Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;

Pursuant to Decree No. 23/2014/NĐ-CP dated April 3, 2014 of the Government on the Charter on Organization and Operation of the National Science and Technology Development Fund amended and supplemented by certain provisions pursuant to Decree No. 19/2021/NĐ-CP dated March 15, 2021 of the Government;

At the proposal of the Director of the National Science and Technology Development Fund and the Director of the Legal Department;

The Minister of Science and Technology issues this Circular amending and supplementing certain provisions of Circulars on management of scientific and technological tasks and activities to enhance national scientific and technological capacity funded by the National Science and Technology Development Fund.

Article 1. Amending and supplementing certain provisions of Circular No. 37/2014/TT-BKHCN dated December 12, 2014 of the Minister of Science and Technology on management of basic research projects funded by the National Science and Technology Development Fund.

1. Amending and supplementing Clause 3, Clause 4, Clause 5, and Clause 6 of Article 2 as follows:

“3. International reputable journal These are scientific journals selected from the categories of journals ranked and classified according to the world's popular scientific databases, approved by the Management Council of the Fund.

4. Principal author The author of the article published in scientific journals is the person who has made significant contributions to forming the idea, organizing the research implementation, and publishing the research results.

5. Exploratory project is a project aimed at promoting the research of young scientists under 40 years old or scientists registering for their first basic research project funded by the Fund.

6. Development project is a project oriented towards long-term major goals to promote outstanding and breakthrough research results, combining the establishment of research groups and training high-level scientific human resources.”

2. Amending and supplementing Clause 4 as follows:

"Article 4. Projects supported by the Fund

The Fund will consider supporting basic research projects proposed by organizations and individuals, including:

1. Exploratory projects;

2. Development projects.”

3. Supplementing Clause 3 of Article 5 as follows:

“3. Participating and presenting reports on project outcomes at international conferences and seminars abroad.”

4. Amend and supplement Clause 1 of Article 6 as follows:

“1. Evaluation through the Science and Technology Council (hereinafter referred to as the Science Council) and independent expert advisors (outside the Science Council) when necessary;”

5. Amending and supplementing Article 7 as follows:

“Article 7. Experts for evaluation

1. Evaluation experts are scientists invited by the Fund to advise and evaluate matters related to the Fund’s funding and support activities, either as independent advisors or members of the Science Council. Evaluation experts must meet the following criteria:

a) Evaluation experts have research results published in reputable international journals or specialized monographs in the last five years. In special cases, the decision is made by the Chairman of the Management Council of the Fund;

b) Agree to participate in advisory and evaluation work with high responsibility, honesty, and objectivity.

2. Evaluation experts are responsible for their advisory and evaluation opinions; keep confidential information related to advisory and evaluation work; comply with academic integrity and research ethics regulations during the evaluation process.

3. Evaluation experts shall not participate in evaluating projects they themselves have registered as principal investigators or participated in implementing, or projects registered by the organization where they work as the principal investigator; shall not participate in scientific and technological advisory and evaluation activities if there are other rights, interests, conflicts of interest, or other reasons affecting the objectivity of the evaluation results.

4. The Management Council of the Fund approves the regulation on the database of experts of the Fund consistent with the criteria set out in Clause 1 of this Article.”

6. AMENDING AND SUPPLEMENTING ARTICLE 8 AS FOLLOWS:

“Article 8. Scientific Council

1. The Scientific Council shall be established by field or inter-field science upon the decision of the Management Board of the Fund based on the proposal of the Director of the Fund to advise the Fund on the following issues:

a) Evaluation and selection of projects, assessment of project implementation results;

b) Other issues related to the activities of the Fund.

2. Members of the Scientific Council shall be selected according to the following conditions and criteria:

a) Belonging to the Fund's expert database;

b) Recommended by scientists in the same field or inter-field;

c) Committing to participate and comply with the regulations of the Fund;

d) Criteria for evaluators as stipulated in Clause 1, Article 7 of this Circular.

3. The Scientific Council operates on a two-year term. A member participating in the Scientific Council shall not exceed three consecutive terms; permanent members of the Scientific Council (including chairman, vice-chairman, and scientific secretary) shall hold their positions for no more than two consecutive terms.

4. In case of necessity, the Management Board of the Fund shall consider and decide to adjust or supplement members of the Scientific Council based on the proposal of the Director of the Administrative Agency of the Fund.

5. The Management Board of the Fund shall prescribe the operational regulations of the Scientific Council.”

6 ||| 7. Amend and supplement Article 9 as follows:

“Article 9. Application Documents for Project Implementation

1. Based on the activity plan, the Fund shall announce its research funding activities, provide guidance on relevant conditions, procedures, and deadlines for submitting application documents for funding on the Fund’s electronic portal.

2. The application documents for project implementation shall be written in Vietnamese and English according to the form prescribed in the Appendix issued together with this Circular, including:

a) Project registration form (Form NAFOSTED 01, Form NAFOSTED 01E);

b) Project description (Form NAFOSTED 02, Form NAFOSTED 02E);

c) Academic curriculum vitae of the project leader and research participants (Form NAFOSTED 03, Form NAFOSTED 03E), supporting documents of research results and training.

3. The application documents may be submitted through the following methods: direct submission or via public postal service to the One-Stop Service Department of the Fund or online submission on the Information System for Administrative Procedures of the Ministry of Science and Technology.”

8. Amending and supplementing Article 10 as follows:

“Article 10. Requirements for Organizations and Individuals Implementing Projects

1. For the organization leading the project:

a) Having legal personality, having functions suitable for the field of expertise of the project, and having sufficient material and technical facilities to serve the research activities of the project;

b) At the time of submitting the application documents for project implementation, having submitted the consolidated report on the results of the project implementation and refunded the recoverable funds according to the regulations for previous projects funded by the Fund (if any).

- Conduct research strictly in accordance with the approved outline, ensuring schedule and quality requirements.

a) Having expertise appropriate to the content of the research project;

b) Having research capacity meeting the requirements of the project: holding a doctoral degree and having relevant research results published in reputable international journals within the last five years up to the date when the Fund announces the acceptance of project application documents.

3. Participants in the project must have professional qualifications and skills appropriate to the content of the research project, including:

a) Main participants, scientific secretary: Holding a doctoral degree and having relevant research results published in scientific journals within the last five years up to the date when the Fund announces the acceptance of project application documents.

In case of a master's degree holder, they must have relevant research results, at least one article published in a reputable international journal for natural sciences and engineering; one article published in a reputable international journal or one monograph or two other scientific articles for social sciences and humanities within the last five years up to the date when the Fund announces the acceptance of project application documents.

b) Participant;

c) Technician, other support staff;

d) Research students participating in the project whose dissertation topic is relevant to the project.

4. For development projects, in addition to the requirements stipulated in Clauses 1, 2, and 3 of this Article, the following requirements must also be met:

a) The project leader must be the main author of at least one publication in a reputable international journal belonging to the first or second quartile (Q1 or Q2) within the last five years up to the date when the Fund announces the acceptance of project application documents, capable of gathering many high-level experts to participate in the project, maintaining regular scientific cooperation with international research groups in the same or inter-field;

b) At least two main participants of the project must meet the requirements of the project leader as stipulated in Clause 2 of this Article.

5. At the same time, each individual can lead no more than one (1) project funded by the Fund (except in cases where they take on the role of leading urgent scientific and technological tasks of significant importance in both science and practice).

6. The project leader shall not violate the conditions for leading or participating in projects as prescribed in Clause 5, Article 19 of this Circular.”

9. Amend and supplement Article 11 as follows:

“Article 11. Requirements for the duration of implementation and research results of the project

1. Duration of project implementation

a) For exploration and discovery projects, the duration of project implementation is 36 months (excluding extension periods);

b) For development projects, the duration of project implementation is either 48 or 60 months (excluding extension periods).

2. Research results of exploration and discovery projects must include at least one article published in an internationally reputable journal listed in the Catalogue issued by the Fund most recently before the submission date.

The head of the exploration and discovery project must be the main author of at least one article published in an internationally reputable journal as a result of the project.

3. Research results of development projects must include at least two articles published in internationally reputable journals belonging to the first quartile or second quartile group in the Catalogue issued by the Fund most recently before the submission date, and support training for at least one doctoral student.

The head and key members of the development project must be the main authors of at least one article published in an internationally reputable journal as a result of the project. The doctoral student of the development project must be the author of at least one article published in an internationally reputable journal as a result of the project.

