CIRCULAR
REGULATIONS ON THE CONTENT, STRUCTURE, AND INFORMATION FORMAT
OF THE NATIONAL LAND DATABASE AND TECHNICAL REQUIREMENTS FOR
APPLICATION SOFTWARE OF THE NATIONAL LAND INFORMATION SYSTEM
On the basis of Land Law dated January 18, 2024; Law amending and supplementing certain articles of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Credit Institutions Law No. 32/2024/QH15 dated June 29, 2024;
Decree No. Decree No. 71/2024/NĐ-CP dated June 27, 2024 of the Government on land prices;
Decree No. Decree No. 101/2024/NĐ-CP dated July 29, 2024 of the Government on basic land surveys; registration, issuance of land use right certificates, ownership certificates of immovable property attached to land, and the Land Information System;
Decree No. Decree No. 102/2024/NĐ-CP dated July 30, 2024 of the Government detailing implementation of certain provisions of the Land Law;
Decree No. Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the National Land Registration and Information Data Center,
The Minister of Natural Resources and Environment issues this Circular regulating the content, structure, and information format of the national land database and technical requirements for application software of the national land information system.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates technical requirements for application software serving management, operation, updating, and exploitation of the national land database under Clause 3, Article 164 of the Land Law and the content, structure, and information format of component databases of the national land database: cadastral; land survey, evaluation, protection, improvement, and restoration; planning and land use plans; land prices; land statistics and inventory; other related databases.
The content, structure, and information format of the database on land-related regulatory documents and the content, structure, and information format of the database on inspection, examination, citizen reception, dispute resolution, complaint handling, and denunciation regarding land are implemented according to specialized laws and are connected to the national land database for exploitation and use.
Article 2. Applicability
1. State management agencies for land; local agencies with land management functions; Land Registration Offices, Branches of Land Registration Offices; cadastre officials at communes, wards, and towns.
2. Other agencies, organizations, and individuals involved in the construction, management, operation, and exploitation of the national land information system and the national land database.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Land data is land information in digital form, including spatial data, attribute data, and unstructured land data.
2. Spatial land data includes base spatial land data and thematic spatial land data on: cadastral; land survey, evaluation, protection, improvement, and restoration; planning and land use plans; land prices; land statistics and inventory; other related land data.
3. Attribute land data includes structured attribute data on: cadastral; land survey, evaluation, protection, improvement, and restoration; planning and land use plans; land prices; land statistics and inventory; other related land data.
4. Unstructured land data consists of data that does not conform to a specific data structure or model, including PDF files, text files, image files, graphic files, and other unstructured data on: cadastral; land survey, evaluation, protection, improvement, and restoration; planning and land use plans; land prices; land statistics and inventory; other related land data.
5. Land metadata is information describing land data.
6. Data structure is the organization and storage of data on computers in a system for effective data use.
7. Information type of data is the name, value type, and length of data fields.
8. XML (eXtensible Markup Language - Extensible Markup Language) is a standard format for encoding data for data exchange.
9. GML (Geography Markup Language - Extended Geography Markup Language) is a standard format for encoding spatial data for data exchange.
10. JSON (JavaScript Object Notation - data exchange format) is a text-based encoded data format for data exchange.
11. GeoJSON (Geographic JavaScript Object Notation - data exchange format for geographic objects) is a standard format for encoding geographic data structures for data exchange.
Chapter II
CONTENT, STRUCTURE, AND INFORMATION FORMAT OF THE NATIONAL LAND DATABASE
Article 4. Model of the national land database
The components of the national land database as prescribed in Clause 1 of Article 165 of the Land Law are designed according to a data model including: spatial land data, attribute land data, unstructured land data, and land metadata.
Article 5. Content of spatial land data
Spatial land data includes basic spatial land data and specialized spatial land data.
