PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Entry into, Exit from, and Residence of Foreigners in Vietnam dated April 28, 2000;

Pursuant to Resolution No. 61/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Public Security;

Pursuant to Resolution No. 50/NQ-CP dated December 10, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Foreign Affairs;

Considering the proposals of the Minister of Public Security and the Minister of Foreign Affairs,

DECISION:

Article 1. Amending and supplementing certain provisions of the Regulation on visa exemption for overseas Vietnamese citizens issued pursuant to Decision No. 135/2007/QĐ-TTg dated August 17, 2007 of the Government Prime Minister as follows:

1. Amending and supplementing Clause 4 of Article 3 as follows:

"The competent authority shall issue the visa-exemption certificate within five working days from the date of receiving complete and valid application files."

2. Supplement Clause 5 to Article 4 as follows:

"5. The application file for requesting the issuance of a visa-exemption certificate shall be made in one set:"

3. Amend and supplement Article 6 as follows:

"A person entering Vietnam with a visa-exemption certificate may temporarily reside in Vietnam for no more than ninety days per entry. If they wish to stay beyond ninety days, they must have a legitimate reason and be sponsored by an organization, entity, or individual in Vietnam, and their request for extension of temporary residence will be considered and resolved, not exceeding ninety days each time.

A person wishing to extend their temporary residence must submit the extension application at least five days before the expiration date.

- The application file for requesting an extension of temporary residence includes: The passport of the person applying for the extension and the Application Form for Issuance, Supplement, Amendment of Visa, Extension of Temporary Residence (Form N5), certified by the Police Station of the locality where the person is residing temporarily.

- Place to submit the application file: The Immigration Management Department or the Immigration Management Office of the provincial or municipal police force where the person is residing temporarily.

- Time limit for processing: Not exceeding five working days from the date of receiving complete and valid application files."

Article 2. This Decision takes effect from April 15, 2012.

Article 3. THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