4. All publications resulting from the project must acknowledge funding from the Fund according to the project code number. In cases where publications acknowledge funding from multiple projects funded by the Fund or simultaneous funding from the Fund and another sponsor, detailed explanations and full evidence must be provided to demonstrate that there is no overlap in the use of Fund funds or other state funds.”

10. Amend and supplement Article 12 as follows:

“Article 12. Methods and criteria for evaluating and selecting projects

1. The Fund implements the evaluation and selection of projects according to the principles stipulated in Article 6 of this Circular.

2. Evaluation and selection criteria for projects:

a) Suitability with the type of basic research project supported by the Fund, the importance, significance, and necessity of the project;

b) Novelty and creativity of the project;

c) Objectives of the project (clarity, specificity, and scientific basis); suitability of the content, methods, and research plan to achieve the project objectives;

d) Research capacity and experience of the project leader and research team; material and technical conditions of the host organization serving research;

đ) Expected results and success potential of the project;

e) Contribution to postgraduate education;

g) Reasonable budget estimate for research.

3. The Management Board of the Fund specifies the procedures for organizing the evaluation and selection process and the working method of the Scientific Council during evaluation and selection sessions.”

11. Amend and supplement Article 13 as follows:

“Article 13. Financial review, approval, and publication of the project list

1. Based on the evaluation and selection results, the Fund's management agency reviews the financial resources required to implement the proposed projects. The financial review is conducted through the Financial Review Team. The Management Board of the Fund defines the composition and working method of the Financial Review Team and assigns the Fund Director to establish the Financial Review Team.

2. The Fund's management agency reports the evaluation and selection results, financial review results, and compares them with the Fund's plans and financial capabilities, then submits to the Management Board of the Fund for consideration and decision on approving the project list and funding.

3. Based on the report of the Fund's management agency, the Management Board of the Fund considers and decides on approving the project list and funding. If necessary, the Management Board of the Fund seeks additional opinions from independent consultants before making a decision.

4. Within six months from the deadline for submitting applications, the Fund publishes the list of funded projects on its official website.

12. Amend and supplement Article 15 as follows:

“Article 15. Implementation of Research Funding Contracts

1. Based on the Decision approving the list and budget for research topics, the Fund Management Agency shall issue a Notice of Funding and guide organizations and individuals to complete the necessary procedures for signing the contract.

2. The Fund Management Agency shall enter into a research funding contract (hereinafter referred to as the contract) with the leading organization and the project leader according to the model prescribed in the Appendix issued together with this Circular (NAFOSTED Model 04).

3. The contract serves as a legal basis during the implementation, inspection, evaluation of the project, and resolution of issues related to the project. The project proposal, after approval, and any amendments made during the implementation process (if any) are integral parts of the contract.

4. Revocation of the funding approval decision, adjustment, and termination of the contract during the implementation of the project shall be carried out in accordance with the provisions of Articles 14 to 22 of Circular No. 15/2016/TT-BKHCN dated June 30, 2016, issued by the Minister of Science and Technology on the management of applied research projects funded by the National Research Development Fund and any subsequent amendments and supplements (if any).

13. Amend and supplement Article 16 as follows:

“Article 16. Reporting and Periodic Inspection

1. Based on the progress and content of the research recorded in the contract, the project leader and the leading organization shall prepare a periodic report on the implementation of the project according to the model prescribed in the Appendix issued together with this Circular (NAFOSTED Model 05) and submit it to the Fund Management Agency.

2. The Fund Management Agency shall establish a periodic evaluation board to assess the progress, results, and financial usage of the project through the periodic reports on the implementation of the project.

In case of necessity, the Fund Management Agency may organize an actual inspection of the project's implementation based on the recommendations of the periodic evaluation board. The inspection results shall be recorded in a protocol signed by all relevant parties.

3. The results of the periodic evaluation and the actual inspection of the project's implementation (if any) shall be reported to the leading organization and the project leader and serve as the basis for deciding whether to continue implementing the contract.

For projects that violate the terms committed in the contract, the Fund shall consider the extent of the violation and handle it according to current regulations.

4. The Fund Management Board shall specify the composition and working methods of the periodic evaluation board.

14. Amend and supplement Article 17 as follows:

“Article 17. Reporting on the Results of Project Implementation

1. The report on the results of project implementation includes:

a) A comprehensive report on the results of project implementation according to the model prescribed in the Appendix issued together with this Circular (NAFOSTED Model 06);

b) An appendix containing the results published and other results of the project with supporting evidence.

2. The project leader and the leading organization are responsible for preparing the report on the results of project implementation and submitting it to the Fund within thirty days from the end date of the project implementation period.

15. Amend and supplement Article 18 as follows:

“Article 18. Evaluation of Project Results

1. The Fund shall organize the evaluation of project results in accordance with the principles stipulated in Article 6 of this Circular.

2. The evaluation dossier for project results includes:

a) Report on the results of project implementation;

b) Contract (including the project description);

c) Any amendments made during the implementation of the contract (if any).

3. Criteria for evaluating project results:

a) Organization of implementation and use of project funds;

b) Quantity and quality of research outcomes achieved during the project implementation period, as reflected in the comprehensive report on the results of project implementation and accompanying evidence;

c) Quantity and quality of publications during the project implementation period (if any): articles published in reputable international journals, other scientific journals (online or print); articles submitted for publication in reputable international journals and accepted for review; scientific presentations at conferences and seminars; monographs; other results;

d) Postgraduate training; support for young scientists; development of research teams;

đ) Success level of the project when comparing the achieved results with the research objectives and expected results outlined in the project description.

4. The Fund Management Board shall specify the procedures for organizing the evaluation of project results and the working methods of the Scientific Council at the evaluation session.

16. Amend and supplement Article 19 as follows:

“Article 19. Recognition and Handling of Research Project Results Evaluation

1. Based on the evaluation of research project results by the Scientific Council, the leading and principal organization of the project shall be responsible for registering the implementation results in accordance with the laws on registration and retention of information about science and technology tasks.

2. The Fund's management agency shall compile the content of the evaluation of the project implementation results, submit it to the Fund Management Council for consideration, and issue a decision recognizing the project implementation results. In necessary cases, the Fund Management Council shall seek additional opinions from independent experts before making a decision.

3. The decision recognizing the project implementation results serves as the basis for conducting the contract termination procedures.

4. The leading and principal organization of the basic research project funded by the Fund, and the members of the research group shall be recognized for their research achievements equivalent to national-level science and technology tasks.

5. Projects evaluated as not meeting requirements or having contracts terminated shall be handled according to the investment regulations and financial mechanisms for scientific and technological activities.

In case the project does not meet requirements, the principal investigator of the project shall not be eligible to register as the leading researcher of a new project within two years from the date of issuance of the Decision recognizing the project implementation results.

In case there is misconduct leading to suspension of implementation or criminal prosecution or violation of academic integrity and research ethics, the principal investigator and those criminally prosecuted shall not participate in projects funded by the Fund within five years from the date of the violation handling document issued by the competent state authority and completed execution.

17. Amend and supplement some points in Clause 1, Article 20 as follows:

a) Amend and supplement Point c Clause 1 as follows:

"c) Receive, manage, use, settle accounts, and finalize the funds provided by the Fund, confirm the progress of implementation, the situation of fund usage, and manage the files and vouchers in accordance with the regulations;"

b) Supplement point l and point m after point k in Clause 1 as follows:

l) Ensure academic integrity and research ethics regarding contents related to the Fund-supported project;

m) Publicly introduce in the leading organization updated information about the Fund-supported project, including the project name, total funding, implementation period, principal investigator and members of the project, research results throughout the implementation period (Model NAFOSTED 08);"

18. Repeal Article 14.

19. Replace and supplement the forms issued together with the Appendix of Circular No. 37/2014/TT-BKHCN dated December 12, 2014, of the Minister of Science and Technology, regulating the management of basic research projects funded by the National Science and Technology Development Fund as follows:

a) Replace forms NCCB01, NCCB01E, NCCB02, NCCB02E, NCCB03, NCCB03E, NCCB04, NCCB05, NCCB06, NCCB07, NCCB08 with forms NAFOSTED 01, NAFOSTED 01E, NAFOSTED 02, NAFOSTED 02E, NAFOSTED 03, NAFOSTED 03E, NAFOSTED 04, NAFOSTED 05, NAFOSTED 06 in Appendix I issued together with this Circular;

b) Supplement form NAFOSTED 07, NAFOSTED 08 in Appendix I issued together with this Circular.

