REGULATIONS ON THE CODE AND STANDARDS FOR PROFESSIONAL TITLES OF SPECIALIZED CIVIL SERVANTS IN PERFORMING ARTS AND FILM

Pursuant to the Law on Public Servants No. 58/2010/QH12 dated November 15, 2010;

Scope of Regulation and Applicabilityb) Flat surface, not slippery. Provincial public libraries have professional and vocational units to implement activities according to the following groups of tasks:

Decree No. 1. This Joint Circular stipulates the code, standards for professional titles, and appointment and grading according to professional titles for specialized civil servants in performing arts and film.th, 20162. This Joint Circular applies to specialized civil servants in performing arts and film working in public service units, including:d) Administrative and management task group: carry out tasks related to statistics, compilation, issuance of library user cards, evaluation of library activities, international cooperation in libraries; administrative, archival, personnel organization, accounting, and other internal management activities.u organ Pursuant to Decree No. 07/2012/NĐ-CP of February 9, 2012 of the Government stipulating the agencies entrusted with the function of specialized inspection and activities of specialized inspection;

a) Technical and vocational task group: carry out tasks related to building, processing, organizing, and preserving information resources; guide, advise, and support the development of library networks; a) Group of artistic director titles: Stage director; film director; choreographer; dance trainer; music composer and conductor; scriptwriter;b) Performer title: Performers active in the field of performing arts and film. Article 2. Code and Classification of Professional Titles for Specialized Civil Servants in Performing Arts and Film1. The professional titles for specialized civil servants in performing arts and film include: group of artistic director titles and group of performer titles.2. The group of artistic director titles includes:a) Artistic Director Grade I                             Code: V.10.03.08

Article 3. Professional ethics standards for positions of specialized art performance and film civil servants

1. Have a high sense of responsibility, be passionate about art, be enthusiastic about assigned tasks, always comply with laws, and fully perform the duties of a civil servant in professional activities.

2. Care about the development of art performance and film industries; always have a consciousness to preserve, protect, and promote traditional arts of Vietnam's ethnic communities.

3. Be honest, objective, straightforward, and have clear opinions; have a humble attitude when interacting with the public; have a consciousness to combat wrongful and negative behaviors; practice thrift and oppose waste.

4. Respectful, cooperative, and supportive of colleagues, sharing experiences in work.

Chapter II

OCCUPATIONAL STANDARDS

Article 4. Artistic Director Grade I - Code: V.10.03.08

1. Duties:

a) Lead in building scripts, staging, and directing artistic works and programs in theater and film with high ideological and artistic value; large-scale and grandiose;

b) Identify new artistic trends, determine the artistic trend of the specialty; define and direct the consistency of artistic style within the unit;

c) Lead in organizing evaluations, analyses, and handling of scripts; direct the construction of scene scripts, stage direction, choreography, musical arrangements; select actors and collaborators; direct actor performances, guide collaborators, and coordinate with relevant parties to unify creative ideas and ensure the completion process of works and programs;

d) Organize the construction of plans, propose measures to implement staging and production; organize the collection of necessary materials and documents to serve the staging of works and programs; organize reviews, improvements, handovers of works and programs;

đ) Lead in preparing content for domestic and international professional seminars; lead in developing objectives, contents, programs, and materials, and organize training to enhance professional skills for lower-level directors and actors;

e) Monitor the social impact of works and programs after their wide release to continue improving and perfecting them; summarize experiences from staged works and programs at the unit; participate in summarizing professional experiences in the field;

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field of art performance and film;

b) Hold a certificate for standard position training for first-class artistic director;

3. Standards for professional competence:

a) Firmly grasp and correctly implement the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Master comprehensive knowledge of various forms of literature and art; characteristics of different art disciplines; master scientific and technological achievements and cultural arts both domestically and internationally related to professional work;

c) Have extensive experience in creative activities, staging, and directing;

d) Possess leadership capabilities, research abilities, and collaboration skills with colleagues in organizing professional activities; have the ability to propose innovative artistic solutions;

đ) Have at least two works or programs recognized by the Ministry-level or equivalent Art Council for artistic quality;

4. Civil servants promoted to the position of first-class artistic director include one of the following cases:

a) Awarded the title of People's Artist or won the Ho Chi Minh Prize in literature and art;

b) Meet all the criteria stipulated in Clause 2 and Clause 3 of this Article and must have held the position of second-class artistic director or equivalent for at least six years, including at least two years in the most recent period as a second-class artistic director;

