CIRCULAR

Guidelines for preparing environmental impact assessment reports for urban planning projects

 

Based on the Environmental Protection Law dated December 27, 1993;

Based on Decree No. 15/CP dated March 4, 1994 of the Government regarding the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Based on Decree No. 175/CP dated October 18, 1994 of the Government guiding the implementation of the Environmental Protection Law;

Based on Decree No. 91/CP dated August 17, 1994 of the Government promulgating the Urban Planning Management Regulations;

To strengthen environmental protection work and ensure sustainable development of cities and rural residential areas, the Ministry of Construction provides guidelines for preparing environmental impact assessment reports for urban planning projects as follows:

 

2. Individuals who have registered as the principal investigator of a Research Project or Pilot Production Project and those participating in its implementation shall not participate in the Evaluation and Selection Council for that Research Project or Pilot Production Project (hereinafter referred to as the Council). In necessary cases, members of the Council may be staff members of the organization registering as the principal investigator of the Research Project or Pilot Production Project, but not more than one person and they cannot serve as Chairperson, Vice-Chairperson, or reviewing member.

1. Purpose of preparing environmental impact assessment reports for urban planning projects

The environmental impact assessment report (hereinafter referred to as EIA) is a component of the content of urban planning projects. Preparing environmental impact assessment reports for urban planning projects aims at the following purposes:

1.1. To specifically implement Article 9 of Chapter 3 of Decree No. 175/CP dated October 18, 1994 of the Government, which stipulates that project investors and managers must conduct EIA when preparing overall development plans for regions, sectoral development plans, provincial and centrally-administered city development plans, urban planning, and residential area planning.

1.2. To analyze and assess the current state of the environment; forecast the demand for and exploitation of natural resources to serve the goal of developing urban and rural areas; predict pollutants and adverse impacts that may arise from activities planned in the urban planning project, thereby recommending improvements to design solutions and reasonable policies and measures to protect the environment, prevent or treat pollution, ensuring stable and sustainable development of cities and rural residential areas.

1.3. To establish a basis for construction management according to planning, monitoring and supervising the environment of cities and rural residential areas during renovation and development.

All urban planning projects including territorial planning, general and detailed urban planning, rural residential area planning, and specialized construction planning must prepare an EIA report.

For detailed land use planning projects for concentrated investment areas such as new urban areas, industrial zones, and other functional zones managed by a single investor assigned land by the State, only one EIA report needs to be prepared during the investment preparation phase.

3. Explanation of some terms

Environment: Natural factors and man-made material factors closely related to each other, surrounding humans, affecting their lives, production, existence, and development, as well as that of nature.

Baseline environment: The current state of the environment within the planning area and adjacent areas affected by activities planned in the construction planning.

Environmental components: Are the factors constituting the environment such as air, water, soil, sound, light, underground, mountains, forests, rivers, lakes, seas, living organisms, ecosystems, residential areas, production areas, natural conservation areas, natural landscapes, scenic spots, historical sites, and other material forms.Ecosystem:

A system of biological communities living together and developing in a specific environment, interacting with each other and with that environment. Environmental Impact Assessment (EIA):

Is a process of researching, recognizing, forecasting, and analyzing significant environmental impacts of a project to provide necessary information to improve decision-making quality. Screening:

(Screening) is a task that needs to be carried out at the initial stage of an EIA study to analyze the scale, scope, and degree of environmental impact of the project, thereby determining the necessity and extent of conducting an EIA.Scope of EIA:

Is the spatial limits, content, source, key issues to be studied in the EIA, and the process of environmental impact evolutionaccording to each planning phase. time Environmental incident:

Accidents or risks occurring during human activities or abnormal changes in nature, causing serious environmental degradation. Environmental degradation:

Changes in the quality and quantity of environmental components adversely affecting human life and nature. Pollutants:

Physical, chemical, biological substances, and others that make the environment harmful. Environmental pollution:

Altering the characteristics of the environment, violating national environmental protection standards. Environmental protection standards:

Norms and permissible limits set by competent state authorities as a basis for managing and protecting the environment. 4. Bases for preparing EIA reports

The bases for preparing EIA reports for urban planning projects include:

4.1. Urban planning projects established by organizations with legal personality;

4.2. Necessary information about the current state of the environment and relevant planning forecasts;

4.3. Technical standards and regulations issued by competent state authorities (see Appendix I);

4.4. Relevant state regulatory legal documents (Appendix II).

5. Procedure and methods for EIA

5.1. Main steps of EIA for urban planning projects include:

a. Screening to determine the necessity and extent of preparing an EIA report for the urban planning project.

b. Determining the scope of EIA

The scope of EIA for urban planning projects includes: spatial, temporal dimensions, and environmental components affected:

In terms of spatial dimension: The EIA scope can be determined based on the planning area and boundaries and adjacent territories directly affected by the impacts of activities planned in the construction planning;

In terms of time: It is determined according to the planning period.