Article 2. Amending, supplementing, and abolishing certain provisions of Circular No. 40/2014/TT-BKHCN dated December 18, 2014, issued by the Minister of Science and Technology on the management of urgent scientific and technological tasks with significant scientific and practical importance, and potential scientific and technological tasks funded by the National Research Development Fund

1. Amending Clause 2, Clause 3, and supplementing Clause 4 of Article 2 as follows:

“2. Potential scientific and technological task is a scientific and technological topic with high applicability according to priority research directions issued by the Fund, with prospects for creating new products (hereinafter referred to as potential topics).

3. International reputable journal These are scientific journals selected from the categories of journals ranked and classified according to the world's popular scientific databases, approved by the Management Council of the Fund.

4. Principal author of an article published in scientific journals is the author who has made significant contributions to forming the idea, organizing the implementation of research, and publishing research results."

2. Amending and supplementing Point c Clause 1 of Article 3 as follows:

"c) The time of emergence of the issue shall not exceed six (06) months from the date of submission of the application. The duration of implementing the topic shall not exceed eighteen (18) months (including extension periods);"

3. Amending and supplementing Point b Clause 2 of Article 3 as follows:

"b) Any products published by the topic (if any) must acknowledge the Fund's sponsorship according to the correct project code. In cases where the published product acknowledges sponsorship from multiple projects funded by the Fund or acknowledges sponsorship simultaneously by the Fund and another sponsor organization, detailed explanations and full evidence must be provided regarding the non-duplication of Fund funds or other state funds."

4. Amending and supplementing Article 4 as follows:

“Article 4. Requirements for potential topics

1. Potential topics proposed by organizations or individuals to the Fund must meet the following requirements:

a) Must have breakthrough and pioneering characteristics; upon successful research, they have the potential to create new products; there must be application addresses for the main results generated when the topic is completed;

b) Must align with priority research directions issued by the Fund;

c) The duration of implementing the topic shall not exceed thirty-six (36) months (including extension periods).

2. Products of the topic

a) A comprehensive report on the implementation results of the topic including scientific and technological solutions with sufficient scientific and practical grounds to promote the creation of new products and solve the issues raised.

b) Scientific publication in at least one of the following forms:

- Two articles published in reputable international journals;

- One article published in a reputable international journal and one draft monograph (for social sciences and humanities fields);

- One patent;

- One plant variety protection certificate.

In cases where a patent or plant variety protection certificate has not yet been granted, there must be an acceptance notice and proof of the acceptance of the examination request by the competent authority issuing the patent or plant variety protection certificate, along with search results on the possibility of protection from recognized authorities or organizations.

The principal investigator of the topic is the primary author in scientific articles, the inventor of the patent, and the author of the plant variety protection certificate, which are results of the topic. Main members of the topic are authors of at least one publication that is a result of the topic.

Any publications of the topic must acknowledge the Fund's sponsorship according to the correct project code. In cases where the published product acknowledges sponsorship from multiple projects funded by the Fund or acknowledges sponsorship simultaneously by the Fund and another sponsor organization, detailed explanations and full evidence must be provided regarding the non-duplication of Fund funds or other state funds."

5. Amending and supplementing Clause 1 of Article 5 as follows:

"1. Evaluation through the Science and Technology Council (hereinafter referred to as the Science Council) and independent consultants (outside the Science Council)."

6. Supplementing Article 5a after Article 5 as follows:

“Article 5a. Expert Appraisers

1. Expert appraisers are scientists and managers invited by the Fund to provide advisory services and evaluations on matters related to the Fund's financial support activities, acting as independent consultants or members of the Scientific Council. Expert appraisers must meet all of the following criteria:

a) An expert appraiser who is a scientist must have research results published in reputable international journals or monographs, or be an inventor of patents or useful solutions, or plant varieties protected by intellectual property rights within the last five years. An expert appraiser who is a manager must work in the relevant field or be involved in issues related to research. In special cases, this shall be decided by the Chairman of the Fund Management Board.

b) Agree to participate in advisory work with high responsibility, honesty, and objectivity.

4. The Fund Management Board shall issue regulations on the database of experts of the Fund in accordance with the criteria set forth in Clause 1 of Article 5a of this Circular.

7. Amend and supplement Article 6 as follows:

“Article 6. Scientific Council

1. The Scientific Council shall be established by the Fund Management Board based on the proposal of the Fund Director to advise the Fund on the following issues:

a) Evaluation and selection of projects, assessment of project implementation results;

b) Other issues related to the activities of the Fund.

2. The Scientific Council includes members who are scientists and managers. Members of the Scientific Council shall be selected according to the following conditions and criteria:

a) Belonging to the Fund's expert database;

b) Commitment to participate and implement the Fund's regulations;

c) Criteria for expert appraisers as stipulated in Clause 1 of Article 5a of this Circular.

3. Where necessary, the Fund Management Board shall consider and decide to adjust and supplement members of the Scientific Council based on the proposal of the Director of the Fund Administrative Agency.

4. The Fund Management Board shall issue specific provisions on the operational regulations of the Scientific Council.

8. Amend and supplement Article 8 as follows:

“Article 8. Application Documents for Project Implementation

1. Based on the activity plan, the Fund announces the acceptance of application documents and provides guidance on relevant conditions, procedures, and methods for submitting application documents for urgent projects and potential projects; it also publishes the list of priority research directions on the Fund's electronic portal.

2. Application documents for project implementation shall be in the form prescribed in the Appendix attached to this Circular, including:

a) Project registration form (NAFOSTED Form 01);

b) Project description (NAFOSTED Form 02);

c) Academic curriculum vitae of the individual registering as the project leader and other individuals participating in the project (NAFOSTED Form 03);

d) Other related documents if organizations or individuals deem it necessary to supplement to enhance the persuasiveness of the application documents (if any).

9. Amend and supplement Article 9 as follows:

“Article 9. Requirements for Organizations and Individuals Registering for Project Implementation

1. For organizations registering as the main project proponent:

a) Having legal personality and the capacity to operate in fields relevant to the project's specialty;

b) Having appropriate material and technical conditions to implement the project;

c) At the time of submitting the application documents for project implementation, having submitted comprehensive reports on the results of previously funded projects and repaid recovered funds in accordance with regulations (if applicable).

2. For individuals registering as the project leader:

a) Being the proposer and principal author of the project description;

b) Having a university degree or higher and currently working in a field relevant to the project's research content;

c) Having the ability to organize project implementation and ensure sufficient time to lead the project;

d) Not being restricted from exercising civil rights under Vietnamese law;

đ) Not violating the conditions for registering as the main project proponent as stipulated in Clause 4 of Article 18 of this Circular;

e) Meeting at least one of the following requirements:

- Being the primary author of an article published in a reputable international journal or an inventor of a patent or plant variety protected by intellectual property rights (relevant to the research field of the registered project) within seven years from the date of submission;

- Being the author of a monograph (in the field of social sciences and humanities) relevant to the research direction of the registered project within seven years from the date of submission.

3. At the same time, each individual may not serve as the project leader for more than one (1) project funded by the Fund (except in the case of additionally serving as the leader of an urgent project).

10. Amend and supplement Article 10 as follows:

“Article 10. Criteria for evaluating and selecting research topics

1. The necessity of the research issue and its suitability with the requirements for urgent or potential topics as stipulated in Clause 1 of Article 3 and Clause 1 of Article 4 of this Circular;

2. The novelty, creativity, scientific and practical significance of the topic;

3. Objectives of the topic (clarity, specificity, and scientific basis);

4. The appropriateness of the content, methods, and research plan to achieve the objectives of the topic;

5. A reasonable budget estimate;

6. The applicability and transfer plans for the research results of the topic;

7. The capability, research experience of the principal investigator and research team; material and technical facilities of the leading organization serving the research.”

11. Amend and supplement Article 11 as follows:

“Article 11. Organization of Evaluation and Selection of Research Topics

1. The Fund shall organize the evaluation and selection of research topics in accordance with the principles set forth in Article 5 of this Circular.

2. The process of organizing the evaluation and selection of research topics and announcing the funding results from the date of receiving complete valid files shall not exceed 30 days for urgent topics and 60 days for potential topics (excluding the time for inspection and survey by the working group as stipulated in Clause 3 of this Article).

3. The Management Board of the Fund shall specify the procedures for organizing the evaluation and selection and the working methods of the Scientific Council at the evaluation and selection sessions.

