On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.

The Minister of Transport issues this Circular to amend and supplement some articles of Circular No. 56/2012/TT-BGTVT dated December 27, 2012 of the Minister of Transport on technical safety inspection and environmental protection for road motor vehicles (hereinafter referred to as Circular No. 56/2012/TT-BGTVT) and Circular No. 10/2009/TT-BGTVT dated June 24, 2009 of the Minister of Transport on technical safety inspection and environmental protection for road motor vehicles (hereinafter referred to as Circular No. 10/2009/TT-BGTVT).

Article 1. Amend and supplement some Articles of Circular No. 56/2012/TT-BGTVT as follows:

1. Supplement Clause 3 and Clause 4 after Clause 2, Article 6 as follows:

"3. For automobiles carrying passengers from 16 seats (including the driver's seat) and above, trucks (including specialized trucks) and truck tractors with a total permissible gross weight of 10,000 kg or more that have been produced over seven years, the inspection must be conducted by a high-level Motor Vehicle Inspector. The implementation schedule for this clause starts from July 1, 2015.

4. Motor vehicles undergoing inspection must be photographed, specifically as follows:

a) Take overall photos of the vehicle and photos of the registration plate of the motor vehicle on the inspection line to print on the Inspection Certificate.

b) Take photos of the motor vehicle to print on the Certificate of Conformity. The photo should be taken at a 45-degree angle from the right rear side of the vehicle; the photo must be clear (minimum resolution of 300 dpi), showing the overall view of the vehicle and the license plate, with the vehicle image occupying at least 75% of the photo area."

2. Amend Point a and Point b of Clause 2, Article 8 as follows:

“a) Organizations and individuals bring motor vehicles and relevant documents as stipulated in Article 5 of this Circular to the Inspection Unit for inspection. For vehicles required to install vehicle tracking devices, the Inspection Unit guides the vehicle owner to fill out the declaration form according to the model prescribed in Appendix VII issued together with this Circular.

b) The Inspection Unit receives, checks, and cross-references the file with data in the Management Inspection Program. If the file is incomplete or invalid, the unit will guide the vehicle owner to complete it; if the file is complete and valid, the unit will collect fees, conduct inspections, take photos of the vehicle, take photos of the passenger compartment (for buses), and check the vehicle tracking device through the management website for vehicles required to install such devices.”

3. Amending Clause 1 of Article 9 as follows:

“1. Motor vehicles that pass the inspection standards will be issued a Certificate of Conformity and an Inspection Label according to the model prescribed in Appendix III of this Circular. The Certificate of Conformity and the Inspection Label must have the same serial number, contain information consistent with the Vehicle File, and be printed on forms uniformly issued by the Vietnam Vehicle Registration Agency.

For cars equipped with point-based devices used in driving test centers, trucks used in railway stations, ports, mining areas, and forestry (with no need to participate in road traffic); oversized and overweight motor vehicles operating within narrow areas without participating in road traffic, only a Certificate of Conformity will be issued, and no Inspection Label will be provided. In the "Notes" section of the Certificate of Conformity, the following text shall be noted: "Motor vehicles operating within narrow areas, not participating in road traffic."”

4. Supplement Point d and Point đ after Point c of Clause 2, Article 12 as follows:

“d) A printed copy of the results of the vehicle tracking device inspection via the website.

đ) A printed copy of the photos taken inside the passenger compartment of buses.”

5. Supplement Clause 7 after Clause 6, Article 16 as follows:

“7. Install IP cameras to monitor inspection activities on the inspection line. Images captured by the camera must be transmitted to the screen placed in the waiting room for the vehicle owner and sent to the Vietnam Vehicle Registration Agency. Images captured by the camera must be stored at the Inspection Unit for a minimum of 30 days from the date of inspection.”

6. Replace Appendix III issued with Circular No. 56/2012/TT-BGTVT with Appendix III issued with this Circular.

7. Supplement Appendix VII to Circular No. 56/2012/TT-BGTVT corresponding to Appendix IV issued with this Circular.

Article 2. Amend and supplement some Articles of Circular No. 10/2009/TT-BGTVT as follows:

1. Amend and supplement Appendix I issued together with Circular No. 10/2009/TT-BGTVT corresponding to Appendix I issued together with this Circular as follows: Add Item 1.6 "Emblem, information marked on the door or side of the vehicle according to regulations" after Item 1.5 and amend and supplement Item 10.5 "Vehicle tracking device" after Item 10.4.

2. Replace Appendix II issued together with Circular No. 10/2009/TT-BGTVT with Appendix II issued together with this Circular.

Article 3. Effectiveness and Implementation

1. This Circular takes effect from June 15, 2014 and revokes Circular No. 37/2011/TT-BGTVT dated May 6, 2011 of the Minister of Transport regarding "Amendments and supplements to some provisions of the Regulations on the renovation of road motor vehicles issued together with Decision No. 15/2005/QD-BGTVT dated February 15, 2005, Regulations on conditions for establishment and operation of Motor Vehicle Inspection Centers issued together with Decision No. 45/2005/QD-BGTVT dated September 23, 2005, Circular No. 10/2009/TT-BGTVT dated June 24, 2009 on technical safety inspection and environmental protection of road motor vehicles, and Circular No. 22/2009/TT-BGTVT dated October 6, 2009 on procedures for technical safety inspection and environmental protection of road motor vehicles issued by the Minister of Transport."

2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Director of the Vietnam Motor Vehicle Inspection Center, Directors of Provincial and Central City Transport Departments, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
