertilizers for circulation still in effect.
3. Organizations designated to carry out conformity assessment and testing of fertilizers in accordance with Decree No. 108/2017/NĐ-CP dated September 20, 2017 of the Government on fertilizer management shall continue to conduct conformity assessment in accordance with QCVN 01-189:2019/BNNPTNT until the end of their designation period.
Article 4. Organization of Implementation
The Director of the Ministry's Office, Heads of the Department of Science, Technology and Environment, the Plant Protection Bureau, and heads of other relevant agencies, organizations, and individuals are responsible for implementing this Circular. During the implementation process, if there are any difficulties, they are requested to promptly report to the Ministry of Agriculture and Rural Development (Plant Protection Bureau) for consideration and resolution.
