CIRCULAR

REGULATIONS ON CONTENT, PROCEDURES FOR PREPARATION, REVIEW AND APPROVAL OF DESIGN FOR CONSTRUCTION OF NUCLEAR POWER PLANT PROJECTS

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Atomic Energy Law dated June 3, 2008;

Pursuant to the Construction Law dated November 26, 2003;

Pursuant to the Law Amending and Supplementing Certain Provisions of Laws Related to Basic Construction Investment No. 38/2009/QH12 dated June 19, 2009;

Pursuant to Decree No. 70/2010/ND-CP dated June 22, 2010 of the Government detailing and guiding the implementation of certain provisions of the Atomic Energy Law regarding nuclear power plants;

Pursuant to the Government Decree No. 12/2009/NĐ-CP dated October 2, 2009 on Management of Investment and Construction Projects and the Government Decree No. 83/2009/NĐ-CP dated October 15, 2009 amending and supplementing certain provisions of Government Decree No. 12/2009/NĐ-CP;

Pursuant to Decree No. 15/2013/NĐ-CP dated February 6, 2013 of the Government on construction project quality management;

The Minister of Transport hereby promulgates this Circular stipulating the procedures and formalities for dredging and maintaining the maritime channels of Hai Phong and Saigon-Vung Tau managed by the Ministry of Transport, using state budget funds, piloted under the open bidding mechanism with lump-sum contracts ensuring the design standards of the channel routes from 2015 to 2016 based on the dredging and maintenance plans for maritime channels and lump-sum contracts without adjusting the implementation costs.

At the proposal of the Director General of the Energy General Department;

The Minister of Industry and Trade promulgates this Circular stipulating the content, procedures for preparation, review and approval of design for construction of nuclear power plant projects.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the content of each stage of design for construction of nuclear power plants; the content and procedures for review and approval of technical design and construction drawing design.

Article 2. Applicability

This Circular applies to organizations and individuals involved in the preparation, review and approval of design for construction of nuclear power plant projects.

Chapter II
CONTENTS OF EACH STAGE OF DESIGN FOR CONSTRUCTION OF NUCLEAR POWER PLANTS

Article 3. Stages of Design for Construction of Nuclear Power Plants

Design for construction of nuclear power plants includes the following stages:

1. Foundation design is the design carried out during the project investment construction phase, ensuring that it reflects the main technical parameters in compliance with applicable standards and regulations, serving as the basis for subsequent design stages.

2. Technical design is the design carried out based on the approved foundation design in the project investment construction, ensuring that it reflects all technical parameters and materials suitable for applicable standards and regulations, serving as the basis for the construction drawing design stage.

3. Construction drawing design ensures that all technical parameters, materials used, and detailed structures are reflected in compliance with applicable standards and regulations, ensuring sufficient conditions for construction implementation.

4. Other design stages according to international practices shall be submitted by the contractor for the investor's consideration and approval.

Article 4. Foundation Design

The contents of the foundation design as prescribed in Clause 3, Article 18 of the Government Decree No. 70/2010/NĐ-CP dated June 22, 2010 detailing and guiding the implementation of certain provisions of the Atomic Energy Law regarding nuclear power plants, supplemented with the following contents:

1. Basis for foundation design.

2. Fuel supply plan and management and storage of spent fuel.

3. Interconnection plan with the national power grid.

4. Plan for technical water supply and cooling water.

5. Main construction and installation volumes.

6. Preliminary construction organization plan.

7. Other related documents.

Article 5. Technical Design

Technical design must comply with the foundation design and the approved investment project, including the following main contents:

1. Basis for technical design.

2. List of applied standards and regulations.

3. General description

a) General information: Description of the general construction site; natural and geographical conditions; infrastructure, connection with transportation and communication systems; power plant capacity, selected technology; main buildings, equipment, systems;

b) Basic requirements for the power plant.

4. Design requirements

a) Technical design requirements for: Main equipment (reactor; turbine, generator, and other equipment); main systems (main steam supply system; safety systems; spent fuel management and storage system; radioactive waste processing and storage system; electrical system; measurement, control, and protection system; ventilation and air conditioning system and other synchronous systems);

b) Safety requirements;

c) Architectural and structural design requirements.

