CIRCULAR
Detailed regulations and guidance on implementation of certain provisions of the Labor Code regarding child labor
concerning child labor
Pursuant to the Labor Code on November 20, 2019;
Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
At the proposal of the Director of the Occupational Safety and Health Inspectorate and the Director of the Children's Inspectorate;
The Minister of Labor, Invalids and Social Affairs promulgates this Circular providing detailed regulations and guidance on implementation of certain provisions of the Labor Code regarding child labor.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular provides detailed regulations and guidance on implementation of the following provisions of the Labor Code regarding child labor:
1. Employment of persons under 15 years old as provided for in Clause 4, Article 145.
2. List of light work that persons aged 13 to under 15 may perform as provided for in Clause 3, Article 143.
3. List of occupations and jobs that persons aged 15 to under 18 may work overtime or night shifts as provided for in Clause 2, Article 146.
4. List of jobs and workplaces harmful to the physical, mental development and personality of minors as provided for in Clause 3, Article 147.
Article 2. Applicability
1. Employers.
2. Child workers.
3. Other agencies, organizations, and individuals related to the implementation of this Circular.
Chapter II
EMPLOYMENT OF PERSONS UNDER 15 YEARS OLD
Article 3. Conditions for employment of persons under 15 years old
Employers must comply with Article 145 of the Labor Code when employing persons under 15 years old, with the specific provisions as follows:
1. Enter into a labor contract in writing with the person under 15 years old and their legal representative as stipulated in Article 4 of this Circular.
2. Schedule working hours for persons under 15 years old according to Clause 1, Article 146 of the Labor Code. If the person under 15 years old is engaged in both work and study or has a need for study, the scheduling of working hours must ensure that it does not affect the study time of the person under 15 years old.
3. Arrange rest breaks for persons under 15 years old according to Clause 2, Article 109 of the Labor Code.
4. Comply with the regulations on health check-ups, occupational disease detection, and ensuring working conditions, safety, and hygiene as stipulated in Point c and Point d, Clause 1, Article 145 of the Labor Code and the Law on Occupational Safety and Hygiene.
5. Only recruit and employ persons aged 13 to under 15 into light work if such work meets the following conditions:
a) It is included in the list specified in Article 8 of this Circular;
b) The workplace does not fall within the cases specified in Points a, b, c, and d, Clause 2, Article 147 of the Labor Code and Clause 2, Article 9 of this Circular.
6. Shall not recruit and employ persons under 13 years old for work except artistic, sports activities that do not harm the physical, mental development, and personality of persons under 13 years old and must have the consent of the Department of Labor, Invalids and Social Affairs as stipulated in Article 5 of this Circular.
Article 4. Conclusion of labor contracts for employment of persons under 15 years old
1. The party concluding the labor contract on behalf of the employer shall comply with Clause 3, Article 18 of the Labor Code and meet the following conditions:
a) Hold a criminal record certificate issued no more than six months from the date of issuance to the date of conclusion of the labor contract, which does not indicate any conviction for acts of child abuse;
b) Hold a Commitment Statement of having never been criminally prosecuted or administratively punished for acts of child abuse according to Model No. 02 attached as Appendix I to this Circular.
2. The labor contract with persons under 15 years old must include the contents stipulated in Article 21 of the Labor Code and the following contents:
a) Full name; date of birth; gender; place of residence; telephone number (if any); identification card number or citizen identification card number or passport number of the legal representative of the person under 15 years old;
b) Place of residence for persons under 15 years old who work away from home;
c) Ensuring study conditions.
3. The labor contract with persons under 13 years old shall only be effective after obtaining the consent document of the Department of Labor, Invalids and Social Affairs as stipulated in Article 5 of this Circular.
Article 5. Authority to Agree on the Employment of Persons Under 13 Years Old
When recruiting and employing persons under 13 years old for work as stipulated in Clause 3, Article 145 of the Labor Code, the employer must obtain the consent of the following authorities:
1. The Department of Labor, Invalids and Social Affairs at the location where the main office is located or the address recorded in the business registration certificate, cooperative, cooperative federation, investment registration certificate, approval document for investment orientation, decision on establishment of agencies or organizations, or cooperation contract of the cooperative group, in cases where the employer is a business, agency, organization, or cooperative.
2. The Department of Labor, Invalids and Social Affairs at the place of permanent residence or temporary residence registration of the household or individual, in cases where the employer is a household or individual.
Article 6. Documents for Requesting the Employment of Persons Under 13 Years Old
The documents for requesting the employment of persons under 13 years old include:
1. A request document for the employment of persons under 13 years old according to Model No. 01 attached as Appendix I of this Circular.
3. A copy of the criminal record sheet of the person entering into the labor contract on behalf of the employer according to Point a, Clause 1, Article 4 of this Circular.
4. A commitment statement that the person has not been criminally prosecuted or administratively punished for acts of harming children according to Point b, Clause 1, Article 4 of this Circular.
