Regarding the awarding of the Vietnam Golden Rice Ear Award

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
The Ministry of Agriculture and Rural Development hereby stipulates the procedures for awarding the Vietnam Golden Rice Ear Award.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular prescribes the procedures, processes, and formalities for the examination and awarding of the Vietnam Golden Rice Ear Award.
Article 2. Applicability
This Circular applies to groups, individuals with products participating in the Vietnam Golden Rice Ear Award and agencies, organizations, and individuals related to the activities of examining and awarding the Vietnam Golden Rice Ear Award.
Article 3. Principles for conferring titles
1. The Vietnam Golden Rice Ear Award is the sole award of the Ministry of Agriculture and Rural Development granted to groups and individuals whose products meet the conditions and examination procedures prescribed in Chapter II of this Circular.
2. Products include:
a) High-quality agricultural goods with reputable brands;
b) Inventions, innovations, scientific research works, and technological development projects applied in agricultural production contributing positively to the industrialization and modernization of agriculture and rural areas in Vietnam.
3. The Vietnam Golden Rice Ear Award is awarded every two years.
4. The awarding process must be carried out in accordance with the specified objects, conditions, and procedures set forth in this Circular; ensuring transparency, democracy, and objectivity.
5. Products receiving an average score of at least 70 points from the Examination Council of the Ministry are eligible for the award (according to the criteria specified in Appendix 6 of this Circular).
6. Products that have already received the Vietnam Golden Rice Ear Award are not eligible to participate in subsequent evaluations.
Article 4. Number and Structure of Awards
Each time the Vietnam Golden Rice Ear Award is awarded, no more than 100 winning products will be selected, structured into three categories as follows:
1. Category of inventions, innovations, useful solutions; scientific research and technological development projects: Not exceeding 40 awards.
2. Category of crop and livestock seeds, agricultural technical materials, machinery and equipment, handicraft products: Not exceeding 40 awards.
3. Category of reputable brand products: Not exceeding 20 awards.
Chapter II
ARTICLE ON CONDITIONS AND PROCEDURES FOR AWARDING THE AWARD
Article 5. Conditions for Awarding
The Vietnam Golden Rice Ear Award is presented to groups and individuals within and outside the Agricultural and Rural Development sector, foreigners working in Vietnam who have one of the products specified in Clause 2, Article 3 of this Circular.
The award is given to groups or individuals who are authors or co-authors of the products specified in Clause 2, Article 3 of this Circular and must be confirmed by the competent authority (specific criteria for each product category are defined in Appendix 6 of this Circular):
a) Inventions, innovations, useful solutions: Issued a certificate by the Intellectual Property Office;
b) Scientific research and technological development results: Approved by the competent Science and Technology Council at a good level or higher and applied on a large scale for at least three years, confirmed by at least one Provincial Department of Agriculture and Rural Development;
c) Crop and livestock seeds, agricultural technical materials, machinery and equipment, handicraft products: Applied widely in production and circulation for at least three years, confirmed by the competent provincial authority;
d) Reputable brand products: Confirmed by the Provincial Department of Agriculture and Rural Development or the competent provincial authority.
3. There should be no disputes over copyright, no complaints or appeals regarding the productivity and quality of the products, and no negative impact on human health or the environment.
4. Full documentation proving that these products belong to the author or co-author must be provided.
5. Other files and procedures must comply with the guidelines and requirements set forth in Article 9 of this Circular; the application for the award must be sent to the Ministry within the prescribed time as evidenced by the postmark.
6. Products of groups and individuals currently under disciplinary measures are not eligible to participate in the award evaluation.
Article 6. Award Examination Process
The award examination process is organized through two levels: the grassroots level and the Ministry level:
1. Grassroots-level Award Examination Board: Established and organized by the heads of agencies and units under the Ministry, the General Directors of Economic Groups, the General Director of Total Company 91, the Directors of Provincial Departments of Agriculture and Rural Development, and the Chairpersons of Associations (operating in fields managed by the Ministry of Agriculture and Rural Development) to select before preparing reports for submission to the Ministry-level Award Examination Board as stipulated in Article 9 of this Circular.