5. Technical characteristics of technical systems and equipment

Including an overview of technical systems; design principles; main technical characteristics; testing and inspection requirements for the following systems and equipment:

a) Reactor;

b) Reactor cooling system;

c) Turbine, generator;

d) Main steam system, condenser and condenser cooling system;

đ) Safety system;

e) Measurement, control, and protection system;

g) Self-use power plant electrical system and emergency power supply system;

h) Distribution yard and interconnection with the national power grid;

i) Spent fuel processing, storage, and management system;

k) Radioactive waste processing and storage system;

l) Radiation protection and monitoring system;

m) Ventilation and air conditioning system;

n) Technical water supply system;

o) Self-use steam system;

p) Communication system;

q) Fire prevention and extinguishing system;

r) Equipment of the training center;

s) Equipment of the emergency response center;

t) Other systems of the power plant.

6. Architectural, structural, and building material solutions

Including architectural, structural, and building material solutions for main and auxiliary facilities as follows:

a) Reactor building;

b) Turbine building;

c) Emergency response building;

d) Control and operation building;

đ) Water treatment and storage building;

e) Backup power supply building;

g) Auxiliary building;

h) Training center;

i) Fuel and spent fuel storage facility;

k) Radioactive waste storage and processing facility;

l) Port and wave barrier;

m) Warehouse, workshop, and other synchronous facilities.

7. Organization and overall construction schedule

a) Overall layout of the construction site (equipment complex area, auxiliary area, campsite, material storage area, construction waste disposal area);

b) Construction organization and main construction methods;

c) Overall construction schedule showing completion deadlines for each facility, main construction volume, material and equipment requirements, manpower needs, test and operation plans.

8. Drawings

a) General layout and overall site plan of the power plant;

b) Floor plans and cross-sections of the power plant and each facility;

c) Heat balance diagrams;

d) Piping system diagram for steam, water, and compressed air;

d) Mechanical section;

đ) Electrical section;

e) Measurement, control, and protection section;

g) Information system, monitoring, surveillance, and data collection;

h) Ventilation and air conditioning systems;

i) Architecture and structural design;

k) Construction organization;

l) Other drawings.

9. Total budget estimate

The total budget estimate for the nuclear power plant project is determined by summing up the cost estimates of the works and related costs under the project, including the following main contents:

a) Basis for the Total Budget Estimate;

b) Cost estimates for the works are prepared in accordance with the provisions of Article 8 and Article 9 of Decree No. 112/2009/NĐ-CP dated December 14, 2009 of the Government on managing construction investment costs, special regulations applicable to nuclear power projects;

c) Total budget estimate for the nuclear power plant project.

10. Other documents

a) Fire protection and firefighting design documentation;

b) Quality assurance program;

c) Physical protection;

d) Other reports and calculations.

Article 6. Construction Drawings Design

1. Construction drawings design shall be carried out by the contractor in accordance with international practices and current Vietnamese laws, ensuring the following basic requirements:

a) Compliance with approved technical design;

b) Compliance with applicable standards and regulations;

c) Compliance with safety, environmental, and fire protection regulations;

d) Construction drawings must be prepared and approved to meet the construction schedule of the project;

đ) Drawings must fully reflect technical parameters, materials used, and construction details consistent with applicable standards and regulations, ensuring sufficient conditions for construction, including:

- General layout plans, floor plans, and cross-sections of individual works must fully display the positions and dimensions of structural components and technological equipment, accompanied by a list of quantities of installed materials and equipment for that work, quality specifications of typical prefabricated materials and components, instructions on construction sequence, and labor safety requirements during construction;

- Detailed drawings of individual parts must fully display the positions, dimensions, specifications, and quantities of each type of material and component, with necessary notes for the constructor;

- Detailed drawings for installation of technological equipment must fully display the positions, dimensions, specifications, and quantities of each type of equipment, components, spare parts, and materials, with necessary notes for the constructor and guidance from the equipment manufacturer;

- Construction methods must show progress, sequence, manpower, and construction equipment for individual works; measures to ensure safety for personnel, machinery, equipment, and the project; measures to prevent fires and explosions and protect the environment; measures for site restoration and removal of machinery and equipment from the site upon completion of the project;

- A comprehensive table of quantities of installed materials, equipment, and materials for each individual work and the entire project must fully display the specifications and quantities of each type of material, component, and equipment.

2. Drawings and documents

a) Overall layout plan of the project;

b) Floor plans and cross-sections of systems and equipment;

c) Diagrams of technological systems of the plant;

d) Architectural and structural sections;

đ) Detailed drawings;

e) Overall schedule, phase schedules, and construction methods;

g) Operation, maintenance, and fault handling procedures;

h) Other related documents.

Article 7. Adjustment and Change of Design

1. The design of nuclear power plant construction projects may be changed or adjusted when there is a requirement to change or during the construction process, it is necessary to adjust the design to ensure safety, quality of the project, and investment efficiency.

