JOINT CIRCULAR
Guidelines for amending and supplementing certain points regarding the implementation of policies for volunteers who have completed their tasks during the resistance war.
Implementing the guidance opinion of the Prime Minister in Notification No. 177/TB-VPCP dated December 26, 2000, of the Government Office on policies for former volunteer youth who have completed their tasks during the resistance war;
After receiving comments from the Ministry of Finance in Circular No. 3746/TC-HCSN dated April 24, 2001;
The Ministry of Labor - Invalids and Social Affairs and the Central Committee of the Ho Chi Minh Communist Youth Union issue guidelines for amending and supplementing certain points regarding the implementation of policies for volunteers who have completed their tasks during the resistance war as stipulated in Joint Circular No. 16/1999/TTLT-BLDTBXH-TWĐTNCSHCM dated July 6, 1999, as follows:
1. Objectives:
Volunteer youth concentrated as specified in Section 1 Part I of Joint Circular No. 16/1999/TTLT-BLDTBXH-TWĐTNCSHCM includes volunteer youth performing tasks to overcome the consequences of war, building socialism in the North during the period of 1955-1964.
Military service personnel falling under the categories specified in Article 1 of this Circular may extend their age for active service if they meet all of the following conditions:
Volunteer youth entitled to receive a one-time allowance as specifically provided in paragraph 2 point 2.2 Section 2 Part I of Joint Circular No. 16/1999/TTLT-BLDTBXH-TWĐTNCSHCM: "People suffering from prolonged illness, unable to work, whose families belong to the poverty reduction households in the locality shall be entitled to receive a one-time allowance of VND 1,500,000/person (one million five hundred thousand dong) guaranteed by the central budget" shall be amended and supplemented as follows:
- People with a place to rely on encountering any of the following circumstances shall be entitled to receive a one-time allowance of VND 1,500,000/person (one million five hundred thousand dong) guaranteed by the central budget:
+ People suffering from prolonged illness;
+ People unable to work;
+ People belonging to poor households (according to the poverty standard prescribed in Decision No. 1143/2000/QĐ-LĐTBXH dated November 1, 2000, of the Minister of Labor - Invalids and Social Affairs).
3. War invalid file:
War invalids' dossier as specified in point 3.2 Section 3 Part II of Joint Circular No. 16/1999/TTLT-BLDTBXH-TWĐTNCSHCM shall be amended and supplemented as follows:
3.2. The basis for issuing a certificate of injury is one of the old documents related to the injury such as transfer injury form, hospital transfer form, medical record, discharge certificate, health status form, old resume... If the injured person no longer has these old documents, they must have two people from the same unit (squad, detachment, team, battalion) who are familiar with the injury case certify it, the witnesses must be those who have been awarded the Commemorative Medal of Volunteer Youth by the Central Committee of the Ho Chi Minh Communist Youth Union and confirmed by the head of the agency or unit or the People's Committee of the commune, ward based on the resume and dossier.
4. Dossier for recognition as a martyr:
Martyrs' dossier as specified in point 2.1 Section 2 Part III of Joint Circular No. 16/1999/TTLT-BLDTBXH-TWĐTNCSHCM shall be amended and supplemented as follows:
2.1. Application for discovery and proposal by the family, accompanied by certification from two people from the same unit (squad, detachment, team, battalion) who are familiar with the death case, the witnesses must be those who have been awarded the Commemorative Medal of Volunteer Youth by the Central Committee of the Ho Chi Minh Communist Youth Union and confirmed by the head of the agency or unit or the People's Committee of the commune, ward with signature and time together with the deceased (if applicable).
5. Responsibility for implementing allowances for volunteer youth:
The responsibility of the Department of Labor - Invalids and Social Affairs as specified in Section 3 Part IV of Joint Circular No. 16/1999/TTLT-BLDTBXH-TWĐTNCSHCM shall be amended and supplemented as follows:
3. The Department of Labor - Invalids and Social Affairs receives dossiers handed over by the provincial or municipal Youth Union, reviews and registers for management of the list; organizes the payment of monthly allowances according to the Decision of the Provincial People's Committee. For one-time allowances, the Department prepares five copies of the summary report sent to the Ministry of Labor - Invalids and Social Affairs (three copies) along with a letter to coordinate with the Ministry of Finance for allocation of funds.
Based on the allocated budget, the Department of Labor - Invalids and Social Affairs organizes the payment of one-time allowances and settlement in accordance with the current accounting regulations.
6. Organization of implementation:
This Circular Joint shall take effect fifteen days after its date of issuance.
All previous provisions contrary to the provisions of this Circular are abolished.
During the implementation process, if there are difficulties, please reflect them to the Ministry of Labor - Invalids and Social Affairs and the Central Committee of the Ho Chi Minh Communist Youth Union for guidance on resolution.