2. Ministry-level Award Examination Board: Established by the Minister of Agriculture and Rural Development. The Ministry-level Award Examination Board only convenes to examine products submitted by the grassroots-level Award Examination Board.
Article 7. Ministry-level Award Examination Board
1. Members of the Ministry-level Award Examination Board include:
a) Chairman of the Board: Deputy Minister, First Vice-Chairman of the Ministry's Competition and Reward Council;
b) Vice-Chairman of the Board: Head of the Cadre and Civil Servant Organization Department, Permanent Vice-Chairman of the Ministry's Competition and Reward Council;
c) Leader of the Fisheries General Administration: Member of the Board;
d) Leader of the Water Resources General Administration: Member of the Board;
đ) Leader of the Forestry General Administration: Member of the Board;
e) Leader of the Processing and Marketing Department of Agricultural, Forestry, Fishery Products and Salt Industry: Member of the Board;
g) Leader of the Science, Technology and Environment Department: Member of the Board;
h) Leader of the Quality Management Department of Agricultural and Forestry Products and Fisheries: Member of the Board;
i) Leader of the Crop Production Department: Member of the Board;
k) Leader of the Livestock Breeding Department: Member of the Board;
l) Leader of the Animal Health Department: Member of the Board;
m) Leader of the Plant Protection Department: Member of the Board;
n) Leader of the National Agricultural Extension Center: Member of the Board;
o) Leader of the Ministry Inspectorate: Member of the Board;
ô) Leader of the Vietnam Agricultural and Rural Development Trade Union: Member of the Board;
ơ) Deputy Head of the Cadre and Civil Servant Organization Department, responsible for competition and reward work: Member of the Board;
p) Head of the Competition, Reward and Discipline Section, Cadre and Civil Servant Organization Department: Secretary of the Board.
During the sessions of the Award Examination Board, experts and scientists may be invited at the discretion of the session chairperson.
2. Functions of the Board:
The Award Examination Board advises the Minister of Agriculture and Rural Development on selecting products that have won the Golden Rice Ear Award each time it is organized.
3. Responsibilities of the Board:
a) The Award Examination Board operates based on the principle of scoring and voting by Board members (as specified in Appendix 6 of this Circular);
b) The Award Examination Board recognizes outstanding products contributing to the development of the industry and the industrialization and modernization of agriculture and rural areas in Vietnam;
c) The Award Examination Board must submit a report to the Minister, accompanied by a summary table and minutes for the Minister of Agriculture and Rural Development to consider and decide before the award ceremony;
d) In necessary cases, the Ministry-level Award Examination Board is responsible for inspecting and evaluating the actual effectiveness of products from collectives and individuals nominated for the award at localities and bases.
Article 8. Activities of the Grassroots-level and Ministry-level Award Examination Boards
1. The grassroots-level and Ministry-level Award Examination Boards operate based on the principle of democracy, scoring and voting by Board members during Board meetings (as specified in Appendix 6 of this Circular).
2. Sessions of the grassroots-level and Ministry-level Award Examination Boards are considered valid when two-thirds of the Board members are present. The average score of the Board members is valid when two-thirds of the Board members participate in scoring; if there are two or more products with equal scores and fewer winners are selected, the final decision rests with the Chairman of the Board. The minimum scoring scale is 1.0.
Article 9. Documents and time for award consideration
1. Documents submitted by groups and individuals to the grassroots Council:
a) The documents consist of three sets, enclosed in hard cover envelopes (dimensions 30x25cm), including contents from Section 3 to Section 9 as prescribed in Appendix 5 of this Circular;
b) The deadline for receiving documents is no later than January 31 of the year in which the award is organized and presented.