Article 5. Art Director Grade II - Code: V.10.03.09

1. Duties:

a) Participate in building scripts, staging, and directing theatrical and film works and programs with significant ideological and artistic value, large and medium-sized scale. Evaluate, analyze, and handle scripts: develop directorial concepts, scene scripts, choreography, music; select actors and collaborators;

b) Direct the acting of actors, guide collaborators, and coordinate with relevant parties to unify creative ideas, ensuring the completion process of works and programs;

c) Develop plans, propose measures to implement staging and production; collect necessary materials and documents to serve the staging of works and programs; organize reviews, improvements, and handovers of works and programs;

d) Summarize experiences from staged works and programs and artistic trends; establish and form a unified artistic style for the unit; monitor the social impact of works and programs after their wide release to continue improving and perfecting them;

đ) Lead in training actors, assist in enhancing professional skills for lower-level directors;

e) Participate in preparing content for domestic and international professional seminars;

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field of art performance and film;

b) Hold a certificate for standard position training for second-class artistic director;

3. Standards for professional competence:

a) Firmly grasp and correctly implement the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Master various forms, methods of creation, and related technical procedures;

c) Have experience in creation, staging, and directing;

d) Possess research and collaboration skills with colleagues in professional activities; have the ability to propose and conduct scientific research, apply scientific progress to improve the effectiveness of art performance and film work;

đ) Have at least one work or program recognized by the Ministry-level or equivalent Art Council for artistic quality;

4. Civil servants promoted to the position of second-class artistic director include one of the following cases:

a) Awarded the title of Meritorious Artist or won the State Prize in literature and art;

b) Meet all the criteria stipulated in Clause 2 and Clause 3 of this Article and must have held the position of third-class artistic director or equivalent for at least nine years, including at least two years as a third-class artistic director;

Article 6. Art Director Grade III - Code: V.10.03.10

1. Duties:

a) Participate in building scripts, staging, and directing theatrical and film works and programs with significant ideological and artistic value, medium and small scale. Evaluate, analyze, and handle scripts: develop directorial concepts, scene scripts; select actors and collaborators;

b) Direct the acting of actors, guide collaborators, and coordinate with relevant parties to unify creative ideas, ensuring the completion process of assigned works and programs;

c) Develop plans, propose measures to implement staging and production; collect necessary materials and documents to serve the staging of works and programs; organize reviews, improvements, and handovers of works and programs;

d) Monitor the social impact of works and programs after their wide release to continue improving and perfecting them;

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field of art performance and film;

b) Hold a certificate for standard position training for third-class artistic director;

3. Standards for professional competence:

a) Firmly grasp the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Understand scientific achievements related to professional work;

c) Understand forms and methods of creation;

d) Possess collaboration skills with colleagues in professional activities;

đ) Possess the ability to propose and conduct scientific research, apply scientific progress to enhance the effectiveness of performing arts and cinema work.

4. Civil servants promoted from the title of Art Director Grade IV to Art Director Grade III must meet all the criteria stipulated in Clause 2 and Clause 3 of this Article and have held the title of Art Director Grade IV for at least two years with a college degree or three years with a secondary vocational degree.

Article 7. Artistic Director Level IV - Code: V.10.03.11

1. Duties:

a) Implement the director's concept on analyzing and processing scene scripts, music, selecting actors, and collaborators; collecting necessary materials and documents to serve the construction of scripts, music, and staging works and programs.

b) Participate in building plans, proposing measures to carry out staging and production; monitor the social impact of works and programs after their public release to continue improving and perfecting them.

c) Participate in directing actor performances, guiding collaborators, and coordinating with relevant individuals to unify creative concepts, ensuring the completion process of works and programs;

2. Qualifications regarding education and training:

Hold a diploma from a secondary vocational school or higher, relevant to the field of performing arts and cinema. In cases where there has been no professional training, they must possess a certificate in specialized vocational training issued by authorized agencies or organizations.

3. Standards for professional competence:

a) Firmly grasp the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Understand scientific achievements related to professional work;

c) Understand forms and methods of creation;

d) Possess collaboration skills with colleagues in professional activities;

đ) Possess the ability to propose and conduct scientific research, apply scientific progress to enhance the effectiveness of performing arts and cinema work.

