DIRECTIVE OF THE MINISTER OF AQUATIC RESOURCES
On Preventing Bottom Trawling and Illegal Fishing Activities
In coastal and nearshore waters
In recent times, the bottom trawl netting industry with large wing nets, wide and high mouth openings, using large engine-powered vessels (referred to as bottom trawlers by fishermen) has developed in many localities. Fishermen engaged in bottom trawling have violated laws for short-term gains, operating their vessels in nearshore and coastal waters and prohibited areas, severely impacting coastal aquatic resources, the reproduction and growth of marine species, affecting poor fishermen engaged in traditional crafts, and causing discord among fishing communities.
To prevent bottom trawling and other illegal fishing activities in nearshore and coastal waters; the Minister of Aquatic Resources directs the Departments, Bureaus, and units under the Ministry, Fisheries Departments, Departments of Agriculture and Rural Development responsible for fisheries management (hereinafter referred to collectively as Fisheries Departments), and Fisheries Resource Protection Agencies to implement the following matters effectively:
1. For Fisheries Departments:
a) Direct the Fisheries Resource Protection Agency to strengthen inspection and control efforts, strictly penalizing according to the law fishing vessels, particularly bottom trawlers and other illegal fishing operations in coastal and nearshore waters and prohibited areas, using mesh sizes smaller than those prescribed by law in the fish-holding compartments.
b) Enhance education and awareness campaigns for fishermen regarding the Fisheries Law, legal provisions on prohibited fishing zones for various types of vessels and fishing methods, prohibited fishing areas, prohibited fish species, and permissible mesh sizes in fish-holding compartments to avoid violating legal regulations.
c) Advise the Provincial People's Committees to issue directives to prevent bottom trawling from operating illegally in coastal and nearshore waters and other illegal fishing practices. Investigate and understand the bottom trawl netting industry within the province and prohibit fishermen from expanding bottom trawling operations.
2. For Departments, Bureaus, and units under the Ministry of Aquatic Resources:
a) Assign the Department of Fisheries Resource Exploitation and Protection to lead coordination with the Legal Affairs Bureau, the Inspectorate of the Ministry, and Fisheries Departments, and Fisheries Resource Protection Agencies to manage the activities of bottom trawlers and other fishing operations in coastal and nearshore waters; promptly prevent violations of legal prohibitions on activity zones, prohibited areas, prohibited targets, and permissible mesh sizes.
b) Assign the Department of Fisheries Resource Exploitation and Protection to lead coordination with the Institute of Marine Products Research, the Institute of Fisheries Economic Planning, and localities to develop survey, evaluation, and research programs for appropriate bottom trawl netting development nationwide: determine the number of bottom trawl vessels for each region and province to develop a suitable fleet that does not impact aquatic resources, ensuring sustainable exploitation of aquatic resources and providing nutrition for current and future generations.
The Minister of Aquatic Resources requests the Directors of Fisheries Departments, Chiefs of Fisheries Resource Protection Agencies, Heads of Departments, Bureaus, and heads of subordinate agencies under the Ministry to strictly implement this Directive based on their functions and responsibilities./.
