CIRCULAR

REGULATION on the implementation of mass mobilization work by the People's Public Security Force  

Pursuant to the Law on People's Police dated November 20, 2018;

BASED ON THE LAW AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE POPULAR SECURITY ORGANIZATION LAW dated June 22, 2023;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government amends and supplements certain Articles of Circular No. 09/2024/TT-BCA dated March 13, 2024 issued by the Minister of Public Security regarding the implementation of mass mobilization work by the People's Public Security force and Circular No. 124/2021/TT-BCA dated December 28, 2021 issued by the Minister of Public Security stipulating residential areas, communes, wards, towns, agencies, enterprises, and educational institutions meeting the criteria for "Safety in security and public order".

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the principles, contents, forms, methods, funding, and responsibilities of public security units and localities, public security officers and soldiers in implementing mass mobilization work by the People's Public Security Force.

2. This Circular applies to: units under the Ministry of Public Security; provincial and centrally-administered city public security services; county, district, town, and centrally-administered city public security services; commune, ward, and town public security offices; police stations and independent units deployed in necessary areas (collectively referred to as public security units and localities); officers, non-commissioned officers, conscripted soldiers, and public security workers (collectively referred to as public security officers and soldiers).

Article 2. Interpretation of Terms

1. Mass mobilization is the mobilization of the people to implement the Party's guidelines and policies, and the laws of the Socialist Republic of Vietnam.

2. Mass mobilization work of the People's Public Security Force is the entire activity of the People's Public Security Force to mobilize the people to strictly implement the Party's guidelines and policies, and the State's laws; participate in implementing tasks related to building and defending the country, ensuring national security, maintaining social order and safety, building a clean and strong People's Public Security Force, and consolidating the close relationship between the People's Public Security Force and the people.

3. The model of skillful mass mobilization competition of the People's Public Security Force is a form that attracts and engages a large number of collective bodies and public security officers and soldiers in effectively implementing mass mobilization work by the People's Public Security Force.

4. The model of skillful mass mobilization of the People's Public Security Force is a model of organizing the implementation of mass mobilization work by the People's Public Security Force with high quality and effectiveness.

5. Examples of skillful mass mobilization of the People's Public Security Force are those collectives and individuals who have outstanding achievements in building, maintaining, or participating in building and maintaining the model of skillful mass mobilization of the People's Public Security Force.

Article 3. General Principles

1. Adhere to the Party's guidelines and policies, the State's laws, guiding documents on the implementation of mass mobilization work by the People's Public Security Force, and relevant regulations.

2. Start from the interests of the masses of the people, implement and protect their legitimate rights and interests, aiming at the goal of national unity, and mobilizing the comprehensive strength of the whole people in the cause of building and defending the country and ensuring security and order.

3. Ensure centralized, unified, and synchronized leadership and direction by party committees and public security chiefs at all levels in implementing mass mobilization work by the People's Public Security Force.

4. Implement mass mobilization work according to assigned responsibilities; be suitable for practical requirements in specific areas, fields, and target groups.

Chapter II

CONTENTS, FORMS, METHODS, AND FUNDING FOR THE IMPLEMENTATION

OF MASS MOBILIZATION WORK BY THE PEOPLE'S PUBLIC SECURITY FORCE

Article 4. Content of mass mobilization work

1. Advising on the issuance and implementation of state policies and laws, regulatory legal documents, regulations, programs, plans concerning the mobilization of the people to participate in national security protection and social order and safety assurance.

2. Propaganda and mobilization for the people to strictly comply with the Party's guidelines and policies, state laws, and security and order assurance work. Propaganda and mobilization for overseas Vietnamese to comply with Vietnam Government regulations, local authorities' regulations, and to utilize their capabilities and conditions to participate in political, economic, cultural, and social fields both domestically and internationally; mobilizing and seeking support from the people of other countries and international friends to contribute to the successful implementation of the Party and State's foreign policy in the cause of building and defending the country.

3. Implementing democracy at the grassroots level, promoting the people's right to self-governance, creating favorable conditions for citizens, civil servants, public officials, employees to be informed, express their will, aspirations, and opinions according to the law.

4. Implementing administrative reform work, residence management, application of population data, digital identity and authentication, serving the national digital transformation.

5. Applying information technology and social media utilities in implementing mass mobilization work by the People's Public Security force.

6. Grasping the situation of the people and inspecting, detecting, handling violations, resolving complaints, denunciations, suggestions, and reflections of the people related to security and order assurance work.

