of the Governor of the State Bank of Vietnam promulgating the Circular suspending the implementation of certain provisions of Circular No. 39/2016/TT-NHNN dated December 30, 2016 of the Governor of the State Bank of Vietnam on the lending activities of credit institutions and branches of foreign banks for customers (amended by Circular No. 06/2023/TT-NHNN dated June 28, 2023 of the Governor of the State Bank of Vietnam).

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;
Pursuant to the Law on Credit Institutions dated June 16, 2010; the Law Amending and Supplementing Certain Articles of the Law on Credit Institutions dated November 20, 2017;
Pursuant to Decree No. 102/2022/NĐ-CP dated December 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
Article 1.
Suspension of the implementation of Clause 8, Clause 9, and Clause 10 of Article 8 of Circular No. 39/2016/TT-NHNN dated December 30, 2016 of the Governor of the State Bank of Vietnam on the lending activities of credit institutions and branches of foreign banks for customers (amended according to Clause 2 of Article 1 of Circular No. 06/2023/TT-NHNN dated June 28, 2023 of the Governor of the State Bank of Vietnam on amending and supplementing certain articles of Circular No. 39/2016/TT-NHNN) from September 1, 2023 until the effective date of new regulatory legal documents governing these issues.
Article 1. This Circular takes effect from September 1, 2023.
Article 2. Implementation clause
The Director of the Office, Heads of Departments under the Monetary Policy Department, Heads of Units under the State Bank of Vietnam, Governors of the State Bank of Vietnam Branches in provinces and centrally governed cities, credit institutions, and branches of foreign banks are responsible for organizing the implementation of this Circular./.
This Circular takes effect from December 25, 2025/.
The Head of the Office, the Director of the Monetary Policy Department, the Heads of units under the State Bank of Vietnam, the Governors of the State Bank branches in provinces and centrally governed cities, credit institutions, and foreign bank branches shall be responsible for organizing the implementation of this Circular./.