Article 8. Actor Level I - Code: V.10.04.12

1. Duties:

a) Take on main roles in stage and film programs and works with high ideological and artistic value; large-scale and grandiose productions.

b) Demonstrate artistic imagery language with unique creativity for assigned main characters and related characters based on the director's, choreographer's, dance instructor's, and musical conductor's concepts.

c) Deeply study the content of scripts and works; immerse in real-life situations to enhance knowledge and vividly and truthfully portray roles and sections.

d) Lead, guide, organize according to assignments and strictly implement professional procedures in rehearsals, preliminary reviews, final reviews, and performances;

đ) Summarize experiences from performed roles and sections; participate in summarizing and distilling professional experience.

e) Participate in training and enhancing the skills of lower-grade actors.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field of art performance and film;

b) Hold a certificate in standard position training for Grade I actor.

3. Standards for professional competence:

a) Firmly grasp and correctly implement the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Possess aptitude in the specialized field.

c) Master professional knowledge in the specialized field and effectively apply it to artistic creation; deeply understand the characteristics and features of combined arts and related technical sciences.

d) Possess leadership skills, research capabilities, and the ability to collaborate with colleagues in organizing professional activities;

đ) Possess the ability to propose creative artistic solutions.

e) Have received at least two outstanding actor awards recognized by the Ministry-level specialized art council or equivalent.

4. Civil servants promoted to the title of Grade I Actor include one of the following cases:

a) Awarded the title of People's Artist or won the Ho Chi Minh Prize in literature and art;

b) Meet all the criteria stipulated in Clause 2 and Clause 3 of this Article and must have held the title of Grade II Actor or equivalent for at least five years, including at least two years in the most recent period holding the title of Grade II Actor.

Article 9. Category II Performer - Code: V.10.04.13

1. Duties:

a) Successfully undertake assigned roles.

b) Understand the content of scripts, deeply study the assigned main character and related characters under the guidance of the director, choreographer, dance instructor, and musical conductor to demonstrate artistic imagery language with outstanding creativity.

c) Strictly follow all professional procedures during practice, preliminary review, general rehearsal, and performance.

d) Immerse in real-life situations to enhance knowledge and vividly and truthfully portray roles and sections.

đ) Summarize experiences from performed roles and sections.

e) Guide and enhance the skills of lower-grade actors.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field of art performance and film;

b) Hold a certificate in standard position training for Grade II actor.

3. Standards for professional competence:

a) Firmly grasp and correctly implement the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Possess aptitude in the specialized field.

c) Master professional knowledge in the specialized field and apply it to artistic creation; basic characteristics and features of combined arts, and fundamental knowledge about related technical sciences.

d) Possess the ability to research, propose, and collaborate with colleagues in professional activities.

đ) Have received at least one outstanding actor award recognized by the Ministry-level specialized art council or equivalent.

4. Civil servants promoted to the title of Grade II Actor include one of the following cases:

a) Awarded the title of Meritorious Artist or won the State Prize in literature and art;

b) Meet all the criteria stipulated in Clause 2 and Clause 3 of this Article and must have held the title of Grade III Actor or equivalent for at least five years, including at least two years in the most recent period holding the title of Grade III Actor.

Article 10. Third-Rank Actors - Code: V.10.04.14

1. Duties:

a) Undertake assigned roles.

b) Study the script content, research the assigned character under the guidance of the director, choreographer, dance trainer, and music conductor to express creative artistic language.

c) Strictly follow all professional procedures during practice, preliminary review, general rehearsal, and performance.

d) Engage in real-life immersion to enhance knowledge and realistically portray roles, Section.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field of art performance and film;

b) Hold a certificate for upgrading the standards of the third-rank actor position.

3. Standards for professional competence:

a) Firmly grasp the viewpoints, policies, and guidelines of the Party and state policies and laws regarding art performance and film;

b) Possess aptitude in the specialized field.

c) Understand professional knowledge in the specialized field, basic characteristics of combined arts, and fundamental knowledge about related science and technology fields.

d) Possess collaboration skills with colleagues in professional activities;

4. Staff members promoted from the fourth-rank actor position to the third-rank actor position must meet the criteria stipulated in Clauses 2 and 3 of this Article and have held the fourth-rank actor position for at least two years with a college degree or three years with a secondary vocational degree.