7. Organizing supervision and critical feedback from the Vietnam Fatherland Front, political-social organizations, and the people in building the force and implementing policies and laws on security and order by the People's Public Security force.

8. Cooperating with agencies and organizations within the political system to implement mass mobilization work, building the all-people movement for national security protection, linked with the implementation of campaigns and patriotic emulation movements.

9. Mobilizing the people to participate in and build the all-people movement for national security protection; preventing and combating crime, law violations, accidents, and social evils suitable to each locality, field, and target group.

10. Implementing the skillful mass mobilization emulation movement of the People's Public Security force. Reviewing and evaluating the quality of models and building, maintaining, and expanding skillful mass mobilization models of the People's Public Security force and advanced models in the all-people movement for national security protection.

11. Participating in building, consolidating, and improving the quality of activities of the political system at the grassroots level.

12. Implementing social welfare, charity work, helping the people to prevent, combat, and mitigate the consequences of natural disasters, calamities, and epidemics; strengthening solidarity, building close relationships between the People's Public Security force and the people.

13. Participating in economic, cultural, and social development, implementing national target programs, ethnic and religious policies, and social policies, while preserving and promoting traditional and national cultural identity.

14. Educating cadres and soldiers on politics, ideology, revolutionary morality, sense of responsibility, exemplary conduct, and service to the people. Improving and building the mass mobilization workforce; increasing cadres and soldiers engaged in mass mobilization work and security and order assurance work oriented towards the grassroots level.

15. Organizing training and enhancing knowledge on mass mobilization work for the People's Public Security force.

16. Inspecting, supervising, summarizing, concluding, commending, and rewarding mass mobilization work of the People's Public Security force.

17. Researching, supplementing, and perfecting theoretical foundations on mass mobilization work by the People's Public Security force.

Article 5. Forms of implementing mass mobilization work

1. Based on the nature of openness and secrecy:

a) Public mobilization involves propaganda, explanation, and encouragement of the people through the use of open forces, means, and methods;

b) Secret mobilization involves propaganda, explanation, and encouragement of the people through the use of secret forces, means, and methods.

2. Based on the scope of the affected subjects:

a) Wide-scale mobilization involves propaganda, explanation, and encouragement of the entire population in society through mass media and educational systems;

b) Concentrated mobilization involves propaganda, explanation, and encouragement of a large number of people within a specific space, time, and location, focusing on one or several specific topics or tasks;

c) Individual mobilization involves propaganda, explanation, and encouragement of a specific individual or group with particular characteristics.

3. Based on interaction with the affected subjects:

a) Indirect mobilization involves propaganda, explanation, and encouragement of the people through intermediary stages or environments without direct contact with the mobilized subjects;

b) Direct mobilization involves propaganda, explanation, and encouragement of the people through direct contact with the people.

4. Based on the timing of the impact on the subjects:

a) Continuous mobilization involves ongoing and continuous propaganda, explanation, and encouragement of the people;

b) Periodic mobilization involves propaganda, explanation, and encouragement of the people during specific periods or intervals of time.

Article 6. Methods of Implementing Mass Mobilization Work

1. The method of propaganda involves using arguments, evidence, and reasoning to promote attitudes, thoughts, psychology, and actions of the people.

2. The method of setting examples involves using exemplary models of good people and deeds to stimulate the积极性和自觉性 of the people.

3. The method of persuasion involves using a combination of speech, writing, evidence, attitude, and action to make the people trust and agree.

4. The method of combining and flexibly using various forms of implementing mass mobilization work involves selecting and utilizing multiple specific forms based on requirements and tasks.

Article 7. Sources of Funding for Implementing Mass Mobilization Work

1. The State budget ensures funding for the implementation of mass mobilization work of the People's Public Security force according to the provisions of the Law on State Budget and detailed regulations on分级管理国家预算的规定。

2. Funding integrated from other programs and projects according to the provisions of laws (if applicable).

3. Funding raised from voluntary contributions of organizations and individuals through socialized forms; implemented according to the principle that the level conducting mobilization manages and ensures proper use, transparency, and public participation in accordance with the law.

Chapter III

RESPONSIBILITIES FOR IMPLEMENTING MASS MOBILIZATION WORK

OF THE PEOPLE'S PUBLIC SECURITY FORCE

Article 8. General Responsibilities

Public Security units and localities provide advice, guidance, deployment, and implementation of the contents of mass mobilization work stipulated in Article 4 of this Circular according to their assigned fields, areas, and subjects, adapting to the characteristics and circumstances of the units, localities, and each officer and soldier.