Environmental components are linked to the spatial and temporal dimensions of EIA.

To determine the EIA scope, it is necessary to comprehensively study the impacts of construction planning activities and the potential affected areas with the intensity of impact, duration, and consequences.

c. Prepare an EIA report

The EIA report for urban planning projects shall be prepared in two steps:

Step 1: Prepare a preliminary EIA report, which is primarily developed during the stage of preparing the design assignment for urban planning mainly for regional construction planning, general urban planning of Class I and Class II cities, and other special cases deemed necessary, to serve as a basis for selecting optimal urban planning design options and forming a detailed EIA outline;

Step 2: Prepare a detailed EIA report, which is conducted during the urban planning design phase to submit to the competent state authority for approval.

d. Review and Approve the EIA Report

The review and approval of the EIA report for urban planning projects shall be carried out concurrently with the review and approval of the urban planning projects themselves.

e. Management and Monitoring Plan for EIA

The approved EIA report serves as the basis for developing management plans and monitoring programs to oversee environmental impacts during the implementation of urban planning, such as preparing lower-level urban planning projects, initiating investment preparation work for construction projects, and managing construction according to the plan.

5.2. Methods of EIA

The selection of EIA methods depends on specific conditions to ensure effectiveness in identifying impacts, investigating and monitoring impacts, evaluating and interpreting impacts, accurately selecting and concluding comprehensive impacts within the scope of the EIA.

Depending on specific conditions, the following EIA methods may be selected:

Listing method.

Matrix method.

Network method.

Environmental index method.

Benefit-cost analysis method.

Expert consultation simulation workshop method.

Geographic Information System (GIS) method.

Modeling method, etc.

6. Content of the EIA Report

The main contents of the EIA report include:

6.1. Investigation, monitoring, and evaluation of current environmental conditions;

6.2. Forecasting the impacts of urban planning on natural and social environments, including:

Identifying factors or sources causing environmental impacts and pollution;

Determining pollutants, intensity, and scale of impacts;

Identifying affected objects or environmental components, frequency of impact, and consequences (positive or negative, scope of influence...) and causes;

6.3. Recommendations for improving urban planning solutions and environmental protection measures;

6.4. Developing management, monitoring, and supervision plans for environmental impacts, ensuring sustainable development of cities and rural residential areas;

6.5. Preparing maps assessing current environmental conditions and forecasting environmental impacts of urban planning projects.

7. Responsibilities and Authority for Preparing, Reviewing, and Adjusting the EIA Report

7.1. Investors of urban planning projects must be responsible for organizing the preparation of the EIA report in either self-preparation (if they have legal personality) or by contracting consulting organizations capable of preparing EIA reports as stipulated by law;

7.2. State agencies responsible for reviewing, examining, approving, and adjusting urban planning projects are also responsible for reviewing, examining, approving, and adjusting EIA reports for those projects. When approving or adjusting EIA reports for urban planning projects, the opinions of the competent State management agency on environmental protection must be unified.

8. Legal Value of the EIA Report

The approved EIA report serves as a legal basis for managing the implementation of urban planning from an environmental perspective; monitoring environmental quality, implementing pollution reduction measures, and managing environmental impacts according to approved urban planning.

II. PREPARATION OF THE EIA REPORT FOR REGIONAL URBAN PLANNING SCHEMES

1. Objective

The EIA for regional urban planning schemes aims to:

1.1. Provide information on the current environmental status of the planned region; forecast and evaluate the impacts of activities proposed by the regional urban planning scheme, propose improvements to urban planning design solutions, policies, and environmental protection measures for the region;

1.2. Establish a basis or task for preparing EIA reports for general urban planning schemes, rural residential area planning schemes, specialized construction planning schemes, and investment construction projects within the region, develop management and monitoring plans for EIA during the planning management process.

2. Contents of the EIA Report for Regional Urban Planning Schemes

The contents of the EIA report for regional urban planning schemes include:

2.1. Introduction:

a. Reasons and necessity for preparing the EIA report;

b. Purpose of the EIA report;

c. Basis for preparing the EIA report;

d. Scope and limits of the EIA;

e. EIA methods.