2. Documents submitted by the grassroots Council to the Ministry:
a) The documents consist of two sets, enclosed in hard cover envelopes (dimensions 30x25cm), including contents as prescribed in Appendix 5 of this Circular;
b) The deadline for receiving documents is no later than May 31 of the year in which the award is organized and presented;
c) Place to receive documents:
Department of Organization and Cadres, Ministry of Agriculture and Rural Development.
Chapter III
ORGANIZATION OF AWARDING AND FUNDS
Article 10. Organization of Awarding
1. The ceremony for presenting the Golden Rice Ear Award of Vietnam is held every two years in Hanoi or at a location on the occasion of commemorating the founding day of the Ministry of Agriculture and Rural Development (November 14).
2. The award presentation ceremony must be organized solemnly to honor groups and individuals, leaving a good impression on attendees and society.
3. The award will be widely publicized through mass media.
Article 11. Funds
The funds for organizing the award presentation ceremony, accompanying the award, and for promotional activities, award consideration, and regular operations of the Ministry-level award granting Council shall come from the following sources:
1. Annual trade promotion funds of the Ministry of Agriculture and Rural Development.
2. Financial contributions from enterprises, groups, and individuals both domestically and internationally.
Article 12. Benefits for individuals and groups awarded the prize
1. Receiving the Award Emblem, Certificate of Award, and Commendation from the Minister of Agriculture and Rural Development.
2. They shall be awarded money or tangible items according to current regulations.
3. Their product images shall be promoted and advertised on mass media.
4. Right to exploit and use the award emblem for three years, starting from the date of receiving the award.
5. Products that have been awarded the Golden Rice Ear Award of Vietnam will be exhibited for three years from the date of being awarded the prize by the Ministry of Agriculture and Rural Development at a designated area during fairs and exhibitions organized and co-organized by the Ministry of Agriculture and Rural Development.
Chapter IV
IMPLEMENTATION
Article 13. Implementation Organization
1. The Ministry of Agriculture and Rural Development registers the Golden Rice Ear Award of Vietnam with the Central Steering Committee for Competitions and Awards.
2. The Department of Organization and Cadres is the permanent agency organizing the Golden Rice Ear Award of Vietnam.
Relevant agencies and units: Directly affiliated General Departments of the Ministry, the Ministry's Office, the Finance Department, the Planning Department, the Processing and Marketing Department of Forestry, Aquaculture and Salt Industry, the Science and Technology Department and Environment, the Quality Management Department of Forestry and Aquaculture and Fisheries, and related units shall base their functions and tasks to closely coordinate with the Department of Organization and Cadres to regularly organize the Golden Rice Ear Award of Vietnam to achieve high quality and results.
Chapter V
IMPLEMENTING PROVISIONS
Article 14. Implementation clause
1. This Circular replaces the Regulations on awarding prizes issued previously by the Minister of Agriculture and Rural Development, including: the Golden Rice Ear Award of Vietnam pursuant to Decision No. 42/2004/QĐ-BNN dated September 1, 2004; the Cup Award for High-Quality and Trustworthy Agricultural, Forestry, and Fishery Products pursuant to Decision No. 1895/QĐ-BNN-CB dated June 24, 2008; the Golden Agriculture Cup Award pursuant to Decision No. 1846/QĐ-BNN-VP dated June 23, 2006; and the Handicraft Product Competition Award of Vietnam pursuant to Decision No. 2776/QĐ-BNN-CB dated September 25, 2007.
2. Heads of directly affiliated agencies and units of the Ministry, General Directors of the Vietnam Rubber Industry Group and the General Company 91, Directors of Provincial Departments of Agriculture and Rural Development, Chairpersons of Associations are responsible for disseminating and guiding the content and criteria for awarding the Golden Rice Ear Award of Vietnam to all personnel within their units to implement this Circular.
3. This Circular takes effect 45 days from the date of issuance./.
