RESOLUTION

Regular Meeting of the Government in July 1998

From July 29 to July 31, 1998, the Government held its regular meeting for July 1998 to discuss and adopt the following issues:

1. Regarding the Draft Law on Land (Amendment), the Government heard the presentation from the Director General of the Land Administration on the proposal to amend and supplement the Land Law of 1993. The Government affirmed that the Land Law of 1993 has had significant effects in enhancing land use efficiency, contributing to producing more products for society, improving people's living standards... However, there are still some issues not clearly defined in the Law, causing difficulties and hindrances to development under the new mechanism; some provisions are unclear, easily creating loopholes leading to negative consequences... Entering a new stage of development, some provisions of the Law need to be amended and supplemented to meet the requirements of social development, create a dynamic mechanism to further enhance land use efficiency, exploit potential land resources, contribute to promoting economic and social development, and leverage internal strength during the period of industrialization and modernization; while maintaining political stability and strengthening state management over land.

The Government agrees with the contents that need to be focused on amending and supplementing the Land Law including:

- Subjects eligible for land allocation and land lease;

- Rights and obligations of organizations, households, and individuals granted land by the State and leased land;

- Cultivation limits and issues related to land consolidation;

- Terms for land allocation and land lease;

- Authorities for land allocation, land lease, and issuance of land use right certificates;

- Issues related to land prices and public land funds;

- Issues concerning discipline and order in state management of land...

The Government instructs the Land Administration to coordinate with the Ministry of Justice, the Government Office, and relevant agencies to incorporate the opinions discussed and the results of the vote on the views of government members at this meeting, promptly complete the Draft Law, seek final approval from government members before submitting it for the Central Committee's opinion, submit it to the Standing Committee of the National Assembly in the first half of August 1998, and proceed with necessary follow-up actions to ensure submission of the Draft Law on Land (Amendment) to the National Assembly for approval at the October 1998 session.

2. Adoption of the Draft Law Amending and Supplementing Certain Provisions of the Law on Election of People's Council Deputies. The Government assigns the Government's Organization and Cadre Department to coordinate with the Ministry of Justice and the Government Office to study and incorporate the opinions discussed by government members at this meeting and the results of the vote on certain issues of the Draft Law, report to the Prime Minister before submitting it to the National Assembly.

3. Adoption of the main content of the Action Program of the Government to implement the Resolution of the Fifth Plenary Session of the Central Committee of the Communist Party of Vietnam (Eighth Term) on "Building and Developing a Modern and Distinctly National Vietnamese Culture," presented by the Minister of Culture and Information.

The Government determines that this Action Program needs to focus on several large projects of particular importance and inter-sectoral nature, requiring coordination in implementation among many agencies, aiming to bring about significant changes in the cultural field, education, ideological and moral values, and lifestyle. It is necessary to mobilize the participation of many agencies, scientists, and experts to quickly complete these projects, shorten the time compared to the original plan, and particularly emphasize the implementation phase.

The Government assigns the Ministry of Culture and Information to coordinate with the Government Office and relevant agencies to incorporate the opinions from this meeting, adjust the deadlines for some related projects to align with the 1998 Law and Decree Construction Program approved by the National Assembly, and the proposed Program of the National Assembly and the Standing Committee of the National Assembly for 1999 and the entire term of the Ninth National Assembly; complete the Program and have the Prime Minister sign and issue it in August 1998; simultaneously incorporate all issues mentioned in this Program into the Government's overall work program and urge project leaders and relevant agencies to implement according to schedule.

The Government requests Ministries, agencies equivalent to Ministries, and governmental agencies within their respective responsibilities to urgently develop action programs consistent with their functions and tasks to effectively implement the Central Resolution.

4. Regarding the Labor Export Project for the 1998-2010 period, presented by the Minister of Labor, Invalids, and Social Affairs:

The Government evaluates that labor export activities in recent times, although still having some limitations, especially in organizational management, have played a very important role in job creation, income generation, and skill enhancement for workers, foreign currency earning for the country, strengthening cooperation and consolidating international relations between our country and other countries, and contributing to reinforcing the Vietnamese community abroad. Labor export is an economic and social activity with inherent laws, which requires comprehensive summary to draw necessary lessons. For our country now, we need to intensify labor export, viewing it as both urgent and long-term strategy. The project must reflect a comprehensive set of solutions, particularly those regarding market and organizational management; specific policies, and issues related to legal aspects to protect the legitimate rights of workers...

The Government assigns the Ministry of Labor, Invalids, and Social Affairs to complete the project based on incorporating the opinions of government members and attendees, report to the Prime Minister, and submit it for the Central Committee's opinion. After receiving the Central Committee's opinion, the Ministry of Labor, Invalids, and Social Affairs will present the project to the Prime Minister for approval and issuance of a Decree on sending Vietnamese workers to work abroad for a limited period (replacing Decree No. 07/CP dated January 20, 1995 of the Government).

5. The Government heard the Minister of Planning and Investment's report on the main issues regarding the socio-economic situation in July and the first seven months of 1998.

In July 1998, the economy had not shown significant positive changes, particularly agriculture was severely affected by drought, the industrial growth rate was slow, and import and export growth was slower than the average for the first six months of the year. The Government requested that ministries, sectors, and localities urgently and strictly implement Resolution No. 08/1998/NQ-CP dated July 16, 1998 on measures to manage the plan for the last six months of 1998, effectively address difficulties, release production forces, tap potential for development, strive to achieve socio-economic targets adjusted, and prepare necessary conditions for building and implementing the 1999 plan.

6- The Government heard the State Auditor General's report on the situation of inspections, handling complaints and denunciations from citizens in the second quarter of 1998.

The Government affirms the need to enhance the effectiveness and efficiency of inspection work, while improving the post-inspection handling mechanism. All levels of government and heads of state agencies must take responsibility for resolving citizens' complaints and denunciations, settle pending cases thoroughly, and avoid situations where citizens have to file multiple complaints or escalate them beyond their level./.