Article 9. Specific Responsibilities

1. The Department of Mass Mobilization for National Security:

a) Research and propose to the Ministry of Public Security to advise the National Assembly, the Standing Committee of the National Assembly, and the Government;

b) Research and propose the Minister of Public Security to decide on policies, programs, and plans to coordinate with the Central Steering Committee for Mass Mobilization, relevant agencies, ministries, sectors, and political-social organizations at the central level to implement mass mobilization work of the People's Public Security force. Take the lead and coordinate in organizing the implementation of these policies, programs, and plans as stipulated herein;

c) Take the lead and advise the Ministry of Public Security to direct and guide activities within the People's Public Security force aimed at commemorating the Traditional Day of Party Mass Mobilization Work (October 15) and the "National Day for Safeguarding National Security" (August 19);

d) Conduct scientific research, improve theoretical foundations, organize training sessions, and update knowledge on mass mobilization work of the People's Public Security force;

đ) Coordinate with local public security units to organize and implement mass mobilization work according to their assigned functions and tasks;

e) Coordinate in advising and proposing commendations for collectives and individuals with outstanding achievements in implementing mass mobilization work as prescribed by law;

g) Guide local public security units in implementing the mass mobilization competition and work on building, maintaining, and expanding exemplary models of effective mass mobilization across various areas and fields of public security work.

2. The Department of Legal Affairs and Administrative Reform:

Take the lead in advising and guiding the implementation of legal education and popularization work; grassroots democracy work; and administrative reform and judicial work within the People's Public Security force.

3. The Department of Party Work and Political Work:

Take the lead in organizing political education, ideological guidance, moral education, lifestyle guidance, communication skills, and conduct within the People's Public Security force; organize and guide various levels of mass organizations within the People's Public Security force to carry out mass mobilization work.

4. The Department of Public Communication of the People's Public Security:

a) Take the lead in advising, guiding, and organizing the implementation of information dissemination and propaganda about the Party's guidelines and policies, the State's laws, directives, and resolutions of the Central Party Committee for Public Security and the Minister of Public Security regarding mass mobilization work and the construction of a nationwide movement to safeguard national security; outstanding achievements, feats of arms, and notable results of the People's Public Security force, especially those related to the daily work of officers and soldiers in contact with organizations and citizens; good deeds and exemplary models of effective mass mobilization across various areas and fields of public security work; promptly combat and refute false and hostile viewpoints, opposing the Party, State, undermining national solidarity, and disrupting the close relationship between the People's Public Security force and the people;

b) Develop special columns, programs, and contents on mass mobilization work and the construction of a nationwide movement to safeguard national security for publication and broadcast on various media outlets;

c) Cooperate with external media organizations to promote information dissemination and propaganda about the results of mass mobilization work and the construction of a nationwide movement to safeguard national security carried out by the People's Public Security force.

5. The Inspectorate General:

a) Take the lead in guiding the implementation of legal provisions on receiving citizens' visits, creating favorable conditions for citizens to exercise their rights to appeal, report, make suggestions, and reflect issues; promote and mobilize the people to actively participate in preventing and combating crime, social evils, and violations of laws on national security and public order;

b) Advise, organize, and implement inspection and supervision activities related to mass mobilization work of the People's Public Security force as prescribed.

6. The Department of Foreign Security:

Take the lead in organizing and implementing work to mobilize and engage foreigners residing and studying in Vietnam in the nationwide movement to safeguard national security, prevent, stop, and combat negative public opinion and malpractices arising in localities, areas, and fields.

7. The Department of Internal Security:

a) Guide and coordinate with local public security units to organize mobilizing the people, religious leaders, and followers, and ethnic minority groups to comply with the Party's guidelines and policies, and the State's laws, and participate in ensuring national security and public order;

b) Direct, guide, and coordinate in organizing mobilization work in resolving activities that exploit appeals and large gatherings affecting national security and public order.

8. The Department of Internal Political Security:

a) Take the lead in advising, guiding, inspecting, and urging the implementation of mass mobilization work in the areas and regions under the responsibility of central agencies;

b) Promote and mobilize state agencies, enterprises, organizations, and individuals to actively participate in the nationwide movement to safeguard national security and protect state secrets.

9. The Department of Economic Security:

Take the lead in guiding and organizing the mobilization of the people, cadres, workers, and employees to ensure economic security and public order in industrial zones, export processing zones, and areas under the responsibility of central agencies and enterprises.