Article 11. Fourth-Rank Actors - Code: V.10.04.15

1. Duties:

a) Undertake assigned roles.

b) Study the script content, research the assigned character under the guidance of the director, choreographer, dance trainer, and music conductor to express artistic language.

c) Strictly follow all professional procedures during practice, preliminary review, general rehearsal, and performance.

d) Engage in real-life immersion to enhance knowledge and realistically portray roles, Section.

2. Qualifications regarding education and training:

Hold a diploma or higher degree in a relevant performing arts or film industry field. In cases where there has been no professional training, a certificate for upgrading specialized performing arts skills issued by an authorized agency must be obtained.

3. Standards for professional competence:

a) Understand the viewpoints, policies, and guidelines of the Party and state laws regarding performing arts and cinema;

b) Possess aptitude in the specialized field.

c) Master specialized professional knowledge, basic characteristics of various art forms, and fundamental knowledge about related scientific and technical fields;

d) Have the ability to collaborate with colleagues in professional activities.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES

Article 12. Principles for Appointment and Salary Classification Based on Professional Titles for Staff Members

1. The appointment to professional titles for staff members as specified in this Circular must be based on their current job positions, responsibilities, and professional qualifications, in accordance with Article 13 of this Circular.

2. When appointing from the current civil servant rank to a corresponding professional title in performing arts and cinema, it shall not combine salary grade increases or promotions (except in cases of appointment to professional titles in performing arts and cinema as stipulated in Article 13 and Clause 3 of Article 14 of this Circular).

Article 13. Cases for Appointment to Professional Titles

Staff members who were appointed to the civil servant rank in the performing arts sector according to Decision No. 428/TCCP-VC dated June 2, 1993, issued by the Minister - Head of the Government's Organizational and Cadre Affairs Department (now the Minister of Home Affairs), setting out the professional standards for the civil service rank in the Ministry of Culture and Information, may now be appointed to the professional title of performing arts staff member as specified in this Circular, as follows:

1. For the director of performing arts profession:

a) Appoint to the first-rank professional title of director of performing arts (code V.10.03.08) for staff members currently holding the senior director rank (code 17.154); senior scriptwriter (code 17.139); staff members awarded the People's Artist title or won the Ho Chi Minh Award in literature and arts;

b) Appoint to the second-rank professional title of director of performing arts (code V.10.03.09) for staff members currently holding the principal director rank (code 17.155); principal scriptwriter (code 17.140); staff members awarded the Meritorious Artist title or won the State Award in literature and arts;

c) Appoint to the third-rank professional title of director of performing arts (code V.10.03.10) for staff members currently holding the director rank (code 17.156); scriptwriter (code 17.141);

d) Appoint to the fourth-rank professional title of director of performing arts (code V.10.03.11) for staff members with a secondary or college degree in performing arts and cinema;

2. For the actor profession:

a) Appoint to the first-rank professional title of actor (code V.10.04.12) for staff members currently holding the senior actor rank - first class (code 17.157); staff members awarded the People's Artist title or won the Ho Chi Minh Award in literature and arts;

b) Appoint to the second-rank professional title of actor (code V.10.04.13) for staff members currently holding the principal actor rank - second class (code 17.158); staff members awarded the Meritorious Artist title or won the State Award in literature and arts;

c) Appoint to the third-rank professional title of actor (code V.10.04.14) for staff members currently holding the third-rank actor position (code 17.159) with a university degree in performing arts and cinema;

d) Appoint to the fourth-rank professional title of actor (code V.10.04.15) for staff members currently holding the third-rank actor position (code 17.159) with a secondary or college degree.

