Detailed regulations on the content, format, and time for reporting on comprehensive management of marine resources and environmental protection of islands and seas
pursuant to the Law on Marine Resources and Islands' Environment dated June 25, 2015;

On the basis of Pursuant to Decree No. 51/2014/NĐ-CP dated May 21, 2014 of the Government on the transfer of certain marine areas to organizations and individuals for exploitation and utilization of marine resources;
Pursuant to the Law on the Sea of Vietnam dated June 21, 2012;
On the basis of Decision No. 130/2007/QĐ-TTg dated August 2, 2007, issued by the Prime Minister, concerning some mechanisms and financial policies for investment projects under the Clean Development Mechanism;
Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Director General of the Vietnam Marine and Island Administration and the Head of the Legal Department,

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 2. This Circular applies to ministries, ministerial-level agencies, agencies under the Government (hereinafter referred to collectively as ministries and sectors), and provincial People's Committees directly under the central government with coastal areas (hereinafter referred to collectively as provincial People's Committees).
Article 3. Types of reports on comprehensive management of marine resources and environmental protection of islands and seas
1. Reports from ministries and sectors on the situation of managing basic survey activities, scientific research, exploitation, utilization of marine resources, and environmental protection of islands and seas within their assigned sectors and fields.
2. Reports from provincial People's Committees on the situation of managing basic survey activities, scientific research, exploitation, utilization of marine resources and islands, comprehensive management of marine resources, and environmental protection of islands and seas within their jurisdiction.
3. Reports from the Ministry of Natural Resources and Environment on comprehensive management of marine resources and environmental protection of islands and seas submitted to the Government.
Article 4. Requirements for reports
1. Reports must be prepared in accordance with the requirements, content, format, and time stipulated in this Circular.
2. Information in the report must be complete, accurate, objective, and truthful.
3. The data in the report must be the latest available at the time of reporting.
4. The content of the report must reflect the current status of comprehensive management of marine resources and environmental protection of islands and seas, implementation results, difficulties encountered, causes, proposals, and recommendations for solutions to overcome these difficulties.
CONTENT, FORMAT, AND TIME FOR REPORTING ON COMPREHENSIVE MANAGEMENT OF MARINE RESOURCES AND ENVIRONMENTAL PROTECTION OF ISLANDS AND SEAS
Chapter II
Article 5. Content of reports from ministries and sectors
The content of reports from ministries and sectors includes the following main points:
1. An overview of the situation of managing basic survey activities, scientific research, exploitation, utilization of marine resources, and environmental protection of islands and seas.
2. Implementation results during the reporting period:
a) Work on drafting, issuing, enforcing, and inspecting normative legal documents on managing basic survey activities, scientific research, exploitation, utilization of marine resources, and environmental protection of islands and seas;
b) Implementation of strategies for sustainable exploitation and utilization of marine resources and environmental protection of islands and seas;
c) Implementation of marine use plans;
d) Implementation of overall plans for sustainable exploitation and utilization of coastal resources;
đ) Management and implementation of basic survey activities and scientific research on marine resources and environment;
e) Management of activities exploiting and utilizing marine resources and islands;
g) Environmental pollution control work in marine and island environments;
h) Prevention, response, and remediation work for oil and toxic chemical spills in the sea;
i) Statistics on marine and island resources; comprehensive monitoring and surveillance systems, and information databases on marine resources and environment;
k) International cooperation on marine resources and environment;
l) Publicity work on marine and islands; dissemination and education on laws related to comprehensive management of marine resources and environmental protection of islands and seas;
m) Inspection, supervision, and handling of violations in activities exploiting and utilizing marine resources and protecting the marine environment.
3. Difficulties, obstacles, causes, and proposals and recommendations for solutions to overcome them.
m) Inspect, supervise, and handle violations in the exploitation, utilization of resources, and protection of the marine and island environment.
3. Difficulties, obstacles, causes, and recommendations for proposed solutions to address them.
Article 5. Contents of the Report of the Provincial People's Committee
The contents of the report of the Provincial People's Committee include the contents prescribed in Article 4 of this Circular and the following contents:
1. Comprehensive management program for coastal resources.
2. Work on establishing and managing coastal protection zones.
3. Establishment and management of marine and island resource files.
4. Allocation and utilization of sea areas.
5. Management of submarine disposal activities.
Article 6. Contents of the Report of the Ministry of Natural Resources and Environment
The contents of the report of the Ministry of Natural Resources and Environment include the consolidation of the contents prescribed in Articles 4 and 5 of this Circular.
Article 7. Reporting Time
1. Reports of ministries, sectors, and provincial people's committees shall be conducted annually. The reporting period runs from January 1 to December 31 of the reporting year.
Reports must be submitted to the Vietnam Marine and Island Administration under the Ministry of Natural Resources and Environment before January 15 each year.
2. The report of the Ministry of Natural Resources and Environment shall be submitted to the Government before January 31 each year.
Article 8. Format of the Report
1. Report Form:
a) Reports of ministries, sectors, and reports of provincial people's committees shall be prepared according to Form No. 01 attached to this Circular;
b) Reports of the Ministry of Natural Resources and Environment submitted to the Government shall be prepared according to Form No. 02 attached to this Circular.
2. Report Format:
a) Reports must be presented in writing, signed with the name and position of the head of the reporting agency, stamped according to regulations, and accompanied by an electronic data file (file);
b) Summary tables accompanying the report must be stamped with a cross-stamp.
3. Method of Submitting Reports:
Reports shall be submitted to the receiving agency through one of the following methods:
a) Sent via postal service;
b) Sent directly;
c) Sending via fax;
d) Submission via email in the form of image files (PDF format) or electronic data files with digital signatures.
Chapter III
IMPLEMENTATION
Article 9. Implementation Organization
1. Units under the Ministry of Natural Resources and Environment are responsible for establishing and implementing reporting systems on the situation of basic investigation activities, scientific research, exploitation, utilization of resources, and marine and island environmental protection within their assigned management scope, similar to reports sent to the Vietnam Marine and Island Administration.
2. The Vietnam Marine and Island Administration is the central unit for consolidating reports from ministries, sectors, provincial people's committees, and units under the Ministry of Natural Resources and Environment.
3. Departments of Natural Resources and Environment of provinces and centrally governed cities with coastlines are the central units assisting provincial people's committees in consolidating and preparing reports.
Article 10. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from July 1, 2016.
2. Circular No. 28/2012/TT-BTNMT dated December 28, 2012, of the Minister of Natural Resources and Environment regarding the contents and reporting system for the management of basic investigation activities, resource exploitation, utilization, and marine and island environmental protection becomes invalid from the date this Circular takes effect.
3. Heads of agencies, organizations, and individuals related to this matter are responsible for its implementation.
4. In the course of implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for study, consideration, and resolution./.