10. The Department of Cybersecurity and High-Tech Crime Prevention:

a) Promote and mobilize the people to actively and voluntarily participate in safeguarding national security and maintaining social order and safety; effectively implement models and systems of the people's defense front in cyberspace;

b) Mobilize the people to participate in propaganda, struggle, and refute false and hostile viewpoints of hostile forces and reactionaries opposing on cyberspace; prevent and combat cybercrime and high-tech crimes.

11. The Department of Exit and Entry Administration:

a) Take the lead in advising, guiding, inspecting, and urging the implementation of administrative reform, application of science and technology, simplification of administrative procedures in the field of exit and entry, creating favorable conditions for Vietnamese citizens, foreigners, and overseas Vietnamese to enter and exit the country;

b) Propaganda and mobilize the people to participate in building the nationwide movement for national security, contributing to ensuring security and order in the management of entry and exit.

12. The General Bureau of Public Order Administration:

Take the lead in organizing the mobilization of the people to implement regulations on administrative management, residence management; issuance, management of identity cards, electronic identification accounts and various integrated paper documents displayed on the VNeID application; state management over certain business sectors subject to conditions related to security and order and seals; management of weapons, explosives, support tools, and fireworks; struggle against crime and violations of the law within its jurisdiction.

13. The General Bureau of Prison Management, Compulsory Education Facilities, and Juvenile Rehabilitation Schools:

Coordinate and mobilize relevant agencies, organizations, units, and individuals in preparing for community reintegration before prisoners complete their sentences, conditional early release, or amnesty, covering aspects such as information dissemination, education on community reintegration; psychological counseling, legal procedure support; vocational guidance, job search; other supportive measures as prescribed by law.

14. The Command of Mobile Police Force:

a) Take the lead and coordinate with local authorities, departments, mass organizations, and police units where they are stationed or conducting field exercises to carry out mass mobilization work combined with propaganda on the Party's guidelines and policies, state laws, and mobilizing the people to build the nationwide movement for national security;

b) Study and guide the integration of mass mobilization work during the execution of regular and urgent tasks of the Mobile Police Force.

15. The Planning and Finance Department:

Take the lead in guiding and inspecting local police units' budget preparation, management, and utilization to ensure funding for the mass mobilization work of the People's Public Security force according to the State Budget Law and other regulations of the Minister of Public Security.

16. Criminal Investigation Units:

Take the lead in directing, guiding, and implementing work to mobilize the people to participate in detecting, preventing, and combating crime, law violations, and social evils; providing information and reporting crimes; mobilizing wanted persons, criminals, and law violators to surrender themselves.

17. Intelligence Units:

a) Coordinate with agencies and units both inside and outside the People's Public Security force to organize monitoring, detection, and handling of complex issues that may affect the stable and strong development of overseas Vietnamese communities; prevent, detect, and combat plots and activities aimed at inciting overseas Vietnamese communities to oppose the Party and the State; mobilize and leverage the roles and potentials of peace-loving forces, international friends, and progressive world citizens to invest and develop the economy, contributing to the construction and defense of the Socialist Fatherland;

b) Propagate the Party's guidelines and state policies; regulations of the host country's authorities regarding the activities of Vietnamese abroad. Through representative offices, create favorable conditions to support overseas Vietnamese communities in gathering and leveraging their capabilities and conditions to participate in political, economic, cultural, and social management fields.

18. Police Academies and Schools:

a) Directly research, train, and teach cadres and soldiers about the People's Public Security force's mass mobilization work; compile teaching materials on mass mobilization work; organize training and capacity building for students on mass mobilization work;

b) Coordinate with relevant units to organize theoretical and practical summaries on the People's Public Security force's mass mobilization work and research, propose solutions to improve the effectiveness of mass mobilization work.

19. Provincial and Municipal Police Departments under the Central Government:

a) Implement and organize the implementation of the Party's guidelines, state policies, and directives from local party committees, governments, and higher-level police departments regarding mass mobilization work in the locality;

b) Coordinate with the Mass Mobilization Committee, Vietnam Fatherland Front, and relevant agencies, departments, organizations, and political-social organizations at the provincial level in advisory, organizational, and implementation work on mass mobilization, building, consolidating, and improving the quality and effectiveness of the political system's operations in the locality;

c) Direct, guide, and organize the implementation of mass mobilization work in various police operations and the construction, maintenance, and expansion of exemplary mass mobilization models of the local police;

d) Direct, guide, and organize the implementation of work to understand the situation of the people, social welfare activities, charity, helping the people to prevent, mitigate the consequences of natural disasters, accidents, epidemics in the locality;

đ) Take the lead and coordinate with relevant agencies and units to organize training and capacity building for local cadres and soldiers on mass mobilization work. Improve organizational structure and arrange competent personnel to perform mass mobilization work;

e) Direct, guide, inspect, and urge the implementation of the Ministry of Public Security's guidelines and measures on mass mobilization work in the locality.