Article 14. Salary Grading

1. The professional titles of performing arts and cinema staff members as specified in Article 2 of this Circular shall apply the Specialized Professional Pay Scale for Civil Servants and Staff in State-Owned Enterprises (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the remuneration system for civil servants, public officials, staff members, and armed forces personnel, as follows:

a) For the director of performing arts profession:

- The first-rank professional title of director of performing arts (code V.10.03.08) shall apply the pay scale coefficient for type A3, group 1 (A3.1) staff members ranging from coefficient 6.20 to 8.00;

- The second-rank professional title of director of performing arts (code V.10.03.09) shall apply the pay scale coefficient for type A2, group 1 (A2.1) staff members ranging from coefficient 4.40 to 6.78;

- The third-rank professional title of director of performing arts (code V.10.03.10) shall apply the pay scale coefficient for type A1 staff members ranging from coefficient 2.34 to 4.98;

- The fourth-rank professional title of director of performing arts (code V.10.03.11) shall apply the pay scale coefficient for type B staff members ranging from coefficient 1.86 to 4.06.

b) For the actor profession:

- The first-rank professional title of actor (code V.10.04.12) shall apply the pay scale coefficient for type A3, group 1 (A3.1) staff members ranging from coefficient 6.20 to 8.00;

- The second-rank professional title of actor (code V.10.04.13) shall apply the pay scale coefficient for type A2, group 2 (A2.2) staff members ranging from coefficient 4.0 to 6.38;

- The third-rank professional title of actor (code V.10.04.14) shall apply the pay scale coefficient for type A1 staff members ranging from coefficient 2.34 to 4.98;

- The professional title of actor grade IV (code number V.10.04.15) shall apply the salary coefficient of category B staff from coefficient 1.86 to coefficient 4.06.

2. Salary classification upon completion of probationary period and appointment to occupational title.

After completing the probation period as prescribed and being appointed to the professional title by the competent authority managing staff, the following steps shall be taken to classify the salary grade in the appointed professional title:

a) In case of having a doctoral degree relevant to the performing arts and cinema fields, the staff member shall be classified at grade 3 with a salary coefficient of 3.00 for the professional title of artistic director grade III (code number V.10.03.10) or actor grade III (code number V.10.04.14);

b) In case of having a master's degree relevant to the performing arts and cinema fields, the staff member shall be classified at grade 2 with a salary coefficient of 2.67 for the professional title of artistic director grade III (code number V.10.03.10) or actor grade III (code number V.10.04.14);

c) In case of having a college degree relevant to the performing arts and cinema fields, the staff member shall be classified at grade 2 with a salary coefficient of 2.06 for the professional title of artistic director grade IV (code number V.10.03.11) or actor grade IV (code number V.10.04.15).

3. The classification of salaries into professional titles for performing arts and cinema staff as stipulated in Article 13 and Clause 1 of this provision for staff who have been classified into the ranks of performing arts and cinema staff according to Decision No. 428/TCCP-VC dated June 2, 1993 issued by the Minister - Head of the Organizational - Cadre Department of the Government (now the Minister of Home Affairs) on the criteria for the performing arts and cinema staff rank, Decision No. 78/2004/QĐ-BNV dated November 3, 2004 issued by the Minister of Home Affairs on the list of civil service ranks and staff ranks, and Decree No. 204/2004/NĐ-CP dated December 14, 2004 issued by the Government on the remuneration system for cadres, civil servants, staff members, and armed forces personnel shall be implemented in accordance with Circular No. 02/2007/TT-BNV dated May 25, 2007 issued by the Ministry of Home Affairs guiding the classification of salaries when upgrading ranks, transferring ranks, and changing types of civil servants and staff members.

In the case of staff members holding a college degree relevant to the performing arts and cinema fields currently classified under the old actor grade III rank (code number 17.159) and appointed to the professional title of actor grade IV (code number V.10.04.15):

If they were classified at grade 1 of the old actor grade III rank (code number 17.159) upon recruitment, they shall be upgraded to the next higher grade compared to their current grade; the time for enjoying the new grade salary shall be counted from the date of signing the decision appointing them to the professional title of actor grade IV (code number V.10.04.15); the time for considering the next salary grade increase shall be calculated from the date of holding the previous grade.

If they were classified at grade 2 of the old actor grade III rank (code number 17.159) upon recruitment, they shall be classified at the same grade and percentage of seniority allowance exceeding the ceiling (if any) as enjoyed in the old rank (including the time for considering the next salary grade increase or enjoying the seniority allowance exceeding the ceiling if any in the old rank) transferred to the professional title of actor grade IV (code number V.10.04.15).

