CIRCULAR

Guidelines for naming enterprises in accordance with historical traditions,

culture, ethics, and good customs and practices of the nation

Pursuant to the Enterprise Law dated November 29, 2005;

Pursuant to Decree No. 43/2010/NĐ-CP dated April 15, 2010 of the Government on enterprise registration;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Cultural Institutions,

The Minister of Culture, Sports and Tourism issues this Circular guiding the naming of enterprises in accordance with historical traditions, culture, ethics, and good customs and practices of the nation.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular guides the naming of enterprises in accordance with historical traditions, culture, ethics, and good customs and practices of the nation.

Article 2. This Circular applies to organizations and individuals registering enterprises and operating within the territory of Vietnam in accordance with Vietnamese law.

Article 2. Naming enterprises that violate national historical traditions

The following cases of naming enterprises violate national historical traditions:

1. Using names identical to those of famous persons, except in the following cases:

a) When the founder of the enterprise uses their own name to name the enterprise but it partially or entirely matches the name of a famous person, they must fully include the surname and given name as recorded in the birth certificate of the founder;

b) In the case where an enterprise founded by multiple organizations or individuals plans to name the enterprise using the name of one of the founders but it matches the name of a famous person, the naming of the enterprise shall be carried out in accordance with the provisions of point a, Clause 1 of this Article;

c) In the case where the enterprise name is formed by combining the names of founding organizations or individuals and it matches the name of a famous person, there must be a hyphen (-) between the names of the combined founding organizations or individuals.

2. Using the names of the country, place names during periods of invasion, and the names of historical figures considered to be against righteousness and hindering progress.

3. Using the names of historical figures who were foreign invaders or individuals guilty to the country and the nation.

4. Other cases of using language or symbols that violate historical traditions as prescribed by law.

Article 3. Naming enterprises that violate cultural, ethical, and traditional customs of the nation

The following cases of naming enterprises violate cultural, ethical, and traditional customs of the nation:

1. Using language or symbols with vulgar, pornographic, violent, criminal, or social vice connotations;

2. Using language or symbols that express or imply threats, insults, defamation, slander, rudeness towards other organizations or individuals;

3. Using language or symbols that express or imply discrimination, prejudice based on region, ethnicity, religion, race, or gender;

4. Other cases of using language that violates cultural, ethical, and traditional customs of the nation as prescribed by law.

Article 4. Responsibilities of related parties

1. Organizations and individuals when registering to establish an enterprise have the responsibility to comply with the provisions of this Circular.

2. Specialized inspection agencies for culture, sports, and tourism; organizations and individuals with authority to handle violations have the responsibility to detect and handle organizations and individuals violating the law according to the law.

Article 5. Effective Date

1. This Circular takes effect from November 25, 2014.

2. During implementation, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism (through the Department of Cultural Bases) for research, amendment, and supplementation to ensure compliance./.