The Fund's management agency shall establish a working group to inspect and survey the material and technical facilities, capacity, and resources of organizations and individuals assigned to implement the topic (if necessary) based on the proposal of the Scientific Council. The working group shall conduct inspections and surveys within 10 days from the date of the decision to establish the group.”

12. Amend and supplement Article 12 as follows:

“Article 12. Review, Approval, and Announcement of the List of Funded Topics

4. The Fund shall announce the list of funded topics on the Fund’s electronic portal within the deadline specified in Clause 2 of Article 11 of this Circular.”

13. Amend and supplement Article 14 as follows:

“Article 14. Implementation of Research Funding Contracts

1. The Fund's management agency shall send the Funding Notification and guide the necessary procedures to the organizations and individuals receiving funding to complete the topic file according to the approved list and budget.”

14. Amend and supplement Article 15 as follows:

"Article 15. Reporting and Periodic Inspection

In case of necessity, the Fund's management agency may organize on-site inspections of the implementation status of the topic based on the proposal of the periodic evaluation council. The inspection results shall be recorded in minutes confirmed by all relevant parties.

For projects that violate the terms committed in the contract, the Fund shall consider the extent of the violation and handle it according to current regulations.

4. The Fund's Management Board shall approve regulations on the composition and working methods of the periodic evaluation council.”

15. Amend and supplement Article 16 as follows:

“Article 16. Reporting on the Implementation Results of the Topic

1. The report on the topic results, including:

a) The comprehensive report on the implementation results of the topic (NAFOSTED Model 06), accompanied by evidence of published products and training (if applicable);

b) Documentation on the measurement, testing, and evaluation of the topic's products conducted by authorized organizations (if applicable);

c) Certifications and related documents regarding the publication, release, acceptance, and utilization of the research results of the topic (if applicable);

d) Design drawings (for products such as machines, equipment, etc.), original investigation and survey data, research diaries, or original data records of the topic (if applicable).

16. Amend and supplement Article 17 as follows:

“Article 17. Evaluation of Research Project Results

1. The Fund shall organize the evaluation of research project results in accordance with the principles stipulated in Article 5 of this Circular.

2. The evaluation dossier for project results includes:

a) Report on the results of project implementation;

b) Contract (including the project description);

c) Any amendments made during the implementation of the contract (if any).

3. Criteria for evaluating project results:

a) Implementation and use of the project's funding;

b) Quantity and quality of research outcomes achieved during the implementation period, as reflected in the comprehensive report on the implementation results, scientific and technological solutions to address the issues raised, and new products (if any);

c) Quantity and quality of publications during the implementation period (if any): patents; plant variety protection certificates; utility models; articles published in reputable international journals or other scientific journals (online or print); articles submitted for publication in reputable international journals and accepted for peer review; monographs; scientific reports presented at conferences or seminars; other results;

d) Practical significance, applicability, and transfer plans for research outcomes;

đ) Success level of the project when comparing the achieved results and new products (if any) with the research objectives and expected outcomes stated in the proposal;

4. In case of necessity, the Fund's Management Agency may establish a working group to inspect and evaluate the actual products of the project based on the proposal of the Scientific Council. The working group shall conduct inspections and surveys within ten days from the date of establishment decision.

5. The Fund's Management Board shall specify the procedures for organizing the evaluation of research project results and the operating methods of the Scientific Council during the evaluation session."

17. Amend and supplement Article 18 as follows:

“Article 18. Recognition and Handling of Research Project Evaluation Results

3. The decision recognizing the implementation results serves as the basis for conducting the contract termination procedures.

4. The leading organization, principal investigator, and members of the research team funded by the Fund shall be recognized for their research achievements equivalent to national-level scientific and technological tasks.

In cases where the project is evaluated as not meeting the criteria, the principal investigator shall not be eligible to lead a new research project for two years from the date of issuance of the decision recognizing the implementation results.

In cases of misconduct leading to suspension or criminal liability or academic integrity and research ethics violations, the principal investigator and those held criminally responsible shall not participate in projects funded by the Fund for five years from the date of the violation handling document and upon completion of the obligations set forth therein by the competent authority."

18. Amend and supplement some points in Clause 1 of Article 19 as follows:

a) Amend and supplement Point c Clause 1 as follows:

b) Supplement Points l and m of Clause 1 as follows:

"l) Issuing regulations to ensure academic integrity and research ethics in the implementation of research;

m) Publicly disclosing in the leading organization updated information about the projects funded by the Fund, including the project name, total funding, implementation period, principal investigator and team members, research outcomes throughout the implementation period (NAFOSTED Form 08)."

19. Repeal Article 7 and Article 13.

20. Replace, supplement, and repeal certain forms attached to Circular No. 40/2014/TT-BKHCN dated December 18, 2014, issued by the Minister of Science and Technology, concerning the management of urgent scientific and technological tasks of significant scientific and practical importance and potential scientific and technological tasks funded by the National Research Development Fund as follows:

a) Replace Forms DXTN-02, DXTN-03, DXTN-06, DXTN-09, DXTN-10, DXTN-12 with NAFOSTED Forms 01, 02, 03, 04, 05, 06 in Appendix I attached to this Circular;

b) Supplement NAFOSTED Forms 07, 08 in Appendix I attached to this Circular;

c) Repeal Forms DXTN-01, DXTN-04, DXTN-05, DXTN-07, DXTN-08, DXTN-11.

Article 3. Amend and supplement some articles of Circular No. 09/2015/TT-BKHCN dated May 15, 2015, issued by the Minister of Science and Technology on the management of activities to enhance national science and technology capacity supported by the National Research Development Fund.

1. Amend and supplement some clauses of Article 1 as follows:

a) Amend and supplement Clause 4 as follows:

“4. Organizing international scientific conferences in Vietnam and domestic basic research conferences in specialized fields (in annual or biennial series).”

b) Supplement Clause 10, Clause 11 as follows:

“10. Foreign outstanding scientists coming to Vietnam for short-term academic exchanges.

11. Enhancing the capacity of basic research organizations to reach regional and world standards.”

2. Amend Clause 1 and supplement Clause 1a of Article 3 as follows:

“1. International scientific conference is an organized activity where scientists with different nationalities working in various countries present and discuss their in-depth research results on one or more topics or specialized fields of science.

1a. Domestic specialized basic research conference is a deep scientific conference on a basic science field organized in Vietnam.”

3. Amend Clause 3, Clause 4 and supplement Clause 4a of Article 3 as follows:

“3. Young talented scientist is a scientist recognized as a young talented scientist according to Article 23 of Decree No. 40/2014/NĐ-CP dated May 12, 2014, of the Government on the use and promotion of individuals engaged in science and technology activities (amended and supplemented by Decree No. 27/2020/NĐ-CP dated March 1, 2020, of the Government).

4. International reputable journal These are scientific journals selected from the categories of journals ranked and classified according to the world's popular scientific databases, approved by the Management Council of the Fund.

4a. Principal author of an article published in scientific journals is the author who has made significant contributions to forming the idea, organizing the implementation of research, and publishing research results."

4. Amend and supplement some points and clauses of Article 6 as follows:

a) Amend Point b, supplement Point c Clause 1 of Article 6 as follows:

“b) For scientists proposing support to attend and report excellent scientific research works at specialized international scientific conferences: Having excellent scientific research works accepted for presentation (in oral presentation form) at specialized international scientific conferences. The conference must be regularly organized by reputable organizations in the field, attended and presented reports by reputable scientists in the field, and have a website for news and introduction;

c) For young talented scientists proposing support to participate in international scientific conferences: Having reports accepted for presentation at international scientific conferences organized by reputable organizations in the field. The conference must be attended and presented reports by reputable scientists in the field, and have a website for news and introduction.”

b) Amend and supplement Clause 3 of Article 6 as follows:

“3. Content of support:

a) The Fund supports individual scientists attending international scientific conferences with travel expenses for up to six days including travel time (including: one round-trip economy class air ticket or other means of transportation from Vietnam to the conference location; rental fees for transportation from airport, train station, bus terminal, border gate upon entry and return; accommodation, food, and incidental expenses; health insurance) and conference registration fees;

b) The time interval between two consecutive support periods provided by the Fund for a scientist attending international scientific conferences shall not be less than twenty-four months (calculated from the opening dates of the conferences). For young talented scientists, the time interval between two consecutive support periods provided by the Fund shall not be less than twelve months.”

c) Amend and supplement Point đ Clause 4 of Article 6 as follows:

“đ. Decision recognizing young talented scientists (if applicable);”

d) Amend and supplement Point a Clause 5 of Article 6 as follows:

“a) Registration forms may be submitted through the following methods: direct submission or submission via public postal service to the One-Stop Service Unit of the Fund or online submission through the Administrative Procedure Information System of the Ministry of Science and Technology;”

5. Amending and supplementing Article 7 as follows:

“Article 7. Post-doctoral Research Study

1. Conditions for Consideration of Support:

The Fund will consider and support Vietnamese and foreign scientists who fully meet the following conditions to conduct post-doctoral research studies in Vietnam:

a) Hold a Doctorate degree and be the author of at least one article published in an international reputable journal within five years from the date of submitting the application;

b) Be sponsored by a Vietnamese scientist to carry out post-doctoral research. The sponsor must meet the following criteria: be the main author of at least one scientific article published in an international reputable journal within five years from the date of submitting the application; not be the supervisor of the scientist applying for support at the doctoral level;

c) Have a Vietnamese scientific and technological organization accept to be the leading unit for the post-doctoral research study. The leading unit must have sufficient material resources and related conditions to implement the research, agree to accept the person coming to conduct the post-doctoral research study, and agree to support and create conditions for implementing the research.

