REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL BORDER COMMISSION UNDER THE MINISTRY OF FOREIGN AFFAIRS

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 26/2017/ND-CP dated March 14, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

Considering the proposal of the Minister of Foreign Affairs;

The Prime Minister issues this Decision stipulating the functions, tasks, powers, and organizational structure of the National Border Committee under the Ministry of Foreign Affairs.

Article 1. Position and Functions

1. The National Border Commission (hereinafter referred to as the Commission) is an agency under the General Department level directly subordinate to the Ministry of Foreign Affairs, assisting the Minister of Foreign Affairs in performing state management functions over national borders and territories.

2. The Commission has legal personality, bears the State Emblem, and is entitled to open an account at the State Treasury in accordance with the provisions of the law, with its headquarters located in Hanoi City. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft resolutions, decisions, directives of the Government; draft decisions, directives of the Prime Minister regarding border and territorial affairs;

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Clause 1. To advise and assist the Minister of Foreign Affairs in presenting to the Government, the Prime Minister, and competent authorities:

b) Draft international treaties determining national borders and maritime zones of Vietnam; the scope of sovereignty, sovereign rights and jurisdiction of Vietnam over the continental shelf, maritime zones, islands, and archipelagos; plans for delimiting national borders, defining airspace boundaries, and maritime boundaries of Vietnam with neighboring countries;councillORSc) Strategies, target programs of the nation, action programs, projects, and important proposals on border and territorial affairs or related to national borders and territories.

2. Submit to the Minister of Foreign Affairs for consideration and decision:to b) Long-term, medium-term, and annual plans on border and territorial affairs.This Resolution takes effect from the date it is adopted by the National Assembly.3. Implement policies, strategies, plans, programs, projects, and proposals on border and territorial affairs after they have been issued or approved by competent authorities.

4. Provide professional guidance on state management of national borders and territories.

5. Organize the implementation of information dissemination and popularization of Party guidelines and state laws on national borders and territories. tr6. Study and propose policies for signing and implementing international treaties related to borders and territories.

a) Draft circulars and other documents on border work, national territory;

7. Organize negotiations to resolve border and territorial issues with relevant countries.

8. Direct, guide, organize the implementation, and inspect the demarcation and erection of national boundary markers based on international treaties on national borders signed between Vietnam and neighboring countries.

9. Summarize, evaluate, and inspect the situation of border and territorial management, airspace, maritime zones, islands, and archipelagos of Vietnam; forecast, propose policies and appropriate measures for management.

10. Take the lead and coordinate with ministries, agencies at the ministerial level, related agencies, and localities to implement inspections, monitoring, summarizing situations, and handling disputes, defending sovereignty, sovereign rights, jurisdiction, and legitimate interests of Vietnam in border areas on land, airspace, maritime zones, islands, and archipelagos, and other legitimate rights and interests of Vietnam in international airspace and maritime zones.

11. Develop and propose Vietnam's stance at international forums related to borders and territories; propose policies and build dossiers for legal proceedings to resolve border and territorial disputes before international judicial bodies.

12. Implement international cooperation related to national borders and territories in accordance with the law; dialogue on border and territorial issues with relevant countries and partners; take the lead and coordinate in managing the organization of international conferences and seminars on borders and territories in Vietnam.

13. Take the lead and coordinate with ministries, agencies at the ministerial level, related agencies, and localities to advise the Government on building and implementing projects and programs to protect border lines and national boundary markers; develop the economy, society, defense, and security related to borders, territories, sovereignty, sovereign rights, and jurisdiction., 14. Handle or guide the handling of issues arising from the activities of ministries, agencies at the ministerial level, related agencies, and localities concerning sovereignty, sovereign rights, jurisdiction, and national interests on land, airspace, maritime zones, islands, and archipelagos, and other legitimate rights and interests of Vietnam in international airspace and maritime zones.

15. Review maps and publications related to national borders, airspace, maritime zones, islands, and archipelagos before publication and distribution.

16. Organize the establishment of databases on national borders and territories.a 17. Implement administrative reform according to the goals and contents of the state administrative reform program approved by competent authorities.

18. Manage organizational structures and staffing; implement salary systems and incentive policies, training, commendation, and disciplinary measures for civil servants and employees under the Commission's management in accordance with the law and the delegation of the Minister of Foreign Affairs.

19. Manage financial resources allocated and organize the implementation of the state budget in accordance with the law.policies20. Organize citizen reception, handle complaints and denunciations, and prevent corruption, promote thrift, and combat waste and negative practices in accordance with the law.

21. Perform other tasks and powers assigned by the Minister of Foreign Affairs and as provided by law.

These organizations assist the Director of the Commission in performing state management functions. The Office is organized into four departments.

Article 3. Organizational Structure

4. Department of Propaganda, Information, and Documentation.

5. Office.

These organizations are administrative bodies assisting the Director of the Committee in performing state management functions. The Office is organized into four departments.

Article 4. Leadership of the Committee

1. The Committee has a Director and not more than four Deputy Directors.

2. The Chairman of the Committee shall be appointed and relieved of duty by the Minister of Foreign Affairs and shall be responsible to the Minister of Foreign Affairs for all activities of the Committee. The Minister of Foreign Affairs shall appoint a Deputy Minister as the Chairman of the Committee.

3. The Deputy Chairmen of the Committee shall be appointed and relieved of duty by the Minister of Foreign Affairs upon the proposal of the Chairman of the Committee and shall be responsible to the Chairman of the Committee for the assigned areas of work.

Article 5. Effectiveness and responsibility for implementation

1. This Decision shall take effect from April 5, 2019; replacing Decision No. 108/2008/QĐ-TTg dated August 8, 2008 of the Government Chairman on the functions, tasks, powers, and organizational structure of the National Border Committee under the Ministry of Foreign Affairs.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees directly under the central government, Chairman of the National Border Committee, and related agencies and organizations shall be responsible for implementing this Decision./.
