Guidelines on leadership and management positions, specialized occupational titles, and the structure of civil servants according to occupational titles in public service units under the natural resources and environment sector

Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and staffing levels in public service units;

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Personnel Department and the Director of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular to provide guidelines on leadership and management positions, specialized occupational titles, and the structure of civil servants according to occupational titles in public service units under the natural resources and environment sector.

Article 1. Scope of Regulation

This Circular provides guidelines on leadership and management positions, specialized occupational titles, and the structure of civil servants according to occupational titles in public service units under the natural resources and environment sector.

Article 2. Applicability

Article 1. This Circular applies to public service units under the natural resources and environment sector established in accordance with the provisions of the law and related organizations and individuals.

2. This Circular does not apply to:

a) Public service units under the Ministry of Public Security, Ministry of Defense;

b) Public service units under the management of special administrative-economic units.

Article 3. Principles and bases for determining job positions

Clause 1. Principles for determining job positions

a) Ensuring the principles stipulated in Article 3 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and the number of employees in public service units;

b) Each job position must have a specific name and be associated with a leadership or management post or a rank of occupational title of civil servant.

Clause 2. Bases for determining leadership and management job positions and specialized occupational titles in the natural resources and environment sector shall be implemented in accordance with the provisions of Clause 1, Article 4 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and the number of employees in public service units.

Article 4. List and description of job positions

Clause 1. List of job positions

a) The list of leadership and management job positions in public service units under the natural resources and environment sector as specified in Appendix I attached hereto;

b) The list of job positions of specialized occupational titles in public service units under the natural resources and environment sector as specified in Appendix II attached hereto.

Clause 2. Description of job positions

a) Job descriptions and competence frameworks of leadership and management job positions and specialized occupational titles in the natural resources and environment sector as specified in Appendix III attached hereto. Public service units shall establish specific job descriptions and competence frameworks based on the functions and tasks of the unit and the job descriptions specified in Appendix III attached hereto, and submit them to the competent authority for approval;

b) The competence framework of leadership and management job positions must be consistent with the standards of leadership and management positions prescribed by the competent authority; the competence framework of job positions of specialized occupational titles in the natural resources and environment sector must ensure consistency with the standards of specialized occupational titles of civil servants in the natural resources and environment sector prescribed by the Ministry of Natural Resources and Environment or the standards of administrative civil service ranks prescribed by the Ministry of Home Affairs. The levels of each group of competencies in the competence framework specified in Appendix IV attached hereto.

Article 5. Staff Structure According to Professional Titles

The determination of the structure of civil servants according to occupational titles shall be carried out in accordance with the provisions of Clause 3, Article 4 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and the number of employees in public service units.

Article 6. Effectiveness

Article 1. This Circular takes effect from November 20, 2023.

2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the provisions of the amended, supplemented, or replacing documents.

Article 7. Transitional Provisions

For civil servants currently holding a higher rank of occupational title than the required rank of occupational title for the job position as prescribed in this Circular, they will be retained until new guidelines on salary systems are issued.

Article 8. Implementation organization

Article 1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, cities directly under the central government, relevant agencies, organizations, and individuals are responsible for implementing this Circular.

Article 2. In the course of implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Natural Resources and Environment for consideration and resolution./.