2. Criteria for Consideration of Support:

a) Quality of the research proposal description;

b) Research achievements of the applicant for support;

c) Research achievements of the sponsor; professional suitability and material conditions of the leading research unit.

3. Content of Support:

a) The Fund supports a one-time travel expense directly to the leading research unit and back for the post-doctoral researcher who does not reside in the province or city where the leading research unit is located;

b) Scientific research labor remuneration for the post-doctoral researcher for a period of twelve months. In case the scientist completes the post-doctoral research program on schedule and continues to submit an application for post-doctoral research, the Fund will prioritize consideration of support. The total time the Fund supports a scientist to conduct post-doctoral research shall not exceed twenty-four months.

4. Expected Results of Post-doctoral Research: One (1) article submitted for publication in an international reputable journal with content consistent with the registered research direction, authored primarily by the post-doctoral researcher.

5. Application Documents Include:

a) An application for support from the person registering to conduct post-doctoral research according to Model NCNLQG 04 stipulated in the Appendix of this Circular;

b) A scientific curriculum vitae of the person registering to conduct post-doctoral research according to Model NCNLQG 02 stipulated in the Appendix of this Circular;

c) A copy of the Doctorate Degree;

d) Decision recognizing young talented scientist (if any);

đ) Description of the post-doctoral research proposal (clarifying objectives, contents, methods, research plan, and expected results) confirmed by the sponsor and the leading research unit;

e) An application for support from the post-doctoral research sponsor according to Model NCNLQG 05 stipulated in the Appendix of this Circular;

g) A scientific curriculum vitae of the post-doctoral research sponsor according to Model NCNLQG 02 stipulated in the Appendix of this Circular.

6. Application for Support Registration:

a) The application can be submitted through various forms: direct submission or through public postal services to the One-Stop Service Unit of the Fund or online on the Information System for Administrative Procedures of the Ministry of Science and Technology;

b) Deadline for submission: no later than three (03) months before the planned start date of the post-doctoral research.

6. Amend and Supplement Some Points and Clauses of Article 8 as Follows:

a) Amend and Supplement Clause 1 of Article 8 as Follows:

“1. Conditions for Consideration of Support:

The Fund will consider and support short-term overseas research internships for scientists who fully meet the following conditions:

a) Invited for internship and research by a foreign research organization or a foreign scientist heading a research unit (foreign partner scientist);

b) Belong to one of the following cases:

- Currently undertaking national-level or equivalent science and technology tasks. The internship and research aim to resolve research issues of the task that cannot be carried out domestically;

- Participating in cooperation programs between the Fund and foreign organizations aimed at enhancing the capacity and international research collaboration ability of Vietnamese scientists;

- Being a young talented scientist.”

b) Amend and Supplement Point c Clause 2 of Article 8 as Follows:

“c) Research achievements of the foreign partner scientist; professional suitability and material conditions of the foreign partner organization;”

c) Amend and Supplement Clause 3 of Article 8 as Follows:

“3. Content of support:

a) Living expenses not exceeding six months;

b) Health insurance costs;

c) Round-trip travel expenses (airfare or other economy class transportation), airport, train station, bus terminal, and border crossing fees when entering Vietnam and the leading research unit.”

d) Amend and Supplement Point c, Point d Clause 4 of Article 8 as Follows:

“c) Cooperation research invitation letter from the foreign partner organization or acceptance letter for research guidance from the foreign partner scientist as stipulated in point a Clause 1 of this Article, specifying the location, time, content of the internship and research, and responsibility for paying related expenses;

d) Description of the research outline at the foreign partner organization (clarifying objectives, significance, necessity of the internship and research, content, methods, research plan, and expected results) approved by the foreign partner organization or the foreign partner scientist;”

“Article 9. Organizing scientific conferences and seminars in Vietnam

1. Conditions for Consideration of Support:

The Fund shall consider and support organizing scientific conferences and seminars as prescribed in Clause 4, Article 1 of this Circular if they meet all of the following conditions:

a) The seminar is organized by reputable organizations in the field, with an online page introducing the seminar;

b) Supported by reputable scientific and technological organizations or professional organizations in the field;

c) Consistent with the operational field of the organizing unit;

d) Have reputable scientists in the field registered to attend and present scientific reports at the seminar.

2. Criteria for Consideration of Support:

a) Quality of the seminar: evaluated based on the organization of the seminar (organizing unit, organizing committee, program committee, participating scientists), the reputation of the seminar (quality of previous seminar sessions);

b) The significance of the seminar for research fields in Vietnam;

c) Research achievements of foreign scientists requesting the Fund to support funding to participate in the seminar (for specialized international scientific seminars in Vietnam);

d) Reasonable budget estimate.

3. Content of Support:

a) Venue rental costs for organizing the seminar;

b) Support costs for domestic and foreign scientists invited to attend and present reports at the seminar (up to ten foreign scientists and ten Vietnamese scientists), including accommodation rental, daily meal expenses, travel expenses within Vietnam during the seminar period and one day before and one day after the seminar period;

c) Translation costs.

4. The application package includes:

a) A request for support form from the main organizing agency according to Model NCNLQG 09 stipulated in the Appendix of this Circular;

b) Authorization document for organizing the seminar from the competent authority;

c) Budget estimate for organizing the seminar, including detailed cost estimates for the Fund's support according to Model NCNLQG 10 stipulated in the Appendix of this Circular;

d) List, summary of personal information, and scientific reports of scientists requesting the Fund to support participation fees for the seminar.

5. Application for support request:

b) Deadline for submission of application: at least three (03) months before the opening date of the seminar.”

1. The Fund implements support for foreign outstanding scientists coming to Vietnam for short-term academic exchange through activities inviting foreign experts to work and cooperate on research related to projects funded by the Fund.

2. Content of support: Accommodation rental fees, daily food expenses, travel costs within Vietnam, translation costs for foreign outstanding scientists coming to Vietnam for short-term academic exchange for a maximum period of three months.

Article 14b. Enhancing the capacity of basic research organizations to reach regional and world standards

1. The Fund supports enhancing the capacity of Vietnamese basic research organizations towards the following goals:

a) Increasing the number of national-level and equivalent basic research projects, the number of basic research projects funded by reputable international research sponsors for the main organization;

b) Increasing the number of scientists under 50 years old with PhD degrees and outstanding basic research results published in reputable international journals as lead authors;

c) Increasing the number of international scientists with outstanding basic research results participating in short-term research cooperation or presenting scientific reports;

d) Increasing the number of domestic and international graduate students successfully trained according to international standards;

đ) Increasing the number of international conferences and workshops organized by the main organization;

e) Increasing the number of cooperative research tasks with international basic research organizations.

2. Criteria for Consideration of Support:

a) Mission, vision, functions, and responsibilities of the organization aligning with developing into a basic research organization reaching regional and world standards;

b) The organization's capability in conducting basic research according to international practices demonstrated through the following indicators:

- The number and quality of scientists with PhD degrees and basic research results published in reputable international journals as lead authors at the time of review;

- The number and quality of basic research results published by the organization in the last ten years;

- The number and quality of basic research tasks led by the organization in the last ten years;

- The number and quality of international collaborations in research conducted by the organization.

c) The quality of the organization's website in fully displaying the information mentioned in point a and point b, Clause 2 of this Article.

