DECREE

REGULATING THE AMOUNTS OF SUBSIDIES AND ALLOWANCES FOR PERSONS WITH MERIT TO THE REVOLUTION

Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON THE ORDINANCE ON PRIVILEGES FOR PERSONS WITH MERIT TO THE REVOLUTION NO. 26/2005/PL-UBTVQH11 dated JUNE 29, 2005; AND THE ORDINANCE NO. 04/2012/UBTVQH13 dated JULY 16, 2012 AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF THE ORDINANCE ON PRIVILEGES FOR PERSONS WITH MERIT TO THE REVOLUTION;

BASED ON RESOLUTION NO. 32/2012/QH13 dated NOVEMBER 10, 2012 OF THE NATIONAL ASSEMBLY ON THE STATE BUDGET PLAN FOR THE YEAR 2013;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

THE GOVERNMENT ISSUES THIS DECREE PROVIDING FOR THE LEVELS OF SUBSIDIES AND PRIVILEGE ALLOWANCES FOR PERSONS WITH MERIT TO THE REVOLUTION.

ARTICLE 1. THE STANDARD LEVEL FOR DETERMINING THE LEVELS OF SUBSIDIES AND PRIVILEGE ALLOWANCES FOR PERSONS WITH MERIT TO THE REVOLUTION AND THE LEVELS OF SUBSIDIES AND PRIVILEGE ALLOWANCES

1. THE STANDARD LEVEL FOR DETERMINING THE LEVELS OF SUBSIDIES AND PRIVILEGE ALLOWANCES FOR PERSONS WITH MERIT TO THE REVOLUTION AS PROVIDED IN THIS DECREE IS 1,220,000 VND.

2. THE LEVELS OF SUBSIDIES AND PRIVILEGE ALLOWANCES FOR EACH CATEGORY OF PERSONS WITH MERIT TO THE REVOLUTION INCLUDE:

The Minister of Labor, Invalids and Social Affairs, ministers, heads of ministerial-level agencies, heads of central government agencies, chairpersons of provincial and centrally-administered city people's committees are responsible for implementing this Decree./.

b) The level of disability allowance for war invalids and persons entitled to benefits similar to those of war invalids as prescribed in Appendix II attached to this Decree;

c) The levels of disability allowances for Class B war invalids as prescribed in Appendix III attached to this Decree.

Article 2. Implementation Funding

THE STATE BUDGET WILL ENSURE FUNDS FOR IMPLEMENTING THE SUBSIDY AND ALLOWANCE SYSTEM AS PROVIDED IN THIS DECREE.

Article 3. Effectiveness

1. THIS DECREE SHALL TAKE EFFECT FROM OCTOBER 20, 2013.

2. THIS DECREE REPLACES DECREE NO. 47/2012/NĐ-CP dated MAY 28, 2012 OF THE GOVERNMENT PROVIDING FOR THE LEVELS OF SUBSIDIES AND PRIVILEGE ALLOWANCES FOR PERSONS WITH MERIT TO THE REVOLUTION.

3. THE SUBSIDIES AND PRIVILEGE ALLOWANCES PROVIDED FOR IN THIS DECREE SHALL BE IMPLEMENTED FROM JULY 1, 2013.

Article 4. Responsibilities for Implementation

THE MINISTER OF LABOUR, INVALIDS AND SOCIAL AFFAIRS, THE MINISTERS, HEADS OF GOVERNMENTAL MINISTRIES EQUIVALENT TO MINISTRIES, HEADS OF GOVERNMENTAL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT ARE RESPONSIBLE FOR ENFORCING THIS DECREE./
