REGULATIONS
REGIME FOR CERTAIN OBJECTS OF STAFF ATTENDING STUDY
(Issued together with Decision No. 1269/1998/QĐ-UB dated May 6, 1998 of the Province People's Committee)
GENERAL PRINCIPLES
- Gradually standardize and improve the quality of the cadre contingent to meet the requirements of national industrialization and modernization. The Provincial Party Committee, People's Council, and People's Committee encourage study to enhance qualifications.
- Implement decentralization and diversification of resources for the training cause. Units benefiting from the budget at various levels and economic bases have the responsibility to pay training costs, while mobilizing contributions from individuals attending study.
- Budgets at various levels and economic bases allocate a certain amount of funds annually for training and include them in the budget from the beginning of the year.
PART I
OBJECTS ELIGIBLE FOR SUBSIDIES
Article 1: The objects eligible for subsidies are cadres holding elected positions at the provincial and district levels, state civil servants, and employees; cadres from party organizations, mass organizations, armed forces, and grassroots administrative bodies (communes, wards, towns) selected to attend study according to planning at the following institutions:
a - Courses for in-service training, retraining, and upgrading at:
- Ho Chi Minh National Political Academy, National Administration College, schools of mass organizations, and industry management schools organized by central-level party organizations, ministries, and agencies equivalent to ministries, and government agencies.
- Provincial and district political schools organized by the Provincial Party Committee, Provincial People's Committee, or authorized agencies.
b - Graduate courses and research student programs appointed by the Provincial Party Committee and Provincial People's Committee.
c - Graduate courses and research student programs appointed by agencies through consultation and agreement but must report and obtain approval from competent authorities.
d - Supplementary education courses for cadre planning at commune, ward, and town levels decided by the Provincial People's Committee and allocated annually to district educational centers.
Article 2: This regulation does not apply to cadres and staff voluntarily attending study to meet qualification standards. In cases where cadres and staff attend study voluntarily, they retain their full salary, time for study, and may receive additional financial support based on the capacity of their respective agencies...
Chapter II
SUBSIDY LEVEL AND PERIOD OF ELIGIBILITY FOR SUBSIDIES
Article 3: Cadres attending study under Article I, Chapter I are entitled to:
a - Full basic salary and allowances, and the original living allowance for commune, ward, and town cadres.
b - Training fees, medical fees, and accommodation rental fees (if applicable) paid according to school receipts. For supplementary education course participants as specified in Point d of Article I, only training fees are provided.
c - Subsidies for meal expenses:
- For short-term courses (from 1 to 3 months): If students reside in dormitories and the distance between their workplace and the study location exceeds 30 kilometers, they receive a daily subsidy of 3,000 VND per person.
- For long-term courses with a unified meal cost of 180,000 VND per person per month. Students must contribute up to 50% of their monthly salary towards meals. Any shortfall between 50% of the salary contribution and the prescribed meal cost is covered, and if the 50% salary contribution exceeds the meal cost, no additional payment is made.
- For university and intermediate political studies courses held at provincial and district political schools, students must cover their own meal expenses.
- Commune cadres attending centralized long-term and short-term training programs according to planning receive meal subsidies based on actual days of study: 6,000 VND per person per day at the provincial political school, and 3,000 VND per person per day at the district political school.
d - Travel expenses for round trips from the workplace to the study location (if over 30 kilometers) during the entire study period.
The items listed in Points a, b, c, and d are covered by the budget.
Article 4: For female cadres attending study:
In addition to the general subsidy provisions in Article 3, female cadres attending study also receive the following additional subsidies:
- Short-term study: 30,000 VND per month (for full months).
- Long-term study: 20,000 VND per month.
b - Travel expenses for female cadres with separate families:
- Short-term study: One round trip for one month of study.
- Long-term study: One round trip for each quarter of study, reimbursed according to bus tickets or train tickets.
c - Childcare expenses for female cadres attending study with children under 24 months old, reimbursed according to school receipts, or a monthly subsidy of 60,000 VND if not bringing the child along.
Article 5: During the concentrated study period, students do not receive travel allowances.
Article 6: The period of eligibility for subsidies is the concentrated study period at the school and the time spent on practical training as stipulated by the school.
Chapter III
REGIME FOR ISSUANCE, SETTLEMENT, AND REIMBURSEMENT OF EXPENSES
Article 7: For elected cadres (provincial and district level), state civil servants, and party cadres attending study:
- The subsidies as stipulated in Articles 3 and 4 are paid by the sending agency's budget and settled within that agency's budget.
Article 8: For commune, ward, and town cadres:
Subsidies for commune and ward cadres attending study at provincial or district political schools are paid by the provincial or district budget through the school.
For cadres of communes, wards, and towns attending cultural supplementary education programs funded by the provincial budget through the district-level permanent education centers.
Article 9: Regarding the training re-budgeting expenses: The Provincial Administration Committee shall develop a plan to submit to the People's Committee of the province for decision. The Department of Finance and Prices shall allocate funds for each specific class according to the decision of the People's Committee of the province.
Article 10: As for the undergraduate classes (political science, specialized subjects) trained according to the cadre planning decided by the Provincial Party Committee and the People's Committee of the province, the funding sources will be resolved as follows:
a- Training contract fees averaged per trainee according to the signed contract level, the unit with selected cadres attending the program shall pay. For communes, wards, and towns unable to cover costs for personnel, the higher-level budget shall provide direct support.
b- Learning materials expenses shall be paid by the unit sending cadres to study. Specifically, cadres from communes, wards, and towns must cover their own expenses.
c- All transportation, accommodation, meal, opening ceremony, closing ceremony, and mid-year review expenses during the academic year shall be covered by the provincial budget or the district budget (specifically stipulated in the document for opening the class).
Chapter IV
IMPLEMENTING PROVISIONS
Article 11: Those selected to attend training who drop out without valid reasons or transfer to another location without permission must reimburse the incurred tuition fees.
Article 12: During implementation, if there are any issues, departments, levels, and units shall report in writing to the People's Committee of the province for timely research, supplementation, or amendment./.
