Guidelines for confirming natural disasters and epidemics in implementing policies to support agricultural insurance
WHEREAS EDUCATION APPLICATION a) Providing testimonies and expert opinions for the case for which they have been summoned; number 15/2017/NĐ-CP dated 17 the 2 years of 2017 LAW ; pursuant to the Law on Forestry dated November 15, 2017;
Pursuant to Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on Agricultural Insurance;
At the request of the Director of the Department of Cooperative Economy and Rural Development,
The Minister of Agriculture and Rural Development issues this Circular guiding the confirmation of natural disasters and epidemics in implementing policies to support agricultural insurance.
Article 1. Scope of Regulation
Article 1. This Circular guides the confirmation of natural disasters and epidemics to determine insurance events in implementing policies to support agricultural insurance as prescribed in Clause 4, Article 36 of Decree No. 58/2018/ND-CP dated April 18, 2018 of the Government on agricultural insurance (hereinafter referred to as Decree No. 58/2018/ND-CP).
Article 2. The determination of losses and compensation for agricultural insurance shall be carried out in accordance with the agricultural insurance contract stipulated in Decree No. 58/2018/ND-CP and laws on insurance business.
Article 2. Applicability
Organizations and individuals engaged in agricultural production; insurance companies; competent state agencies related to the confirmation of natural disasters and epidemics in implementing policies to support agricultural insurance as prescribed in Decree No. 58/2018/ND-CP.
Article 3. Guidelines for confirming natural disasters to determine insurance events
Clause 1. The confirmation of natural disasters to determine insurance events shall be regulated as follows: Using the content regarding the situation and development of natural disasters in the consolidated report of the natural disaster wave as prescribed in Point a, Clause 2, Article 8 of Joint Circular No. 43/2015/TTLT-BNNPTNT-BKHĐT dated November 23, 2015 of the Ministers of the Ministry of Agriculture and Rural Development and the Ministry of Planning and Investment guiding the statistics and assessment of losses caused by natural disasters as the basis for determining insurance events.
Clause 2. Organizations and individuals engaged in agricultural production or insurance companies use the report prescribed in Clause 1 of this Article of the People's Committee of the commune to determine insurance events in implementing policies to support agricultural insurance.
Article 4. Guidelines for confirming animal diseases when not meeting the conditions for declaring an epidemic to determine insurance events
Clause 1. The confirmation of animal diseases when not meeting the conditions for declaring an epidemic to determine insurance events shall be regulated as follows:
a) For terrestrial animal diseases: Using one of the disease reports of terrestrial animals as prescribed in Clauses 3, 4, 5, and 6, Article 7 of Circular No. 07/2016/TT-BNNPTNT dated May 31, 2016 of the Minister of Agriculture and Rural Development on prevention and control of terrestrial animal diseases as the basis for determining insurance events.
b) For aquatic animal diseases: Using one of the disease reports of aquatic animals as prescribed in Points c and d, Clause 1, Clauses 3 and 4, Article 5 of Circular No. 04/2016/TT-BNNPTNT dated May 10, 2016 of the Minister of Agriculture and Rural Development on prevention and control of aquatic animal diseases or the disease report of aquatic products as prescribed in Appendix I attached to Circular No. 01/2020/TT-BNNPTNT dated January 16, 2020 of the Minister of Agriculture and Rural Development on periodic reporting systems within the scope of management under the Ministry of Agriculture and Rural Development as the basis for determining insurance events.
Clause 2. Organizations and individuals engaged in agricultural production or insurance companies use the report prescribed in Clause 1 of this Article of the specialized veterinary management agency at the district or provincial level to determine insurance events in implementing policies to support agricultural insurance.
Article 5. Guidance on confirming plant pests when not meeting the conditions for declaring a disease to determine an insurance event
1. The confirmation of plant pests when not meeting the conditions for declaring a disease to determine an insurance event shall be carried out as follows: Using one of the notification documents, urgent telegrams specified in Sections 4.1.2, 4.1.3, and Section 4.2 of the National Technical Regulation on Methods for Surveying and Detecting Plant Pests (QCVN 01-38: 2010/BNNPTNT) issued together with Circular No. 71/2010/TT-BNNPTNT dated December 10, 2010 of the Minister of Agriculture and Rural Development on Issuing National Technical Regulations on Plant Quarantine and Plant Protection, or the pest situation report specified in Appendix I issued together with Circular No. 01/2020/TT-BNNPTNT dated January 16, 2020 of the Minister of Agriculture and Rural Development on the regular reporting system within the scope of management under the Ministry of Agriculture and Rural Development shall serve as the basis for determining an insurance event.
2. Agricultural production organizations or agricultural insurance enterprises shall use reports, notification documents, and urgent telegrams specified in Clause 1 of this Article from specialized management agencies for plant protection and quarantine at the district or provincial level to determine an insurance event in implementing the policy of supporting agricultural insurance.
Article 6. Responsibility for Implementation
1. The Department of Cooperative Economy and Rural Development shall direct and organize the implementation of this Circular. The General Department of Disaster Prevention and Control, the Plant Protection Department, and the Animal Health Service shall cooperate to resolve difficulties and obstacles during the implementation process.
2. Provincial People's Committees: Direct People's Committees at all levels, specialized management agencies for disaster prevention and control, veterinary services, plant protection and quarantine within their jurisdiction to publicly display the notification documents and reports specified in Clause 1 of Article 3, Clause 1 of Article 4, and Clause 1 of Article 5 of this Circular as the basis for determining an insurance event in implementing the policy of supporting agricultural insurance.
Article 7. Effective Date
1. This Circular takes effect from September 28, 2020.
2. In cases where the legal normative documents cited for application in this Circular are amended, supplemented, or replaced by other legal normative documents, they shall be applied according to the newly issued documents.
3. During the implementation period, if there are any difficulties, relevant agencies, organizations, and individuals shall promptly reflect them to the Ministry of Agriculture and Rural Development for consideration and resolution./.