5. A labor contract or draft labor contract between the employer and the person under 13 years old and their legal representative. In case of a draft labor contract, there must be an Agreement Form of the legal representative of the person under 13 years old according to Model No. 03 attached as Appendix I of this Circular.
6. A copy of the birth certificate and health examination report of the person under 13 years old. Schedule or study program of the educational institution where the person under 13 years old is currently studying if they are enrolled in school.
Article 7. Procedure and Formalities for Requesting the Employment of Persons Under 13 Years Old
1. When there is a need to employ persons under 13 years old for work, the employer shall submit directly, through postal service, or online one set of documents for each person under 13 years old as specified in Article 6 of this Circular to the Department of Labor, Invalids and Social Affairs as specified in Article 5 of this Circular.
2. The Department of Labor, Invalids and Social Affairs shall accept the documents for requesting the employment of persons under 13 years old when all required components of the documents as specified in Article 6 of this Circular are complete.
3. Within ten working days from the date of receipt of the complete documents as stipulated in Clause 2 of this Article, the Department of Labor, Invalids and Social Affairs shall cooperate with relevant agencies and organizations to verify information (if necessary), review the documents, and respond in writing to the employer regarding the agreement on the employment of persons under 13 years old according to Model No. 04 attached as Appendix I of this Circular. In cases where the employment of persons under 13 years old is not agreed upon, the Department of Labor, Invalids and Social Affairs must provide a written response stating the reasons and send it to the employer.
Chapter III
LIST OF OCCUPATIONS, JOBS, AND WORKPLACES APPLICABLE TO YOUTH LABOR
Article 8. List of light work that persons aged from 13 to under 15 years old may perform
Appendix II attached herewith sets forth the List of light work that persons aged from 13 to under 15 years old may perform.
Article 9. List of work and workplace harmful to the physical, mental development, and personality of minors
1. Appendix III attached herewith sets forth the List of work harmful to the physical, mental development, and personality of minors as prescribed in point h, Clause 1, Article 147 of the Labor Code.
2. Appendix IV attached herewith sets forth the List of workplace harmful to the physical, mental development, and personality of minors as prescribed in point đ, Clause 2, Article 147 of the Labor Code.
Article 10. List of occupations and work that persons aged from 15 to under 18 years old may work overtime and night shifts
Appendix V attached herewith sets forth the List of occupations and work that persons aged from 15 to under 18 years old may work overtime and night shifts.
Chapter IV
IMPLEMENTATION
Article 11. Responsibilities of the Department of Labor, Invalids and Social Affairs
1. To take the lead and coordinate with specialized agencies under provincial People's Committees, central city People's Committees on health, culture, sports and tourism, education, and other relevant agencies and organizations to regularly urge and supervise the implementation of this Circular.
2. To guide, inspect, and audit the employment of minors in the locality.
3. To organize training and capacity building for professional skills in managing, inspecting, and auditing the employment of minors.
4. To apply information technology in managing the employment of minors.
5. Before December 25 each year, report to the Ministry of Labor, Invalids and Social Affairs on the situation of employing persons under 13 years old in the locality according to Model No. 05 at Appendix I attached herewith.
Article 12. Responsibilities of employers
1. To establish a Register to monitor the situation of employing minors according to Model No. 06 at Appendix I attached herewith and update information regularly in the Register.
2. To respect and seek opinions of minors regarding issues related to their rights and interests.
3. To regularly inspect and supervise to ensure safety for minors at workplaces.
4. In case the health of a minor is no longer suitable for the job, notify the minor, and if the minor is under 15 years old, also notify the legal representative of the minor.
5. To fully comply with all current laws and regulations on protecting children.
Chapter V
IMPLEMENTING PROVISIONS
Article 13. Effective Date
1. This Circular takes effect from March 15, 2021.
2. From the date this Circular takes effect, the following Circulars shall cease to be effective:
a) Circular No. 10/2013/TT-BLĐTBXH dated June 10, 2013 issued by the Minister of Labor, Invalids and Social Affairs setting out the List of prohibited work and workplace for using labor of minors;
b) Circular No. 11/2013/TT-BLĐTBXH dated June 11, 2013 issued by the Minister of Labor, Invalids and Social Affairs setting out the List of light work for using persons under 15 years old to work.

Appendix III
LIST OF JOBS THAT HARM THE PHYSICAL DEVELOPMENT, INTELLECTUAL DEVELOPMENT, AND MORAL CHARACTER OF YOUTH UNDER POINT H CLAUSE 1 ARTICLE 147 OF THE LABOUR CODE
(Annexed to Circular No. 09/2020/TT-BLĐTBXH dated November 12, 2020 of the Minister of Labor, Invalids and Social Affairs)
1. Directly smelting colored metal ores (copper, lead, tin, mercury, zinc, silver).
2. Burning and coking ovens.
3. Burning steam locomotive furnaces.
4. Operating boilers burning fuel (coal, sugar cane residue, wood, sawdust, rice husk) and boilers using liquid fuels with working pressure from 4.0 bar and above, capacity over 0.5 T/h.
