DECISION OF THE MINISTER OF INDUSTRY

Regarding the issuance of the Commemorative Medal "For the Cause of Developing Vietnam's Industry"and the Regulation on Awarding the Commemorative Medal.

THE MINISTER OF INDUSTRY

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to the Law on Encouragement and Reward dated November 26, 2003;

At the proposal of the Ministry of Industry’s Council for Encouragement and Reward,

DECISION:

Article 1. The Commemorative Medal "For the Cause of Developing Vietnam's Industry" and the Regulation on Awarding the Commemorative Medal are hereby issued.

Article 2. Departments of Industry, State-owned Enterprises within the industry sector, and subordinate agencies and enterprises shall base on the contents, criteria, and objects of reward stipulated in the Regulation to disseminate, select, and propose to the Ministry of Industry for awarding the Industry Commemorative Medal.

Article 3. This Decision replaces Decision No. 28/1999/QĐ-BCN dated June 1, 1999 of the Minister of Industry regarding the issuance of the Medal "For the Cause of Developing Vietnam's Industry" and the Regulation on Awarding the Medal, and it shall take effect 15 days from the date of publication in the Official Gazette.

The Head of the Ministry’s Office, the Standing Members of the Ministry’s Council for Encouragement and Reward, and the Heads of agencies and enterprises under the Industry Sector are responsible for implementing this Decision.

REGULATIONS

Awarding the Commemorative Medal "For the Development of Vietnam's Industry"

(Issued together with Decision No. 10/2005/QĐ-BCN dated March 14, 2005)of the Minister of Industry)

PART I

GENERAL PROVISIONS

Article 1. The Commemorative Medal "For the Cause of Developing Vietnam's Industry" (hereinafter referred to as the Industry Commemorative Medal) is a form of recognition by the Ministry of Industry of the contributions of individuals who have made significant positive contributions to the cause of building and developing Vietnam's Industry Sector.

Article 2. The Industry Commemorative Medal has content, shape, size, and color that reflect the characteristics of the Industry Sector and comply with general state regulations.

Article 3. The Industry Commemorative Medal is awarded once per individual according to the provisions of Chapter II of this Regulation.

Individuals who have been awarded the Medal "For the Cause of Developing Vietnam's Industry" pursuant to Decision No. 28/1999/QĐ-BCN dated June 1, 1999 of the Minister of Industry shall not be eligible for the Industry Commemorative Medal under this Regulation.

Chapter II

OBJECTS AND CRITERIAAWARDING THE INDUSTRY COMMENDATION MEDAL

Article 4. Objects eligible for the Industry Commendation Medal

1. Cadres, workers, and civil servants who are currently or have previously worked in production, service, or activities directly related to Vietnam's Industry Sector.

2. Political figures, social activists, scientists, and technologists outside the Industry Sector but who have made significant and effective contributions to the development of Vietnam's Industry Sector.

3. Vietnamese citizens, overseas Vietnamese, and foreigners who have made outstanding contributions or provided effective support to the development of Vietnam's Industry Sector.

4. Other specific cases decided by the Minister of Industry based on proposals from units, organizations, or individuals.

Article 5. Criteria for awarding the Industry Commendation Medal to cadres, workers, and civil servants in the Industry Sector

1. Cadres, workers, and civil servants in the Industry Sector (including central and local industries) who are currently working or have transferred to other sectors, retired, or resigned, must have at least 20 years of service for men, 15 years for women, and 10 years for those directly engaged in hazardous or dangerous occupations.

2. For cadres, workers, and civil servants in the Industry Sector who have achieved three national-level or sector-level scientific research projects or five creative labor certificates applied in production, the required service period is 15 years for men and 10 years for women.

3. The following cases are not counted towards the service period when awarding the medal:

a) Leaders of the Ministry of Industry;

b) National Labor Heroes and Industry Sector Model Workers;

c) Scientists, academicians, professors, teachers, and medical professionals who have received titles from Excellent Teacher or Excellent Doctor upwards, and cadres, workers, and civil servants who have been honored with State awards such as the Labor Order and above during their time in the Industry Sector;

d) Cadres, workers, and civil servants in the Industry Sector who heroically sacrificed their lives while performing duties for the Industry Sector or their respective units and were recognized as martyrs.

Article 6. Criteria for awarding the Industry Commendation Medal to individuals outside the Industry Sector

1. Individuals who have invented patents, national-level scientific works applied in industrial production, recognized by relevant agencies and the Ministry of Industry as contributing to the development of Vietnam's Industry Sector.