Example 1: Mr. Nguyen Van A, holding a college degree in performing arts and cinema, currently classified under the old actor grade III rank (code number 17.159), grade 8, salary coefficient 3.26 (staff category B salary table as prescribed in Decree No. 204/2004/NĐ-CP) since July 1, 2014 (when recruited and classified at grade 1 of the old actor grade III rank) has been appointed by the competent authority to the professional title of actor grade IV (code number V.10.04.15) and shall be classified at grade 9, salary coefficient 3.46 of the professional title of actor grade IV from the date of signing the appointment decision; the time for considering the next salary grade increase shall be calculated from July 1, 2014.

Example 2: Ms. Tran Thi B, holding a college degree in performing arts and cinema, currently classified under the old actor grade III rank (code number 17.159), grade 5, salary coefficient 2.66 (staff category B salary table as prescribed in Decree No. 204/2004/NĐ-CP) since October 1, 2015 (when recruited and classified at grade 2 of the old actor grade III rank) has been appointed by the competent authority to the professional title of actor grade IV (code number V.10.04.15) and shall be classified at grade 5, salary coefficient 2.66 of the professional title of actor grade IV from the date of signing the appointment decision; the time for considering the next salary grade increase shall be calculated from October 1, 2015.

4. Promotion of staff in the performing arts and cinema field shall be carried out after being appointed to the professional title of performing arts and cinema staff as stipulated in this joint circular and implementing the salary classification guidance as provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 issued by the Ministry of Home Affairs guiding the classification of salaries when upgrading ranks, transferring ranks, and changing types of civil servants and staff members.

Chapter IV

IMPLEMENTING PROVISIONS

Article 15. Effective Date

1. This Circular takes effect from March 1, 2016.

2. Abolish the provisions regarding the list of staff ranks related to the director, scriptwriter, and actor professional titles stipulated in Decision No. 428/TCCP-VC dated June 2, 1993 issued by the Minister - Head of the Organizational - Cadre Department of the Government and the list of performing arts and cinema staff ranks promulgated by Decision No. 78/2004/QĐ-BNV dated November 3, 2004 issued by the Minister of Home Affairs.

Article 16. Transitional Provisions

The competent authority managing and using civil servants shall create conditions for civil servants to supplement the remaining criteria of the profession-specific civil servant positions in the performing arts and cinema as stipulated in this Joint Circular for those civil servants who have been appointed to the ranks of profession-specific civil servants in the performing arts and cinema according to Decision No. 428/TCCP-VC dated June 2, 1993 issued by the Minister - Head of the Organizational Cadre Department of the Government (now the Minister of Home Affairs) establishing the vocational standards for the ranks of civil servants in the Culture and Information sector.

Article 17. Implementation Organization

1. This Joint Circular serves as one of the bases for implementing the recruitment, utilization, and management of profession-specific civil servants in the performing arts and cinema in public service units.

2. Non-public organizations and units outside the public sector may apply the provisions of this Joint Circular to recruit, utilize, and manage personnel working in the performing arts and cinema sector.

3. The heads of public institutions directly managing and utilizing staff are responsible for:

a) Review job positions within the unit, develop plans for appointing profession-specific civil servant positions in the performing arts and cinema within their management authority, submit them for review and decision by the competent authority or make decisions according to delegated authority;

b) Appoint profession-specific civil servant positions in the performing arts and cinema corresponding to public service units according to their authority or delegated authority after the appointment plan has been approved by the competent authority.

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Direct subordinate units under their management to implement the appointment of profession-specific civil servant positions and salary grading for profession-specific civil servants in the performing arts and cinema;

b) Approve plans for the appointment of profession-specific civil servant positions and salary grading for profession-specific civil servants in the performing arts and cinema within their management scope from the current civil servant ranks to the corresponding profession-specific civil servant positions stipulated in this Joint Circular; resolve issues within their authority during the process of appointing profession-specific civil servant positions and salary grading;

c) Decide on the appointment of profession-specific civil servant positions and salary grading for profession-specific civil servants in the performing arts and cinema within their management scope to corresponding profession-specific civil servant positions in subordinate units;

d) Annually report the results of the appointment of profession-specific civil servant positions and salary grading for profession-specific civil servants in the performing arts and cinema within their management scope to the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs.

Article 18. Responsibility for Implementation

1. The Ministers, heads of ministerial-level agencies, heads of government agencies; Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Joint Circular.

2. In case of difficulties during implementation, they are requested to report to the Ministry of Culture, Sports and Tourism for consolidation and coordination with the Ministry of Home Affairs to examine and resolve such issues./.