2.2. Summary description of the content of the regional urban planning scheme.

a. For the preliminary EIA report preparation step, the summary description of the content of the design assignment for the regional urban planning scheme includes:

Scope and research boundaries of the regional urban planning scheme;

Timeframe for preparing the regional urban planning scheme;

General overview of natural conditions and current status of the region;

Economic and technical bases for the region;

Selected development directions for the region, including detailed explanations of spatial organization and infrastructure development plans (national and regional wide-scale infrastructure);

Initial planning tasks.

b. For the detailed EIA report preparation step, the summary description of the content of the regional urban planning scheme includes:

Scope and research boundaries of the regional construction planning;

Timeframe for preparing the regional urban planning scheme;

General overview of natural conditions and current status;

Content and scale of investment and development of economic and technical bases for the region;

Direction for spatial organization and infrastructure development at a wide scale (national and regional);

Staged investment development and initial planning content.

2.3. Evaluation of the current environmental status of the region.

a. Summary list of investigation and survey data and sources of information about the background environment;

b. Overview of the environment and ecosystems in the region; relationships between ecosystems and the environment including:

Main components of the human living environment;

Identify the characteristic ecosystems of the region, their distribution characteristics, and the necessary conditions for their existence and development.

c. Assess the current status of environmental pollution in the region.

Determine the main sources of environmental pollution such as: low-quality urban and residential areas (shantytowns); industrial zones, warehouses; service facilities (healthcare, food services, public amenities, sports and recreation, tourism, etc.), infrastructure engineering systems; waste disposal sites, cemeteries; agricultural production, mineral resource extraction, and the impacts of natural factors: air, climate, geology, radiation, flooding, etc.

Inspect and determine various types of pollutants (solid, liquid, gas, noise, radioactive, etc.) causing environmental pollution in the region including physical pollutants, chemical pollutants, biological pollutants, and aesthetic damage to the environment and landscape.

Evaluate the situation of environmental pollution and the main causes of pollution affecting the environment such as:

Air quality and noise;

Water quality;

Soil quality;

Greenery, landscapes, or natural conservation frameworks, historical and cultural relics, etc.

Assess the current status of regulatory frameworks and policies for managing and controlling the environment in the region.

2.4. Environmental impact assessment for the regional construction planning scheme.

a. Forecast the planning factors causing environmental impacts and the system of pollution sources including:

Urban and rural residential areas;

Industrial zones, warehouses;

Systems of public service centers and specialized centers;

Tourist, leisure, and entertainment zones;

Other special function zones;

Transportation systems, technical infrastructure projects, environmental sanitation facilities (wastewater treatment plants, landfills, cemeteries, etc.);

b. Forecast the types, quantities, properties, frequency, etc., of pollutants discharged from these sources (as per the planning scheme);

c. Assess the environmental impact on the regional planning scheme, specifying the types of pollutants generated by pollution sources affecting air quality, water quality, soil quality, cultural and historical environments, landscapes, and the conditions for the existence and development of characteristic ecosystems.

d. Recommendations and implementation organization:

Recommend adjustments, supplements, and improvements to the design solutions for the regional construction planning scheme;

Recommend measures, policies, and methods to protect and reduce environmental pollution;

Develop an action plan comprising management programs, monitoring, supervision of environmental impacts, and priority investment projects;

Recommend the regulatory framework and policy implementation for the regional EIA report.

3. Documentation for the EIA Report on the Regional Construction Planning Scheme

The documentation components of the EIA report on the regional construction planning scheme include:

3.1. Textual Part

a. Summary EIA Report;

b. Comprehensive EIA Report accompanied by scaled-down drawings as specified in Section 3.2 of this Circular and appendices with relevant legal documents.

3.2. Drawing Part (Color Documentation)

a. Scope and boundaries of the EIA area;

b. Current environmental condition assessment diagram of the region;

c. Comprehensive EIA assessment diagram and environmental protection measures.

Scale of drawings according to the regulations of the Ministry of Construction for the preparation and review of regional construction planning schemes.

III. PREPARATION OF THE EIA REPORT FOR THE COMPREHENSIVE URBAN PLANNING SCHEME.

1. Objective

The EIA for comprehensive urban planning schemes aims to:

1.1. Elaborate on the EIA report of the regional planning scheme (if applicable);

1.2. Provide information on the current urban and rural residential environmental conditions, forecast and assess the impacts of the comprehensive planning scheme; propose the completion of comprehensive planning design solutions, recommend environmental protection policies and measures;

1.3. Establish the basis or tasks for preparing the EIA report for detailed planning schemes, specialized construction planning schemes, and investment construction projects, develop management plans and programs to monitor environmental impacts during the construction management process according to the planning scheme.