3. Form of support: The Fund periodically reviews and announces potential organizations and prioritizes funding for basic research projects and international cooperation projects of the Fund, and prioritizes supporting national science and technology capacity enhancement activities as stipulated in Clauses 1, 2, 3, 4, 5, and 10 of Article 1 of this Circular.”

14. Amend and supplement some clauses of Article 15 as follows:

a) Amend and supplement Clause 1, Clause 2, and Clause 3 of Article 15 as follows:

“1. Based on the provisions of this Circular, after receiving the application for support from organizations and individuals sent to the Fund, the Fund Management Agency organizes the examination and evaluation of the application, which is then submitted to the Fund Management Board for consideration and decision. The Fund Management Agency does not examine incomplete applications or those that do not meet the submission deadline requirements or fall under the cases specified in Clause 2 of Article 16 of this Circular.

a) In the case of applying for support for activities specified in Clause 1, Clause 4, and Clause 5 of Article 1 of this Circular, the Fund Management Agency examines, evaluates, and proposes solutions;

b) In the case of applying for support for activities specified in Clause 2, Clause 3, Clause 6, Clause 7, Clause 8, and Clause 9 of Article 1 of this Circular, the Fund Management Agency invites at least two independent consultants (from the Fund’s expert database according to the Ministry of Science and Technology's regulations on managing basic research projects funded by the National Research Development Fund) to review and evaluate each application and propose solutions to the Fund Management Board;

c) The Fund prioritizes supporting talented young scientists, scientists who have won the Ta Quang Buu Award, and scientists awarded by the Fund.

2. Applications that meet all Fund requirements and are supported by at least two-thirds of the independent consultants (for cases specified in point b, Clause 1 of this Article) will be submitted by the Fund Management Agency to the Fund Management Board for consideration and decision on support. If necessary, the Fund Management Board may seek additional opinions from independent consultants before making a decision.

3. After the Fund Management Board decides on the application for support, the Fund Management Agency directly informs the individual or organization applying for support of the result. The Fund does not return the application for support.”

b) Amend and supplement Clause 5 of Article 15 as follows:

“5. The recognition and reward of organizations and individuals with outstanding achievements in basic research, applied research, and activities to enhance scientific and technological capacity supported by the Fund will be carried out according to the Fund's operational plan. The Fund will notify the organizations and individuals recognized for awards by the Fund Management Board and publicly announce the results of the awards on the Fund's electronic portal.”

15. Amend and supplement Point d, Point đ Clause 1 and Clause 2 Article 16 as follows:

"d) Submit a written report to the Fund on the situation and results of activities supported by the Fund according to Model NCNLQG 17 attached as an Appendix to this Circular within one (01) month after completing the task, and hand over to the Fund any related results upon completion. Provide information and participate in surveys regarding the activities carried out at the request of the Fund (if any)."

"d) Be responsible for the content of public announcements in accordance with laws on science and technology, publishing, intellectual property, ensuring academic integrity and research ethics, and other provisions of Vietnamese law; acknowledge the support of the National Research Development Fund (NAFOSTED) in published research results that are outcomes of the activities stipulated in Clause 2, 3, and 8 of Article 1 of this Circular."

"2. Organizations and individuals violating the provisions of Clause 1 of this Article and other provisions of the Fund shall not be eligible to apply for funding or support from the Fund for a period of two (02) years from the date of the decision to handle the violation. In cases where the violation leads to the suspension of tasks funded or supported by the Fund, criminal prosecution, or violations of academic integrity and research ethics, the individual violator shall not be eligible to apply for funding or support from the Fund for a period of five (05) years from the date of the decision to handle the violation and after fulfilling all obligations under such decision. If the violation is directly related to awards granted by the Fund, the Fund shall issue a decision to revoke these awards."

"16. "Article 4. Amend, supplement, and abolish certain articles of" "Circular No. 15/2016/TT-BKHCN dated June 30, 2016 issued by the Minister of Science and Technology on the management of applied research topics funded by the National Research Development Fund"

"1. Amend Clause 1, and supplement Clause 1a of Article 2 as follows:"

“1. International reputable journal "are scientific journals selected from journal categories ranked and classified based on widely used global databases, approved by the Fund Management Council."

1a. Principal author of an article published in scientific journals is the author who has made significant contributions to forming the idea, organizing the implementation of research, and publishing research results."

"2. Amend and supplement Point a of Clause 1 of Article 3 as follows:"

"“a) Evaluate through the Science and Technology Council (hereinafter referred to as the Science Council) and independent consulting experts (outside the Science Council);”"

"3. Supplement Clause 3 of Article 4 as follows:"

"“3. Participate and present the results of the topic at international scientific conferences abroad.”"

4. Amending and supplementing Article 5 as follows:

“"Article 5. Reviewers"

"1. Reviewers are scientists and managers invited by the Fund to provide advice and review matters related to the Fund's funding and support activities, either as independent consulting experts or members of the Science Council. Reviewers must meet the following criteria:"

"a) A reviewer who is a scientist must have research results published in reputable international journals or monographs or be an inventor of patents or utility models or plant varieties protected by intellectual property rights in the last five (05) years, or have research results applied and published in the last ten (10) years. A reviewer who is a manager must work in the relevant field or be involved in issues related to the research. Special cases are decided by the Chairman of the Fund Management Council;"

b) Agree to participate in advisory work with high responsibility, honesty, and objectivity.

"4. The Fund Management Council promulgates regulations on the database of reviewers of the Fund consistent with the criteria set forth in Clause 1 of this Article."

5. Amend and supplement Article 6 as follows:

“Article 6. Scientific Council

1. The Scientific Council shall be established by the Fund Management Board based on the proposal of the Fund Director to advise the Fund on the following issues:

a) Evaluation and selection of projects, assessment of project implementation results;

b) Other issues related to the activities of the Fund.

"2. The Science Council includes members who are scientists and managers. Members of the Science Council are selected based on the following criteria:"

"a) Meeting the criteria for reviewers as stipulated in Clause 1 of Article 5 of this Circular;"

"b) Being recommended by scientists and managers in the same field;"

"c) Belonging to the Fund’s database of reviewers;"

"d) Committing to participate and comply with the Fund’s regulations."

5. The Management Board of the Fund shall prescribe the operational regulations of the Scientific Council.”

"6. Amend and supplement some clauses of Article 7 as follows:"

a) Amending and supplementing Clause 1 of Article 7 as follows:

"“1. Based on the activity plan, the Fund announces research directions supported by the Fund, provides guidance on conditions, procedures, and deadlines for submitting applications to implement projects on the Fund’s electronic portal.”;"

"b) Amend and supplement Clause 3 and Clause 4 of Article 7 as follows:"

"“3. The application package for implementing the project includes:"

a) Project registration form (NAFOSTED Form 01);

b) Project description (NAFOSTED Form 02);

"c) Scientific curriculum vitae of the project leader and members (Model NAFOSTED 03) and supporting documents proving research achievements;"

"d) Other relevant documents if organizations or individuals consider it necessary to enhance the persuasiveness of the application package."

"4. The application package for implementing the project can be submitted through the following methods: direct submission or submission via postal service to the One-Stop Service Department of the Fund or online through the Ministry of Science and Technology’s Administrative Procedure Information System."

"7. Amend and supplement some clauses of Article 8 as follows:"

a) Amend and Supplement Clause 1 of Article 8 as Follows:

"“1. For the leading organization of the project:"

"It must have legal personality, appropriate capacity for activities in the field of expertise of the project, and sufficient material and technical facilities to serve the research activities of the project. At the time of submitting the application package for implementing the project, it must have submitted a comprehensive report on the results of previously implemented projects funded by the Fund (if any) and refunded recovered funds as required.”;"

"b) Amend and supplement Clause 4 of Article 8 as follows:"

"“4. At the same time, each individual may only serve as the leader of one (01) project funded by the Fund (except in cases where they also serve as the leader of urgent scientific and technological tasks of significant scientific and practical importance).”"

"8. Amend and supplement some points and clauses of Article 9 as follows:"

"a) Amend and supplement Clause 1 and Clause 2 of Article 9 as follows:"

"“1. The implementation period of the project is thirty-six (36) months (excluding extension periods)."