2. Leaders of various sectors, localities, mass organizations, and people's associations (at central and local levels) who have made significant contributions to the construction and development of Vietnam's Industry Sector.

3. Political, social, cultural activists directly related to the Industry Sector (at central and local levels) through specific activities or works proposed by enterprises or agencies within the Industry Sector to the Ministry of Industry.

4. Large business leaders operating domestically or abroad, and overseas Vietnamese who have made significant material and spiritual contributions to the development of Vietnam's Industry Sector.

5. In special cases, high-ranking Party and State officials, prominent intellectuals both domestically and internationally will be awarded the Commemorative Medal by decision of the Minister of Industry.

Article 7. Cases ineligible for the Industry Commendation Medal

1. Individuals in the Industry Sector who have been sentenced to imprisonment or have voluntarily left their positions at the time of award consideration are not eligible for the award.

2. Individuals who have been disciplined with a warning or higher penalty by their unit or superior unit shall not have the disciplinary period counted towards the eligibility period for the award.

Chapter III

RIGHTS OF INDIVIDUALS AWARDED THE INDUSTRY COMMENDATION MEDAL AND IMPLEMENTATIONThe individual awarded the Commemorative Medal "For the Cause of Developing Vietnam's Industry" shall receive the Commemorative Medal, a certificate of the Commemorative Medal, and be recorded in the Golden Book of Honor of the Ministry of Industry.

Article 8. The individual awarded the Commemorative Medal "For the Cause of Developing Vietnam's Industry" shall receive the Commemorative Medal, a certificate of the Commemorative Medal, and be recorded in the Golden Book of Honor of the Ministry of Industry.

The person awarded the Industrial Commemorative Medal shall be presented with a tangible award or monetary reward from the fund for commendation or welfare fund by the agency or enterprise (where the application was submitted).

Article 9. The Office of the Ministry of Industry is responsible for organizing the production, storage, preservation of the Industrial Commemorative Medal, certificates; the Golden Honor Book, and implementing the issuance according to the Decision of the Minister of Industry.

Chapter IV

PROCEDURE FOR CONSIDERING THE AWARDING OF THE INDUSTRIAL COMMENDATION MEDAL

Article 10. The heads of central ministries' agencies, provincial and centrally-administered city industry departments, industrial corporations, companies, institutes, schools, bureaus, centers, newspapers, magazines, and enterprises under the Ministry (referred to collectively in this document as agencies and enterprises within the industry sector) are responsible for disseminating and guiding the content of standards and eligible recipients for the awarding of the Industrial Commemorative Medal to all cadres, workers, and civil servants under their management.

Article 11. Based on the content of this Regulation, the Commendation and Award Councils at all levels will review individuals who meet the criteria (based on personal history files and social insurance record files of each individual in the unit), compile a list of those proposed for the awarding of the Industrial Commemorative Medal, and report to their immediate superiors. This list includes both current employees and former employees who have retired, left service, or transferred out of the industry sector.

The Commendation and Award Councils of agencies and enterprises are responsible for reviewing each individual proposed by subordinate units, compiling a list of approved candidates, and submitting it to the Ministry for decision.

Article 12. The consideration for awarding the Industrial Commemorative Medal to individuals outside the industry sector shall be proposed and reported by the central ministry's agencies and provincial and centrally-administered city industry departments to the Ministry for decision.

Article 13. The dossier for considering the awarding of the Industrial Commemorative Medal includes:

1. A proposal for commendation.

2. A list and summary of achievements (according to the attached model) of individuals proposed for the awarding of the Industrial Commemorative Medal.

Article 14. The Standing Committee of the Commendation and Award Council of the Ministry is responsible for receiving commendation dossiers for the Industrial Commemorative Medal from agencies and enterprises within the industry sector, consolidating them, comparing them with the standards set forth in this Regulation before submitting to the Minister for decision.

Article 15. The Industrial Commemorative Medal shall be presented directly by the Minister or delegated to the leadership of the provincial industry departments, agencies, and enterprises within the industry sector.

Article 16. The consideration for awarding the Industrial Commemorative Medal is conducted twice a year on May 1st and September 2nd annually.

Chapter V

IMPLEMENTING PROVISIONS

Article 17. Any amendments or supplements to this Regulation shall be proposed by the Standing Committee of the Commendation and Award Council of the Ministry for the Minister of Industry to consider and decide./.
