CIRCULAR

On the System of Statistical Indicators for the Justice Sector

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding implementation of certain provisions of the Law on Statistics;

Pursuant to Decree No. 97/2016/NĐ-CP dated July 1, 2016 of the Government stipulating the content of statistical indicators within the National Statistical Indicator System;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Planning and Finance Department;

The Minister of Justice promulgates this Circular on the System of Statistical Indicators for the Justice Sector.

 

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the System of Statistical Indicators for the Justice Sector, including a list of statistical indicators and their content within the jurisdiction of the Ministry of Justice as prescribed by law.

2. This Circular applies to agencies and organizations conducting statistical work in the Justice Sector.

Article 2. Purpose of the System of Statistical Indicators for the Justice Sector

1. The System of Statistical Indicators for the Justice Sector is a collection of indicators reflecting the situation and results of main activities in areas under the jurisdiction of the Ministry of Justice as prescribed by law, aimed at gathering information to form a system of statistical information for the Ministry and the Justice Sector, serving the directive and management work of the Ministry of Justice and higher-level state agencies; serving evaluations, forecasts, strategic planning, policy-making, and development plans for the Justice Sector and contributing to national economic and social development; meeting the need for statistical information on the Justice Sector by organizations and individuals.

2. Statistical indicators for the Justice Sector serve as a basis for division of responsibilities and coordination among agencies and organizations in establishing reporting systems for statistical work in the Justice Sector, developing statistical survey programs, and utilizing administrative data for statistical activities within the jurisdiction of the Ministry of Justice as prescribed by law.

Article 3. Structure of the Judicial Sector Statistical Indicators System

1. The list of statistical indicators for the Judicial Sector is specified in Appendix I attached to this Circular and includes: serial number, code, name of indicator.

2. The content of the statistical indicators for the Judicial Sector is detailed in Appendix II attached to this Circular, including indicators categorized by areas under the jurisdiction of the Ministry of Justice. Each indicator comprises: name, definition, calculation method, main classification, data sources and other contents as prescribed by the Statistics Law.

 Article 4. Implementation

1. Responsibilities of units under the Ministry of Justice

a) The Planning-Finance Department shall take the lead in coordinating with relevant units within the Ministry to organize the establishment of the reporting system for Judicial Sector statistics, submit it to the Minister for approval; take the lead or coordinate in organizing statistical surveys and using administrative data within the jurisdiction of the Ministry of Justice; compile information according to the Judicial Sector indicators system and report to the Minister for publication; monitor, guide, and report on the implementation of this Circular.

b) Heads of units under the Ministry related to this matter shall be responsible for collecting and compiling statistics nationwide for assigned indicators within the Judicial Sector indicator system and provide them to the Planning-Finance Department for compilation and submission to the Minister for publication.

2. Directors of Departments of Justice and heads of relevant agencies and organizations shall be responsible for organizing data collection, compilation, and provision on judicial work within their jurisdiction.

Article 5. Implementation Provisions

1. This Circular takes effect from February 15, 2018.

For the ten indicators with codes ranging from 1501 to 1510 in the field of state compensation listed in Appendices I and II attached to this Circular, they shall take effect from July 1, 2018.

2. During the implementation of this Circular, any difficulties or issues should be promptly reported to the Ministry of Justice for study and resolution./.