"2. The results of the project:"

a) For research topics in the field of social sciences and humanities, the results of the topic are new methods and approaches to address social and human issues for specific subjects and objectives;

b) For research topics in the field of natural sciences and technology, the results of the topic are demonstrated through at least one of the following forms: technical secrets, proposals, technological processes, technical solutions, production rationalization solutions, technological innovations;

b) Amend Point b Clause 4 Article 9 as follows:

“b) One (1) article published in an international reputable journal and one (1) article published in a national journal; In cases where the research issue cannot be published in international journals due to special characteristics, the project product must have at least one (1) monograph (published) and two (2) articles published in national journals. The Scientific Council evaluates and selects these cases for the Fund to consider and decide.”

c) Amend and supplement Clause 5, Clause 6 Article 9 as follows:

“5. The head of the project is the author of at least one (1) patent, or one (1) plant variety protection certificate, or the main author of at least one (1) article published in an international reputable journal as the result of the project. The main members of the project are the authors of at least one publication as the result of the project.

6. The publications of the project must acknowledge the funding of the Fund according to the project code number. In cases where the publication acknowledges funding from multiple projects funded by the Fund or acknowledges funding simultaneously by the Fund and another funding organization, detailed explanations and full evidence regarding the non-reuse of Fund funds or other state funds must be provided.”

9. Amend and supplement some clauses of Article 10 as follows:

“1. The Fund implements the evaluation and selection of projects according to the principles stipulated in Clause 1 Article 3 of this Circular.”

a) Amend and supplement Clause 1 of Article 10 as follows:

“3. The Management Board of the Fund specifies the procedures for organizing the evaluation and selection and the working method of the Scientific Council at the evaluation and selection sessions.”

b) Amend and supplement Clause 3 of Article 10 as follows:

10. Amend and supplement Article 11 as follows:

Article 11. Reviewing the budget, approving and announcing the list of projects

“4. Within five (5) months from the deadline for submitting applications, the Fund announces the list of projects to be funded on its official website.”

11. Amend and supplement Article 12 as follows:

Article 12. Implementation of research funding contracts

“4. During the implementation of the contract, if there are issues arising that may change the content of the contract or terminate the contract, the leading organization and the head of the project are responsible for reporting in writing to the Fund in accordance with the regulations.”

12. Amend and supplement Article 13 as follows:

Article 13. Reporting and periodic assessment

“3. The results of periodic assessments and actual inspections of project implementation (if any) are reported to the leading organization, the head of the project, and serve as the basis for deciding whether to continue implementing the contract. For projects violating the commitments made in the contract, the Fund will consider the extent of the violation and handle it according to current regulations.”

13. Amend and supplement Article 15 as follows:

4. The Fund Management Board shall specify the composition and working methods of the periodic evaluation board.

Article 15. Adjusting the project budget

“The adjustment of the project budget (according to the lump-sum payment to the final product and according to the phased payment method) is carried out in accordance with the current financial management regulations.”

The adjustment of project funding (in the form of final product cost reimbursement and partial cost reimbursement) shall be carried out in accordance with the current financial management regulations.”

14. Amend and supplement Article 16 as follows:

“Article 16. Changing the Leading Organization of the Project

1. In cases where the leading organization changes according to the decision of the competent authority regarding mergers, divisions, or dissolutions, the original leading organization, the new leading organization, and the project leader shall submit a written request to the Fund for consideration and decision. The new leading organization must meet the requirements for the leading organization of the project as stipulated by the Fund.

2. In cases where the leading organizations change their names: The leading organization shall notify the Fund in writing along with the Decision on Changing the Name of the Leading Organization (original or certified copy). The leading organization may use its new name in all transaction documents with the Fund from the date the Decision on Changing the Name of the Leading Organization becomes effective.

3. The Fund will not consider proposals to change the leading organization except in the cases mentioned above.”

15. Amend and supplement Article 17 as follows:

“Article 17. Changing the Project Leader

1. The Fund will consider changing the project leader when the leading organization sends a written notice to the Fund and falls under one of the following circumstances:

a) The project leader is ill or sick and unable to manage the research activities of the project (confirmed by a competent health authority);

b) The project leader has died or been missing for more than six months.

2. The new project leader must meet the requirements for the project leader funded by the Fund as stipulated.”

16. Amend and supplement Article 18 as follows:

“Article 18. Adjusting the Content of the Project

The leading organization may proactively adjust the content of the project based on the proposal of the project leader and bear responsibility for the adjustment decision without altering the objectives, time frame, results, and total project implementation budget.”

17. Amend and supplement Article 19 as follows:

“Article 19. Adjusting the Implementation Time of the Project

1. In cases where the project cannot be completed within the scheduled timeframe, at least sixty (60) days before the deadline, the leading organization and the project leader have the responsibility to report in writing, explain the reasons, and propose an extension of the implementation period to the Fund, accompanied by a consolidated report on the project's implementation results (Model NAFOSTED 06) as specified in the Appendix issued together with this Circular. Within thirty (30) days from receiving the request, the Fund will review and issue a written response on whether to accept or reject the extension of the implementation period. The extension can only be granted once for each project, with a maximum duration of twelve (12) months.

In special cases, the Chairman of the Management Board of the Fund will examine and decide.

2. In cases where the project has completed the work content, implemented at least three-quarters (3/4) of the implementation time, and achieved sufficient results as stipulated in the contract, the project leader and the leading organization shall submit a written request and a consolidated report on the project's implementation results for the Fund to consider organizing an evaluation of the project's implementation results.”

18. Amend and supplement Article 20 as follows:

“Article 20. Other Adjustments to the Project

1. The leading organization and the project leader have the right to make adjustments in the following cases without altering the objectives, time frame, results, non-granted total budget (if applicable), and total project implementation budget:

a) Adjusting procurement of materials, raw materials: Based on the proposal of the project leader, the head of the leading organization decides to adjust the procurement plan and budget for the quantity, volume, and type of materials and raw materials purchased with state budget funds without increasing the total budget for material procurement expenses;

b) Adjusting and supplementing participants in the project: Based on the proposal of the project leader, the head of the leading organization decides to adjust and supplement participants in the project to ensure the achievement of the approved objectives, content, and results of the project. The adjustment and supplementation must comply with the requirements for participants in the project;

c) For outbound delegations: For projects implemented under the final product cost-sharing method, the leading organization and the project leader may proactively decide to adjust the outbound delegation plan.

For projects implemented under partial cost-sharing methods, the leading organization and the project leader may proactively adjust the timing and duration of the outbound delegation to suit the actual situation.

2. The Fund will consider approving and adjusting in the following cases:

a) For outbound delegations: Adjusting the destination country, number of participants, and organizational costs of outbound delegations for projects implemented under partial cost-sharing methods;

b) Other cases as proposed by the leading organization and the project leader.”

19. Amend and supplement Article 21 as follows:

“Article 21. Procedures for Adjustment

1. For matters within the authority to adjust of the Fund:

a) The application for adjustment includes: The application form for changing the content of the research project contract submitted by the project leader accompanied by the request letter from the leading organization of the project (Model NAFOSTED 07) as prescribed in the Appendix attached to this Circular; other related documents (if any);

b) Within thirty (30) days from the date of receipt of the complete application for adjustment, the Fund shall issue a decision on adjustment or send a reply letter to the leading organization of the project stating the reasons for not adjusting;

c) The Management Board of the Fund decides on the adjustment plan for cases involving changes in the name, objectives, products, total budget, leading organization, or project leader;

In cases where adjustments are decided by the Management Board, the Fund's Executive Office bases its proposal for submission to the Management Board for consideration and decision on the adjustment file;

d) The Fund's Executive Office examines and decides on the adjustment of implementation time, delegation, non-committed expenditure based on ensuring the project's objectives and results without altering the total budget for implementing the project;

đ) Any adjustment documents (if any) are part of the signed Contract;

e) Where necessary, the Fund's Executive Office seeks the opinion of independent experts or the Scientific Council or establishes an Advisory Board to evaluate the appropriateness of the adjustment request. The comments of independent experts or the Scientific Council or the Advisory Board serve as grounds for the Fund to consider and handle the adjustment request.

2. For matters within the authority to adjust of the leading organization:

a) The application and procedures for adjustment are carried out according to the internal regulations of the leading organization of the project;

b) In cases where the change proposed by the project leader is not accepted, within fifteen (15) days from the date of receipt of the adjustment request document, the leading organization must provide a written response to the project leader stating the reasons for not agreeing to the adjustment;

c) The leading organization and the project leader report to the Fund on the adjusted contents within ten working days from the date of receipt of the adjustment document. If the Fund's Executive Office disagrees with the adjustments made by the leading organization and the project leader, it must provide a written response to the leading organization within ten working days from the date of receipt of the report, stating the reasons for disagreement.

