ISSUING STANDARDS FOR EXPENSES new rural areas

Decree No. 81/2017/NĐ-CP dated July 17, year 2017 OF THE GOVERNMENT PROVIDING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CONSTRUCTION;

Decree No. 68/2019/NĐ-CP dated August 14, year 2019 of the Government on investment construction cost management;

the Director at the proposal of the Director of the Institute of Construction Economics and the Director of the Department of Construction Economics;

The Minister of Construction issues this Circular to promulgate construction norms new rural areas.

Article 1. Scope of application

Accompanying this Circular are construction norms including: construction survey budget norms for construction projects; construction project budget norms; technical system installation budget norms for construction projects; machine and technological equipment installation budget norms; specialized construction experiment budget norms; construction project repair and maintenance budget norms; construction material usage norms. These construction norms issued in this Circular shall be applied to determine the investment construction costs of projects using state budget funds, non-budget state funds, and public-private partnership (PPP) construction investment projects.

Article 2. Group Scope of application

1. This Circular applies to organizations and individuals related to determining the investment construction costs of construction investment projects using state budget funds, non-budget state funds, and public-private partnership (PPP) construction investment projects as stipulated in Clause 1, Article 2 of Decree No. 68/2019/ND-CP dated August 14, 2019 of the Government on investment construction cost management.
2. Construction norms issued in this Circular may be applied to determine the investment construction costs of other construction investment projects as a basis for performing financial obligations towards the State.

Article 3. Transitional provisions

The application of construction norms during the transitional period as stipulated in Article 36 of Decree No. 68/2019/ND-CP is specified as follows:

1. For construction investment projects approved before the effective date of Decree No. 68/2019/ND-CP and currently being implemented, continue to apply and utilize construction norms as prescribed in Decree No. 32/2015/ND-CP dated March 25, 2015 of the Government on investment construction cost management. In cases where construction tender packages have not signed contracts after the effective date of this Circular, the investor shall decide to apply the construction norms issued in this Circular to adjust the tender package prices but must meet the project's schedule and effectiveness requirements.
2. For construction investment projects approved after the effective date of Decree No. 68/2019/ND-CP:

1. If construction tender packages have already utilized and applied construction norms as prescribed in Decree No. 32/2015/ND-CP to determine tender package prices, selected contractors, and signed construction contracts before the effective date of this Circular, they shall implement according to the contents of the signed contracts.
2. If construction tender packages have not yet commenced contractor selection or are in the process of selecting contractors before the effective date of this Circular, the construction norms issued in this Circular shall be applied to update the tender package prices.

3. For construction contracts based on adjustable unit prices that were signed before the effective date of this Circular, price adjustments shall be based on the contents of the signed contracts and applicable laws governing the contracts.

Article 4. Effective date

This Circular takes effect from February 15, 2020.
