CIRCULAR

Providing the contents of the safety analysis report in

the application dossier for construction permit of nuclear power plants

Pursuant to the Atomic Energy Law dated June 3, 2008;

Pursuant to Decree No. 70/2010/NĐ-CP dated June 22, 2010 of the Government detailing and guiding the implementation of certain Articles of the Atomic Energy Law on nuclear power plants;

Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology,

At the proposal of the Director of the Radiation and Nuclear Safety Administration and the Head of the Legal Department;

The Minister of Science and Technology issues this Circular providing the contents of the safety analysis report in the application dossier for construction permit of nuclear power plants.

Article 1. Scope of Regulation

This Circular provides the contents of the safety analysis report in the application dossier for construction permit of nuclear power plants (hereinafter referred to as the Safety Analysis Report - SAR).

The requirements and guidelines for design, systems, and safety analysis set forth in this Circular shall be understood as requirements and guidelines appropriate to the level of detail of technical design at the construction permit stage as prescribed in Article 5 of Circular No. 23/2013/TT-BCT dated October 18, 2013 of the Ministry of Industry and Trade on the contents, procedures for preparation, examination, and approval of the design for construction of nuclear power plant projects.

Article 2. Applicability

This Circular applies to organizations and individuals related to the preparation and examination of the Safety Analysis Report - SAR.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Safe operating limits include all possible operational states in the design basis that ensure no unacceptable risk to the health and safety of workers and the public around the plant at any time.

2. The ALARA principle is the principle of ensuring radiation protection so that the dose received by radiation workers and the public is kept as low as reasonably achievable.

3. Nuclear power plant configuration management is the activity of identifying and documenting the characteristics of the structure, systems, and components of the nuclear power plant (including computer software) to ensure that changes to these characteristics are reported, evaluated, approved, implemented, inspected, and documented appropriately.

4. Design basis accidents are accidents considered in the design to ensure that the nuclear power plant can withstand them when they occur, while fuel damage and radioactive material release remain within the limits specified by the competent authority.

Article 4. Contents of the Safety Analysis Report - SAR

1. The Safety Analysis Report - SAR includes fifteen (15) items: general introduction; general description of the nuclear power plant; safety management; site evaluation; general design aspects; description of major systems of the nuclear power plant; safety analysis; calibration and test operation program; operational aspects; operational conditions and limits; radiation protection; accident response; environmental aspects; radioactive waste management; decommissioning and end-of-life issues.

2. The contents of the Safety Analysis Report - SAR are detailed in the Appendix attached hereto.

Article 5. Dossier, procedure, and process for examining the Safety Analysis Report - SAR

1. The organization applying for permission must submit one (1) set of dossier (printed version) in Vietnamese and one (1) set of dossier (printed version) in English of the Safety Analysis Report - SAR and the request for examination to the Ministry of Science and Technology (through the Radiation and Nuclear Safety Agency). In addition to the printed versions, the organization applying for permission must also submit the electronic version (Vietnamese and English) of the Safety Analysis Report - SAR.

2. The Radiation and Nuclear Safety Agency checks the validity of the dossier. If the dossier is invalid, the Radiation and Nuclear Safety Agency will issue a document requesting the organization applying for permission to supplement information and necessary documents within fifteen (15) days from the date of receipt of the dossier.

3. The Radiation and Nuclear Safety Agency organizes the examination of the Safety Analysis Report - SAR within fifteen (15) months from the date of receipt of valid dossier.

4. During the examination of the Safety Analysis Report - SAR, the organization applying for permission has the responsibility to explain when requested by the Radiation and Nuclear Safety Agency.

Article 6. Effectiveness

1. This Circular takes effect from July 28, 2016.

2. During the implementation, if there are any difficulties, agencies, organizations, and individuals should promptly reflect them to the Ministry of Science and Technology for consideration and resolution./.
