CIRCULAR
Guidelines for procedures to submit for review and approval of projects and reports in mineral activities and preparation of exploration and survey projects for minerals
Pursuant to the Minerals Law dated March 20, 1996, and Decree No. 68/CP dated November 1, 1996 of the Government detailing the implementation of the Minerals Law, on January 28, 1997, the Minister of Industry issued Decision No. 190/QĐ-TCCB establishing the Review Board for project and report reviews in mineral activities.
The Review Board is an advisory body assisting the Minister of Industry in reviewing exploration and survey projects for minerals to serve as a basis for the Minister of Industry to issue or not issue permits for mineral exploration and survey, reviewing reports on the results of mineral surveys for common construction materials, reviewing reports on the results of mineral surveys that do not lead to feasibility studies for exploitation, or in cases where exploration permits terminate prematurely.
To ensure that the review process is carried out in accordance with regulations, this Circular provides specific guidelines for procedures to submit for review and approval of projects and reports in mineral activities and the content of exploration and survey projects for minerals as follows:
I. PROCEDURES FOR SUBMITTING PROJECTS AND REPORTS FOR REVIEW AND APPROVAL IN MINERAL EXPLORATION AND SURVEY
1. Exploration and survey projects submitted for review or approval to obtain permits for exploration and survey must be established in accordance with the provisions of Section II of this Circular, and must bear the signature of the project author, the signature and seal of the organization or individual applying for the permit. The Board will only review exploration and survey projects when it has received complete and valid application files in accordance with the "Administrative Procedures for Mineral Activity Permits" issued by the Minister of Industry pursuant to Decision No. 325/QĐ-ĐCKS dated February 26, 1997.
2. For reports on the results of mineral surveys for common construction materials, gemstone survey reports, and reports on the results of mineral surveys involving foreign investment when submitted to the Review Board, the following documents must be provided:
- A letter requesting review and approval of the survey and exploration result report from the organization or individual authorized to conduct surveys and explorations.
- Three copies of the report, including one original copy accompanied by all appendices, drawings, and original documentation (including coordinates of structures, analysis results of various samples, etc.).
The original report and accompanying documents must bear the signature of the author, the signature and seal of the organization or individual granted the exploration permit.
- A summary of the aforementioned report.
- After the review, the original documentation will be returned to the organization or individual granted the exploration permit for inclusion in geological records according to the Regulations on Submission and Provision of Geological and Mineral Documentation issued pursuant to Decision No. 127/QĐ-ĐCKS dated January 16, 1997 of the Minister of Industry.
3. In cases where the Board deems it necessary to conduct on-site inspections, the organizations or individuals submitting projects and reports for review must cooperate and provide necessary conditions as requested by the Board.
4. When defending projects and reports before the Board, the organizations or individuals submitting them for review must be present; in case of absence, they must provide a power of attorney for their representative.
II. CONTENT OF EXPLORATION AND SURVEY PROJECTS FOR MINERALS
The structure and basic chapters of exploration and survey projects for minerals are detailed in the annex attached hereto. The contents of each chapter and section must be presented in detail in accordance with the geological conditions of the specific areas to be surveyed and explored.
III. IMPLEMENTATION
This Circular takes effect fifteen days after its issuance and is uniformly applicable throughout the country to all domestic and foreign organizations and individuals engaged in mineral activities.
The Vietnam Geological Survey and the Industry Departments of provinces and centrally-administered cities are responsible for guiding and supervising the implementation of this Circular.
During the implementation process, if difficulties arise, organizations and individuals engaged in mineral activities are advised to promptly reflect these issues to the Ministry of Industry for consideration and resolution.