2. Content of the EIA Report for the Comprehensive Planning Scheme

The content of the EIA report for the comprehensive urban and rural residential planning scheme includes:

2.1. Introduction

a. Reasons and necessity for preparing the EIA report;

b. Purpose of the EIA report;

c. Basis for preparing the EIA report;

d. Scope and limits of the EIA.

e. EIA methodology.

2.2. Summary description of the comprehensive planning scheme.

a. For the preliminary EIA report stage, simulate a summary of the comprehensive planning design task content including:

Scope and research limits of the comprehensive planning;

Timeframe for the comprehensive planning;

Overview of natural conditions and current urban or rural residential conditions;

Economic and technical bases for the formation and development of urban or rural residential areas;

Planning structure options for urban or rural residential construction regarding land selection, spatial organization, and development of technical infrastructure;

Initial planning tasks.

b. For the detailed EIA report stage, simulate a summary of the comprehensive planning content including:

Scope and research limits of the comprehensive planning;

Timeframe for the comprehensive planning;

General overview of natural conditions and current status;

Investment content and scale or economic and technical bases for the formation and development of urban or rural residential areas;

Spatial development orientation for urban or rural residential areas;

Development orientation for urban or rural residential technical infrastructure;

Staged investment development and initial planning construction stages.

2.3. Assessment of the current environmental conditions of urban or rural residential areas.

a. Summary of survey data, investigation results, and environmental background information sources;

b. Overview of the environment and characteristic ecosystems; relationships between ecosystems and the environment:

Main components of the human living environment;

Characteristic ecosystems, distribution characteristics, and necessary conditions for their existence and development.

c. Assessment of the current status of environmental pollution in urban or rural residential areas.

Determine the main sources of environmental pollution such as:

Low-quality residential areas, shantytowns;

Industrial zones, warehouses;

Service facilities like healthcare, food services, public amenities, tourism;

Technical infrastructure projects, environmental sanitation facilities (landfills, cemeteries);

Assess the situation of environmental pollution and the main causes of pollution to the environment such as:

Air quality and noise;

Water quality;

Soil quality;

Greenery, landscapes, vegetation cover, and natural protection frameworks, cultural historical relics...

Assess the current status of institutional frameworks, policies for managing and controlling urban or rural residential area environments.

2.4. Assess the environmental impact on the general planning project.

a. Forecast planning factors affecting the environment and the system of sources causing environmental pollution, including:

Residential areas.

Industrial zones, warehouses.

Systems of public service centers and specialized centers.

Green zones, tourism, rest and recreation areas.

Other special function zones.

Transportation systems and technical infrastructure facilities, environmental sanitation facilities (water treatment plants, garbage disposal sites, solid waste disposal sites, cemeteries, etc.).

b. Forecast types of waste, quantities, characteristics, features, distribution, frequency, etc., discharged from pollution sources.

c. Assess the environmental impact on the general planning project, clearly stating the types of waste generated by pollution sources affecting air quality, water quality, soil quality, cultural and historical environmental quality, landscapes, and conditions for the existence and development of characteristic ecosystems.

d. Recommendations and organization for implementation.

Recommend adjustments and improvements to urban and rural residential area construction planning design solutions.

Recommend environmental protection policies and measures to reduce pollution.

Develop an action plan comprising management programs, monitoring, supervision of environmental impacts, and priority investment projects;

Recommend institutional policy frameworks for implementing and monitoring EIA reports for general planning projects.

3. Environmental Impact Assessment Report Documentation for General Planning Projects.

3.1. Textual Part.

a. Summary EIA report.

b. Comprehensive EIA report with reduced drawings, appendices, and related legal documents.

For cities classified as Type I or higher, EIA reports can be written independently from the general planning explanatory notes, while for other cities and rural residential areas, EIA reports should be written as a chapter within the general planning explanatory notes, potentially omitting unnecessary content as directed in Section 2.2, Clause 2, Part III of this Circular.

3.2. Drawing Part (Color Documentation)

a. Diagram of the scope and boundaries of environmental impact assessment.

b. Current environmental condition map.

c. Comprehensive environmental impact assessment map and environmental protection measures.

Scale of drawings according to the Ministry of Construction's regulations for preparing and reviewing general planning projects.

IV. PREPARATION OF ENVIRONMENTAL IMPACT ASSESSMENT REPORTS FOR DETAIL PLANNING AND SPECIALIZED CONSTRUCTION PLANNING PROJECTS.