1. Content of basic spatial land data:
a) Spatial control point data including: coordinate data layer; elevation data layer;
b) Border and administrative boundary spatial data including: border and administrative boundary marker data layer; border line data layer; provincial administrative boundary line data layer; district administrative boundary line data layer; commune administrative boundary line data layer; provincial administrative area data layer; district administrative area data layer; commune administrative area data layer;
c) Hydrographic spatial data including: hydrographic line data layer; hydrographic area data layer; water edge line data layer;
d) Transportation spatial data including: road centerline data layer; transportation area data layer; transportation line data layer; transportation surface data layer;
đ) Geographical name and annotation spatial data including: geographical name point data layer; annotation point data layer.
2. Content of specialized spatial land data:
a) Cadastre spatial data including: parcel data layer; parcel area data layer; parcel point data layer; immovable property attached to land data layer; safe protection construction project demarcation line data layer; safe protection construction project demarcation marker data layer; planning demarcation line data layer; planning demarcation marker data layer;
b) Land survey, evaluation, protection, improvement, and restoration spatial data including: group of land survey, evaluation, protection, improvement, and restoration data layers at socio-economic regions and nationwide; group of land survey, evaluation, protection, improvement, and restoration data layers at provincial level;
c) Land planning and utilization plan spatial data including: group of national land planning and utilization plan data layers; group of provincial land planning and utilization plan data layers; group of district land planning and utilization plan data layers;
d) Land value spatial data including: value area data layer; standard parcel data layer; specific parcel data layer;
đ) Land statistics and inventory spatial data including: group of national land statistics and inventory data layers; group of provincial land statistics and inventory data layers; group of district land statistics and inventory data layers; group of commune land statistics and inventory data layers;
e) Other related land data spatial data including: group of cadastral survey result data layers; parcel and immovable property attached to land address data layer; group of land value summary data layers.
Article 6. Content of attribute land data
The content of attribute land data includes data on: cadastre; land survey, evaluation, protection, improvement, and restoration; land planning and utilization; land value; land statistics and inventory; other related land data.
1. Cadastre attribute data including: group of parcel data; group of data on land managers, users, and owners of immovable property attached to land; group of immovable property attached to land data; group of land management rights, land use rights, and ownership rights of immovable property attached to land; group of legal status data on land management rights, land use rights, and ownership rights of immovable property attached to land; group of land and immovable property attached to land change data; group of cadastral file data; group of right restriction information data.
2. Land survey, evaluation, protection, improvement, and restoration attribute data including: group of land survey, evaluation, protection, improvement, and restoration data at socio-economic regions and nationwide; group of land survey, evaluation, protection, improvement, and restoration data at provincial level.
3. Land planning and utilization plan attribute data including: group of national land planning and utilization plan data; group of provincial land planning and utilization plan data; group of district land planning and utilization plan data.
4. Land value attribute data including: decision on land value data; land price list data; parcel value data; standard parcel data; specific parcel data.
5. Land statistics and inventory attribute data including: group of national and socio-economic region land statistics and inventory data; group of provincial land statistics and inventory data; group of district land statistics and inventory data; group of commune land statistics and inventory data; group of specialized land inventory data.
6. Attribute data of other related land data including: central land file data; group of cadastral survey result information data; parcel and immovable property attached to land address data; data on foreign organizations and individuals owning houses in Vietnam; data on revoked and canceled certificates; land value summary data.
Article 7. Content of Unstructured Land Data
The content of unstructured land data includes PDF files, text files, image files, graphic files, and other types of unstructured data such as: cadastral documents; investigation, evaluation, protection, improvement, and restoration of land documents; land planning and utilization plan documents; land price documents; land statistics and inventory documents; central land dossier documents.
Article 8. Content of Land Metadata
1. Land metadata includes information describing the data of the land data contents specified in Articles 5, 6, and 7 of this Circular.
2. Land metadata includes: a general group of land metadata information; a group of coordinate reference system description information; a group of land data description information; a group of land data quality description information; a group of land data sharing method description information.
