Joint Circular No. 10/2013/TTLT-BCA-BTC guiding the adjustment of monthly allowances for officers and soldiers of the People's Public Security who are entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government.

Guidelines for implementing adjustments to the monthly allowance for officers and soldiers of the People's Public Security who are entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the GovernmentPursuant to Decision No. 73/2013/NĐ-CP dated July 15, 2013 of the Government adjusting pensions, social insurance allowances, and monthly allowances for civil servants who have retired;The Minister of Public Security and the Minister of Finance issue this Joint Circular guiding the implementation of adjustments to the monthly allowance levels for officers and soldiers of the People's Public Security who are entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 and Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government.1. Officers and soldiers of the People's Public Security who are entitled to monthly allowances as prescribed in Article 4 of the Joint Circular No. 05/2010/TTLT-BCA-BLDTBXH-BTC dated November 8, 2010 of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Government on the regime for officers and soldiers of the People's Public Security who participated in the resistance war against America with less than 20 years of service in the People's Public Security and have ceased working, been discharged, or returned to their localities.

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

2. Officers and soldiers of the People's Public Security who are entitled to monthly allowances as prescribed in Clause 1, Article 3 of the Joint Circular No. 05/2012/TTLT-BCA-BLDTBXH-BTC dated May 14, 2012 of the Ministers of the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of policies for officers, non-commissioned officers, soldiers, workers, and civil servants of the People's Public Security under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government on policies for those who participated in wars to protect the country and international missions in Cambodia and Laos after April 30, 1975 and have been demobilized, discharged, or ceased working.

From July 1, 2013, the subjects specified in Article 1 of this Circular shall be adjusted their monthly allowance level according to the following formula:

Article 2. Adjustment of Monthly Allowance

Example 1: Comrade Nguyen Van A belongs to the group entitled to monthly allowances under Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Government, with a total service period of 18 years and 6 months, and a monthly allowance of VND 1,345,759 in June 2013.

Example 2: Comrade Pham Van B belongs to the group entitled to monthly allowances under Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Government, with a total service period of 16 years and 10 months, and a monthly allowance of VND 1,228,631 in June 2013.

From July 1, 2013, Comrade Pham Van B's monthly allowance will be adjusted as follows:

1,228,631 VND x 1.096 = 1,346,579 VND.

1. The Ministry of Finance shall ensure the funding for the implementation of the regime and payment fees in accordance with the Law on State Budget.

2. The Ministry of Public Security shall take the lead in coordinating with the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance to guide and inspect the implementation of this Circular.

Adjustments to the monthly allowance levels as stipulated in Article 2 of this Circular shall apply to cases where the decision on monthly allowances was issued from the date this Circular takes effect.

Article 3. Implementation Organization

3. Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities shall implement adjustments and pay monthly allowances to the cases specified in Article 1 of this Circular who are currently receiving monthly allowances at the Departments of Labor, Invalids and Social Affairs of provinces and centrally-administered cities.

4. Four models are attached to this Circular, including Nos. 01/QĐ-X33, 02/GT-X33, 03/QĐ-X33, and 04/GT-X33.

This Circular shall take effect from November 19, 2013.

The adjustment of monthly allowances for the subjects specified in Article 1 of this Circular shall be implemented from July 1, 2013.

During the implementation process, if there are any difficulties, agencies and units should report to the Ministry of Public Security (through the General Department of Public Security Force Construction) for coordination with the Ministry of Finance to resolve them./.

The adjustment level for the monthly subsidy for the subjects specified in Article 1 of this Circular shall be implemented from July 1, 2013.

During the implementation process, if there are any difficulties, the agencies and units shall report to the Ministry of Public Security (through the General Department for Building Police Force) to coordinate with the Ministry of Finance to resolve them./.
