Resolution No. 10/2026/NQ-CP On Continuing to Apply Normative Documents and Specific Measures to Organize, Guide Implementation of Certain Laws That Have Been Amended, Supplemental or Replaced

RESOLUTION

On the continued application of regulations and specific measures to organize and guide implementation of certain laws that have been amended or replacedBASED ON THE ORGANIZATION OF THE GOVERNMENT LAW NO. 63/2025/QH15;BASED ON THE LAW ON ISSUANCE OF REGULATORY DOCUMENTS NO. 64/2025/QH15, AMENDED AND SUPPLEMENTED BY LAW NO. 87/2025/QH15;

IN ACCORDANCE WITH THE PROPOSAL OF THE MINISTER OF JUSTICE;

THE GOVERNMENT ISSUES THIS RESOLUTION ON THE CONTINUED APPLICATION OF REGULATIONS AND SPECIFIC MEASURES TO ORGANIZE AND GUIDE IMPLEMENTATION OF CERTAIN LAWS THAT HAVE BEEN AMENDED, SUPPLEMENTED, OR REPLACED.

ARTICLE 1. SCOPE OF APPLICABILITY

1. This Resolution stipulates the continued application of Decrees issued by the Government and Decisions issued by the Prime Minister that specify detailed provisions and specific measures to organize and guide implementation of certain laws that have been amended, supplemented, or replaced from January 1, 2026, until such time as a competent state organ issues a replacement or revokes these documents.

2. The list of Decrees issued by the Government and Decisions issued by the Prime Minister to be continued in full or in part are annexed hereto.

ARTICLE 2. PRINCIPLES OF LEGAL APPLICATION

1. The application of Decrees and Decisions specified in Article 1 of this Resolution must ensure compliance with the provisions of the amended, supplemented, or replaced laws that have taken effect to effectively implement these laws, ensuring continuity of state management activities, and safeguarding the lawful rights and interests of organizations and individuals during the period before detailed regulations specifying implementation measures are issued for the amended, supplemented, or replaced laws.

2. Decisions and actions taken by competent authorities based on the application of documents specified in Article 1 of this Resolution have legal validity and effect.

ARTICLE 3.

RESPONSIBILITIES FOR IMPLEMENTATION

The Ministry of Finance, the Ministry of Education and Training shall be responsible for coordinating with relevant ministries and agencies to: 1. Guide the implementation of this Resolution.

2. Develop and submit to the Government and the Prime Minister for issuance of regulatory documents to amend, supplement, replace, or revoke the documents listed in the annexed list by April 1, 2026.

ARTICLE 4. ENFORCEMENT

1. This Resolution takes effect from March 10, 2026.

2. In the course of implementation, if difficulties or issues arise, relevant agencies and units shall report to the Ministry of Finance and the Ministry of Education and Training for coordination with relevant ministries and agencies to provide guidance or handling, or submit to a competent authority for examination and instructions.
