CIRCULAR
Supplemental guidance on certain points of the joint circular No. 1699/TT-BQP-BLDTBXH-BTC dated June 19, 2001 issued by the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance to guide the implementation of Decree No. 04/2001/NĐ-CP dated January 16, 2001 of the Government detailing the implementation of certain provisions of the Officer Law of Vietnam 1999 regarding the regime and policies for officers who have ceased active service; officers in active service transferring to professional military personnel or transferring to defense civil servants.
Implementing Decree No. 04/2001/NĐ-CP dated January 16, 2001 of the Government detailing the implementation of certain provisions of the Officer Law of Vietnam 1999 regarding the regime and policies for officers who have ceased active service; officers in active service transferring to professional military personnel or transferring to defense civil servants. The Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance issued Joint Circular No. 1699/TT-BQP-BLDTBXH-BTC dated June 19, 2001 to provide specific guidance on its implementation. During the process of implementation at various ministries, sectors, and localities, there were some issues that remained unresolved; after exchanging and reaching consensus with the Ministry of Labor, Invalids and Social Affairs (in Document No. 2018/LDTBXH-BHXH dated June 28, 2002), the Ministry of Finance (in Document No. 1978/TC-VI dated March 8, 2002), the Government’s Organizational and Cadre Department (in Document No. 46/BTCCBCP-TL dated April 1, 2002), the Ministry of National Defense provides supplementary guidance on certain specific points regarding the transfer and classification of salary coefficients for officers at the rank of lieutenant or professional military personnel transferring to new salaries as the basis for calculating retirement pensions and the salary level as the basis for enjoying social insurance benefits for officers and professional military personnel transferring to other fields as follows:
1. Regarding the transfer and classification of salary coefficients for officers at the rank of lieutenant or professional military personnel transferring to new salaries as the basis for calculating retirement pensions according to Point 5, Section II, Chapter II of Decree No. 04/2001/NĐ-CP dated January 16, 2001 of the Government.
a. For officers at the rank of lieutenant, classify the salary coefficient at 3.0.
b. For professional military personnel, implement the transfer and classification of salaries according to the guidance provided in Circular No. 715/TT-QP dated May 24, 1993 of the Ministry of National Defense guiding the temporary regulations on the new salary system for officers, professional military personnel, non-commissioned officers, soldiers, and civil servants in the defense sector (the table of consolidated salary transfers for professional military personnel attached to the Circular).
2. Regarding the salary level as the basis for enjoying social insurance benefits, supplement as follows:
Take the salary level for calculating retirement pensions specified in Item 1.3.1 or Item 1.3.2, Part II of Joint Circular No. 1699/TT-BQP-BLDTBXH-BTC dated June 19, 2001 of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance to calculate one-time allowances for cases retiring with over 30 years of social insurance contributions and one-time allowances when ceasing employment according to Article 28 of the Social Insurance Regulations promulgated together with Decree No. 12/CP dated January 26, 1995 of the Government.
3. The transfer and classification of salary coefficients for officers at the rank of lieutenant or professional military personnel transferring to new salaries as the basis for calculating retirement pensions and the salary level as the basis for enjoying social insurance benefits for officers and professional military personnel transferring to other fields guided by this Circular shall be applied from April 1, 2000.
4. This Circular takes effect fifteen days after the date of signature. Any guidance on the transfer and classification of salary coefficients for officers at the rank of lieutenant or professional military personnel transferring to new salaries as the basis for calculating retirement pensions and the salary level as the basis for enjoying social insurance benefits for officers and professional military personnel transferring to other fields contrary to this Circular shall be abolished.
In the course of implementation, if there are any issues, please report them to the Joint Ministries of National Defense, Labor, Invalids and Social Affairs, and Finance for research and resolution.