1. Objective

The purpose of EIA reports for detail planning and specialized construction planning projects is to:

1.1. Elaborate on the EIA report of regional construction planning schemes and general planning;

1.2. Provide information on the current state of the environment in the areas subject to detailed planning and specialized construction planning; forecast and assess the impacts of detailed planning; propose improvements to detailed planning design solutions; recommend environmental protection policies and measures;

1.3. Establish a basis for preparing EIA reports for investment construction projects, management plans, monitoring programs, and supervising environmental impacts during the implementation of construction management according to planning.

2. Content of EIA Reports for Detail Planning and Specialized Construction Planning Projects.

2.1. Introduction

a. Reasons and necessity for preparing the EIA report.

b. Purpose of the EIA report;

c. Basis for preparing the EIA report;

d. Scope and limits of the EIA;

e. EIA methods.

2.2. Brief description of the content of the detail planning or specialized construction planning project:

a. Scope and limits of the detail planning or specialized construction planning project;

b. Overview of natural conditions and current status of the research and design area for the detail planning or specialized construction planning project and directly related land areas;

c. Content and scale of investment, along with selected economic and technical indicators for the detail planning or specialized construction planning project;

d. Structure and composition of the detail planning or specialized construction planning project;

e. Planning for the network of technical and social infrastructure.

2.3. Assessment of the current environmental status within the scope of the detail planning or specialized construction planning project:

a. Summary of survey data, investigation results, and environmental background information sources;

b. Overview of environmental characteristics and distinctive ecosystems; relationships between distinctive ecosystems and the environment;

c. Assessment of the current pollution situation in the design area for the detail planning or specialized construction planning project:

Identify pollution sources in the area, including residential buildings, industrial facilities, services, infrastructure, and other natural factors;

Identify types and quantities of pollutants, distribution, and transmission factors;

Assess the pollution situation and causes of air pollution, noise pollution, water pollution, soil pollution, greenery, landscapes, historical and cultural relics;

d. Assessment of the current institutional framework for managing and controlling the environment in the design area.

2.4. Assessment of the environmental impact on the detail planning or specialized construction planning project:

a. Forecast environmental impacts from detailed planning factors and specialized construction planning factors, including names, scales, characteristics, and distribution patterns of planned construction projects;

b. Forecast types of waste, waste treatment, distribution characteristics, and frequency generated by pollution sources;

c. Assessment of the environmental impact on the detail planning or specialized construction planning project, clearly stating the types of waste generated by pollution sources and their effects on air quality, water quality, soil quality, and historical and cultural environmental quality.

d. Recommendations and implementation organization:

Recommend adjustments and improvements to detailed planning or specialized construction planning design solutions.

Recommend environmental protection policies and measures to reduce pollution.

Develop action plans including management programs, monitoring, supervision of environmental impacts, and priority investment projects.

Recommend institutional frameworks and policies for implementing and monitoring EIA reports.

3. Documentation for the Environmental Impact Assessment report for detailed planning schemes and specialized construction planning projects.

3.1. Textual Part

The EIA explanation may be prepared as a separate report or as a chapter of the detailed planning scheme's explanation along with reduced drawings, appendices, and related legal documents.

In cases where the EIA report is a chapter of the Explanation, unnecessary contents as directed in Section 2.2, Clause 2, Part IV of this Circular can be omitted.

3.2. Drawings section (color documentation)

a. Diagram of the scope and boundaries of the EIA;

b. Current environmental map;

c. Map assessing the comprehensive environmental impact and environmental protection measures;

The scale of the drawings shall comply with the regulations of the Ministry of Construction for the preparation and review of detailed planning schemes and specialized construction planning projects.

V. IMPLEMENTATION

1. Based on this Circular, the Chairperson of the People's Committee of provinces and centrally governed cities and Heads of relevant Ministries and sectors shall direct the preparation, examination, and implementation of the EIA report for construction planning projects under their jurisdiction according to the Government's decentralization.

2. Chief Architects of Hanoi and Ho Chi Minh City, Directors of Construction Departments shall cooperate with Science, Technology, and Environment Departments to organize the implementation and guide the preparation and examination of the EIA report for construction planning projects in their localities.

3. This Circular takes effect fifteen days from the date of signature. During the implementation process, if any issues arise, please send comments to the Ministry of Construction for research and resolution.

1. For natural conditions and flood situations, use Construction Standards, Volume 1 1996.

2. For soil environment, use the following standards and regulations:

Method for determining soil erosion levels due to rain: TCVN5929-1995.

Maximum allowable limit of pesticide residues in soil: TCVN5941-1995.

3. For water environment, use the following standards, regulations, and provisions:

Law on Water Resource Protection.

Surface water quality standard: TCVN5942-1995.

Coastal seawater quality standard: TCVN5943-19995.

Underground water quality standard: TCVN5944-1995.
