The Prime Minister issues this Decision to regulate special allowances for officers and soldiers directly engaged in criminal enforcement work, criminal enforcement management, and work at military prisons, temporary detention centers, and holding houses.

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
At the proposal of the Minister of National Defense,
This Decision regulates special allowances for officers and soldiers directly engaged in criminal enforcement work, criminal enforcement management, and work at military prisons, temporary detention centers, and holding houses.
Article 1. Scope of Regulation and Applicability
Article 2. Allowance Rates
1. A 25% allowance rate shall be applied to:
a) Wardens, Political Commissars, Deputy Wardens of military prisons and temporary detention centers;
b) Custody Assistants, Education Assistants, Team Leaders, Deputy Team Leaders, Group Leaders, Guards, Judicial Guards, Doctors, and medical personnel providing healthcare services to detainees and suspects in military prisons and temporary detention centers.
2. A 20% allowance rate shall be applied to:
Officers and soldiers directly engaged in other tasks at military prisons and temporary detention centers.
3. A 15% allowance rate shall be applied to:
Officers under the Criminal Enforcement Management Department of the Ministry of National Defense and the Criminal Enforcement Department of Military Regions who are involved in leadership, command, advisory, and inspection work related to military prisons, temporary detention centers, and holding houses.
4. A 10% allowance rate shall be applied to:
Officers and soldiers engaged in tasks at holding houses and holding houses with temporary detention cells.
Special allowances shall be paid together with monthly salary and rank allowances and shall not be used to calculate contributions or benefits under social insurance and health insurance laws.
Article 3. Method of Calculating Allowances
1. The special allowances specified in Article 2 of this Decision shall be calculated based on the current rank pay grade, position level, or rank allowance plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
2. When transferring to another job without holding the positions or titles specified for the subjects in Article 2 of this Decision, or when preparing for retirement or leaving military service, the special allowance shall cease from the following month.
3. Periods during which allowances cannot be claimed include:
a) Time spent on overseas assignments, study, or work as stipulated in Clause 4, Article 8 of Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on salary regulations for civil servants, public officials, and armed forces personnel;
b) Continuous periods of absence from work without pay lasting one month or more;
c) Periods of leave under social insurance laws;
d) Periods of suspension from duty or detention.
The funding for implementing the provisions of this Decision shall be guaranteed by the State budget and allocated annually in the Ministry of National Defense's budget according to the State Budget Law.
Article 4. Source of Funds
1. This Decision shall take effect from March 15, 2013.
Article 5. Effective Date
2. Abolish the special allowances for officers and soldiers directly engaged in prison management work at military prisons, temporary detention centers, and holding houses as stipulated in Decision No. 316/QĐ-TTg dated May 25, 1995, of the Prime Minister regarding prison allowance regulations, and Decision No. 116/2002/QĐ-TTg dated September 17, 2002, of the Prime Minister regarding management allowance regulations for temporary detention centers and holding houses under the Ministry of National Defense.
1. The Ministry of National Defense shall provide guidance on the implementation of this Decision.
Article 6. Responsibility for Implementation
1. The Ministry of National Defense shall guide the implementation of this Decision.
2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
