Amending some Articles of Circular No. 01/2016/TT-BVHTTDL dated March 24, 2016 issued by the Minister of Culture, Sports and Tourism detailing the implementation of certain provisions of Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government on artistic performances, fashion shows; beauty pageants and model contests; circulation and business of audio and video recordings of music and theater, and Decree No. 15/2016/NĐ-CP dated March 15, 2016 of the Government amending and supplementing certain provisions of Decree No. 79/2012/NĐ-CP

Pursuant to DecreeNo. 79/2012/NĐ-CP dated October 5, 2012 of the"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Government on artistic performances, fashion shows; beauty pageants and model contests;developmentcirculation, business of audio and video recordings of music and theater; lBased on Decree No. 15/2016/NĐ-CP dated March 15, 2016 of the Government amending and

Pursuant to DecreeNo. Article 1. Article 2 shall be amended as follows:shall"Article 2. Article 4 shall be amended as follows:i"Article 4. Procedure for revoking permits (as stipulated in Clause 3, Article 1 of Decree No. 15/2016/NĐ-CP)i 1. When violations are discovered, the competent authority shall revoke the permit by issuing a decision to revoke and notify the relevant organizations and individuals.No. 2. In cases where it does not have the authority to revoke the permit, the agency or organization discovering the violation shall be responsible for preparing a record and sending a written recommendation (Form No. 03) to the competent authority to consider and issue a decision to revoke (Form No. 4). If the permit is not revoked, a written response must be provided with reasons stated."

3. Article 7 shall be amended at Clause 9 as follows: "9. Budget for organizing the contest."

4. Amend the following forms specified in Article 13:

a) Form No. 01: Notification form for organizing artistic performances, fashion shows; beauty pageants, model contests;

b) Form No. 09a: Permit for foreign organizations and individuals to perform artistic performances, fashion shows;

c) Form No. 09b: Permit for Vietnamese individuals residing abroad to perform artistic performances, fashion shows.

"Article 4. Procedure and formalities for revoking licenses (as stipulated in Clause 3, Article 1 of Decree No. 15/2016/NĐ-CP)

1. When discovering any violation, the competent authority shall issue a decision to revoke the license and notify relevant organizations and individuals.

2. In cases where it does not have the authority to revoke the license, the agency or organization that discovers the violation shall be responsible for preparing a record and submitting a written recommendation to the competent authority with the power to revoke the license (Form No. 03) for consideration and issuance of a decision to revoke (Form No. 4). If the license is not revoked, a written response must be provided with clear reasons."

3. Article 7 is amended in Clause 9 as follows: "9. Budget for organizing contests."

4. Amend the following forms prescribed in Article 13:

a) Form No. 01: Notification document for organizing artistic performances, fashion shows; beauty and model contests;

b) Form No. 09a: License for foreign organizations and individuals to perform artistic performances, fashion shows;

c) Form No. 09b: License for Vietnamese individuals residing abroad to perform artistic performances, fashion shows."

Article 2. Repeal certain Articles, Clauses, and Points of Circular No. 01/2016/TT-BVHTTDL.

1. Article 3 on the conduct of artistic performers, fashion models; individuals who have won titles at beauty pageants or model contests shall not be implemented, disseminated, or circulated.

2. Points a and b of Clause 7, Article 7 regarding the content and form of the proposal to organize beauty pageants and model contests.

3. Clause 2 of Article 10 concerning cases where permission to organize beauty pageants and model contests will not be granted.

4. Clause 2 of Article 13 concerning Model No. 02: Notification of approval for organizing artistic performances, fashion shows; beauty pageants and model contests.

5. Clause 15 of Article 13 concerning Model No. 14: Commitment document to fully comply with legal provisions on copyright.

Article 3. Implementation Provisions

1. This Circular takes effect from January 1, 2017.

2. In the course of implementation, if there are any difficulties, organizations and individuals are advised to submit their recommendations to the Ministry of Culture, Sports and Tourism for study and amendment./.