3. Information describing the quality of land data is determined based on the documents and dossiers used to build the database and is updated when the data quality changes.
Article 9. Structure and Type of Information of the National Land Database
The structure and type of information of the data and documents of the national land database as stipulated in Articles 5, 6, 7, and 8 of this Circular are specified in Appendix I issued together with this Circular.
Article 10. Spatial and Temporal Reference Systems for National Land Data
1. National spatial reference systems and coordinate systems, national height reference systems for land spatial data shall be implemented according to the provisions of the National Spatial Reference System and National Coordinate System VN-2000.
a) For national-level spatial data using the conic equal-area projection grid with standard parallels at 11º and 21º, and the central meridian at 108º covering the entire territory of Vietnam;
b) For regional-level spatial data using the transverse cylindrical equal-area projection grid with a zone width of 6º, with a scale factor adjustment for length distortion k0 = 0.9996;
c) For remaining levels of spatial data using the transverse cylindrical equal-area projection grid with a zone width of 3º, with a scale factor adjustment for length distortion k0 = 0.9999, the central meridian of each province and centrally-administered city.
2. Temporal reference system: day, month, year according to the Gregorian calendar; hour, minute, second according to UTC + 07:00 (Coordinated Universal Time).
Article 11. Presentation and Display of the National Land Database
1. Attribute land data is presented and displayed according to the regulations of the land law regarding: cadastral matters; investigation, evaluation, protection, improvement, and restoration of land; land planning and utilization plans; land prices; land statistics and inventory.
2. Spatial land data is presented and displayed according to the provisions set out in Appendix II issued together with this Circular.
Article 12. Formats for Exchange and Sharing of Land Data and Land Metadata
1. Data format standards used for exchange and sharing of land data
a) For spatial land data, apply the GML or GeoJSON format language;
b) For attribute land data, apply the extended XML or JSON format language;
c) For unstructured land data, retain the original storage data format during data exchange.
2. Metadata format standards used for exchange and sharing of land metadata are applied according to the extended XML or JSON format language.
3. Land data and land metadata are exchanged and shared through data exchange services or storage devices in the form of data files.
4. The format for exchanging and sharing the national land database with national databases, departmental databases, and local databases is carried out according to the regulations of the law on management, connection, and sharing of digital data of state agencies.
5. The formats for exchange and sharing of land data and land metadata are detailed in Appendix III issued together with this Circular.
Chapter III
TECHNICAL REQUIREMENTS FOR APPLICATION SOFTWARE OF THE NATIONAL LAND INFORMATION SYSTEM
Article 13. General technical requirements for software
The application software of the National Land Information System must meet the following general technical requirements:
1. Comply with technical standards on the application of information technology in state agencies.
2. Be compatible with the National Digital Architecture Framework.
3. Meet the requirement for readiness with Internet Protocol version 6 (IPv6) inter-networking protocols. 6. Internet protocol version 6 (IPv6).
4. Meet the requirement for deployment on cloud computing.
Article 14. Requirements for technical solutions, scale of implementation, and performance of software
The application software of the National Land Information System must meet the following requirements for technical solutions, scale of implementation, and performance:
1. Requirements for technical solutions
a) Compatibility with information technology infrastructure;
b) Commitment and support from organizations providing application development and service platforms;
c) Meeting requirements for data access and distribution service solutions;
d) Meet the requirements for sharing and integration solutions.
2. Requirements for scale of implementation
a) Meeting deployment scale nationwide;
b) Meet the needs to serve different user groups in managing, operating, updating, and exploiting the national land database.
3. Performance requirements
a) Meeting processing time requirements;
b) Meeting simultaneous user access requirements to the system.
4. Detailed requirements for technical solutions, scale of implementation, and performance of software are specified in Appendix IV issued together with this Circular.