2. In cases where adjusting the design changes the location, construction planning, objectives, scale, or exceeds the approved total investment amount of the project, the investor must submit for review and approval by the investment decision-maker.

3. In cases where adjusting the design changes the Technical Design, the investor must report to the Ministry of Industry and Trade for consideration and decision.

4. In cases where changing the Construction Drawing Design does not alter the approved Technical Design, the investor is permitted to modify the design.

5. Any changes from the approved Construction Design must be reflected in the Completion Drawings.

Chapter III
REVIEW AND APPROVAL OF TECHNICAL DESIGN AND CONSTRUCTION DRAWING DESIGN

Article 8. Review and Approval of Technical Design

1. The investor is responsible for preparing the Technical Design dossier to submit to the Ministry of Industry and Trade for review and approval. The number of dossiers submitted is five (05) sets (including both paper copies and electronic files).

2. The dossier for reviewing and approving the Technical Design includes:

a) A request for approval of the Technical Design in accordance with Appendix 1 issued together with this Circular;

b) A copy of the Decision approving the Project Investment Construction Work (including approval of the Basic Design);

c) The Technical Design dossier containing content consistent with the provisions of Article 5 of this Circular;

d) The Contract for Technical Design preparation;

đ) The dossier of the contractor's capacity for surveying and designing construction works;

e) Other related documents (if any).

3. Timeframe for Review and Approval of Technical Design

a) Within fifteen (15) working days from the date of receiving the dossier, the competent authority will check the validity and completeness of the dossier, requesting the investor to supplement information and documents as required.

b) The time for reviewing and approving the Technical Design shall not exceed nine (09) months from the date of receipt of valid dossiers.

4. Content of Technical Design Review

a) The capacity of the organization conducting surveys and designs compared to the requirements of the Contract and current laws;

b) Compliance with technical standards, norms, unit prices, and current state policies;

c) The suitability of the Technical Design with the Approved Basic Design and technical, safety, and economic regulations:

- Suitability of the Technical Design with the Approved Basic Design;

- Compatibility between the technology used and the overall site plan and architectural space;

- Correctness of the structural solutions for the work;

- Evaluation of the safety and durability of the work;

- Compliance with environmental regulations and fire prevention and extinguishing regulations;

- Technical and economic indicators compared to the approved Investment Project.

d) The consistency of the volume in the General Budget Estimate with the Technical Design; the correctness of applying construction unit prices, cost norms, and other budget items in the General Budget Estimate;

đ) Conditions and technical solutions ensuring stability for adjacent works, environmental protection, and safety during construction.

5. Approval of Technical Design

a) The person authorized to approve the Technical Design must base their decision on the results of the Technical Design review, the results of the Safety Analysis Report review, the Environmental Impact Assessment Report review, the approvals of relevant state management agencies regarding fire prevention and extinguishing, and related requirements;

b) The content of the Technical Design approval is stipulated in Appendix 2 issued together with this Circular.

6. The agency organizing the review and approval of the Technical Design has the right to hire organizations or individuals with the appropriate qualifications to conduct a preliminary review of the design dossier before approval.

Article 9. Review and Approval of Construction Drawings Design

1. The construction drawings design shall be reviewed and approved by the project investor to ensure compliance with legal regulations on investment in construction projects and the construction progress schedule.

2. The main contents of the review of the construction drawings design are as follows:

a) Compliance of the design with the approved technical design;

b) Compliance of technical solutions and technology;

c) Compliance of the design with applicable standards and regulations;

d) Adherence to regulations on safety, environment, fire prevention and firefighting, and other related regulations;

e) Feasibility of the design to ensure implementation of construction works.

3. The agency organizing the review of the construction drawings design has the right to hire organizations or individuals with sufficient qualifications to conduct a preliminary review of the design documentation before approval.

Article 10. Costs for Review and Preliminary Review of Designs

The costs for reviewing and preliminarily reviewing designs shall be implemented according to current legal provisions and included in the total investment cost of the construction project.

Chapter IV
IMPLEMENTATION

Article 11. Effective Date

This Circular takes effect from December 1, 2013.

Article 12. Implementation Organization

1. The General Department of Energy - Ministry of Industry and Trade shall be responsible for guiding and supervising the implementation of this Circular.

2. Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally-run cities, investors constructing nuclear power plants, and related organizations shall be responsible for implementing the provisions of this Circular.

3. During the implementation process, if there are any difficulties, relevant agencies, organizations, and individuals shall promptly report in writing to the Ministry of Industry and Trade for consideration and amendment of this Circular.