20. County, District, City, and Town Police Departments under Provinces and Municipalities under the Central Government:

a) Implement the guidelines and measures of local party committees, governments, and the Ministry of Public Security regarding mass mobilization work in the county area;

b) Coordinate with the Mass Mobilization Committee, Vietnam Fatherland Front, and relevant agencies, departments, organizations, and political-social organizations at the county level in advisory, organizational, and implementation work on mass mobilization, building, consolidating, and improving the quality and effectiveness of the political system's operations from the county to the grassroots level;

c) Organize the implementation of mass mobilization work in various police operations in the county area and the construction, maintenance, and expansion of exemplary mass mobilization models of the county and township police.

d) Organize the work of grasping the situation of the people, social welfare activities, charitable activities, and assisting the people in preventing, combating, and mitigating the consequences of natural disasters, catastrophes, and epidemics within the district level.

đ) Direct, guide, inspect, and urge the implementation of policies and measures of the Ministry of Public Security and provincial-level public security organs regarding mass mobilization work within the district level.

21. Police stations at commune, ward, and town levels:

a) Implement policies and measures of the party committees, authorities at all levels, the Ministry of Public Security, provincial-level public security organs, and district-level public security organs concerning mass mobilization work within the commune level.

b) Coordinate with the mass mobilization sector at the commune level, the People's Committee Council, and forces participating in maintaining security and order at the grassroots level in advisory, deployment, and implementation of mass mobilization work and building the political system at the grassroots level.

c) Carry out mass mobilization work in various fields of police operations and maintain models of skilled mass mobilization of the People's Public Security Force at the commune level.

d) Conduct work to grasp the situation of the people and social welfare activities, charitable activities, and assist the people in preventing, combating, and mitigating the consequences of natural disasters, catastrophes, and epidemics within the commune level.

22. Cadres and soldiers of the People's Public Security Force:

a) Strictly implement the leadership and guidance of the Party Central Committee's Public Security Department, the Ministry of Public Security, the party committees, and leaders of public security units and localities regarding mass mobilization work.

b) Implement mass mobilization work in conjunction with party work, political work, and professional duties of the People's Public Security Force.

c) Proactively identify and promptly report to competent authorities new situations arising in the assigned areas and sectors; study, advise, and propose tasks and solutions for implementing mass mobilization work that are appropriate.

d) Adhere to the law, set exemplary standards in self-cultivation, moral character, revolutionary ethics, sense of responsibility, and service consciousness for the people to emulate.

đ) Study, learn, enhance understanding and skills in carrying out mass mobilization work of the People's Public Security Force.

e) Consolidate close ties between the People's Public Security Force and the people.

g) Participate in implementing the movement of skilled mass mobilization of the People's Public Security Force according to their assigned functions and tasks.

h) Fully leverage their core role in advisory work and building advanced models in the nationwide movement to protect national security.

i) Coordinate with the party committees and local authorities where they reside to effectively carry out mass mobilization work; mobilize family members and relatives to strictly comply with the Party's guidelines, state policies, laws, and local regulations.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from May 1, 2024.

2. In cases where the legal normative documents cited in this Circular are replaced or amended, the replacement or amended documents shall be applied.

Article 11. Responsibility for Implementation

1. Heads of subordinate units under the Ministry of Public Security and Directors of public security departments of centrally governed cities and provinces are responsible for:

a) Directing and organizing the strict implementation of this Circular.

b) Developing programs and plans for annual mass mobilization work linked to the functions and tasks of the unit or locality, clearly assigning responsibilities to units for implementation.

c) Preparing reports on the results of mass mobilization work monthly, semi-annually, and annually for the unit or locality, and other reports as directed by the Ministry of Public Security to be submitted to the Mass Mobilization Movement Construction Bureau for consolidation and reporting to the Party Central Committee's Public Security Department and the Ministry of Public Security leadership.

2. The Mass Mobilization Movement Construction Bureau advises the Ministry of Public Security leadership to monitor, guide, inspect, and urge public security units and localities to implement this Circular; consolidate and report results as prescribed.

During the implementation of this Circular, if there are difficulties or obstacles, public security units and localities should reflect them to the Ministry of Public Security (through the Mass Mobilization Movement Construction Bureau) for timely guidance./.