Article 15. Requirements for software functions
The application software of the National Land Information System must meet the following functional requirements:
1. Requirements for system management and database functions
a) Manage, monitor, issue accounts and grant permissions to user groups; back up and restore data; manage and statistically analyze system access situations and land information exploitation by users;
b) Manage and monitor connections, integration, and sharing of the national land database with other national databases and information systems;
c) Meet the requirements for designing the content and structure of the national land database;
d) Meet the requirements for exchanging and inheriting results from local land database construction.
2. Requirements for central-level land database management, operation, update, and exploitation functions
a) Meet the requirements for digitization and management of file circulation procedures according to land administrative procedures;
b) Meet the requirements for managing, operating, updating, and exploiting the central-level land database;
c) Meet the requirements for summarizing and reporting to support decision-making from the central-level land database.
3. Requirements for local land business functions
a) Meet the requirements for digitizing business processes and file circulation procedures according to land administrative procedures;
b) Meet the requirements for managing, operating, updating, and exploiting the local land database;
c) Meet the requirements for local land management business;
d) Meet the requirements for summarizing and reporting to support decision-making from the local land database;
đ) Meet the requirements for connecting, synchronizing, and integrating land data with the national land database;
4. Requirements for land data exchange and sharing functions
a) Meet the requirements for connecting and sharing land data with the National Public Service Portal, the Ministry of Natural Resources and Environment's Administrative Procedure Resolution Information System;
b) Meet the requirements for connecting and sharing land data with the provincial-level Administrative Procedure Resolution Information System;
c) Meet the requirements for connecting and sharing land data with tax authorities;
d) Meet the requirements for connecting and sharing land data with the national population database;
đ) Meet the requirements for connecting and sharing land data with the national legal document database;
e) Meet the requirements for connecting and sharing land data with the inspection and supervision database and the national database on citizen reception work, complaint resolution, and response handling;
g) Meet the requirements for connecting and sharing data when localities implement land administrative procedures in the national land database;
h) Meet the requirements for connecting and sharing land data with other national databases and databases of ministries and sectors.
5. Requirements for user support functions
a) Record user feedback and provide online assistance from the software;
b) Automatically update technical patches.
6. Detailed requirements for software functions are specified in Appendix V issued together with this Circular.
Article 16. Requirements for Information Security
1. The application software of the National Land Information System must meet information security requirements concerning: authentication; access control; system logging; application and source code security; communication security; and backup.
2. Detailed information security requirements are specified in Appendix VI attached hereto.
Chapter IV
IMPLEMENTING PROVISIONS
Article 17. Transitional Provisions
1. For land databases that have been established but do not comply with the content, structure, and type of information prescribed in this Circular, they must be reviewed, supplemented, and completed before December 31, 2025.
2. For local land database management, operation, update, and exploitation application software that does not meet the technical requirements stipulated in Article 13; point a, point c, and point d Clause 1 and Clause 3 Article 14; point a, point c Clause 1, Clause 3, point b, point c, and point d Clause 4 of this Circular, such software must be improved and upgraded before December 31, 2025.
Article 18. Effective Date
1. This Circular takes effect from August 1, 2024.
2. Circular No. 75/2015/TT-BTNMT dated December 28, 2015 of the Minister of Natural Resources and Environment on technical regulations for land databases shall cease to be effective from the date this Circular takes effect.
3. Circular No. 34/2014/TT-BTNMT dated June 30, 2014 of the Minister of Natural Resources and Environment on construction, management, and exploitation of land information systems is hereby abolished.
Article 19. Responsibility for implementation organization
1. The Land Registration and Land Information Data Center shall be responsible for inspecting the implementation of this Circular.
2. Provincial People's Committees and municipal people's committees directly under the central government shall be responsible for disseminating, directing, and implementing this Circular.
3. Departments of Natural Resources and Environment shall be responsible for implementing this Circular at the local level.
During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report to the Ministry of Natural Resources and Environment for consideration and decision.
