Circular No. 09/2026/TT-BCT promulgating National Technical Standard for Liquid Milk Products

CIRCULAR

Issuing National Technical Standards for Liquid Milk Products Based on the Law on Issuance of Normative Legal Documents No. 64/2025/QH15, amended and supplemented by the Law No. 87/2025/QH15;

Based on the Food Safety Law No. 55/2010/QH12;

Based on the Law Amending and Supplementing Certain Provisions of the Standards and Technical Regulations Law No. 70/2025/QH15;

Based on the Law Amending and Supplementing Certain Provisions of the Product Quality Law, Goods Law No. 78/2025/QH15;

Based on Decree No. 46/2026/NĐ-CP dated January 26, 2026 of the Government, detailing certain provisions and measures to organize and guide implementation of the Food Safety Law;

Based on Decision No. 09/2026/NQ-CP dated February 4, 2026 of the Government suspending the effectiveness and adjusting the application period of Decree No. 46/2026/NĐ-CP dated January 26, 2026 of the Government detailing certain provisions and measures to organize and guide implementation of the Food Safety Law and Decision No. 66.13/2026/NQ-CP dated January 27, 2026 of the Government on declaring and registering food products;

Based on Decree No. 22/2026/NĐ-CP dated January 16, 2026 of the Government detailing certain provisions and measures to organize and guide implementation of the Standards and Technical Regulations Law;

Based on Decree No. 37/2026/NĐ-CP dated January 23, 2026 of the Government detailing certain provisions and measures to organize and guide implementation of the Product Quality, Goods Law;

Based on Decision No. 309/QĐ-TTg dated February 23, 2026 of the Prime Minister approving the Strategy for the Development of the Dairy Industry up to 2030, Vision to 2045;Based on Decree No. 40/2025/NĐ-CP dated February 26, 2025 of the Government on functions, tasks, powers and organizational structure of the Ministry of Commercial Trade, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP;

In accordance with the request of the Director of the Bureau of Innovation, Green Transformation and Industrial Promotion;

The Minister of Commercial Trade issues this Circular to issue National Technical Standards for Liquid Milk Products.

Article 1.

Attached hereto is the National Technical Standard for Liquid Milk Products

Designation: QCVN 28:2026/BCT Article 2. Effective Date of Implementation.

This Circular shall come into force on September 1, 2026.

Article 3. Transitional Provisions

For liquid milk products that have been self-declared prior to the effective date of this Circular, organizations and individuals may continue production, sale, importation of such products until completion of registration of conformity declaration.

Organizations and individuals shall complete the registration of conformity declaration for liquid milk products within the time limit as per current regulations.

Article 4.

In case provisions cited in this Circular are amended or replaced by law, they shall be applied according to the new document.

Article 5. Implementation 1. The Director of the Industry Bureau is responsible for organizing, guiding, disseminating, publicizing, and implementing this Circular.

2. The Minister, Heads of Ministries at the same level, Heads of agencies under the Government, Chairmen of People's Committees of provinces and cities; Heads of units under and directly subordinate to the Ministry of Commercial Trade, and relevant organizations and individuals responsible for production, importation, sale, circulation, and export of liquid milk products shall be responsible for implementing this Circular.

3. In the course of implementation, if any difficulties or obstacles arise, organizations, institutions, and individuals are required to promptly report in writing to the Ministry of Commercial Trade (Industry Bureau) for guidance or further review and amendment as appropriate./.