20. Amend and supplement Article 22 as follows:

“Article 22. Revocation of Approval Decision and Termination of Contract

1. During the period from the date of issuance of the approval decision on the list of projects to be funded until the signing of the implementation contract, the Fund has the right to revoke the approval decision for funding in any of the following cases:

a) There is fraud, deception, or false declaration in the registration documents for implementing the project;

b) Violation of requirements for the leading organization and the project leader;

c) Overlapping of project implementation funds from other state budget sources;

d) The project leader and the leading organization fail to complete the project description and contract as required.

The leading organization and the individual project leader whose decision is revoked must bear the consequences as stipulated by current regulations.

2. Cases for termination of contract procedures:

a) There is sufficient basis to determine that the implementation or continuation of the project is unnecessary, and both parties agree to terminate the contract before the deadline;

b) The leading organization and the project leader are suspended from implementing the project according to the decision of the competent authority or violate the provisions at points a, b, and c of Clause 1 of this Article;

c) The leading organization and the project leader fail to submit the final report on the project's implementation results or submit it late by more than two months beyond the specified deadline;

d) The project cannot continue due to insufficient funding provided by the Fund according to the project's progress without a valid reason, or failure to address the suggestions and proposals of the leading organization and the project leader as prescribed by law.

3. Application for termination of contract consists of one (1) set (original copy) including:

a) Letter from the leading organization regarding the termination of the contract (if any);

b) Notice of suspension of project implementation by the Fund;

c) Signed contract between the project leader, the leading organization, and the Fund;

d) Final report on the project's implementation results (detailing completed, ongoing, and uncompleted scientific and technological products, financial usage and settlement status) or periodic reports on the project's implementation status (if any) and/or inspection records (if any) in cases where the leading organization and the project leader fail to submit the final report on the project's implementation results as prescribed;

6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."

4. Notice of termination of contract:

a) In cases where the leading organization proactively requests termination of the contract: The leading organization sends the termination request to the Fund, including the explanatory letter and the project implementation report as stipulated in point a and point d of Clause 3 of this Article.

Within thirty (30) working days from the date of receipt of the valid request from the leading organization, the Fund reviews and sends a notice of suspension of project implementation to the leading organization;

b) In cases where the Fund requests termination of the contract: The Fund's Executive Office sends a notice of suspension of project implementation;

c) From the date of receipt of the notice of suspension of project implementation, the leading organization must cease all activities related to the project. In cases stipulated in point b of this clause, the leading organization and the project leader must prepare the final report on the project's implementation results and submit it to the Fund within thirty days.

5. Inspection and decision on termination of contract:

a) The Fund's Executive Office organizes inspections and evaluations of the files and sites, completes the application for termination of contract, and submits it to the Management Board for consideration and decision. Where necessary, the Management Board may organize consultations with independent experts. The decision on termination of contract must clearly specify the amount of funds to be refunded to the state budget, the handling plan for products and assets formed or purchased using the Fund's funding.

b) The Fund shall terminate the contract with the leading organization of the project in accordance with current regulations.

6. In cases where the contract for implementing the project is terminated according to the provisions set out in point b and c, Clause 2 of this Article, the project leader shall not be eligible to register as the leader of a new research project for a period of three years from the date of issuance of the Decision terminating the contract.

21. Amend and supplement Article 23 as follows:

“Article 23. Reports and evaluation files on the implementation of projects

1. The report on the results of project implementation includes:

a) A comprehensive report on the results of the project (Model NAFOSTED 06);

b) Documents proving that the project's products are scientific publications in journals, patents, utility models, or plant variety protection certificates (if not yet granted, there must be notification of acceptance of the application and evidence of receipt of the competent authority's review request for patent or plant variety protection certificates and search results for protection capabilities from organizations with legal certification activities) and other scientific products (if any).

2. The evaluation dossier for project results includes:

a) Report on the results of the project in accordance with Clause 1 of this Article;

b) Contract (including the project description);

c) Any amended documents during the contract implementation process (if any).

22. Amend and supplement Article 24 as follows:

“Article 24. Evaluation of Project Results

1. The project leader and the leading organization have the responsibility to prepare reports on the results of the project and submit them to the Fund within thirty days from the end of the project implementation period.

2. The Fund management body prepares the evaluation file on project results in accordance with Clause 2 of Article 23 of this Circular and organizes the evaluation of project implementation results in accordance with the principles stipulated in Clause 1, Article 3 of this Circular.

3. Criteria for evaluating project implementation results:

a) Implementation and use of the project's funding;

b) Research outcomes achieved during the project implementation period are reflected in the comprehensive report on project implementation results;

c) Outcomes published during the project implementation period (if any): patents; plant variety protection certificates; utility model patents; articles published in reputable international journals or other scientific journals (online or print); articles submitted for publication in reputable international journals and accepted for peer review; monographs; scientific reports presented at conferences or seminars; other results;

d) Practical significance and applicability of the research outcomes of the project;

đ) Success level of the project when comparing the achieved results with the research objectives and expected results outlined in the project description.

5. The Management Board of the Fund specifies the procedures for organizing the evaluation of project results and the working methods of the Scientific Council at the meeting to evaluate project results.

23. Amend and supplement some clauses of Article 25 as follows:

a) Amend and supplement Clause 1 and Clause 2 as follows:

“1. Based on the evaluation of the project results by the Scientific Council, the leading organization and the project leader are responsible for registering the project results in accordance with the laws on registration and retention of information on science and technology tasks.

2. Within sixty days from the date of the Scientific Council's evaluation results, the Fund management body compiles the content of the project implementation result evaluation, submits it to the Fund Management Board for consideration, and issues a decision recognizing the project implementation results. If necessary, the Fund Management Board may seek additional opinions from independent experts before making a decision.”

b) Amend and supplement Clause 5 and Clause 6 as follows:

“5. In cases where the project does not meet the requirements, or does not have a patent or plant variety protection certificate as registered, the project leader shall not be eligible to register as the leader of a new research project for a period of two years from the date of issuance of the Decision recognizing the project implementation results.

6. In cases of violations leading to suspension of implementation or criminal prosecution or violation of academic integrity and research ethics, the project leader and those criminally prosecuted shall not participate in projects funded by the Fund for a period of five years from the date of the violation handling document issued by the competent state agency and fully executed.

24. Amend and supplement Clause 2 of Article 26 as follows:

“2. The decision recognizing the project implementation results serves as the basis for proceeding with the contract termination procedures.”

25. Amend and supplement some points of Clause 1 of Article 29 as follows:

a) Supplement Point c of Clause 1 of Article 29 as follows:

“c) Receive, manage, use, settle accounts, and verify the progress of project implementation, financial situation, and manage files and vouchers in accordance with regulations”;

b) Supplement Points h and i after Point g of Clause 1 of Article 29 as follows:

“h) Ensure academic integrity and research ethics for contents related to the funded project;

i) Publicly introduce updated information about the funded project in the leading organization, including the project name, total budget, implementation period, project leader and members, research results throughout the implementation period (Model NAFOSTED 08).”

26. Repeal Clause 3 of Article 3, Point c of Clause 2 of Article 8, and Article 27.

27. Replace and supplement the Forms attached to Decree No. 15/2016/TT-BKHCN dated June 30, 2016, of the Minister of Science and Technology, regulating the management of applied research projects funded by the National Science and Technology Development Fund as follows:

a) Replace Forms NCUD01, NCUD02, NCUD03, NCUD04, NCUD05, NCUD06, NCUD07 with Forms NAFOSTED 01, NAFOSTED 02, NAFOSTED 03, NAFOSTED 04, NAFOSTED 05, NAFOSTED 06, NAFOSTED 07 in Appendix I attached to this Circular;

b) Supplement Form NAFOSTED 08 in Appendix I attached to this Circular.

Article 5. Effective Date

1. This Circular shall take effect from February 15, 2025.

2. For projects whose applications are received by the Fund before the effective date of this Circular, they shall be implemented in accordance with the relevant Circulars in effect at the time of application receipt for the following provisions: lists of reputable ISI journals, reputable international journals, and reputable countries; conditions for organizations and individuals implementing the project; requirements for the implementation period and research results of the project; waiting periods for publication of the project (if any) recognized as the project implementation period.

3. During the implementation process, if any difficulties arise, it is requested that agencies, organizations, and individuals promptly report to the Ministry of Science and Technology for research and amendment./.
